ORDINANCE NO.
AN ORDINANCE GRANTING CERTAIN VARIATIONS FOR
PROPERTY COMMONLY KNOWN AS 300 WEST GOLF ROAD
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet
on the 23rd day of February, 1978, at the hour of 8: 00 p.m., at the Mount Prospect
Public Safety Building, and did hear Case No. 2-V-78, pursuant to proper legal
notice; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hear
this request for certain variations from the Mount Prospect Zoning Ordinance; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recom-
mend to the Building Committee of the Board of Trustees of the Village of Mount
Prospect the approval of this request under Case No. 2-V-78; and
WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount
Prospect has reviewed the matter herein and has recommended the approval thereof
to the President and Board of Trustees of the Village of Mount Prospect; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
have reviewed the matter herein and have determined that the same is in the best
interests of the Village of Mount Prospect;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the property being the subject matter of Case No. 2-V-78
being legally described as follows:
Lot 11 in Block 4 in Lonnquist Gardens Subdivision, a subdivision
of part of the Northeast Quarter of Section 14, Township 41 North,
Range 11, East of the Third Principal Meridian, in Cook County,
Illinois,
is currently zoned under the Zoning Ordinance of the Village of Mount Prospect as
B-2 (Business -Office District), which zoning classification shall remain in effect
subject to the variations granted herein:
(a) That the front and rear yard parking spaces may continue to be
used; and I
(b) That the required truck loading dock be eliminated so long as
the use of the subject property is limited to professional and
business offices.
SECTION TWO: That all requirements of the Mount Prospect Building and Zoning
Code shall be applicable except the variations noted in SECTION ONE heretofore
mentioned.
SECTION THREE: That this Ordinance shall be in full force and effect from and
after its passage, approval, and publication in the manner provided by law.

AN ORDINANCE AMENDING MAP 10 (A) -S OF THE ZONING
ORDINANCE OF THE VILLAGE OF MOUNT PROSPECT
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did
conduct a public hearing under Case No. 17-Z-78, on the 23rd day of March,
1978, on a request for a zoning classification change from R -X (Single Family
Residence District) to R-1 (Single Family Residence District) of certain
property hereinafter described; and
WHEREAS, a notice of the aforesaid public hearing was made and published
in the manner provided by law; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect has
recommended to the President and Board of Trustees of the Village of Mount
Prospect that the petitioner's request under said Case No. 17-Z-78 be granted;
and
WHEREAS, the Building Committee of the Board of Trustees of the Village of
Mount Prospect has reviewed the matter herein and has recommended the
appoval thereof to the President and Board of Trustees of the Village of
Mount Prospect; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
have determined that the best interests of the Village of Mount Prospect will be
attained by the adoption of the following Ordinance regarding the subject
property:
NOW, THERFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That Map 10(A) -S of the Zoning Ordinance of the Village of
Mount Prospect, as amended, be and the same is hereby further amended by
reclassifying from R -X (Single Family Residence District) to R-1 (Single
Family Residence District) the following described property:
PARCEL 1: The North 291.77 feet of the following described
tract of land: Lots 2,3 and 6 (except the North 33.0 feet and
also except the east 40.0 feet which lies South of the North
33.0 feet thereof) in Meier Brothers Subdivision, being a sub-
division of parts of Sections 10 and 15, Township 41 North,
Range 11 East of the Third Principal Meridian, in Cook County,
Illinois.
PARCEL 2: The South 350. 11 feet of the North 641.88 feet of the
following described tract of land: Lots 2,3 and 6 (except the
North 33.0 feet and also except the East 40.0 feet which lies
South of the North 33.0 feet thereof) in Meier Brothers Sub-
division, being a subdivision of parts of Sections 10 and 15,
Township 41 North, Range 11 East of the Third Principal
Meridian, in Cook County, Illinois.
PARCEL 3: That part of Lots 2,3 and 6 in Meier Brothers Sub-
division, being a subdivision of parts of Sections 10 and 15,
Township 41 North, Range 11 East of the Third Principal
Meridian, (except the North 33.0 feet and also except the East
40.0 feet which lies south of the north 33.0 feet thereof) taken
as a single tract of land which lies South of the North 641.88 feet
of said tract (except the East 425.0 feet which lies South of the

SECTION TWO: That Map 10 W -S contained in SECTION ONE of Ordinance
No. 2410, passed and approved March 20, 1973, shall be deemed amended
so as to conform with the reclassification of the subject property contained
in SECTION ONE above.
SECTION THREE: That this Ordinance shall be null and void and of no force
and effect whatsoever until after its passage, approval, publication, and
such time as an accurate platresubdividing the said parcels described in
SECTION ONE hereinabove is recorded with the Recorder of Deeds of Cook
County, Illinois; a copy of which plat of resubdivision shall be attached
hereto and hereby made a part hereof.

