ORDINANCE NO.
AN ORDINANCE AMENDING THE NOTICE
PROVISION OF THE ZONING ORDINANCE
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That Subsection B of Section 14.603 of the Municipal Code of the
Village of Mount Prospect of 1957, as amended, be and the same is hereby further
amended by adding thereto two (2) additional paragraphs, Paragraphs 3 and 4,
containing the requirement that the Zoning Administrator cause a sign to be posted
upon the property which is the subject of a petition for a variation from the terms
of the Zoning Ordinance; so that hereafter said Paragraphs 3 and 4 of Subsection
B of Section 14.603 shall be and read as follows:
ff 3. The Zoning Administrator shall also cause one or more signs to
be posted on the property which is the subject of any variation
request:
a. The number and location of each sign shall be determined by
the said Zoning Administrator.
b . The sign must be a minimum of 32" x 4811 in size, having
letters a minimum of 3/8" wide by 2-1/2" high, and contain
the following information:
1) The Village of Mount Prospect case number;
2) The fact that a public hearing will be held to affect the
subject property, with direction to interested members
of the general public to call the office of the Zoning
Administrator for further information concerning date,
time, and place and subject matter of the said public
hearing; and
3) The Village office address and telephone number of the
Zoning Administrator and the Village Clerk.
4. Within ten (10) days after the official action of the Village has taken
place relative to the proposed variation, the applicant shall remove
the sign or signs from the subject property and return same to the
office of the Zoning Administrator. 17
SECTION TWO: That Subsection B of Section 14-703 of the Municipal Code of the
Village of Mount Prospect of 1957, as amended, be and the same is hereby further
amended by adding thereto two (2) additional paragraphs, Paragraphs 3 and 4,

upon the property which is the subject of a petition for an amendment to the Zoning
Ordinance; so that hereafter said Paragraphs 3 and 4 of Subsection B of Section
14-704 shall be and read as follows:
17 3. Within the time specified hereinabove, the Zoning Administrator
shall also cause one or more signs to be posted on the property
which is the subject of any such amendment.
a. The number and location of each sign shall be determined by
the said Zoning Administrator.
b. The sign must be a minimum of 3211 x 48" in size, having
letters a minimum of 3/8" wide by 2-1/2" high, and contain
the following information:
2) The fact that a public hearing will be held to affect the
subject property, with direction to interested members
of the general public to call the office of the Zoning
Administrator for further information concerning date,
time, and place and subject matter of the said public
hearing; and
3) The Village office address and telephone number of th,;

SECTION FOUR: That Paragraph I of Subsection A of Section 14.2506 of the
Municipal Code of the Village of Mount Prospect of 1957, as amended, be and the
same is hereby further amended in its entirety by adding certain notice provisions
therein; so that hereafter the said Paragraph 1 shall be and read as follows:
if 1. Said amendatory ordinance may be adopted only after a public
hearing by and recommendation of the Zoning Board of Appeals
in like manner as is required herein for the adoption of an
original Planned Unit Development ordinance.
a. The provisions of Subsection B of Section 14-703 regarding
the mailing of notice shall be adhered to and in addition
such notice shall also be mailed to all owners of record
within two hundred fifty (250) feet of the actual building
site or land location which is the subject of the amend-
ment being proposed.
b. The provision of Subsection B of Section 14.703 regarding
the posting of a sign shall be adhered to and additional
sign (s) shall be posted at the actual building site or land
which is the subject of the amendment being proposed. "
SECTION FIVE: That this Ordinance shall be in full force and effect from and after
its passage, approval and publication in the manner provided by law.

