As indicated by the attached letter and model resolution, should a natural disaster strike Mount Prospect, someone shtuld be -designated as the Local Agent to apply for' Federal disaster funds under the appropriate public law. Valuable time can be lost otherwise. Accordingly, I respectfully recommend that the Village Board designate Fire Chief Lawrence A. Pairitz, our Civil Defense Coordinator of many -years, as the Local Agent, and place this matter on the Board's agenda. for April. 18. The District has again submitted a maintenance agreement in the amount of $64,900.00 for the period commencing May l° 1978 and ending April 30, 1979. The current maintenance agreement expires April 30, 1978, and it is estimated that all allotted funds for this -fiscal year will -be expended. Eppley Village Manager JRP..rm 3/23/78 A G R E E M E N T This Agreement made and entered into on the Ist day of May, 1978, by and between The Metropolitan Sanitary District of Greater Chicago, hereinafter called "District" and the Village of Mount Prospect, Illinois, hereinafter called "Village". W I T N E S S E T H : W=FAS, on or about May 1, 1-968, District and Village entered into an Agreement wherein Village agreed to assume the responsibility for the maintenance and repair of the sanitary sewers of District within the corporate limits of said Village on a fiscal year basis, from May 1, 1968, for a one-year period, to be extended yearly upon the mutual. consent of District and Village, which Agreement provided further that the proposed budget established by District for the maintenance and repair of the aforesaid sanitary sewers would be $36,988.00 for said fiscal year, and with the understanding that future years' budgets would be determined and negotiated on the basis of the experience, with costs for said maintenance and repairs; and WHEREAS, as a matter of public health and safety, it is necessary at all times to k6ep and maintain the said sewers in good repair; and E1HE2d= , it is the desire of the parties that Village continue to render to District said services for the fiscal. year commencing May 1,J978, to and 'including April 30, 1979; and T,,=AS, it has been determined on the basis of experience with the costs for said maintenance and repairs during the period of the last previous extension, that costs for said maintenance and repairs will not increase during the fiscal year commencing May 1, 1.978 to and including April 30, 1979; and I-allREAS, the Board of Commissioners of District did duly authorize the extension of this Agreement for the term commencing May 1, 1978, to and including April. 30, 1979, upon the terms and conditions hereinafter stated; NOW, THMIFORE, in consideration of the covenants and the conditions herein contained, the parties hereto mutually agree as follows: L. Village agrees to maintain and repair all the sanitary sewers of District within the corporate limits of Village for the period commencing May 1, 1978, to and including April 30, 1979, and to make all expenditures required for the same. District agrees to pay to Village for said services and expenditures required during said term, and Village agrees to accept, a sum not to exceed $64,900.00. 2. That nothing in this Agreement shall be construed to include major projects as defined by the Maintenance and operations Department of District. If a major project becomes necessary, it shall remain the obligation of District to carry out said project. 3. That if this Agreement is terminated after the one-year term herein created or prior to the complete reimbursement, from District for expenditures made in conformity with the terms hereof, District will reimburse to Village the funds necessary to satisfy such expenditures. 4. Village agrees to submit all purchases of more than $5,000.00 to competitive bidding in conformity with the requirements of the Purchasing Act for District (Chapter 42, Sections 331.1 through 331.23 of the Illinois Revised Statutes) and further agrees that compliance with the same shall. be a condition precedent to the District paying or reimbursing the Village for any such expenditures. 5. The cost of maintenance and repairs shall be construed to include all labor and material, foreman's and engineering supervisions, engineering and clerical costs, costs of cleaning of the sewers and all other costs and charges occasioned by, or reasonably incidental to, the maintenance and repair of said sewers, exclusive of administration costs. 6. A record of the costs of all maintenance, repairs, or reconstruction necessary for the proper operation of said sewers, and of all. equipment necessary for such repairs, maintenance, or reconstruction, shall be kept by Village. A detailed statement of such costs, for the previous month, shall be submitted monthly to District, and District shall promptly process and pay the same. The rates and prices listed on the statement shall be the actual rates and prices paid by Village for materials and services. 7. Commencing from the date that Village has, in fact, taken over the maintenance and repair of the sewerage system, District shall monthly reimburse Village for the cost of maintaining and repairing the said sewerage system. 8. District shall have the right to inspect all work performed hereunder by Village and shall. have the further right of withholding the payment for services or reimbursement of any expenditure for said work, if same fails to' pass the District's inspection. 