AN ORDINANCE GRANTING CERTAIN VARIATIONS FOR
PROPERTY LOCATED AT THE SOUTHWEST CORNER
OF RAND ROAD AND HENRY STREET, MOUNT PROSPECT9 ILLINOIS
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect
did meet on the 25th day of August, 1977, and the '27th day of October,
1977, at the hour of 8: 00 p.m., at the Public Safety Building, 112 East
Northwest Highway,, and did hear Case No. 35-V-77, pursuant to
proper legal notice; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect
did hear this request to permit two (2) uses instead of one (1) main
use upon the subject property, to allow a building set back of 20 feet
instead of 30 feet, and to permit parking and a free standing sign with-
in said 20 feet; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect
did recommend to the President and Board of Trustees of the Village of
Mount Prospect the approval of this request under Case No. 35-V-77; and
WHEREAS, the Building Committee of the Board of Trustees of the Village
of Mount Prospect has reviewed the matter herein and has recommended
approval thereof to the President and Board of Trustees of the Village of
Mount Prospect; and
WHEREAS, the President and Board of Trustees of the Village of Mount
Prospect have reviewed the matter herein and_havedetermined that the
same is in the best interests of the Village of Mount Prospect;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECTo COOK COUNTY, ILLINOIS:
SECTION ONE That the property being the subject matter of Case No. 35-V-77,
being legally described as follows:
Lot I in Block 2 in Frank Serafine's 3rd addition, a subdivision of
the Southwest Quarter of Section 35, Township 42 North, Range 11,
East of the Third Principal Meridian, in Cook County, Illinois.
is currently zoned under the Zoning Ordinance of the Village of Mount
Prosect as B-3 ((Business -Retail and Service) District, which zoning
classification shall remain in effect subject to the variations granted herein:
(a) That one (1) main building containing two (2) uses be
allowed to be constructed upon the subject property;
(b) That the front yard adjacent to Albert Street and Henry
A
Street of the subject parcel be reduced to twenty feet (20') --
pursuant to that plan Site Plan attached hereto and hereby
made a part hereof as Exhibit I; and
(c) That the front yard requirements of the Zoning Ordinance
of the Village of Mount Prospect be altered to permit
parking spaces and driveways within same.
SECTION TWO: That all requirements of the Mount Prospect Building and
Zoning Code shall be applicable except the variations noted in SECTION ONE
heretofore mentioned,
SECTION THREE: That the Director of Building and Zoning of the Village of
Mount Prospect is hereby authorized to issue a building permit for con-
struction in accordance with the variations hereinbefore mentioned.
SECTION FOUR: That the variations granted by this Ordinance shall be
null and void and of no force and effect whatsoever unless an application
for a building permit pursuant to such variations is made and construction
commenced within one (1) year of the date this said Ordinance becomes
effective.
SECTION FIVE: That this Ordinance shall be in full force and effect from
and after its passage, approval, and publication in the manner provided
by law.

AN ORDINANCE ANNEXING PROPERTY COMMONLY
KNOWN AS 3026 BUS SE ROAD
WHEREAS, a written petition under oath signed by the owners of record of land here-
inafter described as well as 100% of the residents residing thereon has been filed
with the Village Clerk of the Village of Mount Prospect requesting that said land be
annexed to the Village of Mount Prospect; and
WHEREAS, the said land is not within the corporate limits of any municipality, but
is contiguous to the Village of Mount Prospect; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect find
and believe it to be in the best interests of the said Village that said land and territory
be annexed thereto;
NOW. THEREFORE, BE IT ORDAMD BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT , COOK COUNTY , ILLINOIS:
SECTION ONE: That all land and territory legally described as follows:
The North 5 acres of the South 30 acres (except the West 210 feet
thereof) of the S.E. 1/4 of the N.E. 1/4 of Section 22, Township
41 North,, Range 11 East of the 3rd P.M.
That part of the West 50 feet of the S.W. 1/4 of the N.W. 1/4 of
Section 23,, Township 41 North, Range 11 East of the 3rd P.M.
lying between the North and South line of said North 5 acres
of South 30 acres extended East,,, alljn.Cook County, Illinois.
an accurate map of which territory is attached hereto and made a part hereof by
this reference, be and the same is hereby annexed to the Village of Mount Prospect,

SECTION TWO ' -. That Map 38-S contained in SECTION ONE of Ordinance No. 241.,

passed and approved March 20,, 1973, be amended to reflect the extension of the
corporate limits of the Village of Mount Prospect to include the property hereinabove

directed to file in the Office of the Recorder of Deeds of Cook County, Illinois, a
certified copy of this Ordinance together with an accurage map of the territory
annexed.
SECTION FOUR: That this Ordinance shall be in full force and effect from and
after its passage, approval, and publication in the manner provided by law.

