WHEREAS, fires continue to plague our Village, State and Nation
placing a costly drain on the American economy; and
WHEREAS, the tragedy in human life loss of more than 8,000 of our
citizens annually coupled with the burned and disfigurement of an
additional 300,000 persons; and
WHEREAS, the annual property loss exceeds four billion dollars in
direct loss and an untold indirect loss; and
WHEREAS, it is hard to realize that responsible citizens permit this
to happen when most of these unwanted fires can be avoided; and
WHEREAS, all citizens can assist in reducing this waste simply by
acquiring the knowledge of those behaviors and risks that cause
unwanted fire and with daily application of this knowledge leading
to the reduction of this nation's fire loss.
NOW, THEREFORE, I, CAROLYN H. KRAUSE, Mayor of the Tillage of Mount
Prospect, do hereby proclaim and designate the week of October. 8 thru
15, 1978, as FIRE PREVENTION WEEK. r call upon our citizens, singly
and as a community to actively support fire prevention through civic
groups, schools, business and labor.
I urge the news media and other public information agencies to cooperate
in the Promotion of FIRE PREVENTION WEEK as a prelude to year round
fire prevention efforts.

AN ORDINANCE AUTHORIZING THE AMENDMENT OF THE
NORTHWEST SUBURBAN WATER SYSTEM AGREEMEN.1'
BE IT ORDANIED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE
OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: It is found and declared by the President and Board of Trustees
(the "Board") of the Village of Mount Prospect (the "Village") as follows:
A, The Village is a member of the Northwest Suburban Water System Venture
(the "Venture") which Venture was established and is governed by the
Northwest Suburban Water System Agreement (the " Agreement");
B. The Agreement provides .for a Board of Directors for the Venture which Board
consists of the Mayor, President or other elected official as designated from
time to time by the corporate authorities of each municipality which is a member
of the Venture (a "Municipality" or collectively the "Municipalities");
C. It is in the best interests of the Venture and of the Village that the Agreement
be amended to allow Alternate Directors from each Plunicipality to serve as
Directors in the absence of the Director from their respectivo Municil ' )ality in
the manner and upon the conditions provided in the Agreement of Amendment
presented to this meeting, and attached hereto and made ,.). part hereof (the
"Agreement of Amendment");
I1. Section 9 of the Agreement provides for amendment of the Agreement by a
written a.greement authorized by an ordinance of the corporate authorities of
each Municipalih1r; and
E. The Village desires to authorize the Agreement of Amendment.
SECTION TWO: That the Village hereby authorizes the execution on its behalf
of the Agreement of Amendment.
SECTION THREE: That this Ordinance shall be in full force and effect from and
after its passage, approval, and publication in the manner provided by law.

AN ORDINANCE AMENDING MAP 47-5 OF THE ZONING
ORDINANCE OF THE VILLAGE OF MOUNT PROSPECT
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did conduct
a public hearing under Case No. 42-Z-78 on the 27th day of July, 1978, on a request
for a zoning classification change from R -X (Single Family Residence) District to
B-3 (Business -Retail and Service) District of certain property hereinafter described;
and
WHEREAS, a notice of the aforesaid public hearing was made and published in the
manner provided by law; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect has recom-
mended to the President and Board of Trustees of the Village of Mount Prospect that
the petitioner's request under said Case No. 42-Z-78 be granted; and
WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount
Prospect has reviewed the matter herein and has recommended the approval thereof
to the President and Board of Trustees of the Village of Mount Prospect; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
have determined that the best interests of the Village of Mount Prospect will be
attained by the adoption of the following Ordinance regarding the subject property;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That Map 47-5 of the Zoning Ordinance of the Village of Mount
Prospect, as amended, be and the same is hereby further amended by reclassifying
from R -X (Single Family Residence) District to B-3 (Business -Retail and Service)
District the following described property:
Lot 2 of Northway Investment Subdivision of the North 480 feet of the
East 931 feet (as measured parallel to the North and East line thereof)
of the South East Quarter of the South East Quarter of Section 23,
Township 41 North, Range 11 East of the Third Principal Meridian
in Cook County, Illinois.
SECTION TWO: That Map 47-5 contained in SECTION ONE of Ordinance No. 2410,
passed and approved March 20, 1973, shall be deemed amended so as to conform
with the reclassification of the subject property herein contained in SECTION ONE
above.
SECTION THREE:
That this Ordinance shall be null and void and of no force and
effect whatsoever until after its passage, approval, and publication in the manner
provided by law.

