AN ORDINANCE REZONING PROPERTY GENERALLY LOCATED NORTH OF RAND ROAD AND SOUTH OF CENTRAL ROAD FROM RX TO B-3 (MAP 10-S) WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hear Case 10-Z/SU-77 at 8 o'clock P -M - on April 28, 1977 and May 26, 1977; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recommend that the President and Board of Trustees of the Village of Mount Prospect rezone the subject property hereinafter described from RX to B-3 pur- suant to the petition in the said Case 10-Z/SU-77; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have reviewed the recommendation of the Zoning Board of Appeals in Case 10-Z/SU-77-, and WHEREAS, the said President and Board of Trustees of the Village of Mount Prospect believe the said rezoning is in the best interests of the Village of Mount Prospect; NOW,, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY. AN ORDINANCE GRANTING A SPECIAL USE FOR PROPERTY GENERALLY LOCATED NORTH OF RAND ROAD AND SOUTH OF. CENTRAL ROAD WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hold Public Hearings on Case No. 10-Z/SU-77, on April 28, 1977 and May 26, 1977, at the hour of 8: 00 P.M., in the Public Safety Building, pursuant to proper legal notice; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect heard testimony presented under Case 10-Z/SU-77 pertaining to a request for certain special uses pursuant to the Mount Prospect Zoning Ordinance to permit certain uses upon the property hereinafter described; and WHEREAS . the Building Committee of the Board of Trustees of the Village of Mount Prospect did meet on June 6, 1977, and did consider the recommendations of the Zoning Board of Appeals under Case No. 10-Z/SU-77; and I WHEREAS, the Building Committee have recommended that the President and Board of Trustees of the Village of Mount Prospect concur in the recommendations of the Zoning Board of Appeals to allow the special use as presented in Case No. 10-Z/SU-77; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have reviewed the matter herein and have determined that the same is in the best interests of the Village of Mount Prospect; NOW. Wattenberg SUBJECT: Judiciary Committee Meeting 6-13-77 DATE: June 17, 1977 Present: Chairman Wattenberg; Trustee M. Minton, as well as Village Attorney John Zimmermann as an observer. Also present were citizens Fletcher, Hagen, and Schierhorn. Brickman ProDert We discussed the 6 -year old controversy with our neighbors in which the Village has reached an agreement, unknown to the adjacent homeowners, with builder Brickman to build a 5 -story building. The homeowners adjacent to Camp McDonald and River Roads bitterly protested the action of the Village, and the Appellate Court ruled in: favor of the residents allowing their intervention in the suit. The court's ruling implied that the Consent Decree was invalid!, the planned structure is a flagrant example of spot zoning, since it abuts single family homes, and the area is also part of a Flood Plain. Because of this and other good and sufficient reasons, your Committee agreed to offer the following motions to reimburse these citizens for legal expenses, while they will continue to try to settle this controversy by active negotiations. Motion #1: The Village will assume legal expense, with a $700 limit, since the dismissal of the suit in November when the residents won dismissal of the Brickman case, and Brickman appealed this dismissal. Reimbursement to be made upon receipt of bills. Motion #2: The Village will reimburse defendant citizens for future reasonable and necessary legal expenses incoirred by them in this controversy. T. Present to the public the results of the rate study which was 're uested by the prior Board and begun in October., 197 - 2. A RESOLUTION RELATING TO PARTICIPATION BY PART-TIME ELECTED OFFICIALS IN THE ILLINOIS MUNICIPAL RETIREMENT FUND WHEREAS, the Village of Mount Prospect is covered under the Illinois Municipal Retirement Fund; and WHEREAS, the Mayor and Board of Trustees may participate in the Illinois Municipal Retirement Fund if they are in positions normally requiring performance of duty during 600 hours or more per year; and WHEREAS, this governing body can determine what the normal annual hourly requirements of its part-time elected officials are, and should make such determina- tion for the guidance and direction of the Board of Trustees of the Illinois Municipal Retirement Fund; NOW., THEREFORE , BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT , COOK COUNTY , ILLINOIS: SECTION ONE: That the Mayor and Board of Trustees finds that the positions of the following part-time elected officials normally require the performance of duty during 600 hours or more a year: Mayor (Village President), Village Clerk, and Village Trustees (six) . Following the presentation and discussion relative to land use and housing, Mayor Krause expressed the intent of the Beard of Trustees to continue to support HIPC financially. Richard Nogawski, 110 Bobby Lane, requested information regarding Mr. Muldowney's report relative to the water study being conducted. Mr. Eppley noted that he would be discussing that subject under 'Manager's Report.' later in the meeting. MANAGER'S REPORT Village Manager Eppley annouced that the water rate study undertaken by Mr. Muldowney would be delivered to the Board the next day (June lst), for discussion at the regular meeting of the Board June 21, 1977. Irene Steffen, 21$ S. William, addressed. the Board in regard to the minimum water usage rate inasmuch as some senior citizens do not use the minimum 10,000 gallons but are charged for the minimum. Mr. Eppley requested authorization of the Board to have the Well #14 property appraised and offered for sale with the proceeds to go into the water fund. Mr. Richard Nogawski, 110 Bobby Lane, requested guidance from the Board as to whether the sidewalk- in his area would be repaired by the Village'if it was determined that the construction was faulty due to builder error. Mayor Krause suggested Mr. Naga ski acquire a legal opinion from his attorney since that would be a legal matter not under the Village's jurisdiction. Mr. Eppley of that the "S" curve improvement would be commenced June 13, if the Resolution accepting the to bid from Milburn Bros, was passed. Village Engineer, Ben Hemmeter, stated that no plans have been made to install curbs at this time. Village Attorney Zimmermann gave a presentation to the Board relative to Federalism of the unemployment compensation program. The National Institute of Municipal Law Officers is instutiting a law suit challenging the constitutionality of the Unemployment Compensation Act of 1976 and Mr. Zimmermann, through his, presentat1on3 encouraged the Village of Mount Prospect to involve itself in this law suit and contribute $2,500 towards the costs of this suit. Trustee Wattenberg,,, seconded by Trustee Mintonmoved to authorize the Mayor and Village Attorney to sign the necessary documents involved with this pending litigation and authorize an expenditure of $23500 towards this litigation. 'Trustee Wattenberg announced that the Judiciary Committee would meet June 13th,.., as scheduled. Goodman Village Clerk Pg. 8 6/7/77 M*PMOTA I\TnTTTvT TO: All Department Heads FROM: Deputy Village Clerk RE: Special Village Board Meeting - June 28, 1977 DATE: June 29, 1977 Mayor Krause called the meeting to order at 8:06 P.M. with Trustees Minton and Wattenberg absent. Mr. Muldowney gave a brief verbal summary of the report submitted, which recommended a 22,000 minimum usage at a cost of $35.00 per quarter. Several citizens expressed their opinions, stating that they should only pay for the water used. The Board also expressed they desire to see the rate structure based on actual gallons used, with the suggestion of a 7,500 gallon minimum or perhaps no minimum at all. Mr. Muldowney was requested to work up a report to be considered at the next Board meeting, July 5th, when the Board hopes to implement the new water rates. The Board went into Executive Session at 10:15. Following that session, the Board passed a motion authorizing the Village Attorney to accept $30,000 cash in full settlement for the Village's claims against Mc Hugh Construction for damage done to Well #10.
