Mayor Krause brought the proposed. Consent Decree relative
to Case No. 69 L 2377 to the attention of the Board.
Village Attorney Zimmermann noted that the amounts for
public improvements would be inserted following review
hy the Engineering Department. The Village Engineer.,
Ben Hemmeter, had issued a memorandum stating that the
park area should have sidewalks surrounding it, and that
three fire hydrants should be provided within the park
area. It was noted that since the revised plans had
been submitted the day before the Village Board meeting,
Pg. 2 8/2/77
various departments had not had adequate time to give a
complete review of the plans.
Mayor Krause stated that she would favor notification
of the residents that action will be taken by the
Village Board before authorization to sign the Consent
Decree was granted. Trustee Floros expressed his
desire to allow the administration adequate time to
review the revised plans. Trustee Murauskis favored
the Mayor's and Trustee Floros position.
Trustee Minton noted that when this matter was in his
Committee, some time ago, discussion did take place on
the subject of sidewalks surrounding the park site, and
it was the desire of the Committee and area residents
that sidewalks would not be installed.
Following discussion with the representatives of the
developer,, it was the decision of the Mayor and Board
of Trustees to schedule this matter to be heard at the
next regular meeting August 16, 1977, following
notification to the residents within the general area
of Tamarack and Palm Drives.

Committee to grant the requested taxi -cab fare increase.
Upon roll call: Ayes: Floros Minton Murauskis
Wattenberg

of the Fire and Police Committee. on review of the

The matter of the overnight parking in the Boxwood area
was reported on by Trustee Minton. Following review of
th's matter
the I Committee recommended the Village
Ordinance prohibiting overnight parking be amended in
order to exclude that area. Village Attorney Zimmermann
to that it was his recommendation that instead of
amending the Traffic Code to reflect this use, authorization
could be given the Village Manager to direct the Chief of
Police not to enforce'the present ordinance in that
particular area (Boxwood Drive and Dogwood Lane between
Boxwood and Wheeling Road).
Trustee Minton, seconded by Trustee Wattenberg, moved to
authorize the Manager to direct the Police Chief not to
enforce the Ordinance in the area commonly known as
Boxwood Drive and Dogwood Lane between Boxwood and
Wheeling Road.
Discussion was directed as to whether Wheeling Road was
meant to be include'd on the no enforcement policy.
Trustee Wattenberg withdrew his second., and Trustee Minton
withdrew his motion noting that this matter would be
placed on the agenda for the next Board meet1 Ing
August 16th,
so that matter could be investigated further.
Mayor Krause introduced Commissioner Foster from the MSD
and requested her to make a few comments relative to a
status report on the problems being experienced by local
residents with damage to their homes.
Pg. 4 8/2/77
d
Commissioner Foster stated that the MSD had adopted the
policy that they were not responsible for damage to
homes. She thea reported that she had approached the
.States Attorney's Office in order to assist the homeowners
in the area., stating that that Office indicated to her
they would become involved with the problem if and when
the residents filed a law suit. Commissioner Foster
further reported that she had been in contact with the Staters
Department of Insurance noting that she had set up a meeting
between the State Insurance Department and Bituminous
Insurance Company, the carrier for the contractor, noting
that it was her hope that something would be accomplished
since so many claims have been turned down by that
insurance company. Commissioner Foster stated that she
would be available to assist anyone who needs help in this
matter.
PUBLIC WORKS COMMITTEE
Trustee Toros, in the absence of the Chairman of the
Public storks Committee, presented that report on the
meeting held July 20, 1977. Following discussion
relative to the proposed water rate increase, it was
recommended that a schedule be established of $1.30 per
thousand gallons with no minimum usage. This figure
would include the sewer charge which was previously
itemized on the water bill. Mr. Muldowney of
FFFletcher Engineering Company was present to answer
questions posed by the Board.
Ben Nadell, 454 Rand Road, asked who pays for the water
usedin fires and hydrant flushing.VillageManagerEppley
explained the residents are not charged for such use.
James Stevens, 301 W. Russell, proposed a flat rate charge
to equal the ,present rates might be considered. Mayor
Krause explained that the conservation program is
successful however, with the drop in usage homes the
drop in revenue.
Irene Stephens, 218 s. William, spoke to the Board
relative to -proposed water rates.
Charles Barbough, Forest Cove Apartments, complimented
the Board on their concern on the subject and action
contemplated to be taken by the Board in adopting the

COMMITTEE REPORT Phone 312 / 392-6000
Ta. Mayor & Board of Trustees
FROM*- Trustee T. J. Wattenberg, Chairman, Judiciary Committee
SUBJECT: Judiciary Committee Report 8-8-77
DATE: August 9, 1977
Present: Chairman Wattenberg; Trustee Floros.; Asst. Village
Manager Geick; Sal DiMucci, Sr.
DiMucci Deed Restrictions,, S.W. Cor. Rte. 83 & Golf Road:
Mt. DiMucci explained that part of lot 3 in the above subdivision
had been donated to the Village for its use as a fire station, with
certain restrictions so that any different use would be compatible
with the surrounding area. However., the Village conveyed the land
back to the donor,, presumably because it had no use for the lot.
However,, the restrictions remained in force, constituting a cloud
under title.
The Committee agreed to cancel the restrictions, namely, prohibiting
the land from in used as a depository for refuse, garage, repair
shop, storage of equipment, or water storage tank, or any elevated
tank.
Unless the administration has contrary views, we ask to sign the
release promptly, since this controversy has been pending for a
long time.
Brickman_Property:
The Committee again reviewed the previous discussion, also reported
by me June 17, 1.977 at that Judiciary Committee meeting.
This involves the 6 year old controversy with some of our neighbors
in which the Village had reached an agreement, unknown to the
adjacent homeowners, to allow ries an to build a 5 story building.
The homeowners adjacent to Camp McDonald & River Roads bitterly
protested the action of the Village, and the Appellate Court ruled
C>
in favor of the residents allowing their intervention in the suit.
The Court's ruling implied that the Consent Decree was invalid)
that the planned structure is a flagrant example of spot zoning,
since it abuts single family homes, and that the area is also a
part of the flood in.
Judiciary Committee Meeting 8-8-77 Page 2.
The Committee recommends that the Village assume legal expenses,
with a $700 limit, since the dismissal of the suit in November
when the residents won dismissal of the Brick ate. case and Brickman
appealed this dismissal. Reimbursement to be made by the admini,stra-
tion upon receipt of bills.
