ADJOURNMENT 6/2/78 ORDINANCE NO, AN ORDINANCE GRANTING A SPECIAL USE FOR PROPERTY - LOCATED AT 101 SOUTH MAPLE STREET WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hold a Public Hearing on Case No. 29 -SU -78, on May 25, 1.978, at the hour of 8: 00 p.m. , in the Public Safety Building, pursuant to proper legal notice; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect heard testimony presented under Case No. 29 -SU -78 pertaining to a request for certain special uses pursuant to the Mount Prospect Zoning Ordinance to permit certain uses upon the property hereinafter described; and WHEREAS, the Zoning Board of Appeals has recommended that the President and Board of Trustees of the Village of Mount Prospect allow the special use as pre- sented in Case No. 29 -SU -78; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have reviewed the matter herein and have determined that the same is in the best interests of the Village of Mount Prospect; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTIO" That the special use authorized and granted in SECTION TWO hereinbelow is conditioned upon and shall be valid and effective only so long as: A. During the term of this special use, no buildings or accessory buildings shall be established and/or constructed on the subject property; and B. The said special use granted in SECTION TWO hereinbelow shall not run with the land, but shall be limited to that period of time wherein the subject property is utilized by the Mount Prospect State Bank for employee and tenant parking, which period of time shall not exceed five (5) years from the date hereof. SECTION TWO: That, pursuant to the Mount Prospect Zoning Ordinance and in accord with the terms and conditions of this Ordinance, the following special use is hereby authorized upon the subject property described in SECTION THREE hereinbelow: The operation of an off-street paved not -for -fee parking lot. North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois, is currently zoned under the Zoning Ordinance of the Village of Mount Prospect as R -I (Single Family Residence) District, which zoning classification shall remain in effect subject to the variations granted herein: A. That the off-street parking ., spaces be reduced from 10' x 201 to 91 x 201 in size. B. Floros Hendricks Murauskis Wattenberg Mr. Harold Haney, 2.420 E. Green, requested the Village to treat diseased Maple trees in his area, showing a branch of an infected tree. Mayor Krause stated the Forestry Department would look into the problem. Mrs. Tomassone, 502 Hill Street, requested consideration of the Board relative to waiving the requirement of a retention basin on a development of 5 acres or more, since the owners of the property are dedicating an acre of the property to the Village. Mayor Krause stated following a report being received from the staff, a recommendation would be made by the Board. This matter was referred to the July 5th meeting of the Village Board. Robert Moore, attorney for the petitioner, brought the matter involved with ZBA 17-Z-78 and ZBA 18 -V - ?8 to the attention of the Board at this point since the petitioner was requesting the matter be put over and there were numerous objectors in the audience. Robert Klein, 2116 Jody Court, and Lois Falco, 524 Louis, spoke in opposition to the proposed development. Mayor Kra-.ise referred this matter to the July 18th meeting of the Village Board.
