SUBJECT: Scavenger Bids of April 25, 1978
DATE: April 28, 1978
After the official opening of the bids on April 25, 1978, all the
documents submitted by the two bidding companies, Arc Disposal Company, Inc.,
and Browning-Ferris Industries of Illinois, Inc., were reviewed with regards
to containing the required information as set forth in both the bid form and
the contract itself. As a result of this review it was found that Arc
Disposal did not submit a detailed plan of operation, Item # 11, as requested
on the bid form. In addition, a current union contract setting forth the
present wages was not attached to the contract and shown as Exhibit A, as
specified. With regards to Browning-Ferris Industries, all the required
attachments and documents were submitted with each contract bid proposal as
specified.
With regards to a recommendation as to which contract proposal to accept, the
Village is in receipt of an opinion from R. Marlin Smith, Attorney at Law, of
Ross, Hardies, O'Keefe, Babcock & Parsons, stating:
TV It is our opinion, in summary, that a garbage collection
ordinance which places apartments in a commercial category
and condominiums and cooperatives in a residential category,
would be vulnerable to constitutional attack."
With respect to this legal opinion and based on the information provided by
the bidders, I believe the contract should be awarded to Browning-Ferris
Industries of Illinois, Inc., for proposal K-1 wherein refuse collection for
any and all residential units, including multi -family dwelling units, would
be collected for the specified time period.
Contract proposal K-1 will provide refuse collection for the Village of
Mount Prospect, I believe, within the legal bounds referenced above in
addition to reducing the overall cost, as shown in the attached summary of
scavenger service bids with adjustment in contractor's wage cost, to the
Village for refuse collection. If either one of the options, or both, are
elected, further cost savings can be achieved.

ORDINANCE NO.
AN ORDINANCE ANNEXING PROPERTY COMMONLY
KNOWN AS 3026 BUSSE ROAD
WHEREAS, a written petition under oath signed by the owners of record of land here-
inafter described as well as 1.00% of the residents residing thereon has been filed
with the Village Clerk of the Village of Mount Prospect requesting that said land be
annexed to the Village of Mount Prospect; and
WHEREAS, the said land is not within the corporate limits of any municipality, but
is contiguous to the Village of Mount Prospect; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect find
and believe it to be in the best interests of the said Village that said land and territory
be annexed thereto;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MO[JNJ'PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That all land and territory legally described as follows:
The North 5 acres of the South 30 acres (except the West 210 feet
thereof) of the S.E. 1/4 of the N.E. 1/4 of Section 22, Township
41 North, Range 11 East of the 3rd P.M.
also:
That part of the West 50 feet of the S.W. 1/4 of the N.W. 1/4 of
Section 23, Township 41 North, Range 11. East of the 3rd P.M.
lying between the North and South line of said North 5 acres
of South 30 acres extended East, all in Cook County, Illinois.
an accurate map of which territory is attached hereto and made a part hereof by
this reference, be and the same is hereby annexed to the Village of Mount Prospect,
Cook County, Illinois.
SECTION TWO: That Map 38-5 contained in SECTION ONE of Ordinance No. 2410,
passed and approved March 20, 1973, be amended to reflect the extension of the
corporate limits of the Village of Mount Prospect to include the property hereinabove
described and hereby annexed.
SECTION THREE, That the Village Clerk of the Village of Mount Prospect is hereby
directed to file in the Office of the Recorder of Deeds of Cool, County, Illinois, a
certified copy of this Ordinance together with an accurage map of the territory
annexed.
SECTION FOUR: That this Ordinance shall be in full force and effect from and
after its passage, approval, and publication in the manner provided by law.

ORDINANCE NO.
AN ORDINANCE AMENDING MAP 38-S OF THE
MOUNT PROSPECT ZONING ORDINANCE
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did here-
tofore conduct a public hearing under Case No. 5-Z-78 at the hour of 8:00 p.m.
on February 23, 1978, pursuant to a request for zoning classification changes in
conjunction with a planned unit development, which requested changes were
from R -X (Single Family Residence District) to R-4 (Residential Development
District) of certain property hereinafter described; and
WHEREAS, a notice of the aforesaid public hearing was made and published in the
mariner provided by law; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect has recom-
mended to the President and Board of Trustees of the Village of Mount Prospect that
the petitioner's request under said Case No. 16-Z--77 be granted; and
WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount
Prospect has reviewed the matter herein and has recommended the approval thereof
to the President and Board of Trustees of the Village of Mount Prospect; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
have determined that the best interests of the Village of Mount Prospect will be
attained by the adoption of the following Ordinance regarding the subject property;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That Map 38-S of the Zoning Ordinance of the Village of Mount
Prospect, as amended, be and the same are hereby further amended by reclassifying
from R -X (Single Family Residence District) to R-4 (Residential Development Dis-
trict) that land legally described as follows:
The North 5 acres (except the West 25.0 feet of the East 50.0 feet
thereof) and (except the West 210 feet thereof) of the South 30 acres
of the Southeast 1/4 of the Northeast 1/4 of Section 22, Township 41
North, Range 11, East of the Third Principal Meridian, in Cook
County, Illinois.
SECTION TWO: That Map 38-S contained in SECTION ONE of Ordinance 2410, passed
and approved March 20, 1973, shall be deemed amended so as to conform with the
reclassificaiton of the property herein contained in SECTION ONE above.
SECTION THREE: That this Ordinance shall be in full force and effect from
and after the recording of an approved plat resubdividing the subject property
into one (1) lot of record; and after its passage, approval, and publication in
the mariner provided by law.