AN ORDINANCE GRANTING CERTAIN VARIATIONS FOR
PROPERTY COMMONLY KNOWN AS 3026 SOUTH BUSSE ROAD
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet on
the 28th day of April, 1977, at the hour of 8: 00 p.m., at the Mount Prospect Public
Safety Building and did hear Case No. 17-V-77, pursuant to proper legal notice; and,
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hear
this request for a side yard variation and for a variation in the size of parking spaces
so as to allow the petitioner to construct a certain Planned Unit Development contain-
ing ninety-six (96) condominium units on property located west of Busse Road at
Charlotte Road extended; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recom-
mend to the President and Board of Trustees of the Village of Mount Prospect the
approval of this request under Case No. 17-V-77 for the reasons that:
(1) There is a practical difficulty and particular hardship on the
petitioner;
(2) The purpose of the variations is not based exclusively upon a
desire to make money;
(3) The conditions upon which the petition for these variations is
based are unique in that the parcel is of an irregular shape;
and
(4) The granting of these variations will not be detrimental to the
public or injurious to surrounding property in that they will not
alter the essential character of the locality; and
WHEREAS , the Building Committee of the Board of Trustees of the Village of Mount
Prospect has reviewed the matter herein and has recommended the approval thereof
to the President and Board of Trustees of the Village of Mount Prospect; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
have reviewed the matter herein and have determined that the same is in the best
interests of the Village of Mount Prospect;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT,' COOK COUNTY,, ILLINOIS:
SECTION ONE: That the property being the subject matter of Case No. 17-V-77,
being legally described as follows:
The North 5 acres (except the west 25.4 feet of the East 50.0 feet
thereof) and (except the west 21.0 feet thereof) of the South 30 acres
of the southeast 1/4 of the Northeast 1/4 of section 22, Town ship 41
North, Range 11, East of the Third Principal Meridian, in Cook.
County, Illinois ,
is currently zoned under the Zoning Ordinance of the Village of Mount Prospect as
R.-4 (Residential Development) District, which zoning classification shall remain
in effect subject to the variations granted herein:
(a) That the side yard adjacent to the northerlymost and easterlymost lot
lines of the subject parcel be reduced to twenty-six (26) feet to permit
construction of buildings --pursuant to that plan for development
attached hereto and hereby made a part hereof as Exhibit I (Site Plan).
(b) That the side yard requirements of the Zoning Ordinance of the Village
of Mount Prospect be altered to permit parking spaces and driveways
within same.
(c) That the required stall size for parking spaces be reduced from ten feet
by twenty feet (101 x 201) in area to nine feet by twenty feet (91 x 201)
for all required parking to be located on the subject property.
SECTION TWO: That all requirements of the Mount Prospect Building and Zoning
Code shall be applicable except the variations noted in Section One heretofore
mentioned.
SECTION THREE: That the Director of Building and Zoning of the Village of Mount
Prospect is hereby authorized to issue a building permit for construction in accordance
with the variations hereinbefore mentioned.
SECTION FOUR: That the variations granted by this Ordinance shall be null and void

