AN ORDINANCE AMENDING MAPS 9--N AND 10--N OF THE ZONING ORDINANCE OF THE VILLAGE OF MOUNT PROSPECT WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did conduct a public hearing under Case No. 46-Z-77, on the 22nd day of September, 1977; the 17th day of November, 1977; and the 1st day of December, 1977, on a request for a zoning classification change from B-1 (Business -- Shopping Centel, District) to B 3 (Business - Retail and Service District) of certain property hereinafter de- scribed; and WHEREAS, a notice of the aforesaid public hearing was made and published in the manner provided by law; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect has recom mended to the President and Board of Trustees of the Village of Mount Prospect that the petitioners request under said Case No. 46-Z-77 be granted; and WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount Prospect has reviewed the matter heroin and has recommended the approval there- of to the President and Board of Trustees of the Village of'Mount Prospect; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have determined that the best interests of the Village of Mount Prospect will be attained by the adoption of the following Ordinance regarding the subject property; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That Maps 9- N and 10-N of the Zoning Ordinance of the Village of Mount Prospect, as amended, be and the same is hereby further amended by re- classifying from B -I (Business - Shopping Center District) to B-3 (Business - Retail and Service District) the following described property: Parcel 1: That part of the South 1322.31 feet (measured along East line of said tract) of the E. 1/2 of the Stays 1/4 of Section 35, Township 42 North, Range 11 East of the Third Principal Meridian, lying NE'Iy of center of Rand Road (except that part of the South 50 feet thereof lying NE'ly of the NE'ly line of said Rand Road taken for highway purposes), and (except the East 40 feet thereof lying North of the South 50 feet thereof, dedicated for public street per Plat of Dedication recorded February 19, 1969 per Doe. No. 20761400). FAM Parcel 2: The SW. 1/4 of the SW. 1/4 of Section 35, aforesaid: (excepting from said tract that part thereof lying Wily of Rand Road), all in Cook County, Illinois. AN ORDINANCE GRANTING CERTAIN VARIATIONS FOR PROPERTY COMMONLY KNOWN AS MOUNT PROSPECT PLAZA WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet on the 22nd day of October, 1977, and the 17th day of November, 1977, at the hour of 8: 00 p.m. , at the Mount Prospect Public Safety Building and did hear Case No. 47-V-77, pursuant to proper legal notice; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hear this request for certain variations from the Mount Prospect Zoning Ordinance; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recom- mend to the President and Board of Trustees of the Village of Mount Prospect the approval of these requests under Case No. 47-V-77; and WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount Prospect has reviewed the matter herein and has recommended approval thereof to the President and Board of Trustees of the Village of Mount Prospect; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have reviewed the matter herein and have determined that the same is in the best interests of the Village of Mount Prospect; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the property being the subject matter of Case No. 47-V-77, being legally described as follows: Parcel 1: That part of the South 1322.31 feet (measured along East line of said tract) of the E. 1/2 of the SW. 1/4 of Section 35, Town- ship 42 North, Range 11, East of the Third Principal Meridian, lying NE'ly of center of Rand Road (except that part of the South 50 feet thereof lying NE'ly of the NE'ly line of said Rand Road taken for highway purposes), and (except the East 40 feet thereof lying North of the South 50 feet thereof, dedicated for public street per plat of dedication recorded February 19, 1969, per Doc. SECTION TWO: That all requirements of the Mount Prospect Building and Zoning Code shall be applicable except the variations noted in SECTION ONE heretofore mentioned. SECTION THREE: That the Director of Building and Zoning of the Village of llK;unt Prospect is hereby authorized to issue a building permit for construction in accordance with the variations hereinbefore mentioned. SECTION FOUR: That the variations granted by this Ordinance shall be null and void and of no force and effect whatseover unless an application for a building permit pursuant to such variation is made and construction commenced within one (1) year of the date this said Ordinance becomes effective. SECTION FIVE: That this Ordinance shall be null and void and of no force and effect whatsoever until after its passage, approval, publication, and such time as an accurate plat resubdividing the said parcel described in SECTION ONE here- inabove (which plat shall contain dedications of certain easements to the Village of Mount Prospect for sewer and water mains) is recorded with the Recorder of Deeds of Cook County, Illinois; a copy of which plat of resubdivision shall be attached hereto and hereby