ORDINANCE NO.
AN ORDINANCE CONSENTING TO THE VILLAGE OF ARLINGTON
HEIGHTS BECOMING AN ADDITIONAL MEMBER OF THE
NORTHWEST SUBURBAN WATER SYSTEM VENTURE
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE
OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That it is found and declared as follows:
A. The Village of Mount Prospect has by previous Ordinance, Ordinance No. 2791,
determined to participate in and has become a member of the Northwest Sub-
urban Water System Agreement (the "Agreement");
B. The Agreement allows additional municipalities to join the Venture as new
members by adopting an ordinance authorizing their execution of the Agreement
but only upon the approval of the Venture's Board of Directors and upon the
unanimous consent by ordinance of all of the then members of the Venture;
C The Village of Arlington Heights now desires to become a member of the Venture;
and the Venture's Board of Directors has approved the Village becoming such
a new member of the Venture; and
D It is in the best interests of the Village of Mount Prospect and the Venture that
the Village of Arlington Heights be allowed to become a new member.
SECTION TWO: That the execution of the Agreement by the Village of Arlington
Heights and its becoming a member of the Venture are consented to and approved.
SECTION THREE: That this Ordinance shall be in full force and effect from and
after its passage and approval.

ORDINANCE NO.
AN ORDINANCE AMENDING MAP 10(A) -S OF THE ZONING
ORDINANCE OF THE VILLAGE OF MOUNT PROSPECT
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did
conduct a public hearing under Case No. 17-Z-78, on the 23rd day of March,
1978, on a request for a zoning classification change from R -X (Single Family
Residence District) to R-1 (Single Family Residence District) of certain
property hereinafter described; and
WHEREAS, a notice of the aforesaid public hearing was made and published
in the manner provided by law; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect has
recommended to the President and Board of Trustees of the Village of Mount
Prospect that the petitioner's request under said Case No. 17-Z-78 be granted;
and
WHEREAS, the Building Committee of the Board of Trustees of the Village of
Mount Prospect has reviewed the matter herein and has recommended the
appoval thereof to the President and Board of Trustees of the Village of
Mount Prospect; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
have determined that the best interests of the Village of Mount Prospect will be
attained by the adoption of the following Ordinance regarding the subject
property:
NOW, THERFORE , BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That Map 10(A) -S of the Zoning Ordinance of the Village of
Mount Prospect, as amended, be and the same is hereby further amended by
reclassifying from R -X (Single Family Residence District) to R-1 (Single
Family Residence District) the following described property:
PARCEL 1: The North 291.77 feet of the following described
tract of land: Lots 2,3 and 6 (except the North 33.0 feet and
also except the east 40.0 feet which lies South of the North
33.0 feet thereof) in Meier Brothers Subdivision, being a sub-
division of parts of Sections 10 and 15, Township 41 North,
Range 11 East of the Third Principal Meridian; in Cook County,
Illinois.
PARCEL 2: The South 350.11 feet of the North 641.88 feet of the
following described tract of land: Lots 2,3 and 6 (except the
North 33.0 feet and also except the East 40.0 feet which lies
South of the North 33.0 feet thereof) in Meier Brothers Sub-
division, being a subdivision of parts of Sections 10 and 15,
Township 41 North, Range 11 East of the Third Principal
Meridian, in Cook County, Illinois.

PARCEL 3: That part of Lots 2,3 and 6 in Meier Brothers Sub-
division, being a subdivision of parts of Sections 10 and 15,
Township 41 North, Range 11 East of the Third Principal
Meridian, (except the North 33.0 feet and also except the East
40.0 feet which lies south of the north 33.0 feet thereof) taken
as a single tract of land which lies South of the North 641.88 feet
of said tract (except the East 425.0 feet which lies South of the
North 742.0 feet of said tract) in Cook County, Illinois.
SECTION TWO: That Map 10 (A) -S contained in SECTION ONE of Ordinance
No. 2410, passed and approved March 20, 1973, shall be deemed amended
so as to conform with the reclassification of the subject property contained
in SECTION ONE above.
SECTION THREE: That this Ordinance shall be null and void and of no force
and effect whatsoever until after its passage, approval, publication, and
such time as an accurate platresubdividing the said parcels described in
SECTION ONE hereinabove is recorded with the Recorder of Deeds of Cook
County, Illinois; a copy of which plat of resubdivision shall be attached
hereto and hereby made a part hereof.