9. Village covenants and agrees that it shall be solely responsible for and will pay all valid claims, and demands whatsoever, and all damages because of bodily injuries, including death at any time resulting therefrom, accidentally sus- tained by any person or persons, for injury to real- property, personal property, including the loss of use thereof, arising out of or in consequence of the performance of this work, and it hereby agrees to defend, indemnify and hold harmless District against all loss or expense by reason of any liability imposed by law and against all suits and actions of every name and description brought against District, for or on account of any bodily injuries, including death at any time resulting therefrom, accidentally sustained by any person or persons, for injury to real property, personal property, including the loss of use thereof, caused by the Village, its servants agents or employees, or anyone else, arising out of or in consequence of the performance of this work. 10. Statement of Intent: if the maintenance and repair of the sewerage system re- ferred to in this Agreement are satisfactory to the parties under the terms of this Agreement, it is the intent of both parties that a new Agreement con- taining the same terms herein stated be executed to cover the annual periods subsequent to April 30, 1979. In addition, it is understood that if' the terms of this Agreement are not entirely satisfactory to the parties hereto, they are subject to being renegotiated at the end of each annual period. 11. This Agreement shall not be taken or construed as modifying or otherwise affecting any existing contract and/or Agreement relating to said sewerage system and its appurtenance.,. - 2 - 12. This Agreement shall continue for its entire term unless terminated by either party, for any reason whatsoever, by giving the other party thirty (30) days notice in writing in accordance with the provisions of sub- paragraph a.) of this paragraph 12. a.) Such notice shall be given by registered or certified mail to the District at 100 East Erie Street, Chicago, Illinois, and to the Village at 100 South Emerson, Mount Prospect, Illinois 60056. Mayor Dated: April 18, 1978 PROCLAMATION WHEREAS, uncontrolled fires continue to place a costly drain on the American economy; and WHEREAS, the tragedy of more than twelve thousand fire deaths nationally and over 600 fire deaths in Illinois, each year is coupled with annual property losses exceeding four billion dollars; and WHEREAS, each person can reduce this waste by eliminating fire producing conditions and being alert and careful in handling fires; and WHEREAS, Mount Prospect firefighters work diligently to reduce these horrendous fire deaths and property losses through prevention, public education and suppression. WHEREAS, the Mount Prospect Fire Department and Randhurst Corporation will host Firefighters Recognition Week at the Randhurst Shopping Center May 7 thru 13, 1978, to highlight the services and abilities of the firefighters of the northwest suburban area. NOW, THEREFORE, I Carolyn H. Krause, Mayor of the Village of Mount Prospect, do hereby proclaim and designate the week of May 7 thru May 13, 1978, as Firefighter Recognition Week. I call upon our citizens singly and as a community to actively support these firefighters in their common fight in controlling fires and reducing fire deaths, injuries and property losses in our Village of Mount Prospect. AN ORDINANCE AMENDING SECTION 13.103A OF CHAPTER 13 OF THE MUNICIPAL CODE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That, pursuant to the authority vested in the President and Board of Trustees of the Village of Mount Prospect under Article VII of the 1970 Constitu- tion of the State of Illinois, Subsection A of Section 13.103 of Chapter 13 of the Municipal Code of Mount Prospect of 1957, as amended, be and the same if hereby further amended in its entirety; so that hereafter the said Subsection A of Sec- tion 13.163 of Chapter 13 shall be and read as follows: "SECTION 13.103. That as final occupancy by residents occur as to each state of development, BERNARD HEWITT will cause a Plat of Open Space Easement to be delivered to the Village of Mount Prospect for recordation, which, by said Plat, is intended to permanently guarantee open space substantially in accordance with said approved Planned Unit Development and any amendment thereto. Said Plat of Open Space EXHIBIT IV Easement shall constitute a covenant running with the land for fifty (50) years from the date of said recording of those covenants and shall be enforceable by said Village of Mount Prospect. 4, The covenants herein contained shall run with the land for the periods of time set forth herein. Thereafter, said covenants shall be extended automatically for successive 'Periods of ten (10) years unless by a vote of the majority of the said landowners of the said property it is agreed otherwise. 5. AN ORDINANCE GRANTING CERTAIN VARIATIONS FOR PROPERTY COMMONLY KNOWN AS 3026 SOUTH BUSSE ROAD WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet on the 23rd day of February, 1978, at the hour of 8: 00 p.m., at the Mount Prospect Public Safety Building and did hear Case No. 7-V-78, pursuant to proper legal notice; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hear this request for a side yard variation and for a variation in the size of parking spaces so as to allow the petitioner to construct a certain Planned Unit Development contain- ing ninety-six (96) condominium units on property located west of Busse Road at Charlotte Road extended; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recom- mend to the President and Board of Trustees of the Village of Mount Prospect the approval of this request under Case No. 7-V-78 for the reasons that: (1) There is a practical difficulty and particular hardship on the petitioner; (2) The purpose of the variations is not based exclusively upon a desire to make money; (3) The conditions upon which the petition for these