AN ORDINANCE GRANTING A SPECIAL USE FOR
PROPERTY LOCATED AT 1326 WEST CENTRAL ROAD
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hold a
Public Hearing on Case No. 36 -SU -78, on May 25, 1978, at the hour of 8: 00 p.m. ,
in the Public Safety Building, pursuant to proper legal notice; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect heard
testimony presented under Case No. 36 -SU -78 pertaining to a reqauest for certain
special uses pursuant to the Mount Prospect Zoning Ordinance to permit certain
uses upon the property hereinafter described; and
WHEREAS, the Zoning Board of Appeals has recommended that the President and
Board of Trustees of the Village of Mount Prospect allow the special use as presented
in Case No. 36 -SU -78; and
WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount
Prospect did meet on June 14, 1978, and did consider the recommendations of the
Zoning Board of Appeals under Case No. 36 -SU -78; and
WHEREAS, the Building Committee has recommended that the President and Board
of Trustees of the Village of Mount Prospect concur in the recommendations of the
Zoning Board of Appeals to allow the special use as presented in Case No. 36 -SU -78;
and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have
reviewed the matter herein and have determined that the same is in the best interests
of the Village of Mount Prospect;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the special use authorized and granted in SECTION TWO herein-
below is conditioned upon and shall be valid and effective only so long as:
A. During the term of this special use, no buildings, additions thereto, or
accessory buildings shall be constructed on the subject property; and
B . The said special use granted in SECTION TWO hereinbelow shall not run with
the land, but shall be limited to that period of time wherein the subject pro-
perty is utilized by the Arlington Club Beverage Company.
SECTION TWO: That, pursuant to the Mount Prospect Zoning Ordinance and in
accord with the terms and conditions of this Ordinance, the following special use
is hereby authorized upon the subject property described in SECTION THREE
hereffibelow:
The operation of a retail sales business in conjunction with an
existing bottling works, which sales may include the selling of
beer, wine and soft drinks in the unrefrigerated original package
only in addition to the other normal and usual sale of items manu-
factured on the premises.
SECTION THREE: That the special use authorized to be established in SECTION
TWO hereinabove shall be valid and effective upon the following property (herein-
above and hereinafter referred to as "subject property") legally described as:
West 38.76 feet of the South 200 feet that part North of the South 50 feet of
Lot H, and the East 61.74 feet of the South 200 feet that part North of South 50
feet of Lot G, all in Kirchoff's Sub. , a sub. of the N.E. 1/4 of the N.E. 1/4
of Sec. 10-41-11, the E. 1/2 of the N.W. 1/4 of the N.E. 1/4 of See. 10-41-11,
the N.W. 1/4 of the N.W. 1/4 of Sec. 11-41-11, the N. 10 chs. of the S.W.
1/4 of the N.W. 1/4 of Sec. 11-41-11, being a tract of land 10 chs. wide from
N. to S. and 20.17 chs. long from E. to W . , containing 20.17 acs. The
following in Sec. 33-42-11, the S. 1/2 of the S.W. 1/4, that part of the W.
1/2 of the N.W. 1/4 that lies S. of the C. & N.W.R.R., the N.W. 1/4 of the
S.W. 1/4, that part of the N.E. 1/4 of the S.W. 1/4 that lies S. of the C, &
N.W.R.R. and the W. 14-1/2 acs. of that part of the W. 1/2 of the S.E. 1/4
that lies S. of C. & N.W.R.R. Rec. May 22, 1917;
which property has been zoned I-1 (Light Industrial District), and which zoning,
classification shall remain in full force and effect, subject to the special use granted
under the terms and conditions of this Ordinance.
SECTION FOUR: That the text of this Ordinance shall be recorded in the Office of
the Recorder of Deeds or registered with the Registrar of Titles (as the case may be)
of Cook County, Illinois.
SECTION FIVE: That this Ordinance shall be null and void and of no force and effect
whatsoever until after its passage, approval, and publication, and at such time as
an accurate plat resubdividing the said parcel described in SECTION THREE herein-
above is recorded in the Office of the Recorder of Deeds or registered with the
Registrar of Titles (as the case may be) of Cook County, Illinois; a copy of which
plat of resubdivision shall be attached hereto and hereby made a part hereof.

