AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY LOCATED AT 109 SOUTH BUSSE ROAD WHEREAS, the a. ring of" Appeals of the Village of Mount Prospect did meet on the 27th day of October, 1.977, and on the 15th day of December, 1977, at the hour of'8: 00 p o ni. , at the Public Safety Building, 112 East Northwest Highway, and did hear Case No., 49-V -77, pursuant to proper legal notice; and WHEREAS, The Zoning Board of Appeals of the Village of Mount Prospect did hear this request for as variation to allow the construction of a $20, 000 garage upon the sul&ct property without first hav-ing to subdivide same into one lot of record; and WHEREAS, the Zoning Board of'Appeals of the 'Village or Mount Prospect did recom- mend to the President and Board of Trustees of t.be Village of Mount Prospect the approval of this request under Case No. 49-V-77; and WHEREAS , the Building Cominittee of -the Board of Trustees of the Village of Mount Prospect has reviewed the matter herein and has recommended g-1pproval thereof to the President and Board of Trustees of the Village of Mount Pt.ospect; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have reviewed the matter herein, arid have determined that the same is in the best interests of the Village of Mount Prospect; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS; SECTION ONE: That subsections 11 and Cl of Section 1.4. 1.01 of the Municipal Code of the Village of Mount Prospect of 1957, as arnended, be and the same are hercl)y varied so as to eliminate the necessity of subdividing the subject gx,operty into one lot of'record arid to thereby allow the issuance of a building permit for a garage to be located upon the subject property, legally deseribed as follows: That part of Lots F and J in Kirchhoff's Subdivision of the Northwest quarter of the Northwest quarter and the Nortb 1.0 chains of the Southwest quarter of the Northwest quarter of Section 11, Township 41 North, Range 11 East of the Third Principal Meridian described as follows: Commencing at a point in the West line of said Lot F 320 feet North of the Southwest corner thereofthence East on as ]fne 320 feet North of and parallel to the South line of Lots F and J as measured on the West line of said Lot F, 733 � 95 feet to the Center of Weller Creek; thence Northerly along the Center of'Weller Creek 1,20 feet to a, line 440 feet North of and parallel with the South line of Lots F and J, as ineasured on the West lune of said Lot F; thence West on said parallel line 72 9 55 feet to the West line of Lot F thence South on N the West line of Lot F 120 feet to the place of beginning; containing 2.0155 Acres niore or less in Cook County, Illinois, except the West 241 7 5 feet thereof. That the variations granted by this Ordinance shall be null and, void and of no force and effect whatsoever unless an application for an building permit pursuant to such variations is made and construction commenced within one (1) year of the date this mid Ordinance becomes effective. APPROVED this day of 19M Village Clerk M Village President j,/1.2/78 AN ORDINANCE GRANTING CERTAIN VARIATIONS FOR PROPERTY COMMONLY KNOWN AS 302 WEST NORTHWEST HIGHWAY, MOUNT PROSPECT, ILLINOIS WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet on the 17th day of November, 1977, at the hour of 8: 00 p,,m , at the Public Safety Building, 112 East Northwest Highway, and did hear Case No. 58-V-77, pursuant to proper legal notice; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hear this request to allow construction of an addition to an existing building in a rear yard, to allow eighteen (18) off street parking spaces instead of the required twenty-eight (28) parking spaces, and to allow no loading space as required by ordinance . AN ORDINANCE AMENDING MAP 43--N OF THE ZONING ORDINANCE OF THE VILLAGE OF MOUNT PROSPECT WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did conduct a public hearing under Case No. 59-Z-77, on the 15th day of December, 1.977, on a request for a zoning classification change from Ii- X (Single Family Residence District) to B-4 (Business -Retail and Service District) of certain property hereim after described ; and WHEREAS, a notice of the aforesaid public hearing was made and published in tile manner providedby law; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect has recom- mended to the President and Board of Trustees of the Village of Mount Prospect that the petitioner's request under said Case No, 59-Z-77 be granted; and WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount Prospect has reviewed the matter herein and has recommended the approval there- of to the President and Board of Trustees of the Village of Mount Prospect; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have determined that the best interests of the Village of Mount Prospect will be attained by the adoption of the following Ordinance regarding the subject property; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE. AN ORDINANCE INCREASING THE FILING FEES FOR HEARINGS BEFORE THE ZONING BOARD OF APPEALS ITHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did conduct a Special Public Hearing under Case No. 4-Z-78, on January 5, 1978, on a request to amend the schedules of filing fees contained in Sections 14.602, 14.702, 14.803, and 14.902 of the Municipal Code of the Village of Mount Prospect (the Zoning Ordinance) for hearings held by the Zoning Board of Appeals of the Village of Mount Prospect on requestsfor variations, special uses, zoning amendments, and appeals; and WHEREAS, a notice of the aforesaid Special Public Hearing was made and published in the manner provided by law; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recommend to the President and Board of Trustees of the Village of Mount Prospect that the request to amend the schedules of filing fees in the Zoning Ordinance, requested under Case No. 4-Z-78, be granted; and WHEREAS, the President and Board of Trustees of the Village of Mount P'rospeci have determined that the best interests of the Village of Mount Prospect will be attained by the adoption of the following Ordinance regarding fees for the Zoning Ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That paragraph 2 of subsection C of Section 14.602 of the Municipal Code o£ the Village of Mount Prospect of 1957, as amended, be and the sarne is hereby further amended in its entirety by increasing the filing fees for hearings held by the Zoning Board of Appeals on requests for variations, so that hereafter the said paragraph 2 shall be and read as follows: "2. Payment of filing fees: a. For variance requests concerned with lot size parking and/or land use: 1) In instances where the decision of the Zoning Board of Appeals is final ---Fifty Dollars ($50). 