Mayor & Board of Trustees FROM*- Trustee T. J. Wattenberg, Chairman, Judiciary Committee SUBJECT: Judiciary Committee Report 8-8-77 DATE: August 9, 1977 Present: Chairman Wattenberg; Trustee Floros.; Asst. Village Manager Geick; Sal DiMucci, Sr. DiMucci Deed Restrictions,, S.W. Cor. Rte. 83 & Golf Road: Mt. DiMucci explained that part of lot 3 in the above subdivision had been donated to the Village for its use as a fire station, with certain restrictions so that any different use would be compatible with the surrounding area. However., the Village conveyed the land back to the donor,, presumably because it had no use for the lot. However,, the restrictions remained in force, constituting a cloud under title. The Committee agreed to cancel the restrictions, namely, prohibiting the land from in used as a depository for refuse, garage, repair shop, storage of equipment, or water storage tank, or any elevated tank. Unless the administration has contrary views, we ask to sign the release promptly, since this controversy has been pending for a long time. Brickman_Property: The Committee again reviewed the previous discussion, also reported by me June 17, 1.977 at that Judiciary Committee meeting. This involves the 6 year old controversy with some of our neighbors in which the Village had reached an agreement, unknown to the adjacent homeowners, to allow ries an to build a 5 story building. The homeowners adjacent to Camp McDonald & River Roads bitterly protested the action of the Village, and the Appellate Court ruled C> in favor of the residents allowing their intervention in the suit. The Court's ruling implied that the Consent Decree was invalid) that the planned structure is a flagrant example of spot zoning, since it abuts single family homes, and that the area is also a part of the flood in. Judiciary Committee Meeting 8-8-77 Page 2. The Committee recommends that the Village assume legal expenses, with a $700 limit, since the dismissal of the suit in November when the residents won dismissal of the Brick ate. case and Brickman appealed this dismissal. Reimbursement to be made by the admini,stra- tion upon receipt of bills. Wattenberg Ctiairman
