AN ORDINANCE AUTHORIZING A VARIATION FROM SECTION 21. 1011 OF THE MOUNT PROSPECT BUILDING CODE WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet on the 27th day of January, 1977 and the 24th day of February, 1977, at the hour of 8: 00 p.m., in the Public Safety Building, and did hear Case No. 1-V-77, pursuant to proper legal notice; and I I WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect, pursuant to authority vested in it under subsection E of Section 14.504 ofthe Municipal Code of Mount Prospect,, did hear this request to locate a central air condition in compressor in the front yard of the property commonly now as 100 South William Street, Mount Prospect, Illinois-, and WHEREAS, the Zoning Board of Appeals ofthe Village of Mount Prospect did recom- mend tote President and Board of Trustees of the Village of out Prospect the denial of this request under said Case No. I -V-77; and WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount Prospect did conduct a public hearing on June 6, 1977, and did recommend to the Board of Trustees of the Village of AITLount Prospect the granting of the requested varia- tion under said as No. I -V-77; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have reviewed the matter herein and have determined that the same is in the best interests of the Village of Mount Prospect; NOW 9 THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT. COOK COUNTY 9 ILLINOIS: SECTION ONE: That the property being the subject matter of Case No. 1-V-77, being legally described as follows: Lot 22 in Block 9 in Busse' s Eastern Addition to Mount Prospect in the East half (1/2) of Section 12, Town 41, Range 11, East of the Third Principal Meridian, is currently zoned under the Zoning Ordinance of the Village of Mount Prospect as R-1 (Single Family Residence) District, which zoning classification shall remain in effect subject to the variation granted herein. SECTIONThat all requirements of the Mount Prospect Building and Zoning Codes shall be applicable except that Section 21. 1011 of the Municipal Code of Mount Prospect of 1957, as amended (Building Code), shall not govern the place- ment of a central air conditioning compressor to serve the home located upon the subject property, and that the location of -said compressor shall be that as shown upon the plans attached hereto and hereby made a part hereof as Exhibit A. SECTION THREE: That the Director of Building and Zoning of the Village of Mount Prospect is hereby authorized to issue a building permit for construction in accordance with the variation hereinabove mentioned. SECTION FOUR: That the variation granted by this Ordinance shall be null and void and of no force and effect whatsoever unless an application for a building pe I rmit pursuant to such variation is made and construction commenced within one (1) year of the date this said Ordinance becomes effective. SECTION FIVE " : That this Ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided by law. ILLINOIS: SECTION ONE: That, pursuant to the power and authority given Home Rule Units in Article VII of the 1970 Constitution of the State of Illinois, Section 5.1701 and Section 5.1704 of Chapter 5 of the Municipal Code of Mount Prospect of 1957, as amended, be and the same is hereby further amended in its entirety; so that said Article XVIII of Chapter 5 shall hereafter be and read as follows: tr SECTION 5.1701. Creation and_�urpose. In that it is useful to the economic welfare of the Village of Mount Prospect, there is hereby created a citizens, Commission which shall be known as the Finance Commission of the Village of Mount Prospect for the purpose of advising and assisting the Village President and Board of Trustees in the maintenance of a sound tax structure and overall fiscal policy for the Village. SECTION 5.1704. Duties and. Responsibilities. In advising and assisting the Village President and Board of Trustees, the Finance Commission shall have the following powers , duties and obligations, the exercise of which shall be dedicated to the promotion of the public interest and financial stability of the Village of Mount Prospect. establish a standing sub -committee within such Commission consisting of not less than three members for the purpose of projecting the Village Budget on a hypothetical basis for one or more years beyond each current fiscal period. B To make findings and recommend ati on s regarding Village finances , from time,to time as it shall deem useful. C. To make findings and recommendations regarding such charges as the Village President or the Board of Trustees may make to the Commission from time to time. 41 D. AN ORDINANCE GRANTING A FRONT YARD VARIATION FOR PROPERTY LOCATED AT 1517 EAST LOWDEN LANE WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did conduct