THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the property being the subject matter of Case No. ZBA-4-V-77, being legally described as follows: Lot 12 in Block 9 in Hillcrest, being a subdivision of the Northeast � quarter of the Southwest quarter (except the North 2 7/8 Acres thereof) of Section 34, Township 42 North, Range 11 East of the Third Principal Meridian, also the North 23.5 Acres of the Southeast quarter of the Southwest quarter (except the West 295.1 feet of the South 295.1 feet lying North of the South 543 feet of the East half of the Southwest quarter of said Section 34, Township 42 North, Range 11 East of the Third Principal Meridian, in Cook County, Illinois, is currently zoned under the Zoning Ordinance of the Village of Mount Prospect as R-1 (Single Family Residence District), which zoning classification shall remain in effect subject to the variation , granted herein: That the yard abutting the frontmost lot line of the subject property � Ll� 3/15/77 adjacent to Henry Street be reduced to twenty feet (20') , as shown upon the survey attached hereto and hereby made a part hereof as Exhibit I. SECTION FOUR: That the variation granted by this ordinance shall be null and void and of no force and effect whatsoever unless an application for a building permit pursuant to such variation is made and construction commenced within one (1) year of the date this said Ordinance becomes effective. A RESOLUTION DIRECTING AND AUTHORIZING THE EXECUTION OF A MEMORANDUM OF AGREEMENT PROVIDING FOR ISSUANCE OF REVENUE BONDS FINANCING SENIOR CITIZENS HOUSING WHEREAS, Dell Corporation, an Illinois corporation (the "Sponsor") wishes to finance the development of Centennial House, a residential housing facility for the elderly which will be owned by an Illinois Land Trust for the benefit of an Illinois Limited Partnership of which Dell Corporation shall be the general partner (the "Partnership"). WHEREAS , the Sponsor wishes to have the Village of Mount Prospect, Illinois (the "Issuer") issue its revenue bonds to provide such housing facilities; and WHEREAS , a Memorandum of Agreement has been presented to the Issuer under the terms of which the Issuer agrees, subject to the provisions of such agreement, to issue its revenue bonds to provide such facilities; NOW , THEREFORE , BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the construction and financing of the Centennial House within the Village limits of the Issuer as provided in the Memorandum of Agreement, attached hereto and hereby made a part hereof as Exhibit "A" . is declared to be a public purpose and a matter pertaining to the government and affairs of the Issuer. I SECTION TWO: That the Mayor of the Issuer '('is hereby authorized to execute and the Village Clerk is hereby authorized to attest the Memorandum of Agreement (Exhibit A) with the Sponsor in substantially the form presented to this meeting. SECTION THREE: That the officers and employees of the Issuer are hereby authorized to take such further action as is necessary to carry out the intent and purposes of the aforesaid Memorandum of Agreement as executed and to provide for revenue bonds in an amount not to exceed $3,500,000 to be issued upon the terms and conditions stated in said Memorandum of Agreement with respect to the facilities described in the Memo- randum of Agreement. AN ORDINANCE PRORATING THE COST OF THE CONSTRUCTION OF SANITARY SEWER AND WATER MAIN IMPROVEMENTS IN THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS WHEREAS, the Village of Mount Prospect has caused to be constructed at its sole cost certain oversized sanitary sewer main and water main improvements to serve what is or is expected to be land and territory within the corporate limits of the Village of Mount Prospect; and WHEREAS, the cost of construction as completed totals Five Hundred Ten Thousand and no/100 ($510,000.00) Dollars, including all engineering and inspection costs; and WHEREAS , the aforesaid improvements can and will serve other properties not pre- sently being served, which properties are adjacent to or within the corporate limits of the Village of Mount Prospect; and WHEREAS, said improvements will be beneficial to and in the best interests of the Village of Mount Prospect and the ultimate users of said improvements; NOW) THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE That, pursuant to the authority vested in the President and Board of Trustees of the Village of Mount Prospect under Article VII of the 1970 Constitu- tion of the State of Illinois, no person, firm, or corporation being the owner of or in any way interested in certain real estate hereinafter described, and no contrac- tor, agent, or other representative of such owner or other interested party shall connect to and obtain any services from any water main owned by the Village of Mount Prospect without first having obtained a permit from the Village of Mount Prospect to make such connection, which certain real estate is described as lying within that area West of Elmhurst Road; South of Dempster street; East of Linneman Road; and North of Algonquin Road; as well as that real estate lying East of Higgins Creek; North of Oakton Street; West of Elmhurst Road; South of Algonquin Road, East of the East line of Semrow's Addition to'Mount Prospect in the West Half (D of 2 the Northwest Quarter (1) of Section 23, Township 41 North , Range 11, East of the 4 Third Principal Meridian, in Cook County, Illinois. A. No such- permit shall be issued unless the applicant therefor shall first pay to the Village of Mount Prospect a sum equal to Five Hundred Twenty -Five and no/100 ($525.00) Dollars per acre of land to be served by such connec- tion, which sum amounts to the proportionate share of the cost of Two Hun- dred Fifty -Two Thousand and no/100 ($252, 000.00) Dollars, the amount here- tofore paid by the Village of Mount Prospect. B Such charge when paid shall entitle such owner to connect to the said water main improvements