AN ORDINANCE GRANTING A SPECIAL USE FOR
PROPERTY LOCATED AT 2 WEST RAND ROAD
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet
on the 27th day of July, 1978, at the hour of 8; 00 p.m., at the Public Safety Building
Boardroom and did hear Case No. 45 -SU -78, pursuant to proper legal notice; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hear
this request to permit a car rental operation in conjunction with a service station
located upon the property which is the subject matter of Case No. 45 -SU -78; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recom-
mend to the Building Committee of the Board of Trustees of the Village of Mount
Prospect the approval of this request under Case No. 45 -SU -78; and
WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount
Prospect did meet on August 16, 1.978, and did review the recommendations of the
Zoning Board of Appeals in Case No. 45 -SU -78; and
WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount
Prospect have recommended that the Board of Trustees of the Village of Mount
Prospect concur in the recommendations of the Zoning Board of Appeals under said
Case No. 45 -SU -78; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
have reviewed the matter herein and have determined that the same is in the best
interests of the Village of Mount Prospect;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the property being the subject matter of Case No. 45 -SU -78,
being legally described as follows:
Lot 1 in Rand -Elmhurst subdivision unit number 2, a subdivision of
part of the East 1/2 of the Southwest 1/4 of Section 27, Township 42
North, Range 11, east of the Third Principal Meridian in Cook County,
Illinois;
is currently zoned under the Zoning Ordinance of the Village of Mount Prospect
as B-4 (Business -Retail and Service District), which zoning classification shall
remain in full force and effect - provided that, pursuant to Article VII of the
Mount Prospect Zoning Ordinance, a special use permit is hereby granted to allow
an automobile rental operation in conjunction with a service station presently
existing upon the promises hereinabove described in accordance with the following
conditions:
(a) That no additional building or appurtenances shall be located upon the
premises as a result of this issuance of the special use permit contemplated
herein.
(b) That the special use permit herein authorized shall not run with the land,
but shall be limited to that period of time wherein the gasoline service
station located upon the subject property is operated and maintained as
Ed's Rent-A-Car, Inc. and in accordance with the terms and conditions
of this Section.
SECTION TWO. That the special use authorized to be established in SECTION ONE
hereinabove shall be valid and effective only upon the performance and continuous

maintenance thereof in accordance with all other laws and ordinances of the Village
of Mount Prospect and State of Illinois.
SECTION THREE: That the Village Clerk be and he is hereby authorized to record
at the petitioner's expense, a certified copy of this Ordinance with the Cook County
Recorder of Deeds and/or the Registrar of Titles of Cook County, Illinois, as the
case may be.
SECTION FOUR, That this Ordinance shall be in full force and effect from and after
its passage -,approval, and publication in the manner provided by law.

