ORDINANCE NO.
AN ORDINANCE GRANTING A SPECIAL USE FOR PROPERTY
LOCATED AT 2010 CAMP MC DONALD ROAD
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet
on the 2nd day of February, 1978, at the hour of 8: 00 p.m., at the Public Safety
Building Boardroom and did hear Case No. 8 -SU -78, pursuant to proper legal
notice; and
WHEREAS, the Zoning Board of Appeals of the Village of Blount Prospect did hear
this request to permit a small animal clinic to be located upon the property which
is the subject matter of Case No. 8 -SU -78;
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recom-
mend to the Building Committee of the Board of Trustees of the Village of Mount
Prospect the approval of this request under Case No. 8 -SU -78; and
WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount
Prospect did meet on March 8, 1978, and did review the recommendations of the
Zoning Board of Appeals in Case No. 8 -SU -78; and
WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount
Prospect have recommended that the Board of Trustees of the Village of Mount
Prospect concur in the recommendations of the Zoning Board of Appeals under said
Case No. 8 -SU -78; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
have reviewed the matter herein and have determined that the same is in the best
interests of the Village of Mount Prospect;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the property being the subject matter of Case No. 8 -SU -78,
being legally described as follows:
Lot 1 of the Center Subdivision being a Subdivision of that part of Lot A
bounded by a line described as follows: Beginning at a point on the South
line of said Lot "A", 185.0 feet West of the Southeast corner of said Lot
and running thence West along said South line, 172. 0 feet; thence Northerly
parallel with the Easterly line of said Lot "A", 155.0 feet; thence East
parallel with said South line of Lot "A", 172.0 feet; thence Southerly parallel
with the Easterly line of said Lot "A", 155.0 feet to the place of beginning in
Woodview Manor, Unit No. 2, being a subdivision of part of the Southeast
1/4 of Section 24, Township 42 North, Range 11, East of the Third Principal
Meridian, in Cook County, Illinois,
is currently zoned under the Zoning Ordinance of the Village of Mount Prospect
as B-3 (Business -Retail and Service District), which zoning classification
shall remain in full force and effect - provided that, pursuant to Article VII of the
Mount Prospect Zoning Ordinance, a special use permit is hereby granted to allow
the premises to be used for a small animal clinic on an outpatient basis only, in
accordance with the following conditions:
(a) That there shall be no boarding of animals upon the premises;
(b) That there shall be no outdoor kennels or runs upon the premises;
(c) That there shall be no crematorium upon the premises; and
(d) That the building and its appurtenances to be located upon the premises
shall be constructed and located in accordance with the site plan attached
hereto and hereby made a part hereof as Exhibit I.
SECTION TWO: That the special use authorized to be established in SECTION ONE
hereinabove shall be valid and effective only upon the performance and continuous
maintenance thereof in accordance with all other laws and ordinances of the Village
of Mount Prospect and State of Illinois.
SECTION THREE: That the special use permit authorized in SECTION ONE herein-
above shall not run with the land, but shall be limited to that period of time wherein
the subject property is operated and maintained as a small animal clinic in accord-
ance with the terms and conditions of SECTION ONE hereinabove and that period
of time the subject property is owned by Dr. T. A. Osborn.
SECTION FOUR: That the Village Clerk shall and he is hereby authorized to record ,
at the petitioner's expense,a certified copy of this Ordinance with the Cook County
Recorder of Deeds and/or the Registrar of Titles of Cook County, Illinois, as the
case may be.
SECTION FIVE: That this Ordinance shall be in full force and effect from and after
its passage, approval, and publication in the manner provided by law.

