.Change Present Elected Library Board System:
The Committee received a written presentation from Village Manager
Eppley relative to if and how the Mount Prospect Public Library
could be operated without benefit of an elected Library Board of
Directors. Village Attorney John Zimmermann, in a written report,
said the Village, under Home Rule power, had the authority to
place the question before the voters via a referendum and to
operate a Library under the overall supervision of the Village
Manager. The Village Manager pointed out that cities throughout
the State of Illinois operate their libraries as a department of
the municipal government. He was Manager of two municipalities
that operated in that manner. He foresaw no problems in such an
operation in Mount Prospect.
Although the members of the Library Board had been invited to
attend the Finance Committee meeting, none was present. A former
Library Board member,, the Library Board's Attorney, and a rep-
resentative of the Northwest Suburban Library Council were present
to voice objection to the proposed dissolution of the elected
Library Board.
After considerable discussion, the Chairman of the Finance Committee
said he would delay the calling of a vote until the next meeting
of the Committee. Because of the holidays, the Finance Committee
will next meet on Thursday,,January 26, 1978.
11'aterworks Bond R,eserve Fun.d.
Jack Ronchetto, Chairman of the Finance Commission, gave an oral
report on the recommendations of the Commission relative to
replenishing the Bond Reserve Fund. The Commission had met earlier
in the evening; consequently, a written report was not yet avail-
able. Such a report will be submitted in advance of the Village
Board meeting of December 6,
The Finance Commission, on the recommendation of Finance Director
Richard Jesse, proposed that $180,000 be transferred from the
corporate purposes 1973 Flood Control Bond Fund into the Water-
works Bond Reserve Fund. This is the amount that was spent
toward the purchase of,the Sunris'e Park property, and was intended
originally to house a water reservoir. That property now offers

the only public access to Weller Creek. Therefore, there is
9ood reason why that purchase price should be charged against
the Flood Control can Fund rather than the Waterworks Bond Fund,
as it has been.
The balance of the Waterworks Bond Reserve Fund deficit would
come from a $35,000 payment recently received from a developer
under litigation relative to water and sewer, and $10,000 from
the sale of property formerly housing Well #14 on Straton Lane.
The Finance Commission';s recommendation was contingent on an
opinion from the Village Attorney on the legality of the transfer
of the $180,000 from the corporate purpoases fund into the Water-
works Reserve Fund. The Finance Committee took no vote on the
matter pending receipt of aiwritten report from the Finance Com-
mission and receipt of the Attorney's legal opinion. All parties
agreed that the Village'Board should take action on this matter
at the December 6 meeting. It is imperative that the money b ' e
restored to the Waterworks Reserve Fund as soon as possible as
the first step toward reclaiming the Village's AA rating with
Standard & Poors.
The Finance Commission also recommended that the Finance Committee
or the entire Village Board may want to consider a meeting with
representatives of Touche Ross sometime in the near future.
The Finance Commission believes that such a meeting, perhaps on
an annual basis, would be beneficial to members of the Villdge
Board.

A rough draft ordinance establishing procedures for sewer and
water main recapture agreements, and a re -draft by Attorney
Zimmermann of the agreement presented at the last meeting by
Jerry Chez, owner of the sewer line, were presented to the Committee
at the opening of the meeting. It was decided to delay any
action on these documents unti.1 the next meeting to allow the
Committee time for review. Furthermore, only one of the residents
from the area was in attendance.... others will be invited to'
attend the next meeting, as will Village Attorney Zimmermann.

Several days after the meeting, Mr. Chez offered to give the
entire section of his sewer line which runs through the Northern
Illinois Gas property to the Village before the end of the year.
It is the recommendation of Manager Eppley that we accept this
offer.
Maplecrest-Water Distribution System: I
Several of the Maplecrest homeowners were in attendance. A report
from Attorney Zimmermann dated 11/15/77 was reviewed and many of
the questions which followed required a legal interpretation.
It wastherefore decided to postpone discussion of this matter
until the next Committee meeting when Attorney Zimmermann will
be present. In the meantime, property owners will check to see
if Citizens Utility Company has easements throughout Maplecrest
for sewer and water lines. The Committee did vote 3-0 to
draft a resolution for Board approval, indicating the official
position of theVillage on this, matter and to send a copy of the
resolution to the president of Citizens Utility, along with a
transmittal letter from the Mayor requesting a reply.
Manager Eppley made mention of $500 on deposit from the developer
for street maintenance, and thought it would be appropriate to
turn that money over' to the pro . perty owners to be used for snow
removal or internal street maintenance. The Committee supported
this proposal.

ORDINANCE NO.
AN ORDINANCE AMENDING MAP 3-N OF
THE MOUNT PROSPECT ZONING ORDINANCE
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect
did heretofore conduct a public hearing' under Case No. 43-Z-77, on the
22nd of September, 1977, on a request to combine R-1 (Single Family
Residence District) Lots 38-43 and 54 with B-2 (Business -Office District)
Lots 9-14 creating a single lot which would be rezoned R-4 (Residential
Development District); and
WHEREAS. a notice of the aforesaid public hearing was made and published
in the manner provided by law; - and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect
has recommended to the President and Board of Trustees of the Village
of Mount Prospect that the petitioner's request under said Case No. 43-Z-77
be granted; and
WHEREAS, the Building Committee of the Board of Trustees of the Village
of Mount Prospect has reviewed the matter herein and ha's recommended
unanimously the approval thereof to the President and Board of Trustees
of the Village of Mount Prospect; and
WHEREAS, the President and Board of Trustees of the Village of Mount
Prospect have determinedd that the best interests of the Village of Mount
Prospect will be attained by the adoption of the following Ordinance re-
garding the subject property.;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT , COOK COUNTY, ILLINOIS:
SECTION ONE: That Map 3-N of the Zoning Ordinance of the Village of Mount
Prospect, as -amended be and is hereby further amended by rezoning from
R-1 (Single Family Residence DisCrict)to* IR 4 (Residential Dev'elopment
District) that land legally described as follows:
Lots: 38, 39, 40, 41, 42, 43 and 54 in H. Roy
Berry Company's Northwest Heights, being a subdivision of all that land'
lying north of the Chicago and North Western Railroad in the Northwest
1/4 of the Southeast 1/4 of Section 33, Township 42 North, Range 11, East
of the Third Principal Meridian, also together with all that part of Rammer
Avenue to be vacated which lies south of the south line of Isabella Avenue
and which lies northeasterly of the northeasterly line of Northwest Highway
as said Rammer Avenue was dedicated in H. Roy Berry Company's North-
west Heights aforesaid, also together with the north 35.4 feet of Evanston
Avenue to be vacated which lies south of and adjoining the south line of