AN ORDINANCE GRANTING A SPECIAL USE FOR PROPERTY
LOCATED AT 215 WEST PROSPECT
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did
hold a Public Hearing on Case No. 32 -SU -78, on May 25, 1978, at the hour
of 8: 00 p.m., in the Public Safety Building, pursuant to proper legal notice; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect heard
testimony presented under Case No. 32 -SU -78 pertaining to a request for a
certain special use pursuant to the Mount Prospect Zoning Ordinance to per-
mit a certain use upon the property hereinafter described; and
WHEREAS, the Zoning Board of Appeals has recommended that the President
and Board of Trustees of the Village of Mount Prospect allow the special use as
presented in Case No. 32 -SU -78; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
have reviewed the matter herein and have determined that the same is in the
best interests of the Village of Mount Prospect;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the special use authorized and granted in SECTION TWO
hereinbelow is conditioned upon and shall be valid and effective only so long as:
During the term of this special use, no buildings or accessory
buildings shall be established and/or constructed on the subject
property.
SECTION TWO: That, pursuant to the Mount Prospect Zoning Ordinance and in
accord with the terms and conditions of this Ordinance, the following special
use is hereby authorized upon the subject property described in SECTION THREE
hereinbelow:
The operation of an off-street paved not -for -fee parking lot.
SECTION THREE: That the special use authorized to be established in SECTION
TWO hereinabove shall be valid and effective upon the following property
(hereinabove and hereinafter referred to as "subject property") legally de-
scribed as:
Lot 50 in H. Roy Berry Company's Colonial Manor, being a
subdivision of part of the Northeast Quarter of Section 11
and part of the Northwest Quarter of Section 12, all in Town-
ship 41 North, Range 11, East of the Third Principal
Meridian, in Cook County, Illinois;
which property has been zoned R-3 (Apartment Residence District), and
which zoning classification shall remain in full force and effect, subject to the
special use granted under the terms and conditions of this Ordinance.
SECTION FOUR: That the text of this Ordinance shall be recorded in the Office
of the Recorder of Deeds or registered with the Registrar of Titles (as the case
may be) of Cook County, Illinois.
SECTION FIVE: That.this Ordinance shall be null and void and of no force and
effect whatsoever until after its passage, approval, and publication, and at such
time as an accurate plat resubdividing the said parcel described in SECTION
THREE hereinabove is registered with the Registrar of Titles of Cook County,
Illinois; a copy of which plat of resubdivision shall be attached hereto and hereby
made a part hereof.

ORDINANCE OF THE VILLAGE OF MOUNT PROSPECT
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did con-
duct a public hearing under Case No. 34-Z-78, on the 25th day of May, 1978,
on a request for a zoning classification change from R -X (Single Family Resi-
dence District) to R-1 (Single Family Residence District) of certain property
hereinafter described; and
WHEREAS, a notice of the aforesaid public hearing was made and published in
the manner provided by law; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect has
recommended to the President and Board of Trustees of the Village of Mount

permit pursuant to such variation is made and construction commenced within
one (1) year of the date this said Ordinance becomes effective.

AN ORDINANCE AMENDING THE MOUNT PROSPECT TRAFFIC CODE
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That Schedule I of Article XX of Chapter IS (Traffic Code)
of the Municipal Code of the Village of Mount Prospect of 1957, as amended.,
be and the same is hereby further amended by amending page 3 thereof in
order '
to add a 25 MPH speed limit westbound on Isabella Avenue, between
Forest -Avenue and Main Street; so that hereafter the said page 3 of Schedule I

SECTION TWO: That Section B of Schedule IV of Article XX of Chapter 18
(Traffic Code) of the Municipal Code of the Village of Mount Prospect of 1957,
as amended, be and the same is hereby further amended by amending page 13
thereof in order to add a yield sign on Henry Street, east and westbound, at
the intersection with Fairview Avenue; so that hereafter the said Section B

Prospect Meadows Water Company: (Reference: Letter from Herb

At the Public Works Committee discussion, which followed the
Finance Committee Meeting of May 31, 1978, Mr. Edward Benjamin,
owner of Prospect Meadows Water Company, proposed that the Vil-
lage purchase his water system. He presented a Report from the
engineering firm Ciorba, Spies, Gustafson and Co. showing the
current replacement value of the system to be $160,000. Deduct-
ing depreciation at the rate of 1.5% per year since 1950 (42%
or $67,200), they arrive at $92,800 for the system as is. This
does not include his two well sites, one of which would be do-
nated to the Park District and the other he planned to sell to
Mack Cadillac for expansion of their parking area. Mr. Benjamin
asked that the lease.owning of this well -site, as well as the
rezoning of a single family residence located between the site
and Mack Cadillac property be a consideration of the sale. . .
the Committee suggested that the regular procedures be followed
for any rezoning. The Committee asked Herb Weeks to analyze
the engineering appraisal and report back at the June Committee
Meeting. Representatives of the Prospect Meadows Homeowners'
Association will be invited to attend the June meeting.