AN ORDINANCE AMENDING MAP 38-S OF THE
MOUNT PROSPECT ZONING ORDINANCE
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hereto-
fore conduct a public hearing under Case No. 16-Z-77 at the hour of 8: 00 P.M.
on April 28, 1977, pursuant to a request for zoning classification changes in conjunc-
tion with a planned unit development, which requested changes were from R -X
(Single Family Residence District) to R-4 (Residential Development District) of
certain property hereinafter described; and
WHEREAS, a notice of the aforesaid public hearing was made and published in the
manner provided by law; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect has recom-
mended to the President and Board of Trustees of the Village of Mount Prospect that
the petitioner's request under said Case No. 16-Z-77 be granted; and
WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount
Prospect has reviewed the matter herein and has recommended the approval thereof
to the President and Board of Trustees of the Village of Mount Prospect; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
have determined that the best interests of the Village of Mount Prospect will be
attained by the adoption of the following Ordinance regarding the subject property;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT , COOK COUNTY. ILLINOIS:
SECTION ONE: That Map 38-S of the Zoning Ordinance of the Village of Mount
Prospect, as amended, be and the same are hereby further amended by reclassifying
from R -X (Single Family Residence District) to R-4 (Residential Development Dis-
trict) that land legally described-6-s-folloWs:'
The North 5 acres (except the West 25.0 feet of the East 50.0 feet
thereof) and (except the West 210 feet thereof) of the South 30 acres
of the Southeast 1/4 of the Northeast 1/4 of Section 22, Township 41
North, Range 11, East of the Third Principal Meridian, in Cook
County, Illinois.
SECTION TWO: That Map 38-S contained in SECTION ONE of Ordinance 2410, passed
and approved March 20, 1973, shall be deemed amended so as to conform with the
r.eclassificait6n of the property herein contained in SECTION ONE above.
SECTION THREE: That this Ordinance shall be in full force and effect from
and after the recording of an approved plat resubdividing the subject property
into one (1) lot of record; and after its passage. approval, and publication in
the manner provided by law.

AN ORDINANCE GRANTING A SPECIAL USE PERMIT IN
THE NATURE OF A PLANNED UNIT DEVELOPMENT FOR
PROPERTY COMMONLY KNOWN AS 3026 SOUTH BUSSE ROAD
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hereto-
fore conduct a public hearing under Case No. 18 -SU -77 on April 28, 1977, at the
hour of 8: 00 p m . , pursuant to a request for a special use in the nature of a Planned
Unit Development; and
WHEREAS, a notice of the aforesaid public hearing was made and published in the
manner provided by law; and
WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount
Prospect has reviewed the matter herein and has recommended the approval thereof
to the President and Board of Trustees of the Village of Mount Prospect-, and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
have determined that the best interests of the Village of Mount Prospect will be
attained by the passage of the following Ordinance regarding the subject property;
NOW . THEREFORE , BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY., ILLINOIS:
SECTION ONE: That a special use permit be and is hereby granted to allow Ferlette,
Realty and Builders to construct a Planned Unit Development upon the following
described property:
The North 5 acres (except the West 25.0 feet of the East 50.0 feet
thereof) and (except the West 210 feet thereof) of the South 30 acres
of the Southeast 1/4 of the Northeast 1/4 of Section 22, Township 41
North, Range 11, East of the Third Principal Meridian, in Cook
County, Illinois.
SECTION TWO: That the Planned Unit Development hereinabove authorized and
permitted shall be constructed pursuant to the land uses and standards shown upon
the Site Plan, attached hereto and hereby made a part hereof as Exhibit I, except
as may otherwise be provided herein, and as necessarily modified to solve engineer-
ing layout and design problems at the time of the construction of the said Planned
Unit Development.
A. Said Planned Unit Development shall consist of the construction of no more
than ninety-six (96) dwelling units upon that portion of the subject pro-
perty zoned R-4 (Residential Development District).
B. The site of said Planned Unit Development shall also be improved with certain
on-site and off-site utilities pursuant to that plan attached hereto and hereby
made a part hereof as Exhibit 11 (Engineering Plan) which improvements shall
be dedicated to the Village of Mount Prospect.
C, The Planned Unit Development shall be served by such fire lanes as are shown
upon Exhibit III (Fire Lane Exhibit) attached hereto and hereby made a part
hereof.
D Said Planned Unit Development may be designated as to location by one (1)
sign erected upon the subject property at the location shown on Exhibit I
(Site Plan) which sign shall conform in size and configuration to the plan
attached hereto and hereby made a part hereof as Exhibit III (a) (Sign
Exhibit).
SECTION THREE: That the Village President is hereby authorized to sign, and
the Village Clerk is hereby authorized to attest,, and Bernard Hewitt shall execute
and see to the recording to the "Restrictive Covenants" attached hereto and hereby
made a part hereof as Exhibit IV -
SECTION FOUR: That the Director of Building and Zoning of the Village of Mount
Prospect is hereby authorized to issue upon proper application for building permits
such permits as may be required for the construction of the said Planned Unit Develop-
ment --which construction shall be governed by the terms of Article XXV of the Mount
Prospect Zoning Ordinance, this Ordinance herein, and all other applicable ordinances
of the Village of Mount Prospect.
SECTION FIVE: That as each building in the development is completed and occupancy
certificates are issued for all of the residences in each building, Bernard Hewitt will
cause an Open Space Easement to be delivered to the Village of Mount Prospect.
A. These easements and plats shall be recorded and shall contain such wording
as may be sufficient to permanently guarantee the open space as shown on such
easement in accordance with the said Planned Unit Development and any amend-
ments thereto.
B. That said Open Space Easements shall constitute a covenant running with the
land and shall be enforceable by the said Village of Mount Prospect.
SECTION SIX: That the text of this Ordinance and the Restrictive Covenants con-
tained in Exhibit IV hereto shall be recorded in the Office of the Recorder of Deeds of
Cook County, Illinois, upon the-pxecution thereof.
SECTION SEVEN: That this Ordinance shall be in full force and effect from and after
the recording of an approved plat resubdividing (consolidating) the subject property
into one (1) lot of record as shown upon that plat attached hereto and hereby made "a
part hereof as Exhibit V and after its passage , approval , and publication in the manner
provided by law.