AN ORDINANCE GRANTING A VARIATION FOR PROPERTY
COMMONLY KNOWN AS 500-502 HILL STREET
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did conduct
a public hearing on the 10th day of August, 1978, at the hour Of 8: 00 p.m. , at the
Public Safety Boardroom, and did hear Case No. 48-V-78, pursuant to proper legal
notice; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hear
this request for a variation to allow the petitioner to construct a single family resi-
dence to within twenty feet (201) of the property line adjacent to Hill Street on the
lot legally described hereinbelow; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recom-
mend to the Building Committee of the Board of Trustees of the Village of Mount
Prospect the approval of this request under Case No. 48-V-78; and
WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount
Prospect did meet on August 16, 1978, and did review the recommendations of the
Zoning Board of Appeals in Case No. 48-V-78; and
WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount
Prospect have recommended that the Board of Trustees of the Village of Mount
Prospect concur in the recommendations of the Zoning Board of Appeals under said
Case No. 48-V-78; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
have reviewed the matter herein and have determined that the same is in the best
interests of the Village of Mount Prospect;
,NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the Zoning Ordinance of the Village of Mount Prospect be
varied with respect to the front yard requirement for land located in the R-1
(Single Family Residence) District; so that the single family residence to be
located adjacent to and north of the north line of the public right-of-way known
as Hill Street and adjacent to and west of the west line of the public right-of-way
known as Eastman Court may be set back only twenty feet (201) rather than the
required thirty feet (301) from the said north line of Hill Street and that area
which is legally described as:
Lot 1 and Lot 18 of the Hill Street Subdivision of the East 400.0 feet of that
part of the North 1/2 of the Southeast 1/4 of the Northeast 1/4 of Section
34, Township 42 North, Range 11 East of the Third Principal Meridian,
lying East of Rand Road, Cook County, Illinois.
SECTION TWO: That all requirements of the Mount Prnspect Building and Zoning
Code shall be applicable except the variation noted in SECTION ONE heretofore
mentioned.
SECTION THREE: That the Director of Building and Zoning of the Village of
Mount Prospect is hereby authorized to issue a building permit for construction in
accordance with the variation hereinbefore mentioned.
SECTION FOUR: That the variation granted by this Ordinance shall be null and
void and of no force and effect whatsoever unless an application for a building
permit pursuant to such variation is made and construction commenced within one
(1) year of the date this said Ordinance becomes effective.
SECTION FIVE: That this Ordinance shall be null and void and of no force and
effect whatsoever until after its passage, approval, and publication, and such
time as an accurate plat resubdividing the said parcel described in SECTION
ONE hereinabove is recorded with the Recorder of Deeds of Cook County Illinois;
a copy of which plat of resubdivision shall be attached hereto and hereby made a
part hereof.

AN ORDINANCE GRANTING A VARIATION FOR PROPERTY
COMMONLY KNOWN AS 21 SOUTH GEORGE STREET
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet
on the 24th day of August, 1978, at the hour of 8:00 p.m., at the Mount
Prospect Village Hall and did hear Case No. 49-V-78, pursuant to proper legal
notice; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hear
a request for a variation from the regulations of the Zoning Ordinance regarding the
erection of a two car detached garage; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did
recommend to the President and Board of Trustees of the Village of Mount Prospect
the approval of this request under Case No. 49-V-78; and
WHEREAS, the Building Committee of the Board of Trustees of the Village of
Mount Prospect have reviewed the recommendations of the Zoning Board of
Appeals and have recommended that the Board of Trustees of the Village of
Mount Prospect concur in the recommendations of the Zoning Board of Appeals;
and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
have reviewed the matter herein and have determined that the same is in the
best interests of the Village of Mount Prospect.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the property being the subject matter of Case No. 49-V-78,
being legally described as follows:
Lot 20 and Lot 21 in Block 2 in the Subdivision of part of Blocks 1, 3, 12, and
14 and all of Blocks 2 and 13 in Busse's Eastern Addition to Mount Prospect
in the East 1/2 of Section 12, Township 41 North, Range 11 East of the Third
Principal Meridian, a plat of which Subdivision was registered June 30,
1926, as Document Number 309555 ,
is currently zoned under the Zoning Ordinance of the Village of Mount Prospect
as R-1 (Single Family Residence) District, which zoning classification shall remain
in effect subject to the variations granted herein:
That in addition to the existing attached single car garage, the subject
property may be improved with a detached garage building of a size to
permit a maximum of two (2) automobiles to be located therein, pursuant
to the plan therefor, attached hereto and hereby made a part hereof as
Exhibit I.
SECTION TWO: That all requirements of the Mount Prospect Building and
Zoning Code shall be applicable except the variation noted in SECTION ONE
heretofore mentioned.
SECTION THREE: That the Director of Building and Zoning of the Village of
Mount Prospect is hereby authorized to issue a building permit for construction
in accordance with the variation hereinbefore mentioned.