2) In all other instances -,-Two Hundred Dollars ($200). b. For all other variance requests: 1) Where the area of the tract of land concerned consists of 27,500 square feet or less -..-Fifty Dollars ($50). 2) Where the area of the tract of land concerned consists of more than 27,500 square feet --.Two Hundred Dollars ($200). e. Special hearings will be held at a time mutually agreed upon by the petitioner and the Zoning Board of Appeals provided further that the petitioner pay a special hearing fee in an amount equal to Two Hundred Dollars ($200) over and above the foregoing scheduled SECTION TWO: That paragraph 2 of subsection C of Section 1.4. 702 of the Municipal Code of t lage of Mount Prospect of 1,957, as amended, be and the same is hereby further amended in its entirety by increasing the filing fees for hearings held by the Zoning, Board of Appeals on requests for special use; so that hereafter the, said paragraph 2 shall be and read as follows: "2. Payments of filing fees; the amount of which shall be determined on the basis of the area of the land with which the special use is concerned pursuant to the following schedule: a. Regular hearings: 1) Less than five acres ---Six Hundred Dollars ($600). 2) Five acres but less than ten acres in area -Nine Hundred Dollars ($goo). 3) Ten acres but less bran. fifteen acres in area --One Thousand Two Hundred Dollars ($1,200). 4) Fifteen acres or more in area ---One Thousand Five Hundred Dollars ($1,500). b, Special hearings will be held at a time mutually agreed upon by the petitioner and the Zoning Board of Appeals provided further that the petitioner pay a special hearing fee in an amount equal to Two Hundred Dollars ($200) over and above the foregoing scheduled fees . 11 SECTION THREE. That paragraph 2 of subsection C of Section 14.803 of the Municipal Code, of the Village of Mount Prospect of 1957, as amended, be and the same is hereby further amended in its entirety by increasing the filing fees for hearings held by the Zoning Board of Appeals on requests for text and map 'amend- ments; so that hereafter the said paragraph 2 shall be and read as follows: "2. Any recapture agreemnent for -water mains and/or sewer mains, entered into after the effective date of this Article shall be in accordance with the following standards: A. The water main and/or sewer main which is the subject matter of any such agreement shall be of such location, size and length as to be of substantial public benefit to the Village as a whole, rather than to the developer or a limited area only, and shall be of a site greater than that required by any other ordinance of the Village of Mount Prospect, B . Such water main and/or sewer main must be an integral part of the Village's water and/or sewer system, and necessary for the reasonable extension or improvement thereof. C. The President and Board of Trustees of the Village of Mount Pros- pect shall authorize any such recapture agreement, if at all, 'by ordinance, which ordinance shall also set forth: 1. The extent to which the installer of the water main and/or sewer main shall be entitled to recover part of the total cost thereof; 7 2, The time over which such right of recovery shall take place; 3. The properties which shall be allowed to connect to said sewer or water main; 4, The dollar amount each such property so benefited shall be expected to pay to the installer towards such recovery of cost, based upon the actual benefit thereby gained by such property; and 3. The time at which the Village of Mount Prospect shall become the absolute owner of said sewer or water main, which time shall not be later than the time over which right of recovery shall exist. 11. No recapture agreement shall obligate the Village of Mount Prospect unconditionally to withhold building permits or ypermjts for connections solely because any property benefited by connection fails to pay its share of the cost as determined by ordinance. E , No recapture agreement shall obligate the Village of Mount Prospect to collect, or enforce collection of, the amount due the installer from properties determined to be benefited . F . All recapture agreements shall provide that the Village of Mount Prospect is entitled to its engineering and legal costs in connection with the sewer or water main and the agreement. G All sewers and water mains which are the subject of recapture agreements shall be in strict accordance with the Village of Mount Prospect standards for same, and their design and con- struction shall be subject to the approval of the Village Engineer. H . The installer shall present proof satisfactory to the Village Engineer and Village Attorney that all labor and material re- lating to said sewer or water main have been paid not later than at the time of final inspection by the Village Engineer, and shall hold the Village harmless for any liens or claims of lien whatsoever. I All such sewers and water mains, when approved by the Village Engineer, shall become part of the Village's water or sewer system and shall be maintained by the Village of Mount Prospect, even if ownership of same shall remain for some time thereafter in the installer. J . The said ordinance determining properties to be benefited shall contain the legal description of such properties, a map showing their location and shall be recorded in the Office of the Recorder M of Deeds of Cook County and/or registered in the Office of the Registrar of Titles of Cook County, whichever shall be appropriate . That upon accomplishing the aforesaid extension, the Owner shall have the right to tap into the aforesaid water main for the purposes of connecting a maximum 6 inch diameter service line so that the Subject Property will be served by Village water. 