Commission.
Insurance Program:
The Committee heard from Bill Radtke, the Village's insurance agent,
and from representatives of Governmental Interinsurance Exchange (GIE).
GIE presently Provides the Village's insurance coverage in the areas
of general liability, auto liability, and other coverage for public
officials. Basically, Mr. Radtke and Jim Bliss of GIE presented
arguments why Mount Prospect should continue its present insurance
program as opposed to entering into a protected self-insurance pool
with other municipalities, as has been recommended. The complexity
of the problem, the Committee agreed, points up the necessity for
hiring an insurance consultant to review the Village's insurance
program and to make recommendations on what course of action we should
follow (see next item).
Insurance Consultant:
The Committee reviewed the proposals submitted for a Village insurance
,study (see memo of 9/27/78 from Mr. Geick to the Mayor & Village Board
on this subject). The Committee, by a vote of 3-0, recommends the
hiring of the firm of Ebasco of Chicago to undertake a study of the
Village's property and liability insurance coverage for a cost not to
exceed $7,000. The study will be completed in 9-12 weeks. Ebasco,
incidentally, has served a number of other Chicago area communities,
including Glenview, Wheeling and Berkley,
The Committee also, by a vote of 3-0, recommends that the health and
medical insurance coverage be put out to bid for the year beginning
May 1, IP79. We have not bid the health and medical insurance for
a period of some 6 or 7 years. The Committee does not recommend an
insurance study on this portion of our coverage at this time.
Li. qu 2 r Ordinance:
In response to a request of the Finance Committee, the Village Attorney
prepared an ordinance that would serve to cancel a liquor license upon
transfer of ownership of a business. The Committee, by a 3-0 vote,
approved the ordinance that would amend Section 13.107 of the Municipal
Code,

BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE
OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That Section 13-106 of the Municipal Code of Mount Prospect of
1957, as amended, be and the same is further amended by adding to the said
Section 13.106 an additional paragraph to establish a new license classification
for a "packaged wine and beer" license; so that hereafter the said additional
paragraph in Section 13.106 shall be and read as follows:
It Class IP' license, which shall authorize the licensee to sell and
offer for sale at retail in the premises specified for such license,
wine and beer in the original and non -refrigerated package only.
1. Consumption of wine and/or beer (as well as samplings
thereof) upon the licensed premises is strictly prohibited.
2. The annual fee therefor shall be $850.
SECTION TWO: That Section 13.107 of the Municipal Code of Mount Prospect of
1957, as amended, be and the same is hereby further amended to provide for one
(1) Class "P11 liquor license and to reduce the number of Class 11RI, licenses by
one (1); so that hereafter the said Section 13.107 shall be and read as follows:
SECTION 13.107. Number of Licenses. There shall be issued in
the Village of Mount Prospect no more than:
(a) Six (6)
Class A Licenses
(b) Fifteen (15)
Class B Licenses
(c) Seven (7)
Class C Licenses

AN ORDINANCE AMENDING SECTION 13.107
OF THE MUNICIPAL CODE
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That Section 13.107 of the Municipal Code of the Village of Mount
Prospect of 1957, as amended, be and the same is hereby further amended in its
entirety in order to provide provisions for the automatic cancellation of liquor
licenses upon alienation or sale of the ownership of the business of the licensee;
so that hereafter the said Section 13.107 shall be and read as follows:

Circus & Carnival Tents:
Attached to this report you will. find a copy of Mr. Dutton's memo
dated August 24, 1978 explaining the necessity to amend our Building
Code to allow small carnivals, generally sponsored by local charitable
organizations. After much discussion on the matter, the Committee
agreed, by a vote of 2-0, to recommend to the Mayor and full Board of
Trustees that our Building Code be amended to include the following:
"Tents and air -supported structures shall not be located in the fire
limits. Exceptions: Tents may only be located in the fire limits if
they meet all of the following conditions:
(1) that they not be located within 30 ft. of any building or
lot line including tied down ropes or cables;
(2) that the side flaps be tied open on all sides when occupied;
(3) that they not be erected to exceed six (6) days;
(4) that they not exceed 20 ft. in height;
(S) that the user hire one or more off-duty firemen as determined
by the Fire Chief;
(6) that said firemen be equipped with two-way radio systems."
The Committee agreed to request that the Village Attorney draft the
proper ordinance to amend our Building Code to include the above-
mentioned changes. Also, because of the severe fire and safety hazards
associated with large circus tents, the Committee agreed to recommend
that "circuses" be deleted from our B-3 Zoning Ordinance and that this
amendment should go to the Zoning Board of Appeals for in-depty review
and reclassification.
Decriminalization of Small Amounts of Marijuana:
The Committee reviewed an ordinance drafted by Village Attorney Zimmermann.
However, no action was taken on the matter, pending comments- and input
from Police Chief Ralph Doney.

