Katz VILLAGE OF MOUNT PROSPECT, a municipal corporation of the County of Cook and ►tate of Illinois. By: Village President am TO,: Mayor and Board of Trustees FROM: Village Attorney RE,: Zoning Board of Appeals Case No. 66-V-76 DATE: December 30, 1976 In reviewing the above captioned file to prepare the requested ordinance granting certain variations from the zoning code , I found that Mr. DeMonte Is petition, if granted, would require a waiver of two restrictive covenants currently running with the land. Each of these covenants is in the nature of building setback lines which have been imposed upon the entire subdivision -- all as is evidenced by the Plat of Survey in the original Zoning Board of Appeals file, a copy of which is attached. A restatement of the law in Illinois is that as between covenants running with the land and zoning regulations, the more restrictive shall control. Accordingly, even if the Board of Trustees were to pass the requested ordinance, the Director of Build- ing and Zoning would remain powerless to issue a building permit for the garage addi- tion, because that addition is proposed to be constructed ten feet beyond the existing twenty foot building line adjacent to Wolf Road and approximately one foot beyond the thirty foot building line adjacent to Emmerson Lane. Quite properly, had the Zoning Board of Appeals been aware of this situation it should not have heard the case until the petitioner had obtained the release of the covenants through one of the three met- hods allowed by law.