RESTRICTIVE COVENANTS
BERNARD HEWITT 5, in accordance with the provisions of Article XXV of the Zoning
Ordinance of the Village of Mount Prospect providing for the creation of Planned
Unit Developments and the regulation of the same, does hereby covenant with the
VILLAGE OF MOUNT PROSPECT, a municipal corporation of the County of Cook
and State of Illinois, as follows:
1. BERNARD HEWITT will maintain control of the Planned Unit Development pro-
posed on the property described as follows:
The North 5 acres (except the West 25.0 feet of the East 50.0 feet thereof)
and (except the West 210 feet thereof) of the South 30 acres of the South-
east 1/4 of the Northeast 1/4 of Section 22, Township 41 North, Range 11,
East of the Third Principal Meridian, in Cook County, Illinois,
to guarantee development substantially in accordance with the Planned Unit
Development Ordinance No. approved by the President and Board of
Trustees of the Village of Mount Prospect on for a
period of eighteen (18) months following completion of said Planned Unit
Development.
2. BERNARD HEWITT does further covenant that for a period of twenty (20) years
from the date of commencement of construction of said Planned Unit Development
that he will , by contract (s) , provide for adequate maintenance of all building
exterior parking areas, and other paved areas, and of all open space located
within said Planned Unit Development, which open space is defined as all of the
land upon completion of construction of the said Planned Unit Development, less
residential buildings, commercial buildings, parking areas and other paved
areas.,
3. That as final occupancy by residents occur as to each state of development,
BERNARD HEWITT will cause a Plat of Open Space Easement to be delivered to the
Village of Mount Prospect for recordation, which, by said Plat, is intended to
permanently guarantee open space substantially in accordance with said approved
Planned Unit Development and any amendment thereto. Said Plat of Open Space
EXHIBIT IV
Easement shall constitute a covenant running with the land for fifty (50) years
from the date of said recording of those covenants and shall be enforceable by
said Village of Mount Prospect.

4. The covenants herein contained shall run with the land for the periods of time
set forth herein. Thereafter, said covenants shall be extended automatically
for successive periods of ten (10) years unless by a vote of the majority of the
said landowners of the said property it is agreed otherwise -
5. Nothing in these covenants shall in any way prevent alienation or sale of the
subject property or portion thereof except that said sale shall be subject to the
provisions hereof and of the Planned Unit Development Ordinance of the Village
of Mount Prospect and the new Owner shall be both benefited and bound by the TM
conditions and restrictions herein and therein expressed.
6. By acceptance of these Restrictive Covenants, the Village of Mount Prospect
acknowledges that its Ordihiainc'4:�ielating to Restrictive Covenants has been
fully complied with.
7. If the parties hereto, or any of them, or their heirs or assigns shall violate
or attempt to violate any of the covenants herein, it shall be lawful for the
other parties hereto, including the Village of Mount Prospect, to prosecute
any proceeding at law or in equity against the person or.persons violating
or attempting to violate any such covenant --and either to prevent him or
them from so doing or to recover damages or other dues for such violation.
8. These covenants shall be binding upon and inure to the benefit of the parties
hereto, their successors and assigns.