AN ORDINANCE AMENDING ORDINANCE NO. 2569,
GRANTING VARIATIONS FOR PROPERTY GENERALLY
LOCATED ON THE NORTHEAST CORNER OF KENSINGTON
ROAD AND ELMHURST ROAD (ILLINOIS ROUTE 83)
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hold a
publichearing on August 24, 1978, at the hour of 8: 00 p.m., in the Mount Prospect
Village Hall pursuant to proper legal notice; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect heard
testimony presented under Case No. 51-V-78 pertaining to a request to erect a
savings and loan association on the south end of the property described herein-
after; and did recommend the amendment of the variation heretofore granted
under Ordinance No. 2569; and
WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount
Prospect did meet on September 13, 1978, and did consider the recommendations of
the Zoning Board of Appeals under Case No. 51-V-78; and
WHEREAS, the Building Committee have recommended that the President and Board
of Trustees of the Village of Mount Prospect concur in the recommendations of the
Zoning Board of Appeals to allow the variations as presented in Case No. 51-V-78;
and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have
reviewed the matter herein and have determined that the same is in the best interests
of the Village of Mount Prospect;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That subsections (a), (b), and (c) of SECTION ONE of Ordinance
No. 2569, passed and approved July 1, 1975, be amended in their entireties so as
to allow a change in use from an existing restaurant use to a savings and loan
(financial institution) use; so that hereafter the said subsections (a), (b), and (c)
of said SECTION ONE of Ordinance No. 2569 shall be and read as follows:
(a) That the owners of the land described above shall have the right
to construct a savings and loan association building at the south-
western corner of the Randhurst Shopping Center properties, and
that such building shall be free-standing -- being in no way
connected or joined to the existing main shopping center building
thereon;
(b) That the building design and layout shall be similar to those plans
attached hereto and hereby made a part hereof as Exhibit 1; and
(c) That the operation of the savings and loan association shall be clas-
sified as providing a retail service and shall be licensed as such
upon payment of the proper fees provided for such business within
Chapter 11 of the Municipal Code of the Village of Mount Prospect.
SECTION TWO: That all other requirements of the Municipal Code of the Village
of Mount Prospect shall be applicable, except those variations as specified in
SECTION ONE heretofore mentioned.
SECTION THREE: That the Director of Building and Zoning of the Village of
Mount Prospect is hereby directed to issue a building permit in accordance with the
variations hereinbefore mentioned.
SECTION FOUR: That the variantions granted by this Ordinance shall be null
and void and of no force and effect whatsoever unless an application for a building
permit pursuant to such variations is made and construction commenced within
One (1) year of the date said Ordinance becomes effective.
SECTION FIVE: That this Ordinance shall be in full force and effect from and
after its passage, approval, and publication in the manner provided by law,