a public hearing on the 23rd day of June, 1977, at the hour of 8: 00 p.m., at the Public Safety Boardroom, and did hear Case No. 22-V-77 , pursuant to proper legal notice; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hear this request for a front yard variation to allow the petitioner to construct a shed to within eight feet (81) of the property line adjacent to Wolf Road on the lot legally described hereinbelow; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recommend to the Building Committee of the Board of Trustees of the Village of Mount Prospect the approval of this request under Case No. 22-V-77; and WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount Prospect did meet on July 13, 1977, and did review the recommendations of the Zoning Board of Appeals in Case No. 22-V-77; and WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount Prospect have recommended that the Board of Trustees of the Village of Mount Prospect concur in the recommendations of the Zoning Board of Appeals under said Case No. 22-V-77; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have reviewed the matter herein and have determined that the same is in the best interests of the Village of Mount Prospect; NOW 9 THEREFORE , BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY. AN ORDINANCE AMENDING SECTION 21. 1011 OF THE MOUNT PROSPECT BUILDING CODE BE IT ORDAINED, BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT . COOK COUNTY o ILLINOIS: SECTION ONE: That Subsection b of Section 21.1011 of Chapter 21 (the Building -Code) of the Municipal Code of Mount Prospect of 1957, as amended, be and the same is further amended in'its entirety so the said Subsection b of Section 21.1011 shall be and read as follows: "(b) If the above conditions cannot be satisfied at the back side of any house or if that location of the said unit would reduce the efficiency thereof, then such central air conditioning compressor unit shall be located on any other side of such house where the aforesaid conditions are satisfied." AN ORDINANCE AMENDING THE MUNICIPAL CODE SO AS TO PERMIT THE IMPROVEMENT OF THE INTERSECTION OF RAND , CENTRAL. AND MT. PROSPECT ROADS WHEREAS, the Village of Mount Prospect, hereinafter known as the Village, and the State of Illinois, acting by and through its Department of Transportation, have entered into an agreement relative to the improvement of the intersection of Rand, Central and Mt. Prospect Roads in the Village of Mount Prospect; and WHEREAS 9 in order to facilitate said improvement it is necessary for the Village to adopt an ordinance regulating encroachments on the right-of-way for said improve- ments, and prohibit the discharge of sanitary and industrial waste water at certain locations; NOW, THEREFORE. BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES *F THE VILLAGE OF MOUNT PROSPECT , COOK COUNTY , ILLINOIS: - SECTION ONE: That Section 24.801 of the Municipal Code of P-4ount Prospect of 1957, as amended, be and the same is hereby further amended by adding thereto Subsec- tions C and D, which Subsections C and D shall prohibit the discharge of sanitary .9 -nd industrial waste water into certain rights-of-way; so that hereafter the said subsections C and D of Section 24.801 shall be and read as follows: tt C It shall be unlawful for any person, firm or corporation to discharge any sanitary or industrial waste into any storm sewers constructed by the State of Illinois as part of the improvement of Busse Road between Golf Road and the southernmost corporate limits of the Village of Mount Pros pect, known as Busse Road C.H.S. Route 012 (F. A. Rout- No.Section 012-0304 MFT, Village Section 40CS. I D. It shall be unlawful for any person, firm or corporation to discharge or permit or cause to be discharged sanitary and industrial waste water into any storm sewers constructed as part of the improvement of the intersection of U.S. Route 12 (Rand Road), Central Road and Mt. Prospect Road in Mount Prospect, Illinois. 11 SECTION TWO ' : That Section 9.108 of the Municipal Code of the Village of Mount Prospect of 1957, as amended, be and is hereby further amended by adding an additional subsection, Subsection F; so that hereafter the said Subsection F of Section 9.108 shall be and read as follows: F. It shall be unlawful for any person, firm, or corporation to erect or cause to be erected , to retain or to be retained ' , any encroach- ment (hereinabove defined) within the roadway existing rights- of-way at the intersection of Rand Road (FAP Route 864) (U.S. Route 12, Central Road (FAU Route 1300) and Mount Prospect Road (FAU Route 2686), at and near the intersection of said three routes, in the Village of Mount Prospect. A Certificate of Appreciation and plaque were presented to Dave Creamer, Director of Public