Geick 4ssi 'Mant V 11 'Manager FROM: ?L a FROM: ,lr_,_ 3i .s, Director of Health Services SUBJECT: Scavenger Bids of April 25, 1978 DATE: April 28, 1978 After the official opening of the bids on April 25, 1978, all the documents submitted by the two bidding companies, Arc Disposal Company, Inc., and Browning-Ferris Industries of Illinois, Inc., were reviewed with regards to containing the required information as set forth in both the bid form and the contract itself. As a result of this review it was found that Arc Disposal did not submit a detailed plan of operation, Item # 11, as requested on the bid form. In addition, a current union contract setting forth the present wages was not attached to the contract and shown as Exhibit A, as specified. With regards to Browning-Ferris Industries, all the required attachments and documents were submitted with each contract bid proposal as specified. With regards to a recommendation as to which contract proposal to accept, the Village is in receipt of an opinion from R. Marlin Smith, Attorney at Law, of Ross, Hardies, O'Keefe, Babcock & Parsons, stating: TV It is our opinion, in summary, that a garbage collection ordinance which places apartments in a commercial category and condominiums and cooperatives in a residential category, would be vulnerable to constitutional attack." With respect to this legal opinion and based on the information provided by the bidders, I believe the contract should be awarded to Browning-Ferris Industries of Illinois, Inc., for proposal K-1 wherein refuse collection for any and all residential units, including multi -family dwelling units, would be collected for the specified time period. Contract proposal K-1 will provide refuse collection for the Village of Mount Prospect, I believe, within the legal bounds referenced above in addition to reducing the overall cost, as shown in the attached summary of scavenger service bids with adjustment in contractor's wage cost, to the Village for refuse collection. If either one of the options, or both, are elected, further cost savings can be achieved. AN ORDINANCE ANNEXING PROPERTY COMMONLY KNOWN AS 3026 BUSSE ROAD WHEREAS, a written petition under oath signed by the owners of record of land here- inafter described as well as 1.00% of the residents residing thereon has been filed with the Village Clerk of the Village of Mount Prospect requesting that said land be annexed to the Village of Mount Prospect; and WHEREAS, the said land is not within the corporate limits of any municipality, but is contiguous to the Village of Mount Prospect; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect find and believe it to be in the best interests of the said Village that said land and territory be annexed thereto; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MO[JNJ'PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That all land and territory legally described as follows: The North 5 acres of the South 30 acres (except the West 210 feet thereof) of the S.E. 1/4 of the N.E. 1/4 of Section 22, Township 41 North, Range 11 East of the 3rd P.M. also: That part of the West 50 feet of the S.W. 1/4 of the N.W. 1/4 of Section 23, Township 41 North, Range 11. AN ORDINANCE AMENDING MAP 38-S OF THE MOUNT PROSPECT ZONING ORDINANCE WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did here- tofore conduct a public hearing under Case No. 5-Z-78 at the hour of 8:00 p.m. on February 23, 1978, pursuant to a request for zoning classification changes in conjunction with a planned unit development, which requested changes were from R -X (Single Family Residence District) to R-4 (Residential Development District) of certain property hereinafter described; and WHEREAS, a notice of the aforesaid public hearing was made and published in the mariner provided by law; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect has recom- mended to the President and Board of Trustees of the Village of Mount Prospect that the petitioner's request under said Case No. 16-Z--77 be granted; and WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount Prospect has reviewed the matter herein and has recommended the approval thereof to the President and Board of Trustees of the Village of Mount Prospect; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have determined that the best interests of the Village of Mount Prospect will be attained by the adoption of the following Ordinance regarding the subject property; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That Map 38-S of the Zoning Ordinance of the Village of Mount Prospect, as amended, be and the same are hereby further amended by reclassifying from R -X (Single Family Residence District) to R-4 (Residential Development Dis- trict) that land legally described as follows: The North 5 acres (except the West 25.0 feet of the East 50.0 feet thereof) and (except the West 210 feet thereof) of the South 30 acres of the Southeast 1/4 of the Northeast 1/4 of Section 22, Township 41 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois. AN ORDINANCE GRANTING A SPECIAL USE PERMIT IN THE NATURE OF A PLANNED UNIT DEVELOPMENT FOR PROPERTY COMMONLY KNOWN AS 3026 SOUTH BUSSE ROAD WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hereto- fore conduct a public hearing under Case No. 6 -SU -78 on February 23, 1978, at the hour of 8: 00 p.m. , pursuant to a request for a special use in the nature of a Planned Unit Development; and WHEREAS, a notice of the aforesaid public hearing was made and published in the manner provided by law; and WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount Prospect has reviewed the matter herein and has recommended the approval thereof to the President and Board of Trustees of the Village of Mount Prospect; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have determined that the best interests of the Village of Mount Prospect will be attained by the passage of the following Ordinance