A Resolution adopted in 1.965 Imposed certain restrictions on Village
employees in connection With information sought by the public or
press.
The free flow of information should be encouraged, to reduce in-
formation and public apathy, and, therefore, your Committee recommends
repeal of Resolution #13-65.
The Village Manager may adopt rules concerning the conduct of Village
employees, as he deems best, to ensure that government in its role
as custodian of information is accountable to those it serves.
Pending Lawsuits:
The Committee reviewed current status of pending suits, with the
excellent hell), interest and cooperation of Ed Geick.
For example, the Tei chert suit against the Village and sonic; Trustees
is still pending, without any action or investigation by plaintiffs,
or any efforts to compromise.
The Lincoln Green suit, involving Mount Prospect, our neighbor
Arlington Heights, and the Metropolitan Development Corp_ pertains
to our efforts to stop an agreement to build low income housing
next door to Mount Prospect.
The Mount Prospect area is single family ZOTIed and we object to an
increase in traffic and potential flooding problems of land not
zoned for the proposed development.
The results are uncertain and we should monitor this litigation, to
keep legal expenses in line, and to settle on a reasonable basis,
if necessary.
In conclusion, our thanks again to Mr. Geick for his contribution
to making our Judiciary Committee meetings more productive, and
his efforts to develop a case management system,

Ordinance Regulating the Sale Of Drug Paraphernalia:
After several months of discussion and review of ordinances from other
communities regulating the sale and display of drug paraphernalia,
the Committee members requested Village Attorney Zimmermann to draft all
ordinance which he felt would be successful.. Upon reviewing the
resulting ordinance with Mr. Zimmermann and Commander Nastek, the
Committee members agreed, by a vote of 3-0, to recommend to the Mayor
and Board of Trustees that Chapter X1 of the Municipal Code be amended
to include this ordinance which is intended to protect the youth of
our community.
Parkin Restriction on South Pine between r o sj2.LSj._ A v c Ti u e,
Mike Pekala did a study in response to a complaint from a resident in
the 100 block of South Pine concerning problems created On Sunday morn-
ings due to parked cars blocking driveways while members of St. Mark's
C,burch attend services. After much discussion, the Committee agreed by
a vote of 3-0 to approve Mr. Pekala's recommendation that "No Parking
on Sundays Between 6:30 a.m. and 1:30 p.m." be instituted on the south
side of Pine Street from Evergreen to a point 320 ft. north of evergreen
Avenue. The Committee will. recommend to the Mayor and full Board of
Trustees that our Village Traffic Code be amended to juCJudc the above-
mentioned parking restrictions on South Pine Street,
Helena Avenue - One Way Street and Parking Restrictions:
The Committee reviewed Mike Pekala's report concerning a new street -
Helena Avenue - running north and south between Haven and Lincoln Street.
This is in an area that will be developed in the near future with single
family homes. However, at the present time the street is only .1-4 ft.
wide because the east side of the street is still in an unincorporated
area and not within the Village limits, Therefore, the Committee agreed,
by a vote of 3-0, to approve Mr. Pekala's recommendation thia.t Hcicna
Avenue be restricted to one way southbound traffic between Lincoln
and Haven and that "No Parking Anytime" restrictions he placed on both

sides of Helena Avenue from Lincoln Street to a point 300 ft. south of
Lincoln Street. The Committee will recommend to the Mayor & full Board
of Trustees that our Village Traffic Code be amended to include the
abovementioned traffic restrictions on Helena Avenue. Attached to this
report you will find a copy of Mr. Pekala's memo dated August 28
explaining in detail. the need for these Traffic Code amendments.
Haudic.2yped Parking Identification Cards:
Larry Eils informed the Committee that the Northwest Municipal Conference
Is sponsoring an areawide program to provide plastic handicapped parking
ID cards. Apparently, many people prefer not to apply for the special.
license plates; therefore, a card that can be carried or placed In the
window of a car could be more convenient in assisting these people where
parking spaces are provided for the handicapped, The Townships will
do all of the screening of applicants and issue the ID cards. The
Committee agreed, by a vote of 2-0, to recommend to the Mayor & Board of
Trustees that Mount Prospect participate In this program, thereby
requesting that our Village Attorney modify or amend Section 18.1.324 of
our Village Traffic Code to recognize and enforce the use of these
handicapped parking ED cards. ('Trustee Hendricks left the meeting early,