made a part hereof. AN ORDINANCE AMENDING MAP 8-S OF THE ZONING ORDINANCE OF THE VILLAGE OF MOUNT PROSPECT WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did conduct a public hearing under Case No. 52-Z-77, on the 27th day of October, 1977; the 17th day of November, 1977; the lst day of December, 1977; and the 15th day of December, 1977, on a request for a zoning classification change from R-1 (Single Family Residence District) to P-1 (Off -Street Parking District) of certain property hereinafter described; and WHEREAS, a notice of the aforesaid public hearing was made and published in the manner provided by law; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect has recom- mended to the President and Board of Trustees of the Village of Mount Prospect that the petitioner's request under said Case No. 52-Z-77 be granted; and WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount Prospect has reviewed the matter herein and has recommended the approval there- of to the President and Board of Trustees of the Village of Mount Prospect; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have determined that the best interests of the Village of Mount Prospect will be attained by the adoption of the following Ordinance regarding the subject property; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That Map 8-S of the Zoning Ordinance of the Village of Mount Prospect, as amended, be and the same is hereby further amended by reclassifying from R-1 (Single Family Residence District) to P-1 (Off -Street Parking District) the following described property: Lots 1 and 2 in Block 11, in Busse and Wille's Resubdivision in Mount Prospect in the West Half (12) of Section 12, Township 41 North, Range 11, East of the Third Principal Meridian. SECTION TWO: That Map 8-S contained in SECTION ONE of Ordinance No. 2410, passed and approved March 20, 1973, shall be deemed amended so as to conform with the reclassification of the subject property herein contained in SECTION ONE above. SECTION THREE: That this Ordinance shall be null and void and of no force and effect whatsoever until after its passage, approval, publication, and such time as an accurate plat resubdividing the said parcel described in SECTION ONE here- inabove is registered with the Registrar of Titles of Cook County, Illinois; a copy of which plat of resubdivision shall be attached hereto and hereby made a part hereof. AN ORDINANCE GRANTING A VARIATION FOR PROPERTY COMMONLY KNOWN AS 101 SOUTH MAPLE STREET WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet on the 27th day of October, 1977; the 17th day of November, 1977; the 1st day of December, 1977; and the 15th day of December 1977, at the hour of 8: 00 p.m., at the Mount Prospect Village Hall and did hear Case No. 53-V-77, pursuant to proper legal notice; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hear a request for a variation from the regulations of the Zoning Ordinance regarding off- street parking; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recom- mend to the President and Board of Trustees of the Village of Mount Prospect the approval of these requests under Case No. 53-V-77; and WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount Prospect has reviewed the matter herein and has recommended approval thereof to the President and Board of Trustees of the Village of Mount Prospect; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have reviewed the matter herein and have determined that the same is in the best interests of the Village of Mount Prospect; NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the property being the subject matter of Case 53-V-77, being legally described as follows: Lots 1 and 2 in Block 11, in Busse and Wille's Resubdivision in Mount Prospect in the West Half (-,!-) of Section 12, Township 41 North, Range 11, East of the Third Principal Meridian, is currently zoned under the Zoning Ordinance of the Village of Mount Prospect as P-1 (Off -Street Parking District), which zoning classification shall remain in effect subject to the variation granted herein: That the off-street parking spaces be reduced from 101 x 201 to 91 x 201 in size. SECTION TWO: That all requirements of the Mount Prospect Building and Zoning Code shall be applicable except the variation noted in SECTION ONE heretofore mentioned. SECTION THREE: That the Director of Building and Zoning of the Village of Mount Prospect is hereby authorized to issue a building permit far construction in accordance with the variation hereinbefore mentioned. AN ORDINANCE AMENDING MAP 8-S OF THE ZONING ORDINANCE OF THE VILLAGE OF MOUNT PROSPECT WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet on the 2nd day of February, 1978, at the hour of 8: 00 p.m., at the Mount Prospect Public Safety Building and did hear Case No. 11-Z-78, on a request for a zoning classification change for certain property heretofore in part zoned B-3 (Business - Retail and Service District) and in part zoned R-2 (Duplex Residence District); which classification change would render the entire subject property B-3 (Business - Retail and Service District); and WHEREAS, a notice of the aforesaid public hearing was made and published