ADJOURNMENT (Exhibit B) (Exhibit C) P R 0 C L A M A T 1 0 N i I WHEREAS, respiratory disease and other hazards to the human lungs present a major health problem in Mount Prospect; and WHEREAS, respiratory disease such as emphysema, chronic bronchitis and asthma today also constitute a serious threat to the health and welfare of this community and the nation as a whole; and WHEREAS, air pollution continues to be a serious problem in the Chicago area and physicians suspect that air pollution may be linked to the rising number of deaths from lung disease; and WHEREAS, smoking is injurious to the lungs and the heart; NOW, THEREFORE, 1, Carolyn H. Krause, Mayor of the Village of Mount Prospect do urge every citizen to contribute generously to the Christmas Seal campaign being conducted by the Chicago Lung Association, and do proclaim the week of December 3 - 10, 1978 to be CHRISTMAS SEAL WEEK in this community. Christmas Seal dollars will be used the year -around to support and expand Chicago Lung Association's programs of public and professional education, encouraging research in lung disease, as well as combatting air pollution and smoking. AN ORDINANCE AMENDING THE NOTICE PROVISIONS OF THE ZONING ORDINANCE NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES", OF THE VILLAGE OF MOUNT PROSPECT, COOT{ COUNTY, ILLINOIS: SECTION ONE: That Subsection B of Section 14.603 of the Municipal Code of the Village of Mount Prospect of 1957, as amended, be and the same is hereby further amended by adding thereto two (2) additional paragraphs, Paragraphs 3 and 4, containing the requirement that the Zoning Administrator cause a sign to be posted upon the property which is the subject of a petition for a variation from the terms of the Zoning Ordinance; so that hereafter said Paragraphs 3 and 4 of Subsection B of Section 14.603 shall be and read as follows: " 3. The Zoning Administrator shall also cause one or more signs to be posted on the property which is the subject of any variation request: a. The number and location of each sign shall be determined by the said Zoning Administrator. a b. The sign must be a minimum of 32" x 48" in size, having letters a minimum of 3/8" wide by 2-1/2" high, and contain the following information: 1) The Village of Mount Prospect case number; 2) The fact that a public hearing will be held to affect the subject property, with direction to interested members of the general public to call the office of the Zoning Administrator for further information concerning date, time, and place and subject matter of the said public hearing; and 3) The Village office address and telephone number of the Zoning Administrator and the Village Clerk. 4. Within ten (10) days after the official action of the Village has taken` place relative to the proposed variation, the applicant shall remove the sign or signs from the subject property and return same to the office of the Zoning Administrator. it SECTION TWO: That Subsection B of Section 14-703 of the Municipal Code of the Village of Mount Prospect of 1957, as amended, be and the same is hereby further amended by adding thereto two (2) additional paragraphs, Paragraphs 3 and 4, containing the requirement that the Zoning Administrator cause a sign to be posted upon the property which is the subject of any special use permit; so that here- after said Paragraphs 3 and 4 of Subsection B of Section 14-703 shall be and read as follows: It 3. The sign must be a minimum of 32" x 4811 in size, having letters a minimum of 3/811 wide by 2-1/211 high, and contain the following information: 1) The Village of Mount Prospect case number; 2) The fact that a public hearing will be held to affect the subject property, with direction to interested members of the general public to call the office of the Zoning Administrator for further information concerning date, time, and place and subject matter of the said public hearing; and 3) The Village office address and telephone number of the Zoning Administrator and the Village Clerk. 4. Within ten (10) days after the official action of the; Village has taken place relative to the proposed special use permit, the applicant shall remove the sign or signs from the subject property and return same to the office of the Zoning Administrator. 11 SECTION THREE: That Subsection B of Section 14-804 of the Municipal Code of the Village of Mount Prospect of 1957, as amended, be and the same is hereby further amended by adding thereto two (2) additional paragraphs, Paragraphs 3 and 4, containing the requirement that the Zoning Administrator cause a sign to be posted upon the property which is the subject of a petition for an amendment to the Zoning Ordinance; so that hereafter said Paragraphs 3 and 4 of Subsection B of Section 14-704 shall be and read as follows: 3. Within the time specified hereinabove, the Zoning Administrator shall also cause one or more signs to be posted on the property which is the subject of any such amendment. a. The number and location of each sign shall be determined by the said Zoning Administrator. b. The sign must be a minimum of 3211 x 4811 in size, having letters a minimum of 3/8" wide by 2-1/211 high, and contain the following information: 1) The Village of Mount Prospect case number; 2) The fact that a public hearing will be held to affect the subject property, with direction to interested members of the general public to call the office of the Zoning Administrator for further information concerning date, time, and place and subject matter of the said public hearing; and 3) The Village office address and telephone number of the Zoning Administrator and the Village Clerk. 4. Within ten (10) days after the official action of thej Village has taken place relative to the proposed zoning amendment, the applicant shall remove the sign or signs from the subject property and -2- return same to the off cc of the Zoning Administrator. SECTION FOUR: That Paragraph 1 of Subsection A of Section 14.2506 of the Municipal Code of the Village of Mount Prospect of 1957, as amended, be and the same is hereby further amended in its entirety by adding certain notice provisions therein; so that hereafter the said Paragraph 1 shall be and read as follows: 1. Said amendatory ordinance may be adopted only after a public hearing by and recommendation of the Zoning Board of Appeals in like manner as is required herein for the adoption of an original Planned Unit Development ordinance. a. The provisions of Subsection B of Section 14-703 regarding the mailing of notice shall be adhered to and in addition such notice shall also be mailed to all owners of record within two hundred fifty (250) feet of the actual building site or land location which is the subject of the amend- ment being proposed. b. The provision of Subsection B of Section 14.703 regarding the posting of a sign shall be adhered to and additional sign (s) shall be posted at the actual building site or land which is the subject of the amendment being proposed. 11 SECTION FIVE: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided by law. AN ORDINANCE AMENDING CHAPTER 13 OF THE MUNICIPAL CODE BE IT ORDAINED BYTHE PRESII-��[--NT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK C6bNTY, ILLINOIS: SECTION ONE: That Subsection A of Section 13.107 of Chapter 13 of the Municipal Code of Mount Prospect of 1957, as amended, be and the same is hereby further amended by increasing the number of Class 'IV" Liquor Licenses by one (1); so that hereafter the said Subsection A shall be and read as follows: it SECTION 13.107. Number of Licenses. A. AN ORDINANCE�L CR'M'NAL'ZING THE USE OF SMALL AMOUNTS OF MARIJUANA NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That pursuant to the authority vested in the President and Board of Trustees of the Village of Mount Prospect under Article VII of the 1970 Constitution of the State of Illinois, Section 25.305 of Chapter 25 of the Municipal Code of the Village of Mount Prospect of 1957, as amended, be and the same is hereby amended in its entirety by substituting a new Section for the existing Section 25.305, which new Section shall regulate and prohibit possession and distribution of marijuana; so that hereafter the said Section 25.305 shall be and read as follows: it SECTION 25.305. Reg-ulation of Small Quantities of Mari uana. A.- While it is unlawful for anyperson to grow, possess, sell, give away, barter, deliver, exchange, distribute, or administer any marijuana by reason of the Statutes of the State of Illinois, it shall be deemed a violation of this Section for any person, firm, or corporation to grow, possess, sell, give away, barter, deliver, exchange, distribute, or administer up to ten (10) grams of marijuana. B. Any person who violates this Section with respect to not more than ten (10) grams of marijuana shall be fined not less than Fifty Dollars ($50) nor more than Five Hundred Dollars ($500). 11 SECTION TWO: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided by law.