4. The covenants herein contained shall run with the land for the periods

for successive periods of ten (10) years unless by a vote of the majority of the said
landowners of the said property it is agreed otherwise.
5. Nothing in thses covenants shall in any way prevent alienation

be subject to the provisions hereof and of the Planned Unit Development
Ordinance of the Village of Mount Prospect and the new Owner shall be
both benefited and bound by the conditions and restrictions herein and there-

6. By acceptance of these Restrictive Covenants , the Village of
Mount Prospect acknowledges that its Ordinance relating to Restrictive
Covenants has been fully 'complied with.
7. If the parties hereto, or any of them, or their heirs or assigns
shall violate or attempt to violate any of the covenants herein, it shall be
lawful for the other parties hereto, including the Village of Mount Prospect, to
prosecute any proceeding at law or in equity against the person or persons
violating or attempting to violate any such covenant -- and either to prevent
him or them from so doing or to, recover damages or other dues for such violation.

made a part hereof as Exhibit II (Engineering Plan) which improvements shall
be dedicated to the Village of Mount Prospect.
C. The Planned Unit Development shall be served by such fire lanes as are shown
upon Exhibit III (Fire Lane Exhibit) attached hereto and hereby made a part
hereof.
D. Said Planned Unit Development may be designated as to location by one (1)
sign erected upon the subject property at the location shown on Exhibit I
(Site Plan) which sign shall conform in size and configuration to the
ordinances of the Village of Mount Prospect as if such sign were located
within the B-2 (Business -Office) District.
SECTION THREE: That the Village President is hereby authorized to sign , and

BERNARD HEWITT will cause a Plat of Open Space Easement to be delivered to the
Village of Mount Prospect for recordation, which, by said Plat, is intended to
permanently guarantee open space substantially in accordance with said approved
Planned Unit Development and any amendment thereto. Said Plat of Open Space

Easement shall constitute a covenant running with the land for fifty (50) years
from the date of said recording of those covenants and shall be enforceable by
said Village of Mount Prospect.
4. The covenants herein contained shall run with the land for the periods of time
set forth herein. Thereafter, said covenants shall be extended automatically
for successive periods of ten (10) years unless by a vote of the majority of the
said landowners of the said property it is agreed otherwise.
5. Nothing in these covenants shall in any way prevent alienation or sale of the
subject property or portion thereof except that said sale shall be subject to the
provisions hereof and of the Planned Unit Development Ordinance of the Village
of Mount Prospect and the new Owner shall be both benefited and bound by the
conditions and restrictions herein and therein expressed.
6. By acceptance of these Restn'idtive Covenants, the Village of Mount Prospect
acknowledges that.- its Ordinance relating to Restrictive Covenants has been
fully complied with.
7. If the parties hereto, or any of them, or their heirs or assigns shall violate
or attempt to violate any of the covenants herein, it shall be lawful for the
other parties hereto, including the Village of Mount Prospect, to prosecute
any proceeding at law or in equity against the person or. persons violating
or attempting to violate any such covenant --and either to prevent him or
them from so doing or to recover damages or other dues for such violation::
8. These covenants shall be binding upon and inure to the benefit of the parties
hereto, their successors and assigns.

MANAGER'S REPORT

Village Manager Eppley reported that the improvements be'
made to the "S" curve were near completion and that the
traffic signal at Sha Bonee and street lighting were all
that remained to be done. Mr. Eppley noted that he was
hopeful Route 83 would be open for traffic by the end of
November.
MAYOR'S REPORT
Mayor Krause,proclaimed the week of November 20 - 273 1977�

It was announced by Mayor Krause that,, following meetings

with citizens and various ci izen groups, it had been
determined that an advisory referendum for the purpose
of the,' possible acquisition of Citizens Utilities Companies
would not be held. Itwas noted that the various groups
had expressed an interest in acquisition at a lowerprice.
Trustee Richardson, seconded by Trustee Wattenberg� moved
to authorize the Mayor to contact fzens Utilities
Cornpa'nies,and state that a price in the area of 141-2- to 16
m illion dollars was unacceptable to the citizens and to

seeknegotiations to a lower price.

Fire Protection District,, members of the Village Board,,

fire pr'otection contract by the Village effective

It was also announced by Mayor Krause that a round -table
discussion',session would,begin the first Saturday in
January,, 19785' between residents and members of the Village
Board. These 'sessions would be held on the first Saturday
of each month for informal discussions -7 beginning at
§030 A.M. until noon.
COMMITTEE REPORTS
BUILDING COMMITTEE
Trustee Hendricks reported on the Building Committee
meeting h ' eld N ' ovember 9., 1977. ZBA Case No. 49-V-77 was
referred back to the Zoning Board of Appeals due to
defective legal notice. Upon approval by that Board,
Case No. 49-V-77 will be heard by the Building Committee.