Works,,, for his and the entire Public Works Department's cooperation and work involved in restoring the original Village Hall and the School House Museum. Jerome Thomas, 400 S. Wille, requested consideration from the Board relative to 3 trees that had been scheduled to be removed because of the 'IS" curve construction. Mayor Krause noted the issue will be investigated before such action is taken. John Kriola, 710 S. Emerson, approached the Board relative to the excess traffic generated on Emerson Street as a result of the construction on the 'IS" curve. Mr, Kriola suggested re-routing all thru traffic to Mount Prospect or Busse Roads. He also mentioned that the traffic was exceeding the speed limit and was a danger to the residents. Mayor Krause said the situation would be reviewed by the administration. Bob Musser, 504 S. Pine., also spoke to the Board relative Pg. 2 7/5/77 to the increased volume of traffic on Emerson Street. MANAGER I S REPORT Village Manager Eppley requested the Board to accept the Pavement Marking Program. Trustee Hendricks, seconded by Trustee Wattenberg, moved to authorize the Mayor to sign and Clerk to attest the Pavement Marking Program. Mr. Eppley requested authorization to have the Well #10 property appraised for possible re -sale, since that site is no longer in use as a well. Mr. Eppley noted that it is his intention for this policy to be in effect for the remainder of 1977, since these particular residents will be required to obtain Village vehicle stickers in future years. KAISER WHEREAS, Filrefighter LEONARD A. KAISER served his community as a Firefighter and trained Paramedic Pg- 3 7/5/77 since August 1.,, 1962; and WHEREAS, Firefighter LEONARD A. KAISER served as a Volunteer Fireman for the Mount Prospect Fire Department as well as the Charles Bruning Fire Brigade for three years before taking the oath of office as a Firefighter for the Mount Prospect Fire Department,- and WHEREAS, Firefighter LEONARD A. KAISER served as a Firefighter under Fire Chief Lawrence A. Pairiltz and as a Firefighter under former Fire Chief Edwin Haberkamp and was a trained Emergency Medical Technician and Paramedic; and WHEREAS I I Firefighter LEONARD A. KAISER originated the Cadet Fireman Program in Illinois" in 1973 and spent many personal hours in preparing, promoting and recruiting the program; and 11HEREAS, Firefighter LEONARD A. KAISER, under the auspices of the Village of Mount Prospect,, personally saw to the training of many high school students under the Fire Cadet Program with the objective that the Program would lead to career employment in fire fighting; and IffAEREAS, the Mount Prospect Fire Cadet Program is the first of 'Its kind in the United States and is the only 4 one in the Northwest suburbs; and WHEREASFirefighter LEONARD A. An ordinance relating the responsibilities of the Finance Commission was presented for first reading. Trustee Richardson stated that one of the original purposes of that Commission was to research the tax structure of the Village. There was discussion of this subject and it was noted that the Commission members themselves had expressed an opinion that the project would be of such a magnitude that they could not direct their attention to the project, but would undertake all the other specified responsibilities outlined in the ordinance. Mayor Krause presented the revised report from Fletcher Engineering, noting that Mr. Muldowney from Fletcher Engineering was not present to explain the revisions. The Board was of the opinion that it did not present itself to the Village's need to encourage conservation of water and the tax structure. Trustee Richardson expressed his desire to see this subject go to Committee for further study with particular attention to be given an escalating schedule. Trustee Wattenberg noted that it was his desire to have the Village staff review and make reccmmendations on the subject. Mayor Krause referred the subject to the Public Works Committee for further revilew, in light of the fact that the report was compiled with the sewer charges included with the water bill. Charles Barbough, Forest Cove Apartments, spoke to the Board relative to the water rate structure and the pg. 5 7/5/77 effect the proposed water rate increase would have on multi-flamily dwellings. Richard Cohen, Huntington Commons Apartments, also spoke to the Board relative to multi--fanvilwater use, noting that charges should be per dwelling unit not total volume. Irene Stephan, 218 S. William, spoke to the Board on the effect the new water rate structure would have on senior ci. izens noting the gallons used is much below the present minimum. Trustee Richardson stated that the Public Wo 'rks Comm ' i1ttee would meet July 21,., and Mr. Muldowney would be requested to attend that meeting.