ORDINANCE NO.
AN ORDINANCE GRANTING A FRONT YARD VARIATION FOR
PROPERTY COMMONLY KNOWN AS 1590 SOUTH BUSSE ROAD
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did
conduct a public hearing on the 7th day of June, 1978, at the hour of 8: 00 p.m.,
at the Public Safety Boardroom, and did hear Case No. 39-V-78, pursuant to
proper legal notice; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hear
this request for a front yard variation to allow the petitioner to erect a metal
canopy over gasoline dispensing islands to within ten feet six inches (10' 611)
of the property line adjacent to Busse Road on the lot legally described hereinbelow;
and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recom-
mend to the Building Committee of the Board of Trustees of the Village of Mount
Prospect the approval of this request under Case No. 39-V-78; and
WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount
Prospect did meet on July 12, 1978, and did review the recommendations of the
Zoning Board of Appeals in Case No. 39-V-78; and
WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount
Prospect have recommended that the Board of Trustees of the Village of Mount
Prospect concur in the recommendations of the Zoning Board of Appeals under said
Case No. 39-V-78; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
have reviewed the matter herein and have determined that the same is in the best
interests of the Village of Mount Prospect;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the property being the subject matter of Case No. 39-V-78
being legally described as follows:
Lot Lin Bulk Petroleum Corporation Subdivision in the East
1/2 of the Southeast 1/4 of Section 15, Township 41 North,
Range 11, East of the Third Principal Meridian, in Cook
County, Illinois;
is currently zoned under the Zoning Ordinance of the Village of Mount Prospect
as B-4 (Business - Retail and Service) District, which zoning classification
shall remain in effect subject to the variation granted herein:
That the yard abutting the frontmost lot line of the subject property
adjacent to Busse Road be reduced to ten feet six inches (101 611),
as shown upon the site plan which is attached hereto and hereby
made a part hereof as Exhibit I.
SECTION TWO: That all requirements of the Mount Prospect Building and
Zoning Code shall be applicable except the variation noted in SECTION ONE
heretofore mentioned.

SECTION THREE: That the Director of Building and Zoning of the Village of
Mount Prospect is hereby authorized to issue a building permit for construction
in accordance with the variation hereinbefore mentioned.
SECTION FOUR: That the variation granted by this Ordinance shall be nun and'
void and of no force and effect whatsoever unless an application for a building
permit pursuant to such variation is made and construction commenced within
one (1) year of the date this said Ordinance becomes effective.
SECTION FIVE: That this Ordinance shall be in full force and effect from and
after the removal of all non -conforming uses (including non -conforming
advertising signs and billboards) from the subject property, and the passage ,
approval, and publication of this Ordinance in the manner provided by law.