With the recent concern and publicity about the use of Park District property
for business purposes, by allowing the "Storm" baseball team to use Park District
facilities, I would like to get some direction from the Village Board on ^
somewhat related problem.
Before l came to Mount Prospect, the Building Department was permitting circuses,
carnivals, 0otoberfest and other similar uses in various zoning districts.
After I was here approximately two years` Chief Pairitz and I found that we
were having extreme difficulties with circuses and carnivals, but mostly with circuses.
Accordingly, we decided to invoke the DOCA Building Code to eliminate circuses if
they were proposed to be located in the fire limits. All nun -residential districts
are in the fire limits. The 80CA Code provision rends as follows:
"Section 422.3 Location: Tents and air supported structures shall be
located outside the fire limits."
Carnivals have not been too much of a problem` except in that they are set up so
fast that we have some difficulty making the required inspections prior to their
opening for business.
In a meeting with Mr. Eppley several years aDu` we decided that small tents used
in carnivals, which contained games with only one or two persons, did not violate
the intent of the code for hazardous conditions, in contrast to large circus tents
containing hundreds of people. Our decision was, to some degree, based on the fact
that most, if not all, carnivals are operated by and for local charitable organiza-
tions, and we did not want to cause them any hardship. In addition, the Village
Board was, in effect" condoning such uses by waiving fees.
The Octoberfest was treated differently because, although they use a large tent to
protect hundreds of people from the elements, we have insisted that, while in use,
all side flaps must be tied up in the open position, thus allowing the -people 180%
perimeter exiting capabilities. This is in contrast to a circus tent which has
extremely limited exit facilities, principally to keep people from attending without

It should also be pointed out that the Zoning Ordinance allows circuses as a
permitted use in a D-3 District. This represents a conflict with the Building
Code.
Recently we had a request to operate n circus at the Mount Prospect Plaza` within
the fire limits, and I have refused permission, based on the nhuvo. Mr. Jerry
Meese, the applicant, has said that he intends to challenge my rulings because of
what he feels are discrepancies in our prior approvals of other than circus uses
as explained above.
Because of the foregoing, I would like the Village Board to give me some direction
on what should be done. If the Village Board wishes to continue permitting local
charitable groups and other similar uses to have tents within the fire limits, I
would recommend that the Building Code be amended as follows:

WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have
determined and hereby find that a problem exists within its territorial limits involv-
ing the exposure of children of Elementary, Junior High School and High School age
to the use of drugs and controlled substances other than as authorized by law; and
WHEREAS, it is a well-known and documented fact that drug use and abuse by
minors constitutes a very real and dangerous health hazard to the youth of America;
end
WHEREAS, the said President and Board of Trustees of the Village of Mount Prospect
have determined and hereby find that the display and availability for sale of certain
instruments hereinafter enumerated contributes to the usage of drugs and controlled
substances by the youth of the community by creating an atmosphere of apparent
condonation by the business community;
WHEREAS, it is a matter of public policy to regulate and control the public exhibi-
tion, display and sale of any and all items which are known and generally accepted
to be used to facilitate the consumption or ingestion of controlled substances or
cannabis in order to protect the health and welfare of our youths; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
desire to take all steps necessary to aid in the fight against drug use and abuse by
minors;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That, pursuant to the authority vested in the President and Board
of -Trustees of the Village of Mount Prospect under Article V11 of the 1970 Constitu-
tion of the State of Illinois, Article XXV111 of Chapter 11 of the Municipal Code of
the Village of Mount Prospect of 1957, as amended, be and the same is hereby
further amended by substituting an entirely new Section for the existing Section
11. 2826 and moving the current text contained within the existing Section 11.2826
to Section 11.2827 --thereby, in effect, creating a new Section regulating and pro-
hibiting possession, display or sale of instruments used for inhaling or ingesting
certain controlled substances; so that hereafter the said Sections 11.2826 and
11.2827 shall be and read as follows:
A. It shall be unlawful for any person, firm or corporation to have,
Possess, sell, offer to sell, dispense or give away any pipe, device
or contrivance adapted for the use of smoking or inhaling any
controlled substance, which said pipe, device or contrivance is
herein defined as an instmiment; provided, however, that such
pipe, device or contrivance defined herein as an instrument has
been used for the purpose of smoking or inhaling or ingesting a
controlled substance.
B. It shall be unlawful for any person, firm or corporation to sell or
display any instrument as defined in this Chapter in or upon any
premises which: (1) is a premises open to minors; or (2) is in
close proximity to any public or private school, day care center,
nursery, church, synagogue or other place of worship, park,
or any facility holding a liquor license; unless such premise is
a place of display.
C. Definitions. Unless the context otherwise requires, the following
terms 7WTxsed in this Chapter shall be construed according to the
definitions given below.
Close Proximity - As used in this Section, close proximity means
within 1,500 feet on a straight line commencing at the property
lines nearest to each other.
Controlled Substance - As used in this Section, controlled sub-
stance means any drug or controlled substance as defined
under any law of the State of Illinois or of the United States of
America.
Instrument - As used in this Section, instrument means a device used,
designed for use, or intended for use in ingesting, smoking,
administering or preparing cannabis, cocaine, phencycledine,
opium, or any derivative thereof, or any other controlled
substance, and includes the following:
1. Metal, wooden, acrylic, glass, stone, plastic, or
ceramic marijuana (Cannabis Sativa) or hashish
pipes with or without screens, permanent screens,
hashish heads, or punctured metal bowls.
2. Water pipes designed for use or intended for use with
marijuana (Cannabis Sativa) hashish, hashish oil,
or cocaine.
3. Carburetion tubes and devices.
4. Smoking and carburetion masks.
5. Roach clips.
6. Separation gins designed for use or intended for use
in cleaning marijuana.
7. Cocaine spoons and vials.
8. Chamber pipes.
9. Carburetor pipes.
10. Electric pipes.
11. Air driven pipes.
12. Chilams.
13. Bongs.
14. Ice pipes or chillers.
Minor - As used in this Section, the term minor shall mean any
person who has not attained 18 years of age.

any museum, library, school or other similar public place
upon which business is not transacted for a profit.
Premises Offen to Minors - As used in this Section, premises open
to minors means any business establishment which sells its
wares or merchandise to minors or which permits minors to
enter into its place of business.
School - As used in this Section, school means any public or private
Elementary, Junior High, or High School.
1. A violation of this Section is hereby declared to be a public
nuisance and shall be subject to abatement as provided by law.
2 . Any person, firm or corporation that shall violate any of the
terms of this Ordinance shall be fined not less than Fifty
Dollars ($50) nor more than Five Hundred Dollars ($500).
In cases of illegal display, each day that a violation exists
shall be deemed a separate offense.
SECTION 11.2827. Revocation of License. All licenses issued under
this Article may be revoked by the Village Manager, or an application for
issuance or renewal of such license may be refused by the Village Clerk,
in the manner provided for such proceedings in Chapter 10 of this Municipal
Code. ti
SECTION TWO: That this Ordinance shall be in full force and effect from and after