AN ORDINANCE GRANTING CERTAIN VARIATIONS FOR
PROPERTY LOCATED AT THE NORTHWEST CORNER
OF NORTHWEST HIGHWAY AND SCHOOL STREET
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet on
the 2nd day of February, 1978, at the hour of 8: 00 p.m. , at the Mount Prospect
Public Safety Building and did hear Case No. 10-V-78, pursuant to proper legal
notice; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hear
this request for certain variations from the Mount Prospect Zoning Ordinance; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recom-
mend to the President and Board of Trustees of the Village of Mount Prospect the
approval of these requests under Case No. 10-V-78; and
WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount
Prospect has reviewed the matter herein and has recommended approval thereof
to the President and Board of Trustees of the Village of Mount Prospect; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
have reviewed the matter herein and have determined that the same is in the best
interests of the Village of Mount Prospect;
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the property being the subject matter of Case No. 10-V-78,
being legally described as follows:
That part of Block 9 described as follows: Commencing at the point of
intersection of the East line of Block 9 extended South to the Southwesterly
line of Block 9 extended Southeasterly; thence Northwesterly along said
extension and along the Southwesterly line of Block 9 a distance of 169.0
feet; thence Northeasterly at right angles to the Southwesterly line of Block
9 a distance of 120.0 feet; thence East a distance of 81.84 feet to a point
on the East line of Block 9 which is 190.43 feet North of the point of inter-
section aforesaid; thence South along the east line of Block 9 and its extension
South 190.43 feet to the point of beginning (excepting from said tract that
part which has been heretofore dedicated for street purposes) all in Busse
and Willie's Resubdivision in Mount Prospect in the West 1/2 of Section 12,
Township 41 North, Range 11, East of the Third Principal Meridian,
in Cook County, Illinois,
is currently zoned under the Zoning Ordinance of the Village of Mount Prospect
as B-3 (Business -Retail and Service District), which zoning classification shall
remain in effect subject to the variations granted herein:
(a) That the off-street parking spaces be reduced from 101 x 201 to
9' x 201 in size;
(b) That the required transitional front yards adjacent to Northwest High-
way and School Street be eliminated.
(c) That the required truck loading dock be eliminated so long as the use
of the subject property is limited to professional, real estate, and
insurance offices; and
(d) That parking of automobiles be allowed within the required yards
upon the subject property --pursuant to the site plan attached hereto
and hereby made a part hereof as Exhibit I.
SECTION TWO: That all requirements of the Mount Prospect Building and Zoning
Code shall be applicable except the variations noted in SECTION ONE heretofore
mentioned.
SECTION THREE: That the Director of Building and Zoning of the Village of Mount
Prospect is hereby authorized to issue a building permit for construction in
accordance with the variations hereinbefore mentioned.
SECTION FOUR: That the variations granted by this Ordinance shall be null and
void and of no force and effect whatsoever unless an application for a building
permit pursuant to such variation is made and construction commenced within one
(1) year of the date this said Ordinance becomes effective.
SECTION FIVE: That this Ordinance shall be null and void and of no force and

AN ORDINANCE AMENDING MAP 25-N OF THE ZONING
ORDINANCE OF THE VILLAGE OF MOUNT PROSPECT
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did conduct
a public hearing under Case No. 54-Z-77, on the 27th day of October, 1977, on a
request for a zoning classification change from R -X (Single Family Residence Dis-
trict) to R-3 (Apartment Residence District) of certain property hereinafter de-
scribed; and
WHEREAS, a notice of the aforesaid public hearing was made and published in the
manner provided by law; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect has recom-
mended to the President and Board of Trustees of the Village of Mount Prospect that
the petitioner's request under said Case No. 54-Z-77 be granted; and
WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount
Prospect has reviewed the matter herein and has recommended the approval there-
of to the President and Board of Trustees of the Village of Mount Prospect; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
have determined that the best interests of the Village of Mount Prospect will be
attained by the adoption of the following Ordinance regarding the subject property;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That Map 25-N of the Zoning Ordinance of the Village of Mount
Prospect, as amended, be and the same is hereby further amended by reclassifying
from R -X (Single Family Residence District) to R-3 (Apartment Residence District)
the following described property:
Lots 1000, 1001, 1002 and Outlet "All (except the North 215 feet thereof)
in Brickman Manor 1st Addition Unit No. 6, being a Subdivision of part
of the East half of the Southwest quarter of Section 27, Township 42
North, Range 11, East of the Third Principal Meridian, together with the
South 241.56 feet of the West 30 feet of Outlot "H" in Brickman Manor 1st
Addition Unit No. 1, being a Subdivision of part of the East half of the
Southeast quarter of Section 27 and part of the West half of the West half
of the South ' west quarter of Section 26, Township 42 North, Range 11,
East of the Third Principal Meridian, in Cook County, Illinois.
SECTION TWO: That Map 25-N contained in SECTION ONE of Ordinance No. 2410,
passed and approved March 20, 1973, shall be deemed amended so as to conform
with the reclassification of the subject property herein contained in SECTION ONE
above.
SECTION THREE: That this Ordinance shall be null and void and of no force and
effect whatsoever until after its passage, approval, publication, and such time
as an accurate plat resubdividing the said parcel described in SECTION ONE
hereinabove is recorded with the Recorder of Deeds of Cook County, Illinois;

WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet on
the 27th day of October, 1977; the 17th day of November, 1977; the 1st day of
December, 1977; and the 15th day of December 1977, at the hour of 8: 00 p.m. , at
the Mount Prospect Village Hall and did hear Case No. 53-V-77, pursuant to
proper legal notice; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hear a
request for a variation from the regulations of the Zoning Ordinance regarding off-
street parking; and