The Committee conducted a public hearing at the request of Mr. Charles
Kolls, The petitioner was requesting taxi licenses to operate is taxi-
cabs within the Village limits, Mr. Robert Birks, the holder of a.11
available licenses within the Village, was present also. After listening
to statements from both Mr. Kol Is and Mr. Birks, the Committee agreed to
delay any action, pending further Information and review on the matter.
However, the Committee requested Mr. Birl<s to provide the statistical
data, as required by ordinance.
Several representatives attended the meeting from the River Trails Park
District and the Mt. Prospect Park District, inquiring as to certain
provisions in our. Development Code relating to land or monetary contri-
butions from residential developers, The Naperville ordinance was
discussed also, The Committee Chairman explained that our Development
Code J.s presently being reviewed, and that we would inform them of any
major changes that might be of interest to them and their Di.stricts.
The Committee requested our Village Attorney to draft an ordinance
pc-rtaini.ng to the decriminalization of small amounts of marijuana for
.review by our Committee at the next regular meeting.

SUBJECT: Helena Avenue - One Qday Street and Parking Restrictions
Public improvements recently completed for a new subdivision, named
Lincoln Square, resulted in the construction of a half-width street.
The street, named Helena Ave., runs north and south between Lincoln
St. and Haven St. and forms the eastern boundary of the subdivision
(see attached map). Another subdivision located at the northeast
corner of the intersection of Helena Ave. and Haven St. will be
improved in the near future and annexed into the 'Tillage. The
improvements to this subdivision will result in the paving of the
remaining half of Helena Ave. from Haven St. to a point 300 feet
north. The street north of this point will remain unimproved on
the east half for a distance of 300 feet up to Lincoln Street. The
half-street width provides 14 feet of pavement and the full width
street will provide approximately 29 feet of pavement.
Under normal residential street operating conditions, a parked vehicle
will utilize approximately 7 feet of pavement and a moving vehicle
(including delivery trucks) will utilize 8 feet of pavement. In
addition, another 2.5 feet of pavement is required between two vehicles
passing each other or between one moving vehicle and a parked vehicle.
These clearance figures are for ideal situations and can be reduced
depending on prevailing speed, volume and parking conditions.
However, the width of the vehicles cannot be reduced and it is evident
that the half-Street portion of Helena Ave. will not be able to
safely carry two lanes of traffic, moving or parked,at any one time.
Therefore, based upon the analysis presented above, it is my recommendation
that Helena Ave. be restricted to one-way traffic operation southbound
between Lincoln St. and Haven St. Furthermore, it is recommended that
"No Parking AnyTime" restrictions be placed on both sides of Helena Ave.
from Lincoln St. to a point 300 feet south of Lincoln St.
It is anticipated that these restrictions will result in a safe
operating condition for this street with very little inconvenience to
the local residents.