SECTION FOUR: That the Director of Building and Zoning of the Village of
Mount Prospect is hereby authorized to issue upon proper application for
building permits, such permits as may be required for the construction of the
said Planned Unit Development -- which construction shall be governed by the
terms of Article XXVof the Mount Prospect Zoning Ordinance, this Ordinance
herein, and all other applicable ordinances of the Village of Mount Prospect.
SECTION FIVE.- That as each building in the development is completed and
occupancy certificates are issued for all of the residences in each building,
Albert M. Katz will cause a Plat of Open Space Easement to be delivered to the
Village of Mount Prospect.
A., These plats shall be recorded and shall contain such wording as may
be sufficient to permanently guarantee the open space as shown on such
easement in accordance with the said Planned Unit Development and any
amendments thereto.
B. That said Plats of Open Space Easement shall constitute a covenant
running with the land and shall be enforceable by the said Village of
Mount Prospect.
SECTION SIX: That the text of this Ordinance and the Restrictive Covenants
contained in Exhibit B hereto shall be recorded in the Office of the Recorder
of Deeds of Cook County, Illinois, upon the execution thereof.
SECTION SEVEN: That this Ordinance shall be in full force and effect from and
after its passage, approval, and publication in the manner provided by law.

WHEREAS,., the Zoning Board of Appeals of the Village of Mount Prospect did
heretofore conduct a public hearing under Case No. 52 -SU -76 on September 2, 1976,
at the hour of 8: 00 p . m . , pursuant to a request for a special use in the nature of
a Planned Unit Development; and
WHEREAS, a notice of the aforesaid public hearing was made in the manner
provided by law and published in the August 17, 1,976, edition of a newspaper
of general, circulation withIn the Villae of Mount, Prospect; and

have determined that the best interests of the Village of Mount Prospect will be
attained by the passage of the following Ordinance regarding the subject propertyl;

Ho'liday Lane Building Corp. and Albert M. Katz, or their assigns, to construct
a Planned Unit Development upon the following described property:
The East 151.05 feet of the West 585.25 Feet (measured along
a line parallel with the North Llne) of Lot 2 (except the
North 703.70 feet thereof, and except that part taken for
Algonquin Road) in Edward Busse's division of part of the
Southeast Quarter of Section 15 and the Northeast Quarter
of Section 22, Township 41 North, Range 11 East of the Third
Principal Meridian in Cook County, Illinois.
SECTION TWO: That the Planned Unit Development hereinabove authorized and
permitted shall be constructed pursuant to the land uses and standards shown
upon the Site Plan, attached hereto and hereby made a part hereof as Exhiblit
except as may otherwise be provided herein, and as necessarily modified to

solve engineering layout and design problems at the time of the construction of
the said Planned Unit Development. I
A. Said Planned Unit Development shall consist of the construction
of no more than 78 dwelling units upon that subject property
zoned R-4 (Residential Development District).

RESTRICTIVE COVENANTS,
ALBERT M. KATZ,, in accordance with the provisions of Article XXV
of the Zoning Ordinance of the Village of Mount Prospect providing for the
creation of Planned Unit Developments and the regulation of the same, does
hereby covenant with the VILLAGE OF MOUNT PROSPECT, a municipal corporation
of the County of Cook and State of Illinois, as follows:
1. ALBERT M. KATZ will maintain control of the Planned Unit
Development proposed on the property described as follows:
The East 151.05 feet of the West 585.25 Feet (measured along
a line parallel with the North LIne) of Lot 2 (except the
North 703.70 feet thereof, and except that part taken for
Algonquin Road) in Edward Busse's division of part of the
Southeast Quarter of Section 15 and the Northeast Quarter
of Section 22, Township 41 North,, Range 11 East of the Third
Principal Meridian in Cook County, Illinois.
to guarantee development substantially in accordance with the Planned Unit
Development Ordinance No. , approved by the President and Board of
Trustees of the Village of Mount Prospect on for a period
of eighteen (18) months following completion of said Planned Unit Development.
2. ALBERT M. KATZ does further co'nvenant that for a period of twenty
(20) years from the date of commencement of construction of said Planned Unit
Development that he will, by contract(s), provide for adequate maintenance of
all building exterloors, parking areas, and other paved areas, and of all open
space located within said Planned Unit Development, which open space is defined
as all of the land upon completion of construction of the said Planned Unit
Developments less residential buildings, commercial buildings, parking areas
and other paved areas.
3. That as final occupancy by residents occur as to each stage of
development, ALBERT M. KATZ will cause a Plat of Open Space Easement to be
delivered to the Village of Mount Prospect for recordation, which, by said Plat,