ORDINANCE NO.
AN ORDINANCE INCREASING THE FILING FEES FOR
HEARINGS BEFORE THE ZONING BOARD OF APPEALS
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did
conduct a Special Public Hearing under Case No. 4-Z-78, on January 5, 1978,
and a Public Hearing on April 27, 1973, on a request to amend the schedules
of filing fees contained in Sections 14.602, 14.702, 14.803, and 14.902 of the
Municipal Code of the Village of Mount Prospect (the Zoning Ordinance) for
hearings held by the Zoning Board of Appeals of the Village of Mount Prospect
on requests for variations, special uses, zoning amendments, and appeals: and
WHEREAS, notices of the aforesaid Special Public Hearing and Public Hearing
were made and published in the manner provided by law; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did
recommend to the President and Board of Trustees of the Village of Mount
Prospect that the request to amend the schedules of filing fees in the Zoning
Ordinance, requested under Case No. 4-Z-78, be granted; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
have determined that the best interests of the Village of Mount Prospect will
be attained by the adoption of the following Ordinance regarding fees for the
Zoning Ordinance;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That paragraph 2 of subsection C of Section 14.602 of the
Municipal Code of the Village of Mount Prospect of 1957, as amended, be and
the same is hereby further amended in its entirety by increasing the filing fees
for hearings held by the Zoning B ' oard of Appeals on requests for variations;
so that hereafter the said paragraph 2 shall be and read as follows:
112. Payment of filing fees:
a. For variance requests concerned with lot size, yard size,
parking and/or land use:
1) All fences -- Fifty Dollars ($50).
2) Signs -- Two Hundred Dollars ($200).
b. For all other variance requests:
1) Where the area of the tract of land concerned consists of
17,000 square feet or less.-- Fifty Dollars ($50).
2) Where the area of the tract of land concerned consists of more
— than 17,000 square feet -- Two Hundred Dollars ($200).
c. Special hearings will be held at a time mutually agreed upon by the
petitioner and the Zoning Board of Appeals provided further that
the petitioner pay a special hearing fee in an amount equal to Two
Hundred Dollars ($200) over and above the foregoing scheduled
fees.
d. In the event a petition for a variation is heard in conjunction with
a petition for an amendment, no filing fee will be
charged for the variation petition. 11
SECTION TWO: That paragraph 2 of subsection C of Section 14.702 of the
Municipal Code of the Village of Mount Prospect of 1957, as amended, be and
the same is hereby further amended in its entirety by increasing the filing fees
for hearings held by the Zoning Board of Appeals on requests for special use;
so that hereafter the said paragraph 2 shall be and read as follows:
112. Payments of filing fees; the amount of •which shall be determined on
the basis of the area of the land with which the special use is concerned
pursuant to the following schedule:
a. Regular hearings:
1) Less than one acre -- One Hundred Twenty Five Dollars ($125).
2) One acre but less than five acres in area -- Two Hundred
Fifty Dollars ($250).
3) Five acres but less than ten acres in area -- Nine Hundred
Dollars ($900).
4) Ten acres but less than fifteen acres in area -- One Thousand
Two Hundred Dollars ($1,200).
5) Fifteen acres or more in area One Thousand Five Hundred -
Dollars ($1,500).
b. Special hearings will be held at a time mutually agreed upon by the
petitioner and the Zoning Board of Appeals provided further that
the petitioner pay a special hearing fee in an amount equal to Two
Hundred Dollars ($200) over and above the foregoing scheduled
fees.
c. In the event a petition for a special use is heard in conjunction with
a petition for an amendment, no filing fee will be charged
for the special use petition. 11
SECTION THREE: That paragraph 2 of subsection C of Section 14.803 of the
Municipal Code of the Village of Mount Prospect of 1957, as amended, be and the
same is hereby further amended in its entirety by increasing the filing fees for
hearings held by the Zoning Board of Appeals on requests for text and map amend-
ments; so that hereafter the said paragraph 2 shall be and read as follows.

112. Payment of filing fees, pursuant to the following schedule:
a. Regular hearings:
1) Text amendment -- Five Hundred Dollars ($500).
2) Map amendment, determined on the basis of the area of the
land which is the subject of the map amendment:
a) Less than one acre in area -- One Hundred Twenty
Five Dollars ($125).
b) One acre but less than five acres in area -- Seven
Hundred Dollars ($700).
c) Five acres but less than ten acres in area -- Nine
Hundred Dollars ($900).
d) Ten acres but less than fifteen acres in area -- One
Thousand Two Hundred Dollars ($1,200).
e) Fifteen acres or more in area 7-- One Thousand Five
Hundred Dollars ($1,500).
b. Special hearings will be held at a time mutually agreed upon by the

a.. Two Hundred Fifty Dollars ($250) for regular hearing.
b. Four Hundred Fifty Dollars ($450) for special hearing."
SECTION FIVE:. That this Ordinance shall be in full force and effect from and
after its passage, approval and publication in the manner provided by law.

AN ORDINANCE AMENDING THE MOUNT PROSPECT TRAFFIC CODE
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That Schedule I of Article XX of Chapter 18 (Traffic Code)
of the Municipal Code of the Village of Mount Prospect of 1957, as amended,
be and the same is hereby further amended by amending page 5 thereof in
order to upgrade the speed limit on Prospect Avenue from 25 MPH to 30 MPH
between Maple Street and Mount Prospect Road; so that hereafter the
said page 5 of Schedule I of Article XX of the Traffic Code shall be and read
as follows:

order to delete a "No Parking - 5 minute Loading Zone" sign on the north side of
Evergreen Ave., between Maple St. and a pt. 70 feet east of Maple St.; so

SECTION THREE: That Schedule XI of Article XX of Chapter 18 (Traffic Code)
of the Municipal Code of the Village of Mount Prospect of 1957, as amended,
be and the same is hereby further amended by amending page 1 thereof in
order to institute two hour parking restrictions on the north side of Evergreen
Avenue between Maple Street and a point 100 feet west of Elm Street; so that
hereafter the said page 1 of Schedule XI of Article XX of the Traffic Code shall
be and read as follows:

Busse Road Watermain:
The Busse Road watermain came under discussion during the Committee of
the Whole meeting which preceded this Public Works Committee meeting.
It was the consensus of the Board that this project should be undertaken
as soon as arrangements on method of financing can be completed. it
was left as a charge to the Public Works Committee for further study.
Ben Hemmeter estimated the cost of a 16" main from Central Road south
to Lincoln would be $96,000 with recapture from tap -ons to bring in
$30,000+. He recommended that this main be extended south to Willow
as a part of the overall plan for Lake Michigan water distribution. This
would also make it possible to eliminate Well #12 which is used only a
few months out of the year for reserve storage. This well site is
presently costing the Village $300 per month ground rental plus property
taxes. ($1025 included in last list of bills for these taxes.) The
Chairman of the Public Works Committee will defer the financing phase
of the Busse Road watermain to the Finance Committee.
Mr. & Mrs. Peter Oda, who live at 8 S. Busse, were at the meeting to
express their interest in the Busse Road watermain. Their well has run
dry, and they are presently getting water from the next door neighbor
via a garden hose. Because of their urgent need for water they are un-
able to wait for the Villageto install the Busse Road watermain. The
Committee, by a vote of 2-0, and the administration are recommending a
waiver of the ordinance which requires residents who have their own
well to tap on to Village water. If the Board concurs, Mr. & Mrs. Oda
will proceed to drill a new well.
Plumbing Code Amendment:
Buell Dutton attended the meeting to discuss this matter which had come
before the Board at its regular meeting of July 5, 1978 and was referred
to Committee for clarification. Mr. Dutton agreed to delete the word-
ing which was in question, and the Committee then voted 2-0 in favor
of the amendment.

COMMUNICATIONS AND PETITIONS - CITIZENS TO BE HEARD
Mr. Bob Gattone,representing some residents in unincorporated
Cook County on Susan Drive, requested information relative
to annexation to the Village of Mount Prospect. It was
determined that Mr. Gattone would meet with Village Attorney
Zimmermann to work on various requirements for possible
annexation, as well as the Petition for Annexation.
Mr. Don Erickson, representing residents in the Pickwick Commons
area, requested a waiver of any annexation fee relative to that
area entering into a Pre -Annexation Agreement. Mayor Krause
noted that Ordinance No. 2618 stated newly annexed areas would
be billed for scavenger service until revenue was received via
real estate taxes. Mr. Erickson stated that such a billing
would not be objectionable to the association. Following
discussion, it was determined that Mr. Erickson would meet
with the Village Attorney to draft a Pre-Annextion Agreement
for the Pickwick Commons area.
Mr. Devaney, 801 S. Owen and Mr. Lamberti, 802 S. William,
requested the Board have a fence erected along Weller Creek
between Owen and William, due to a recent accident where a
young boy fell into the Creek.
Mr. John Green, 807 S. Owen, spoke in favor of such a fence.
Following discussion, it was determined that the administration
would look further into the problem and report back to the
Board at the August lst meeting.
Rena Miller requested information relative to the Northwest
Opportunity Center setting up operations in the building
formerly known as Sunset School on Lonnquist Blvd, stating
the residents in that area were in opposition to the proposed
use of that building being considered by School District 57.

Attorney Bill Moore presenting a brief history of the cases
in question, noting an ordinance was passed some time ago
rezoning the subject property, however, due to the requirement
of a plat of subdivision not being approved by the Village
Board this Ordinance No. 2741, was not in effect.

removed and "2 Hour Parallel" restrictions be instituted.

Unity Plat of Resubdivision - Route 83, Kensington and
Rand Roads.
Modifications to that plat having been made by the petitioner,
Trustee Hendricks, seconded by Trustee Richardson, moved to
authorize the Mayor to sign and Clerk to attest her signature
on the Unity Plat of Resubdivision providing first the wording
"approval and recording of this subdivision hereby abrogates
all previously recorded building lines except as shown hereon"
is removed from the linen; a restrictive covenant is installed
on the linen which reads substantially as follows: "No
building or structure will be installed on either Lots 1 or 2
within 50 feet of Rand Road"; and any and all bonds for public
improvements be posted with the Village of Mount Prospect.