AN ORDINANCE AMENDING CHAPTER 11 OF THE MUNICIPAL
CODE OF THE VILLAGE OF MOUNT PROSPECT, ILLINOIS
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have
determined and hereby find that a problem exists within its territorial limits involv-
ing the exposure of children of Elementary, Junior High School and High School age
to the use of drugs and controlled substances other than as authorized by law; and
WHEREAS, it is a well-known and documented fact that drug use and abuse by
minors constitutes a very real and dangerous health hazard to the youth of America;
and
WHEREAS, the said President and Board of Trustees of the Village of Mount Prospect
have determined and hereby find that the display and availability for sale of certain
instruments hereinafter enumerated contributes to the usage of drugs and controlled
substances by the youth of the community by creating an atmosphere of apparent
condonation by the business community;
WHEREAS, it is a matter of public policy to regulate and control the public exhibi-
tion, display and sale of any and all items which are known and generally accepted
to be used to facilitate the consumption or ingestion of controlled substances or
cannabis in order to protect the health and welfare of our youths; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
desire to take all steps necessary to aid in the fight against drug use and abuse by
minors;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That Article 28 of Chapter 11 of the Municipal Code of the Village
of Mount Prospect of 1957, as amended, be and the same is hereby further amended
by substituting an entirely new Section for the existing Section 11.2826 and moving
the current text contained within the existing Section 11.2826 to Section 11.2827 --
thereby, in effect, creating a new Section regulating and prohibiting possession,
display or sale of instruments used for inhaling or ingesting certain controlled sub-
stances; so that hereafter the said Sections 11.2826 and 11.2827 shall be and read
as follows:
ff SECTION 11. 2826. Control of Controlled Substances and Instruments
Used for Inhaling or Ingestion of Controlled Substances.
A. It shall be unlawful for any person, firm or corporation to have,
possess, sell, offer to sell, dispense or give away any pipe, device
or contrivance adapted for the use of smoking or inhaling any
controlled substance, which said pipe, device or contrivance is
herein defined as an instrument; provided, however, that such
pipe, device or contrivance defined herein as an instrument has
been used for the purpose of smoking or inhaling or ingesting a
controlled substance.
B. It shall be unlawful for any person, firm or corporation to sell or
display any instrument as defined in this Chapter in or upon any
premises which: (1) is a premises open to minors; or (2) is in
close proximity to any public or private school, day care center,
nursery, church, synagogue or other place of worship, park,
or any facility holding a liquor license; unless such premise is
a place of display.
C. Definitions. Unless the context otherwise requires, the following
terms sed in this Chapter shall be construed according to the
definitions given below.
Close Proximity - As used in this Section, close proximity means
within 1,500 feet on a straight line commencing atithe property
lines nearest to each other.
Controlled Substance - As used in this Section, controlled sub-
stance means any drug or controlled substance asil defined
under any law of the State of Illinois or of the United States of
America.
Instrument - As used in this Section, instrument means a device used,
designed for use, or intended for use in ingesting, smoking,
administering or preparing cannabis, cocaine, phencycledine,
opium, or any derivative thereof, or any other, controlled
substance, and includes the following:
1. Metal, wooden, acrylic, glass, stone, plastic', or
ceramic marijuana (Cannabis Sativa) or hashish
pipes with or without screens, permanent screens,
hashish heads, or punctured metal bowls.
2. Water pipes designed for use or intended for use with
marijuana (Cannabis Sativa) hashish, hashish oil,
or cocaine.
3. Carburetion tubes and devices.
4. Smoking and carburetion masks.
5. Roach clips.
6. Separation gins designed for use or intended for use
in cleaning marijuana.
7. Cocaine spoons and vials.
8. Chamber pipes.
9. Carburetor pipes.
10. Electric pipes.
11. Air driven pipes.
12. Chilams.
13. Bongs.
14. Ice pipes or chillers.
Minor - As used in this Section, the term minor shall mean any
I person who has not attained 18 years of age.
Place of Dis a - As used in this Section, place of display means
any museum, library, school or other similar public place
upon which business is not transacted for a profit.
Premises Open to Minors - As used in this Section, premises open
to minors means any business establishment which sells its
wares or merchandise to minors or which permits minors to
enter into its place of business.
School - As used in this Section, school means any public or private
Elementary, Junior High, or High School.
D. Penalty.
1. A violation of this Section is hereby declared to be a public
nuisance and shall be subject to abatement as provided by law.
2. Any person, firm or corporation that shall violate any of the
terms of this Ordinance shall be fined not less than Fifty
Dollars ($50) nor more than Five Hundred Dollars ($500) .
In cases of illegal display, each day that a violation exists
shall be deemed a separate offense.
SECTION 11.2827. Revocation of License. All licenses issued under
this Article may be revoked by the Village Manager, or an application for
issuance or renewal of such license may be refused by the Village Clerk,
in the manner provided for such proceedings in Chapter 10 of this Municipal
Code. It
SECTION TWO: That this Ordinance shall be in full force and effect from and after
its passage, approval and publication in the manner provided by law.