SECTION ONE: That Schedule III of Article XX of Chapter 18 of the Municipal Code
of Mount Prospect of 1957, as amended, be and the same is hereby further amended
to prohibit northbound traffic on Melena Avenue between Haven and Lincoln Streets;
so that hereafter the said Schedule III shall contain in alphabetical order the
following:

SECTION TWO: That subsections A. and B. of Section 18.1324 of Chapter 18

and B. of Section 18.1324 shall be and read as follows:
A. Any motor vehicle having an identification card on display
in its windshield (which identification card declares the
possessor thereof to be a handicapped person and which
card has been issued by any of the townships of the State of
Illinois) or a motor vehicle bearing registration plates issued
to a physically handicapped person pursuant to Section 3-61.6
or to a disabled veteran pursuant to Section 3-609 of "The
Illinois Vehicle Code", effective July 1, 1970, as amended,
is exempt from any statute of the State of Illinois or any
ordinance of the Village of Mount Prospect imposing time --
limitations
limitations on parking in a business district; but otherwise
is subject to the laws which prohibit parking in "no stopping"
and "no standing" zones in front of or near fire hydrants,
driveways, public building entrances and exits, bus stops
and loading areas, and is prohibited from parkinf.), where the

must be moved at the instruction and request of the Depart-

supported structures to be utilized under certain conditions; so that hereafter the
said subparagraph c. shall be and read as follows:
it c. That Article IV be amended to make the following changes:
1) Amend Section 431.2.8 so as to require oversized elevator
cabs in all buildings containing elevators.
2) Amend Section 422.3 so as to allow tents and air supported
structures on a temporary basis within the fire limits pro-
vided the following conditions are met:
a) That the tent or air supported structure, including
appurtenances such as tie -down ropes, stakes, and/or
cables, not be located within thirty (30) feet of any
building or lot line.
(1) That the tents, air supported structures, and
appurtenances thereof so erected shall be re-
moved within six (6) days.
(2) That the overall height of such tents, air supported
structures, and appurtenances thereof shall
not exceed twenty (20) feet.
(3) That whenever members of the general public
are present or are allowed in such tents and/or
air supported structures, the operator thereof
shall have made arrangements with the Fire
Chief as specified in this Municipal Code for
at least one (1) fire guard to be on duty.
b) With respect to tents, whenever any person is located
within same, the side flaps shall be tied open on all
sides; however, in the event of inclement weather,
the side flaps may be lowered. it

COMMUNICATIONS AND PETITIONS - CITIZENS TO BE HEARD
Nancy Bartlett, a resident of the Bralen Townhouses in
Huntington Commons, gave a presentation relative to the
dev6lopment underway of the 'Knights of Huntington'.
One of the buildings in the 10 building development has
had the foundation poured and is within 5 feet of the
private swimming pool of the Bralen Townhouse owners.
Mrs. Bartlett requested the Village Board to look into
the possibility of having the construction stopped.
Mayor Krause stated the administration would investigate
the matter as to whether the case was handled in the
manner provided by the Zoning Ordinance and the matter
would be reported out at the October 3rd meeting of the
Village Bcard.
A representative of Community Presbyterian Church,
Main & Gregory, requested the Board waive permit fees for
construction at that site, except for out-of-pocket
expenses.

to waive the permit fees except for out-of-pocket expenses
for the Ccmmunity Presbyterian Church.

MAYOR'S REPORT
Mayor Krause proclaimed the week of October 8 - 15, 19785 --as Fire
Prevention Week in Mount Prospect.
It was also proclaimed by Mayor Krause that the week of
October 1 - 7, 1978, would be recognized by Mount Prospect as
Respect For Life Week.
Mayor Krause presented the recommendations submitted by the
Library Advisory Commission (attached to these minutes) rioting

several of the suggestions had been acted on by the Village
and Library Board. Mayor Krause noted that the item
referring to a referendum would be something to be determined
by the Library Board. Following discussion, Mayor Krause
expressed appreciation to the Library Advisory Commission

Prospect Meadows Water Company, subject to the approval
by the residents.
