A Special Meeting of the Village Board has been called for an Executive Session to review applications for Village Manager, to be held August 22, 1978 8:00 P.M. in the Trustees' Room XIV. ADJOURNMENT 6/2/78 ORDINANCE NO. AN ORDINANCE GRANTING A SPECIAL USE FOR PROPERTY LOCATED AT 101 SOUTH MAPLE STREET WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hold a Public Hearing on Case No. 29 -SU -78, on May 25, 1978, at the hour of 8: 00 p.m. , in the Public Safety Building, pursuant to proper legal notice; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect heard testimony presented under Case No. 29 -SU -78 pertaining to a request for certain special uses pursuant to the Mount Prospect Zoning Ordinance to permit certain uses upon the property hereinafter described; and WHEREAS, the Zoning Board of Appeals has recommended that the President and Board of Trustees of the Village of Mount Prospect allow the special use as pre- sented in Case No. 29 -SU -78; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have reviewed the matter herein and have determined that the same is in the best interests of the Village of Mount Prospect; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the special use authorized and granted in SECTION TWO hereinbelow is conditioned upon and shall be valid and effective only so long as: A. During the term of this special use, no buildings or accessory buildings shall be established and/or constructed on the subject property; and B. The said special use granted in SECTION TWO hereinbelow shall not run with the land, but shall be limited to that period of time wherein the subject property is utilized by the Mount Prospect State Bank for employee and tenant parking, which period of time shall not exceed five (5) years from the date hereof. SECTION TWO: That, pursuant to the Mount Prospect Zoning Ordinance and in accord with the terms and conditions of this Ordinance, the following special use is hereby authorized upon the subject property described in SECTION THREE hereinbelow: The operation of an off-street paved not -for -fee parking lot. SECTION THREE: That the special use authorized to be established in SECTION TWO hereinabove shall be valid and effective upon the following property (herein- above and hereinafter referred to as "subject property") legally described as: Lots one (1) and two (2) in Block Eleven (11), in Busse and Wille's Resubdivision in Mount Prospect in the West Half (1/2) of Section 12, Township 41 North, Range 11, East of the Third Principal Meridian in Cook County, Illinois; I which property has been zoned R-1 (Single Family Residential) District, and which zoning classification shall remain in full force and effect, subject to the special use granted under the terms and conditions of this Ordinance. SECTION FOUR: That the text of this Ordinance shall be recorded in the Office of the Recorder of Deeds or registered with the Registrar of Titles (as the case may be) of Cook County, Illinois. SECTION FIVE: That this Ordinance shall be null and void and of no force and effect whatsoever until after its passage, approval, and publication, and at such time as an accurate plat resubdividing the said parcel described in SECTION THREE hereinabove is registered with the Registrar of Titles of Cook County, Illinois; a copy of which plat of resubdivision shall be attached hereto and hereby made a part hereof. AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY COMMONLY KNOWN AS 101 SOUTH MAPLE STREET WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet on the 25th day of May, 1978, at the hour of 8: 00 p.m., at the Mount Prospect Public Safety Building and did hear Case No. 30-V-78, pursuant to proper legal notice; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hear a request for a variation from the regulations of the Zoning Ordinance regarding off-street parking; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recom- mend to the President and Board of Trustees of the Village of Mount Prospect the approval of these requests under Case No. 30-V-78; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have reviewed the matter herein and have determined that the same is in the best interests of the Village of Mount Prospect; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the property being the subject matter of Case 30-V-78, being legally described as follows: Lots 1 and 2 in Block 11, in Busse and Wille's Resubdivision in Mount Prospect in the West Half (1/2) of Section 12, Township 41 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois, is currently zoned under the Zoning Ordinance of the Village of Mount Prospect as R-1 (Single Family Residence) District, which zoning classification shall remain in effect subject to the variations granted herein: A. That the off-street parking spaces be reduced from 10' x 201 to 91 x 201 in size. B. That off-street parking may be allowed within the front, side, and rear yards of the subject property so long as said property is used pursuant to the special use granted under Ordinance No. SECTION TWO: That all requirements of the Mount Prospect Building and Zoning Code shall be applicable except the variation noted in SECTION ONE heretofore mentioned. SECTION THREE: That the Director of Building and Zoning of the Village of Mount Prospect is hereby authorized to issue a building permit for construction in accordance with the variation hereinbefore mentioned. SECTION FOUR: That the variations granted by this Ordinance shall be null and void and of no force and effect whatsoever unless an application for a building permit