SECTION FOUR: That Subsection B of Section 18.1320 of Chapter 18 (Traffic
Code) of the Municipal Code of the Village of Mount Prospect of 1957, as amended,
be and the same is hereby further amended by deleting reference to thirty minute
parking and substituting therefor reference to four hour parking; so that here-
after the said Subsection B of Section 18.1320 of Chapter 18 shall be and read as
follows:
it B . Four Hour Parkin . Parking of automobiles and other vehicles
is limited to four (4) hours on any day except Saturdays,
Sundays and legal holidays between the hours of 7: 00 o'clock
a.m. and 6: 00 o'clock p.m. on the streets or portions thereof
included in Schedule XII of the Appendix to this Chapter.
SECTION FIVE: That Schedule XII of Article XX of Chapter 18 (Traffic Code)
of the Municipal Code of the Village of Mount Prospect of 1957, as amended, be
and the same is hereby further amended in order to delete thirty minute parking
zones, and further amended to add four hour parking zones; to include in said
four hour parking zone the north side of Lincoln Street, the William and School
Streets except the first 81 feet east of School Street, the Library Parking Lot, and
the Senior Citizens Parking Lot; so that hereafter the said Schedule XII of Article
XX of the Traffic Code shall be and read as follows:
11 SCHEDULE XII. Four Hour Parking
In accordance with Section 18.1320 B, and when signs are erected giving
notice thereof, no person shall park a vehicle for more than four (4) hours
on any day, except Saturdays, Sundays and legal holidays, between the
hours of 7: 00 a.m. and 6: 00 p.m. within the district or upon any of the
streets or parts of streets as follows:

AN ORDINANCE AMENDING THE
MOUNT PROSPECT PLUMBING CODE
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE
OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That Subparagraph (b) of Paragraph 2 of Subsection B of Section
21.105 of the Municipal Code of the Village of Mount Prospect of 1957, as amended,
be and the same is hereby further amended by adding thereto an additional Sub -
subparagraph to delete and prohibit the use of plastic pipe in underground build-
ing drains as the use thereof is currently permitted in the B.O.C.A. Basic Plumbing
Code; so that hereafter the said Sub -subparagraph, Sub -subparagraph 2), shall be
and read as follows:
2) In Section P-405.2.2, delete the words 'or Schedule 40 plastic pipe.
The administrative authority may permit the use of the other approved

COMMUNICATIONS AND PETITIONS - CITIZENS TO BE HEARD
Hal Predovich, Chairman of the Business District Development
and Redevelopment Commission,presented the annual report of
that Commission. Mr. Predovich noted that downtown parking
was one of the main concerns of that Commission as well as the
Ad-Hoc Commission. It was also noted that a new draft of
the Zor-ling Ordinance had. been prepared and, is presently
before the Zoning Board of Appeals for consideration.
M_r. Dan Dokupil, representing residents of a six block area.
bounded by Lincoln to the Magnus T+'arm southern boundaries,
Meier to Douglas, requested consideration for that area to
be annexed to the Village. Mayor. Krause authorized the
Acting Village Manager and Village Attorney to meet with
Mr. Dokupil for further discussion.
Lennart Lorensen, 11.8 Wimboiton, spoke on behalf of' the home-
owners association of the Oid Orchard Counti"y Club relative
to tile Village having tile right of first refusal on a narrow
piece of property abutting the townhouses in that subdivision.
The residents would like to purchase it with the intentions
of having It as open space. Mayor Krause directed the
Village attorney to draft an agreement between the Village
and that Homeowners Association regarding the use and.
maintenance of that parcel.
MANAGER'S REPORT
Acting Village Manager Geick requested direction relative
to the subject of' circuses within fire limits. This subject
was referred to tile Public Health & Safety Committee.

Committee.

to authorize the Mayor to sign a letter submitted by IDOT
relative to concurring with the recommendation to install