regarding the subject property,, NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SEV,TION ONE: That a special use permit be and is hereby granted to allow Ferlette Realty and Builders to construct a Planned Unit Development upon the following described property: The North 5 acres (except the West 25.0 feet of the East 50.0 feet thereof) and (except the West 210 feet thereof) of the South 30 acres of the Southeast 1/4 of the Northeast 1/4 of Section 22, Township 41 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois. SECTION TWO: That the Planned Unit Development hereinabove authorized and permitted shall be constructed pursuant to the land uses and standards shown upon the Site Plan, attached hereto and hereby made a part hereof as Exhibit I, except as may otherwise be provided herein, and as necessarily modified to solve engineer- ing er- ing layout and design problems at the time of the construction of the said Planned Unit Development. A. Said Planned Unit Development shall consist of the construction of no more than eighty-eight(88) dwelling units upon that portion of the subject pro- perty zoned R-4 (Residential Development District). Request for Villae_n Water: Mr. Jeff Haiduke of 10 E. Golf Road appeared before the Committee to request Village water for his residence and for his next door neighbor to the east ... their wells have not been producing for the last 7 months. There is Park District property between Mr. HaiAuke's property and our closest water main. The Park District will not grant an easement to a private party, but will grant one to the Village. Ben Hemmeter and Herb Weeks agreed to start working on this project the following morning. Well #17: Public Works Director Herb Weeks passed on a letter from J. P. Miller Artesian Well Co., showing $80,696.04 as their balance of charges for their services on Well. #17. Sewer System Evaluation Survey Interim Report: The Mayor & Board have received copies of Donahue & Associates, Inc. interim report. Ben Hemmeter recommends Board approval of this report so they can go forward with the next phase of the survey. Rand, Central & Mt Prospect Road Engineering Agreement: In 1972, the Village entered into an agreement with Alstot'& March, Inc. for preparing the engineering plans on the above project. This agreement also included the construction fees of the project. A new agreement for construction engineering services needs to be entered into since the original agreement is 5 years old. The Illinois Department of Transportation and the Federal government have new guidelines for TAUS projects and the agreement has been written to meet the new requirements. Ben Hemmeter recommends that the Village Board adopt the necessary resolution authorizing the Mayor and Village Clerk to execute to execute the revised agreement for construction engineering services Prinled ori 100% Recyclod Paper Public Works Committee Meeting 4-20-78 Page 2. Route 83 -- "S" Curve Project, Supplemental Agreement: During the construction of the "S" curve, it was necessary to relocate the water main in front of the duplexes on Elmhurst Avenue and also replace the sanitary sewer on Main Street. This work was not included in the original contract. The engineering fees for this additional work were paid with MFT funds. In order for the Village to be reimbursed for the State's and Federal government's share, a supplemental agreement for con- struction engineering fees must be executed. This agreement is in accord with the State's guidelines for TAUS projects. , Ben flemmeter recommends that the necessary resolution be adopted by the Village Board authorizing the Mayor and the Clerk to sign the supplemental agreement. Federal Funds for New Brides: The Committee supported Ben Hemmeter's request to make application for Federal funds for construction of new bridges not located on Federal or State highways. If the application is approved, the Public Works Committee will then consider recommending construction of another bridge over Weller Creek in line with long range overall plans for bridging the creek. Central Road, Northwest Highway Railroad Crossing: ------- . .... ......... ... . . . ..... ......... . . The Chicago & Northwestern Railway is trying to get some RTA money for improvements, other than general maintenance, of this crossing, but this work will not take place until 1979 ... if RTA provides the funds. A Federal Aid Highway Act of 1976 provides funds for railroad grade crossings and will provide 90% grants for qualified projects. The balance would come from our MFT funds ... the CN&W Railway has indicated a willingness to pay a portion of our 10% share. Ben Hemmeter is applying for the Federal funds. Rand & Hir, Implovement: Intersection e r s e c t I o n The Committee is requesting the administration to reactivate this project and provide periodic progress reports. Proposed 1978 MFT Maintenance Street Resurfacing: The Engineering Department has completed the designation of streets to be resurvaced under this year's MFT budget... estimated cost is $232,970. PUBLIC WORKS COMMITTEE Trustee Richardson, seconded by Trustee Minton, moved for passage of Ordinance No. 2784 AN ORDINANCE TO PROVIDE A REVISED WATER RATE SCHEDULE Upon roll call: Ayes: Floros Hendricks Minton Murauskis Richardson Wattenberg Motion carried. Trustee Richardson explained that there was a bond issue in 1959 by the MSD for Mount Prospect sanitary relief sewer system. Monies have been accumulated by the District through residents payments of service charges and it was the belief of the Board that sufficient funds have been accumulated to call these bonds for payment. Trustee Richardson, seconded by Trustee Murauskis, moved to authorize the Mayor to sign arid Clerk to attest the MSD Maintenance Agreement commencing May 1, 1978, until such time as sufficient monies have been accumulated to call in those bonds, no additional funds will be paid for any other purpose.