in the manner provided by law; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect has recom- mended to the President and Board of Trustees of the Village of Mount Prospect that the petitioner's request under said Case No. 11-Z-78 be granted; and WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount Prospect has reviewed the matter herein and had recommended the approval thereof to the President and Board of Trustees of the Village of Mount Prospect; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have determined that the best interests of the Village of Mount Prospect will be attained by the adoption of the following Ordinance regarding the subject property: NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That Map 8-S of the Zoning Ordinance of the Village of Mount Prospect, as amended, be and the same is hereby further amended by reclassifying a portion of the following property from R-2 (Duplex Residence District) to B-3 (Business -Retail and Service District); so that the entire following described pro- perty shall be zoned B-3 (Business - Retail and Service District): That part of, Block 9 described as follows: Commencing at the point of intersection of the East line of Block 9 extended South to the Southwesterly line of Block 9 extended Southeasterly; thence Northwesterly along said extension and along the Southwesterly line of Block 9 a distance of 169.0 feet; thence Northeasterly at right angles to the Southwesterly line of Block 9 a distance of 120.0 feet; thence East a distance of 81.84 feet to a point on the East line of Block 9 which is 190.43 feet North of the point of inter- section aforesaid; thence South along the east line of Block 9 and its extension South 190.43 feet to the point of beginning (excepting from said tract that part which has been heretofore dedicated for street purposes) all in Busse and Willie's Resubdivision in Mount Prospect in the West 1/2 of Section 12, Township 41 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois. AN ORDINANCE GRANTING CERTAIN VARIATIONS FOR PROPERTY LOCATED AT THE NORTHWEST CORNER OF NORTHWEST HIGHWAY AND SCHOOL STREET WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet on the 2nd day of February, 1978, at the hour of 8: 00 p.m. , at the Mount Prospect Public Safety Building and did hear Case No. 10-V-78, pursuant to proper legal notice; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hear this request for certain variations from the Mount Prospect Zoning Ordinance; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recom- mend to the President and Board of Trustees of the Village of Mount Prospect the approval of these requests under Case No. 10-V-78; and WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount Prospect has reviewed the matter herein and has recommended approval thereof to the President and Board of Trustees of the Village of Mount Prospect; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have reviewed the matter herein and have determined that the same is in the best interests of the Village of Mount Prospect; NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the property being the subject matter of Case No. 10-V-78, being legally described as follows: That part of Block 9 described as follows: Commencing at the point of intersection of the East line of Block 9 extended South to the Southwesterly line of Block 9 extended Southeasterly; thence Northwesterly along said extension and along the Southwesterly line of Block 9 a distance of 169.0 feet; thence Northeasterly at right angles to the Southwesterly line of Block 9 a distance of 120.0 feet; thence East a distance of 81.84 feet to a point on the East line of Block 9 which is 190.43 feet North of the point of inter- section aforesaid; thence South along the east line of Block 9 and its extension South 190.43 feet to the point of beginning (excepting from said tract that part which has been heretofore dedicated for street purposes) all in Busse and Willie's Resubdivision in Mount Prospect in the West 1/2 of Section 12, Township 41 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois, is currently zoned under the Zoning Ordinance of the Village of Mount Prospect as B-3 (Business -Retail and Service District), which zoning classification shall remain in effect subject to the variations granted herein: (a) That the off-street parking spaces be reduced from 101 x 20, to 91 x 201 in size; (b) That the required transitional front yards adjacent to Northwest High- way and School Street be eliminated. SECTION TWO: That all requirements of the Mount Prospect Building and Zoning Code shad be applicable except the variations noted in SECTION ONE heretofore mentioned. SECTION THREE: That the Director of Building and Zoning of the Village of Mount Prospect is Thereby authorized to issue a building permit for construction in accordance with the variations hereinbefore mentioned. SECTION FOUR: That the variations granted by this Ordinance shall be null and void and of no force and effect whatsoever unless an application for a building permit pursuant to such variation is made and construction commenced within one (1) year of the date this said Ordinance becomes effective.