AN ORDINANCE GRANTING A SPECIAL USE PERMIT IN
THE NATURE OF A PLANNED UNIT DEVELOPMENT FOR
PROPERTY COMMONLY KNOWN AS 3026 SOUTH BUSSE ROAD
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hereto-
fore conduct a public hearing under Case No. 6 -SU -78 on February 23, 1978, at the
hour of 8: 00 p.m. , pursuant to a request for a special use in the nature of a Planned
Unit Development; and
WHEREAS, a notice of the aforesaid public hearing was made and published in the
manner provided by law; and
WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount
Prospect has reviewed the matter herein and has recommended the approval thereof
to the President and Board of Trustees of the Village of Mount Prospect; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
have determined that the best interests of the Village of Mount Prospect will be
attained by the passage of the following Ordinance regarding the subject property,,
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:

Realty and Builders to construct a Planned Unit Development upon the following
described property:

thereof) and (except the West 210 feet thereof) of the South 30 acres
of the Southeast 1/4 of the Northeast 1/4 of Section 22, Township 41
North, Range 11, East of the Third Principal Meridian, in Cook
County, Illinois.
SECTION TWO: That the Planned Unit Development hereinabove authorized and
permitted shall be constructed pursuant to the land uses and standards shown upon
the Site Plan, attached hereto and hereby made a part hereof as Exhibit I, except
as may otherwise be provided herein, and as necessarily modified to solve engineer-

ing layout and design problems at the time of the construction of the said Planned
Unit Development.
A. Said Planned Unit Development shall consist of the construction of no more
than eighty-eight(88) dwelling units upon that portion of the subject pro-
perty zoned R-4 (Residential Development District).
B. The site of said Planned Unit Development shall also be improved with certain
on-site and off-site utilities pursuant to that plan attached hereto and hereby
made a part hereof as Exhibit 11 (Engineering Plan) which improvements shall
be dedicated to the Village of Mount Prospect.
C The Planned Unit Development. shall be served bV-such fire lanes as are shown -
upon Exhibit III (Fire Lane Exhibit) attached hereto and hereby made a part
hereof.
D Said Planned Unit Development may be designated as to location by one (1)
sign erected upon the subject property at the location shown on Exhibit I
(Site Plan) which sign shall conform in size and configuration to the plan
attached hereto and hereby made a part hereof as Exhibit 111(a) (Sign
Exhibit).
SECTION TJIREE: That the Village President is hereby authorized to sign, and

the Village Clerk is hereby authorized to attest, and Bernard Hewitt shall execute
and see to the recording to the "Restrictive Covenants" attached hereto and hereby
made a part hereof as Exhibit IV.
SECTION FOUR: That the Director of Building and Zoning of the Village of Mount
Prospect is hereby authorized to issue upon proper application for building permits
such permits as may be required for the construction of the said Planned Unit Develop-
ment --which construction shall be governed by the terms of Article XXV of the Mount
Prospect Zoning Ordinance, this Ordinance herein, and all other applicable ordinances
of the Village of Mount Prospect.
SECTION FIVE: That as each building in the development is completed and occupancy
certificates are issued for all of the residences in each building, Bernard Hewitt will
cause an Open Space Easement to be delivered to the Village of Mount Prospect.
A. These easements and plats shall be recorded and shall contain such wording
as may be sufficient to permanently guarantee the open space as shown on such�
easement in accordance with the said Planned Unit Development and any amend-
ments thereto.
B. That said Open Space Easements shall constitute a covenant running with the
land and shall be enforceable by the said Village of Mount Prospect.
SECTION SIX: That the text of this Ordinance and the Restrictive Covenants con-
tained in Exhibit IV hereto shall be recorded in the Office of the Recorder- of Deeds of
Cook County, Illinois, upon the execution thereof.
SECTION SEVEN: That this Ordinance shall be in full force and effect from and after
the recording of an approved plat resubdividing (consolidating) the subject property
into one (1) lot of record as shown upon that plat attached hereto and hereby made a
part hereof as Exhibit V and after its passage, approval, and publication in the manner
provided by law.