pursuant to such variation is made and construction commenced within one (1) year of the date this said Ordinance becomes effective. SECTION FIVE: That this Ordinance shall be null and void and of no force and effect whatsoever until after its passage, approval, and publication, and such time as an accurate plat resubdividing the said parcel described in SECTION ONE hereinabove is registered with the Registrar of Titles of Cook County, Illinois; a copy of which plat of resubdivision shall be attached hereto and hereby made a part hereof. Also Present: Village Attorney John Zimmermann; Commander Ed Nastek, Police Department; Mike Pekala and John Sauter, Engineer- ing Department Parking Restrictions for Lynn Court Cul -De -Sac: The Committee reviewed Mike Pekala's report on parking problems on the circular portion of this residential street due to the fact that occupants of a nearby apartment complex have been parking in front of the single family homes, causing property damage, incon- venience, severe traffic congestion and safety hazards for emergency vehicles. The Committee agreed, by a vote of 3-0, to approve Mr. Pekala's proposal for posting of "No Parking Anytime" signs on the circular portion of the Lynn Court cul-de-sac, pending notification to the residents in this area. The Committee Chairman spoke with Mr. Pekala just a few days ago and he stated that the neighbors supported these parking restrictions; therefore, the Committee will recommend to the Mayor and Board of Trustees that our Village Traffic Code be amended to include the abovementioned parking restrictions. 2 -Hour Parking Restrictions on Maple:, Henry to Thayer, and Henry Between Maple & Elm Streets: The Committee reviewed Mike Pekala's proposal to discourage commuter parking in the Maple, Henry and Thayer Streets area which was prompted by complaints of residents of the 100 block of North Maple Street. After much discussion, the Committee agreed to recommend to the Mayor and Board of Trustees that our Village Traffic Code be amended to include "2 -Hour Parking Restrictions 7 a.m. to 6 p.m. -Monday thru Saturday" on both sides of Maple from Henry to Thayer, and on both sides of Henry Street, between Maple and Elm Streets. Amendment to Village Traffic Code to Include 4 -Hour ParkinR Zones: Village Attorney John Aimmermann indicated that, with full Board approval, Section 18.1320 -subsection (b) Schedule XII of our Village Traffic Code, could be amended to delete the 30 -minute parking zones, and further amended to include our new 4 -hour parking zones. There- fore, the Committee agreed, by a vote of 3-0, to recommend to the Mayor and Board of Trustees that this action is essential for implementation of our new 4 -hour parking zones. Public Health & Safety Committee Meeting 7-24-78 Page 2. 4 -Hour Parking Restrictions on Lincoln, Between William & School Streets: Complaints from residents on Lincoln Street between William and School Streets concerning commuter parking prompted Mike Pekala to survey the area. Other alternatives were discussed to solve the parking problem. However, the Committee finally agreed, by a vote of 3-0, to recommend to the Mayor and Board of Trustees that our Village Traffic Code be amended to include the "4 -Hour Parking 7 a.m. to 6 p.m. Monday through Friday" on Lincoln Street between William and School Streets. 4 -Hour Parking Restrictions for Library Parking Lot and Senior Citizens Parking Lot: The Committee then reviewed the recommendation of the administration concerning 4 -hour parking restrictions for the Senior Citizens parking lot and the Library parking lot. Apparently the Library Board and the administration felt that some parking restrictions were necessary to discourage commuter parking. After fully discussing these matters, the Committee agreed, by a vote of 3-0, to recommend to the Mayor and Board of Trustees that our Village Traffic Code be amended to include the 4 -hour parking restrictions on the abovementioned lots. However, some arrangements will be made for Village and Library employees for all -day parking on regular working days. Status Report on Other Items in Committee: (a) Employee parking from a nearby office building has caused incon- venience and traffic congestion on the south side of Edward Street between Milburn and Lincoln Streets. The administration has suggested 2 -hour parking restrictions to resolve the problem. However, many residents from the area attended our meeting and they were fairly evenly divided on the parking restriction proposal. Therefore, the Committee agreed to delay any action on this matter pending investi- gation of alternative solutions to the parking problem which Mike Pekala is now presently exploring. (b) The Committee then reviewed several ordinances from other communities in regard to regulating the sale of drug paraphernalia and the decriminalization of small amounts of marijuana. Village Attorney John Zimmermann stated that he would work on the preparation of ordinances pertaining to these matters for the Committee to review at its next meeting scheduled for August 31. (c) Mr. Charles Kolls and his attorney Norman Kurtz spoke to the Committee regarding his request for licensing of his taxicab fleet, Eskay Transportation Col of Arlington Heights, to operate within our Village limits. However, because Mr. Birks, owner of the Prospect Cab Co. and holder of all taxicab licenses within the Village, was out of town at the time of our last meeting, the Committee agreed to continue the hearing on this matter until our next meeting scheduled for., August -31. -- - Norma J.