variations is based are unique in that the parcel is of an irregular shape; and (4) The granting of these variations will not be detrimental to the public or injurious to surrounding property in that they will not alter the essential character of the locality; and WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount Prospect has reviewed the matter herein and has recommended the approval thereof to the President and Board of Trustees of the Village of Mount Prospect; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have reviewed the matter herein and have determined that the same is in the best interests of the Village of Mount Prospect; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the property being the subject matter of Case No. 7-V-78 being legally described as follows: The North 5 acres (except the West 25.0 feet of the East 50.0 feet thereof) and (except the West 210 feet thereof) of the South 30 acres of the Southeast 1/4 of the Northeast 1/4 of Section 22, Township 41 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois, is currently zoned under the Zoning Ordinance of the Village of Mount Prospect as R-4 (Residential Development) District, which zoning classification shall remain in effect subject to the variations granted herein: Ex 3W (a) That the side yard adjacent to the northerlymost and easterlymost lot lines of the subject parcel be reduced to twenty-six (26) feet to permit construction of buildings --pursuant to that plan for development attached hereto and hereby made a part hereof as Exhibit I (Site Plan). (b) That the side yard requirements of the Zoning Ordinance of the Village of Mount Prospect be altered to permit parking spaces and driveways within same. (c) That the required stall size for parking spaces be reduced from ten feet by twenty feet (101 x 201) in area to nine feet by twenty feet (91 x 201) for all required parking to be located on the subject property. SECTION TWO: That all requirements of the Mount Prospect Building and Zoning Code shall be applicable except the variations noted in Section One heretofore mentioned. SECTION THREE: That the Director of Building and Zoning of the Village of Mount Prospect is hereby authorized to issue a building permit for construction in accordance with the variations hereinbefore mentioned. SECTION FOUR: That the variations granted by this Ordinance shall be null and void and of no force and effect whatsoever unless an application for a building permit pur- suant to such variations is made and construction commenced within one (1) year of the date this said Ordinance becomes effective. AN ORDINANCE ESTABLISHING CERTAIN PLANS OF DEFERRED COMPENSATION WHEREAS, the Village of Mount Prospect is a Home Rule Unit of local government as defined in the 1970 Constitution of the State of Illinois; and WHEREAS, as a Home Rule Unit, the Village of Mount Prospect is empowered to undertake to regulate and control all matters affecting its government and affairs, including those matters involved with employment and personnel; and WHEREAS, on December 8, 1971, the Village of Mount Prospect entered into an Agreed Order in the matter of a petition to annex territory to the Village of Mount Prospect under Case No. 71 CO 0526; and WHEREAS, the aforesaid Order specified that certain firefighters of the Forest River Fire Protection District would be accepted into the Firemen's Pension Fund of the Village of Mount Prospect and that other accrued benefits, rights and future expectancies shall be preserved, remaining inviolate and unimpaired; and WHEREAS, the Illinois Department of Insurance has made its determination that attempts by the Mount Prospect Firemen's Pension Fund Board to comply with the aforesaid Order of Court are not in compliance with the statutes governing the quality and creditable service requirements for all firemen who participate in fire- men's pension funds throughout the State; and WHEREAS, the Illinois General Assembly has adopted Public Act 78-1277, amended by Public Act 79-1425 and Public Act 80-1180, which legislation enables muni- cipalities to establish deferred compensation agreements; and WHEREAS, the Firemen's Pension Fund Board has complied with the directives of the Department of Insurance of the State of Illinois; and WHEREAS, it is the desire and obligation of the Village of Mount Prospect to comply with its agreement heretofore made and entered under the aforesaid Order of Court; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect deem it appropriate to establish and administer plans of deferred compensation as well as an agreement attendant thereto as set forth herein; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That, pursuant to that power and authority given Home Rule Units in Article VII of the 1970 Constitution of the State of Illinois, the President of the Village of Mount Prospect is hereby authorized and directed to enter into written agreements with Firefighters Charles Nick, Richard Vincenzo, and Paul Watkins, to set aside part of their gross compensation (which part shall be in an amount over and above the regular salary and benefits paid all firefighters of similar rank from time to time, and which part shall be in an amount equal to the amount the Village would have paid towards funding the pensions of the said Firefighters had they been participating members of the Mount Prospect Firemen's Pension Fund) in order that the Village Treasurer may invest such benefits. A. Participation within this plan of deferred compensation shall be by written agreement between each of the said Firefighters and the Village of Mount il Prospect, which agreement must be signed, if at all, by any Firefighter hereinabove mentioned no later than April 30, 1978. 