BERNARD HEWITT, in accordance with the provisions of Article XXV of the Zoning
ordinance of the Village of Mount Prospect providing for the creation of, Planned
Unit Developments and the regulation of the same, does hereby covenant with the
VILLAGE OF MOUNT PROSPECT, a municipal corporation of the County of Cook
and State of Illinois, as follows:
1. BERNARD HEWITT will maintain control of the Planned Unit Development pro-
posed on the property described as follows:
The North 5 acres (except the West 25.0 feet of the East 50.0 feet thereof),
and (except the West 210 feet thereof) of the South 30 acres of the South-
east 1/4 of the Northeast 1/4 of Section 22, Township 41 North, Range 11,

permanently guarantee open space substantially in accordance with said,approved
Planned Unit Development and any amendment thereto. Said Plat of Open Space

Easement shall constitute a covenant running with the land for fifty (50) years
-rom the date of said recording of those covenants and shall be enforceable by
said Village of Mount Prospect.
4, The covenants herein contained shall run with the land for the periods of time
set forth herein. Thereafter, said covenants shall be extended automatically
for successive periods of ten (10) years unless by a vote of the majority of the
said landowners of the said property it is agreed otherwise.
5. Nothing in these covenants shall in any way prevent alienation or sale of the
subject property or portion thereof except that said sale shall be subject to the
provisions hereof and of the Planned Unit Development Ordinance of the Village
of Mount Prospect and the new Owner shall be both benefited and bound by the
conditions and restrictions herein and therein expressed.
6. By acceptance of these Restrictive Covenants, the Village of Mount Prospect
acknowledges that its Ordinance relating to Restrictive Covenants, has been
fully complied with.
7. If the parties hereto, or any of them, or their heirs or assigns shall violate
or attempt to violate any of the covenants herein, it shall be lawful for the
other parties hereto, including the Village of Mount Prospect, to prosecute
any proceeding at law or in equity against the person or persons violating
or attempting to violate any such covenant --and either to prevent him or
them from so doing or to recover damages or other dues for such violation.
8. These covenants shall be binding upon and inure to the benefit of the parties

PROPERTY COMMONLY KNOWN AS 3026 SOUTH BUSSE ROAD
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet on
the 23rd day of February, 1978, at the hour of 8: 00 p.m. , at the Mount Prospect Public
Safety Building and did hear Case No. 7-V-78, pursuant to proper legal notice; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hear
this request for a side yard variation and for a variation in the size of parking spaces
so as to allow the petitioner to construct a certain Planned Unit Development contain-

Request for Villae_n Water:
Mr. Jeff Haiduke of 10 E. Golf Road appeared before the Committee
to request Village water for his residence and for his next door
neighbor to the east ... their wells have not been producing for
the last 7 months. There is Park District property between Mr.
HaiAuke's property and our closest water main. The Park District
will not grant an easement to a private party, but will grant
one to the Village. Ben Hemmeter and Herb Weeks agreed to start
working on this project the following morning.
Well #17:
Public Works Director Herb Weeks passed on a letter from J. P.
Miller Artesian Well Co., showing $80,696.04 as their balance of
charges for their services on Well. #17.
Sewer System Evaluation Survey Interim Report:
The Mayor & Board have received copies of Donahue & Associates, Inc.
interim report. Ben Hemmeter recommends Board approval of this
report so they can go forward with the next phase of the survey.
Rand, Central & Mt Prospect Road Engineering Agreement:
In 1972, the Village entered into an agreement with Alstot'& March,
Inc. for preparing the engineering plans on the above project.
This agreement also included the construction fees of the project.
A new agreement for construction engineering services needs to be
entered into since the original agreement is 5 years old. The
Illinois Department of Transportation and the Federal government
have new guidelines for TAUS projects and the agreement has been
written to meet the new requirements.
Ben Hemmeter recommends that the Village Board adopt the necessary
resolution authorizing the Mayor and Village Clerk to execute
to execute the revised agreement for construction engineering services