Prospect in the West Half (2) of Section 12, Township 41 North, Range 11,
Fast of the Third Principal Meridian,
is currently zoned under the Zoning Ordinance of the Village of Mount Prospect
as P-1 (Off -Street Parking District), which zoning classification shall remain
in effect subject to the variation granted herein:
That the off-street parking spaces be reduced from 10' x 201
to 91 x 201 in size.
SECTION TWO: That all requirements of the Mount Prospect Building and Zoning
Code shall be applicable except the variation noted in SECTION ONE heretofore
mentioned.

ORDINANCE OF THE VILLAGE OF MOUNT PROSPECT
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet
on the 2nd day of February, 1978, at the hour of 8: 00 p.m., at the Mount Prospect
Public Safety Building and did hear Case No. 11-Z-78, on a request for a zoning
classification change for certain property heretofore in part zoned B-3 (Business -
Retail and Service District) and in part zoned R-2 (Duplex Residence District);
which classification change would render the entire subject property B-3 (Business -
Retail and Service District); and
WHEREAS, a notice of the aforesaid public hearing was made and published in the
manner provided by law; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect has recom-
mended to the President and Board of Trustees of the Village of Mount Prospect that
the petitioner's request under said Case No. 11-Z-78 be granted; and
WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount
Prospect has reviewed the matter herein and had recommended the approval thereof
to the President and Board of Trustees of the Village of Mount Prospect; and

ORDINANCE OF THE VILLAGE OF MOUNT PROSPECT
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did conduct
a public hearing under Case No. 52-Z-77, on the 27th day of October, 1977; the
17th day of November, 1977; the lst day of December, 1977; and the 15th day of
December, 1977, on a request for a zoning classification change from R-1 (Single
Family Residence District) to P-1 (Off -Street Parking District) of certain property

WHEREAS, a notice of the aforesaid public hearing was made and published in the

the following described property:
Lots I and 2 in Block 11, in Busse and Wille's Resubdivision in Mount
Prospect in the West Half (12) of Section 12, Township 41 North, Range 11,
East of the Third Principal Meridian.
SECTION TWO: That Map 8-S contained in SECTION ONE of Ordinance No. 2410,
passed and approved March 20, 1973, shall be deemed amended so as to conform
with the reclassification of the subject property herein contained in SECTION ONE

WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet on
the 22nd day of October, 1977, and the 17th day of November, 1977, at the hour of
8: 00 p.m. , at the Mount Prospect Public Safety Building and did hear Case No.
47-V-77, pursuant to proper legal notice; and

this request for certain variations from the Mount Prospect Zoning Ordinance; and

Code shall be -applicable except the variations noted in SECTION ONE heretofore

SECTION THREE: That the Director of Building and Zoning of the Village of
Mount 'Prospect—is hereby authorized to issue a building permit for construction
in accordance with the variations hereinbefore mentioned.
SECTION FOUR: That the variations granted by this Ordinance shall be null and
void and of no force and effect whatseover unless an application for a building
permit pursuant to such variation is made and construction commenced within one
(1) year of the date this said Ordinance becomes effective.

An Ordinance Amending Section 13.103A of Chapter 13 of the
Municipal Code had its first reading.
Mayor Krause presented the names of seven residents to
serve on the Advisory Committee to study the present Library
Board system.

meeting of the Village Board, and`the public hearing to
discuss the proposed budget was closed.

COMMITTEE ANNOUNCEMENTS
Trustee Hendricks announced the Building Committee would
meet April 12th. Trustee Murauskis announced the Public
Health & Safety Committee would meet April 13th.
FOR INFORMATION ONLY
It was noted that a Pre -Bid Conference relative to the
proposed garbage contracts, would be held April 12th, at
4:00 P.M. in the Trustees' Room.
A Committee of the Whole meeting was scheduled for
April 17th at 8:00 P.M. in the Trustees' Room for the
purpose of reviewing revisions to the Zoning Ordinance.
Mayor Krause called an Executive Session in order to
discuss personnel and litigation at 10:10 P.M.
The meeting was reconvened at 10:44 P.M.
Trustee Minton, seconded by Trustee Richardson, moved to
authorize Ross, Hardies to defend the Villages interest in
tax objection Case No. 78 CO 14-583.

Motion carried.
ADJOURNMENT
Trustee Murauskis, seconded by Trustee Richardson, moved
to adjourn the meeting.