1. Upon the signing of such an agreement by Firefighter Charles Nick, the total amount heretofore contributed by said Firefighter Charles Nick as it has been established within the Mount Prospect Firemen's Pension Fund, whether such payment was made by the Firefighter, by the Village of Mount Prospect, or by the Forest River Fire Protection District, shall be removed and withdrawn from the Mount Prospect Fire- men's Pension Fund and deposited in a Village of Mount Prospect savings account established for said Firefighter Charles Nick's individual plan of deferred compensation. Thereafter, any said signing Firefighter who is not now an active member of the Mount Prospect Firemen's Pension Fund shall pay into his respective plan of deferred compensation what- ever amount would have been otherwise deducted from his compensation had such Firefighter.been a participating member of the Mount Prospect Firemen's Pension Fund. 2. Upon the signing of such an agreement by Firefighter Richard Vincenzo or Firefighter Paul Watkins, that amount heretofore contributed by such signing Firefighter for creditable service accruing before August 1, 1970, shall be withdrawn from the said Mount Prospect Firemen's Pension Fund and de- posited in a Village of Mount Prospect savings account established for such signing Firefighter's individual plan of deferred compensation. B. The Village Treasurer is hereby authorized to establish and administer a separate fund (in the form of a savings account and other additional accounts - as may be necessary) for each of the aforesaid agreements, sufficient to enable such Fireman upon his death, disability, or retirement from active service to receive payments equal in number, duration, and amount to payments under the laws found in the Firemen's Pension Fund Act of the State of Illinois (S.H.A. 1081, Article 4, as established on the date hereof or as it may be amended hereafter), had such Firefighter been a participating member of the Mount Prospect Firemen's Pension Fund. 1. For purposes of administration of said deferred compensation funds, the Village Treasurer shall be guided by the aforesaid regulations contained in the Illinois Firemen's Pension Fund Act. 2. In view of the fact that Firefighter Charles Nick is not now and shall not be a member of the Mount Prospect Firemen's Pension Fund, in computing his "creditable service time", the Village Treasurer shall consider each year the aforesaid Firefighter, Charles Nick, worked for the Mount Prospect Fire Department as well as twelve (12) additional years of service. 3. In view of the fact that both Firefighter Richard Vincenzo and Firefighter Paul Watkins are presently members of the Mount Prospect Firemen's Pension Fund, in computing the amount of each of the said Firefighter's deferred compensation payments hereunder, whether for death, disability, or retirement, the Village Treasurer shall utilize an amount equal to the additional benefits and payments such Firefighters would have received from the Mount Prospect Firemen's Pension Fund had such Firefighters been participating members of the said Mount Prospect Firemen's Pension Fund calculated on the basis of: a. Three (3) additional years of service, in the case of Firefighter Richard Vincenzo; and b. One (1) additional year of service, in the case of Firefighter Paul Watkins. SECTION TWO: That the Village Clerk be and is hereby directed to publish the foregoing Ordinance in pamphlet form, pursuant to the statutes of the State of Illinois made and provided. SECTION THREE: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided by law. AYES: NAYS: ABSENT: PASSED this day of 1978. AN ORDINANCE TO PROVIDE A REVISED WATER RATE SCHEDULE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That, pursuant to the authority vested in the Board of Trustees of the Village of Mount Prospect under Article VII of the 1970 Illinois Consititution , subsections B and C of Section 23.306 of the Municipal Code of Mount Prospect of 1957, as amended, be and the same are hereby further amended in their entireties; so that hereafter the said subsections B and C of Section 23.306 shall be and read as follows: it B. All Village users within the Village, except as set forth in paragraphs 1 and 2 below, having a direct or indirect connection with Village water mains shall pay the following rates per quarter: Per 1,000 gallons . . . . . . . . . . . . . . $1.40 1. In addition to the foregoing charges, all Village users residing in the Fairview Gardens subdivision, being legally described as: Beginning at a point on the South line of the Southeast Quarter (1) of Section 35, Township 42 North, Range 11, East of the Third Principal Meridian in the County of Cook in the State of Illinois, which said point lies 660.30 feet West of the Southeast corner of said Section 35; running thence West for a distance of 1320.48 feet along the section line; running thence North to the North line of the Southeast Quarter (4) of said Section 35, beginning a distance of 2646.66 feet, more or less; running thence East for a distance of 1319.23 feet along the said North line of the South- east Quarter (4) of said Section 35; running thence South to the point of beginning; and That part of Section 35, Township 42 North, Range 11, East of the Third Principal Meridian in the County of Cook in the State of Illinois described as follows: Commencing at the Southeast corner of said Section 35, running thence West on the South line of said Section 35 for a distance of 66.30 feet; running thence North for a distance of 2646.66 feet; running thence East for a distance of 653.20 feet to a brass monument in Wolf Road; running thence South to the point of beginning; and Apartment project located in the C.A.