and shall be in addition to the other usual charges pay- able to the Village of Mount Prospect for making any such connection and/or for services rendered. SECTION TWO: That , pursuant to the authority vested in the President and Board of Trustees of the Village of Mount Prospect under Article VII of the 1970 Constitu- tion of the State of Illinois, no person, firm, or corporation being the owner of or in any way interested in certain real estate hereinafter described , and no contrac- tor, agent, or other representative of such owner or other interested party shall connect to and obtain any services from any sanitary sewer owned by the Village of Mount Prospect without first having obtained a permit from the Village of Mount Prospect to make such connection, which certain real estate is described as lying within the Northeast Quarter (4) of Section 23, Township 41 North, Range 11, East of the Third Principal Meridian, as well as that property lying within the East Half (D of the Southeast Quarter (1) of Section 23, Township 41 North. Range 11 4 East of the Third Principal Meridian, all in Cook County, Illinois. A. No such permit shall be issued unless the applicant therefor shall first pay to the Village of Mount Prospect a sum equal to Nine Hundred Seventy -Five and no/100 ($975.00) Dollars per acre of land to be served by such connec- tion , which sum amounts to the proportionate share of the cost of Two Hun- dred Fifty -Eight Thousand and no/ 100 ($258, 000.00) Dollars, the amount heretofore paid by the Village of Mount Prospect. B. Such charge when paid shall entitle such owner to connect to the said sani- tary sewer improvements and shall be in addition to the other usual charges payable to the Village of Mount Prospect for making any such connection and/or for services rendered. SECTION THREE: That any person, firm, or corporation being the owner or owners of or in any way interested in any of the property lying within the areas described in SECTION ONE or SECTION TWO hereinabove and any contractor, agent, or other representative of any such owner or owners or other interested party making connec- tions with any sanitary sewer or water main improvements hereinbefore described in SECTION ONE or SECTION TWO without first making application to the Village for such a permit, and without first paying the fees and charges hereinabove provided for , shall be subj ect to a fine of not less than One Hundred and no/ loo ($100.00) Dollars nor more than Five Hundred and no/100 ($500.00) Dollars and upon such a finding the Village through its agents and employees shall remove all such connections so made. SECTION FOUR: That the improvements hereinabove described are public improve- ments owned by the Village of Mount Prospect and nothing herein contained shall be construed in any manner to vest any proprietary rights in said connections to any other person, firm, or corporation. APPROVED this day of 1977. -3- Village President N AN ORDINANCE AMENDING ORDINANCE NCS. 832 REGARDING VARIATION OF THE FRONT YARD SETBACK REQUIREMENT OF PROPERTY USED BY ILLINOIS RANGE COMPANY ON CMTRAL ROAD WHEREAS,, the President and Board of Trustees on June 5. 1962 did pass and approve Ordinance No. 832 establishing a variation of the front yard setback requirement of property owned by Illinois Range Company on Central Road*P and WHEREAS, said Ordinance w&9 adopted as a result of a Public Hearing before the Zoning Board of Appeals of the Village of Mount Prospect under Case No. 62-10; and WHEREAS, the petitioner therein did present testimony with respect to a future second story addition thereon; and WHEREAS, Ordinance No,, 832 did not clearly reflect this; and WHEREAS, the property owner did appear before the Board of Appeals on January 23, 1969 and request clarification of Ordinance No. 832 with respect to the construction of a second story, and .0 WHEREAS, the Board' of Appeals determined it was the Intention of the petitioner and the Zoning Board of Appeals that the 1962 Ormdinance' 832 provide for a futu construction of a second story; and WHEREAS, the President and Board of Trustees believe that the best interests of the Village of Mount Prospect will be served by the amendment of Ordinance No. 832; NOW. Art Braband, 11 N. Pine St., asked the Board to put a moratorium on the construction of senior citizens buildings as a water con- servation measure. Pg. 2 3/15/77 The Village Manager responded by pointing out 'Under the newly adopted building code al -I buildings must be constructed with water saving devices. The Board took no action on the request, MANAGER'S REPORT The Village Manager stated April 5. 1977 will be Cadet Girl Scout Government Day. The Cadet Scouts will, in the afternoon of April 5th, assume the roles of Manager, Assistant Manager, Police Chief, Fire Chief, Director of Public Works and Director of Health Services. A report by the Scouts will be presented at the Board meeting, April 5th. The Village Manager advised 5 grants under the Cook County Community -Development Block Grant Program have been filed, MAYOR'S REPORT Bill Draper , Dell Corporation, requested Board passage of a Resolution authorizing exec ' ution of an agreement providing for issuance of Village revenue bonds financing senior citizen housing. Since this type of Resolution would be a first for the Village, it was referred to the Finance Committee for further study. COMMITTEE REPORTS BUILDING COMMITTEE Trustee Minton discussed his memo of 3-9-77 pertaining to in- creased police security to curb vandalism and kidnapping of young children. He stated much of this is already underway and further requested the Village administration to draft a letter asking residents in potential vandalized areas to be on the Watch for vandalism and notify the Police Department. FINANCE COMMITTEE Trustee Flpros , seconded by Trustee Rhea, moved for concurrence of the Committee's report and g.rant a Class C liquor license for the purpose of issuing it to Matthew Mele.