and indicated a definite interest in the acquisition and
improvement of the system by the Village with the cost to be
spread among the property owners. It was made clear that
they did not represent all the property owners due to the
inactivity of their Homeowners' Association; however, they
agreed to contact all homeowners as soon as definite cost
figures could be determined. They were given the figure of
$130,000 from Herb Weeks as a minimum for up -grading the
system. This included the connecting main, looping the system,
additional hydrants and new meters. Herb Weeks provided the
Committee with an alternate estimate of the value of the system
which was considerably lower than the one furnished by Mr.
Benjamin.
With reference to financing, this could be a separate bond
issue or a part of a larger bond issue covering a new water
main down Busse Road from Central to Bonita Avenue and the
completion of Well No. 17, or a single bank note. . .10 year
or 20 year payback. The Committee favored the establishment
of a Special Service Area whereby the property owners would
be assessed for the cost of the system with their real estate
property taxes. The Committee also voted 2-0 to recommend
Board authorization for the Administration to start immediate
negotiations with Mr. Benjamin. The next move would be for
the Board to approve the negotiated figure, hopefully at the
July 5th Regular Board Meeting, then furnish Mr. Maisel and
Mr. Greist with total cost figures to pass on to the property
owners. A public hearing could then be made a part of the
July 20th Public Works Committee Meeting.
Busse Road Water Main: (Reference: Attached map and copies

1978 and June 14, 1978.)
The Committee favored the recommendation of Ben Hemmeter to
install a 16" water main with funding to be part of a water
system improvement bond issue. Approximately $30,000 of this
cost would be recovered from tap -on fees charged to the home-
owners along Busse Road as they converted from well water.
Rather than request Board concurrence at this time, the Com-
mittee is suggesting a Committee of the Whole Meeting for later
this month or early July to which Ron Norene, Vice President of
Paul D. Speer and Associates, would be invited to explain the

The Mayor and Board will recall approving the purchase of
property for right-of-way and sidewalk installation at this
corner using a part of the MFT funds approved and budgeted
last year for the purchase of the entire corner parcel. Ben
Hemmeter has now been advised that a new appraisal will have
to be made and a new resolution passed. He believes the new
appraisal will come in at something less than the $6 per sq.
ft. as negotiated with the property owner, and the difference
must come from sources other than MPT funds. The Committee
by a 2-0 vote recommends the use of monies recovered from
George L. Busse for our cost of installing the parking strip
along School Street just north of Northwest Highway. Board
clearance is requested.
Payment to the Prospect -Maple property owners will be delayed
somewhat; however, a due date was never established.

The homes on Busse Road between Bonita Drive and Central Road
all have wells from which they obtain their water. The Village
does not have a watermain along this seciton of Busse Road. As
new homes are built the owner has to drill a well for water.
Last year one homeowner's well went dry and they were able to
connect into the water line that serves Westbrook School. Yesterday
Mr. Peter Oda of 8 S. Busse Road came into my office to see what
could be done to bring water down Busse Road since his well is also
running dry. (There is a possibility that the wells in this area are
running dry because of the installation of the Deep Tunnel project).
The water available from shallow wells is being depleted and the
homeowners are faced with the problem of drilling deeper and deeper
wells or getting their water from other sources. A watermain installed
in Busse Road would solve this water supply problem. The following
are three ways in which a watermain can be installed:
1) The homeowners could band together in a joint venture
and install the watermain. This may not be feasible
because not all homes are in critical need for water
at this time.
2) The Village could install the watermain with a Special
Assessment. This method takes time and some of the
homeowners cannot wait that long.
3) The Village could install the watermain using water
revenue funds and then charge the homeowners for their
share as they are forced to connect to the watermain.
The estimated cost for the proposed watermain is $30,000 or approximately
$1500 per homeowner.
I recommend that the Village Board consider the installation of the
above watermain to serve the homeowners along Busse Road with water.

SUBJECT: Busse Road Watermain
My estimate for a watermain made on 31 May 1978 was based only
on providing water along Busse Road. I did not estimate for a
line to be used as a "feeder" line. When, and if a pumping
station and reservoir are built at Busse and Central Roads we will
need to put in a 16" watermain to serve the southwest section of
Mount Prospect.
A 16" watermain should be put in now instead of the 8" main if
the Village intends to begin planning for* Lake Michigan water.
The cost of the 16" watermain would be approximately $55,000.

representing parties presently having a suit against
the Village. Mayor Krause noted. she would get back
to Mr. Muhlenfeld regarding this matter.