t s intended to permanently guarantee open space substantially in accordance
with said approved Planned Unit Development and any amendment thereto. Said
Plat of Open Space Easement shall constitute a covenant running with the land for
fifty (50) years from the date of said recording of those covenants and shall be
enforceable by said Village of Mount Prospect.
4. The covenants herein contained shall run with the land for the period
of time set forth herein. Thereafter, said covenants shall be extended automatically
for successive periods of ten (10) years unless by a vote of the majority of the
said landowners of the said property it is agreed otherwise.
5. Nothing in those covenants shall in any way prevent alienation or
sale of the subject property or portion thereof except that said sale shall be
subject to the provisions hereof and of the Planned Unit Development Ordinance of
the Village of Mount Prospect and the new Owner shall be both benefited and
bound by the conditions and restrictions herein and therein expressed.
6. By acceptance of these Restrictive Covenants, the Village of Mount
Prospect acknowledges that its Ordinance relating to Restrictive Covenants has
been fully complied with.
7. If the parties hereto, or any of them, or their heirs or assigns shall
violate or attempt to violate any of the covenants herein, it shall be lawful for
the other parties hereto, including the Village of Mount Prospect, to prosecute
any proceeding at law or in equity against the person or persons violating or
attempting to violate any such covenant -- and either to prevent him or them from
so doing or to recover damages or other dues for such violation.
8. These covenants shall be binding upon and inure to the benefit of

granted, would require a waiver of two restrictive covenants currently running
with the land. Each of these covenants is in the nature of building setback lines
which have been imposed upon the entire subdivision -- all as is evidenced by
the Plat of Survey in the original Zoning Board of Appeals file, a copy of which
is attached.
A restatement of the law in Illinois is that as between covenants running with the
land and zoning regulations, the more restrictive shall control. Accordingly, even
if the Board of Trustees were to pass the requested ordinance, the Director of Build-
ing and Zoning would remain powerless to issue a building permit for the garage addi-
tion, because that addition is proposed to be constructed ten feet beyond the existing
twenty foot building line adjacent to Wolf Road and approximately one foot beyond the
thirty foot building line adjacent to Emmerson Lane. Quite properly, had the Zoning
Board of Appeals been aware of this situation it should not have heard the case until
the petitioner had obtained the release of the covenants through one of the three met-
hods allowed by law.

AN ORDINANCE AMENDING MAP 31-S OF THE ZONING ORDINANC
OF THE VILLAGE OF MOUNT PROSPECT
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did
conduct a public hearing under Case No. 52 -SU -76 on September 2, 1976, on
a request for a zoning classification change from R -X (Single Family Residence
District) to R-4 (Residential Development District) of certain property hereinafter
described; and
WHEREAS, a notice of the aforesaid public hearing was made and published in
the manner provided by law; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
have determined that the best interests of the Village of Mount Prospect will be
attained by the adoption of the following Ordinance regarding the subject property;
NOW, THEREFORE., BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTYt ILLINOIS:
SECTION ONE: That Map 31-S of the Zoning Ordinance of the Village of Mount

Prospect, as amended, be and is hereby further amended by reclassifying from
R -X (Single Family Residence District) to R-4 (Residential Development District)
the following described property:
The East 151.05 feet of the West 585.25 Feet (measured along
a line parallel with the North LIne) of Lot 2 (except the
North 703.70 feet thereof, and except that part taken for
Algonquin Road) in Edward Busse's division of part of the
Southeast Quarter of Section 15 and the Northeast Quarter
of Section 22, Township 41 North, Range 11 East of the Third
Principal Meridian in Cook County, Illinois.
SECTION TWO,° That Map 31-S contained in SECTION ONE of Ordinance 2410,
passed and approved March 20, 1973, shall be deemed amended so as to conform
with the reclassification of the subject property herein contained in SECTION ONE
above.
SECTION THREE: That this Ordinance shall be null and void and of no force
and effect whatsoever until after its passage, approval, publication, and such
time as an accurate plat resubdividing the said parcel described- in SECTION ONE
hereinabove is recorded with the Recorder of Deeds of Cook County, Illinois; a
copy of which plat of resubdivision shall be attached hereto and hereby made a
part hereof.