Route 83 -- "S" Curve Project, Supplemental Agreement:
During the construction of the "S" curve, it was necessary to
relocate the water main in front of the duplexes on Elmhurst Avenue
and also replace the sanitary sewer on Main Street. This work was
not included in the original contract.
The engineering fees for this additional work were paid with MFT
funds. In order for the Village to be reimbursed for the State's
and Federal government's share, a supplemental agreement for con-
struction engineering fees must be executed. This agreement is in
accord with the State's guidelines for TAUS projects. ,
Ben flemmeter recommends that the necessary resolution be adopted
by the Village Board authorizing the Mayor and the Clerk to sign
the supplemental agreement.
Federal Funds for New Brides:
The Committee supported Ben Hemmeter's request to make application
for Federal funds for construction of new bridges not located on
Federal or State highways.
If the application is approved, the Public Works Committee will
then consider recommending construction of another bridge over
Weller Creek in line with long range overall plans for bridging the
creek.
Central Road, Northwest Highway Railroad Crossing:

The Chicago & Northwestern Railway is trying to get some RTA money
for improvements, other than general maintenance, of this crossing,
but this work will not take place until 1979 ... if RTA provides
the funds.
A Federal Aid Highway Act of 1976 provides funds for railroad grade
crossings and will provide 90% grants for qualified projects. The
balance would come from our MFT funds ... the CN&W Railway has
indicated a willingness to pay a portion of our 10% share. Ben
Hemmeter is applying for the Federal funds.
Rand & Hir, Implovement:

The Committee is requesting the administration to reactivate this
project and provide periodic progress reports.
Proposed 1978 MFT Maintenance Street Resurfacing:
The Engineering Department has completed the designation of streets
to be resurvaced under this year's MFT budget... estimated cost is
$232,970. Streets were selected on the basis of the Dempsey & Novak
Engineering Study conducted last year. A map and listing of the streets
have been prepared for the Board's information.

WHEREAS, the Village of Mount Prospect is desirous of improving
the intersection at Rand Road, Central Road, and Mount Prospect
Road; and
WHEREAS, the engineering firm of Metcalf & Eddy/Alstot, March &
Guillou, Inc. has participated in the planning and design
engineering on said improvement; and
WHEREAS, this improvement known as F.A.U.S. Project M-5003 (42)
and Mount Prospect MFT Section 72 -00045 -00 -RP is ready for
contract letting; and
WHEREAS, it is desirable that the same firm of engineers which
has provided the planning and design phase engineering be retained
to provide construction engineering services for this project.

SUPPLEMENTAL AGREEMENT WITH METCALF & EDDY RELATIVE
TO THE ROUTE 83 "S" CURVE IMPROVEMENT
WHEREAS, the Village of Mount Prospect is currently engaged
in the reconstruction and improvement of Illinois Route 83
from Sha-Bunee Trail to Milburn Avenue, known as F8 Route 872°
Section 1976-030R, Project F -872(l); and
WHEREA^ , the engineering firm of Metcalf & Eddy/Alstot,
March & Guillow, Inc. by agreement with the Village of Mount
Prospect is providing construction engineering services for this
improvement; and
WHEREAS, the estimated fees for providing these services as
set forth in the agreement will be insufficient to compensate
for such services to complete the project; and
WHEREAS, in accordance with provisions of the agreement the
engineering firm has notified the Village and has determined
that the upper limit of the fee should be adjusted to $54,176 in
order to allow the firm to complete the work called for in the
agreement, and has prepared a supplemental agreement adjusting

fees and is in substantial concurrence;
NOW, THEREFORE, DE IT RESOLVED BY THE MAYOR AND THE BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE That the Village Mayor and Clerk be duly authorized
to execute the Supplemental Agreement on behalf of the Village
of Mount Prospect and to affix its corporate seal to said
Supplemental Agreement, a copy of which is attached hereto as
"EXHIBIT A" and by this reference incorporated herein.
SECTION TWO: That this Resolution shall be in full force and
effect from and after its passage and approval in the manner
provided by law.

Board, commented on the recently appointed Advisory
Committee relative to the present Library Board system,
noting that Committee had met on April 8th but he was unable

reducing the proposed budget.

AN ORDINANCE TO PROVIDE A REVISED WATER RATE
SCHEDULE

Trustee Richardson explained that there was a bond issue
in 1959 by the MSD for Mount Prospect sanitary relief
sewer system. Monies have been accumulated by the District
through residents payments of service charges and it was
the belief of the Board that sufficient funds have been
accumulated to call these bonds for payment.
Trustee Richardson, seconded by Trustee Murauskis, moved
to authorize the Mayor to sign arid Clerk to attest the
MSD Maintenance Agreement commencing May 1, 1978, until
such time as sufficient monies have been accumulated to
call in those bonds, no additional funds will be paid for
any other purpose.