3, That the Owner shall pay a tap -on fee and water consumption fee for 1, 000 gallons at a rate calculated at twice the amount established at the date hereof under current ordinances of the Village of Mount Prospect for such tap -on fee and water rate. Furthermore, after accomplishing the aforedescribed exten- sion and tap -on, the Owner shall pay a water rate for water consumption for 1,000 gallons calculated at twice the current rate established by ordinance for such water consumption. 4. That whenever the land and territory described hereinabove as the Subject Property becomes contiguous to the corporate limits of the Village of Mount Prospect, the Owner will file a petition for annexation of subject property with the Village Clerk and thereafter the Village will annex the Subject Property -- which annexation shall be accomplished in the manner provided by law. a. Further, the Owner shall cooperate with the Village and the owners of other properties contiguous to the Subject Property whenever re- quested to cooperate by the Village --which cooperation shall concern itself with the signing of petitions and/or any and all other documents necessary to accomplish the annexation of the Subject Property under any of the methods and procedures established by law to accomplish said annexation. b. Upon the annexation of,the Subject Property the rate charged for water service to that said Subject Property shall be the same rate then established for other properties within the corporate limits of the Village of Mount Prospect. 5. Upon the execution thereof, a certified copy of such resolution as well as the agreement it authorized to be executed shall be recorded or registered with the Cook County Recorder of Deeds or Registrar of Titles, as the case may be. 6. That all provisions, conditions, and regulations set forth in this Agree- ment and the Exhibits to which it refers shall supersede all Village ordinances codes and regulations that are in conflict therewith as they may apply to the Subject Property. Where this Agreement is silent, the Village ordinances shall apply and control. 7. That this Agreement shall be effective until the annexation of the Subject Property to the Village of Mount Prospect or until modified by mutual agreement of the parties hereto. It shall bind the Owner and its heirs, successors, and assigns; and the Village and its corporate officials, and such successors in office. Richardson, Chairman, Public Works Committee FROM: Village Manager SUBJECT: Interim Status/Report -- Water System DATE: January 24, 1.978 We are encountering some problems with a number of our wells. While it is never pleasant to give bad news, neither should it be withheld. First, the wells: We -11- #-6- (SE cor. Randliurst Shopping Center) is one of our major production wells, producing 1400+ gpm. In July, 1.977, we installed a new water pump and electrical panel and set a newly -designed bowl assembly at 1050 ft. depth. It tested at 1550 gpm, and was heralded as the latest designed pump bowl for wells with deep pump settings. In December we noticed vibration problems and a drop off in production to less than 1200 Spm, indicating trouble. Well -# - 5 (Highland Avenue and Emerson) , originally pumping 1550 gpm, ba.; as fallen off in productivity. It had the same type of bowl- installed last spring. Well#8 (rear of 1810 Bonita), a small- producer (500 gpm) is .... . ....... also out of service. I have ordered the pumps pulled on Wells 5 & 6, and we are in contact with the pump manufacturer (Peerless Pump Company, Calif.) since this design is giving other municipalities troubles similar to ours. Much of the cost of pulling and repairing these Wells may be borne by the pump company, if their design proves to be at fault, but otherwise our repair costs might run as high as $30,000. 1 wanted the Village Board to be aware of this potential expense. Repairs must be made at this time, however, before the heavy demand summer. season. Repairs to Well #8 are estimated at $22,000, but I have not ordered this repaired as yet since the quantity of water produced is nowhere near the importance of the other two well.s. With full knowledge of our available finances in the Water & Sewer Fund, I have put a hold on the construction and repair of water mains listed in the current budget as Item #2-390-971 in the amount of $244,000. MAYOR'S REPORT Mayor Krause presented a Certilficate of Merit to Ken Kazmar. Mr. Kazmar resigned from the Zoning Board of Appeals following 1.0 years of service. Mayor Krause presented two appointments and requested Board concurrence. Trustee Minton, seconded by Trustee Murauskis, moved to concur with the appointment of Hal Ross as Chairman of the Planning Commission, to fill the vacancy left by the resignation of Malcolm Young. Mr. Eppley was authorized to present the Village's views on the subject. Trustee Wattenberg, seconded by Trustee Richardson, moved to direct the Mayor to write a letter stating that the Village Manager would attend the meeting and that he would request the other municipalities not to enter into an agreement until the report by DAMP was received, and that if a vote were taken, Mr. Eppley was directed to vote no.
