RESOLUTION NO.
ANNUAL RESOLUTION AUTHORIZING APPLICATIONS FOR PERMITS FROM
THE ILLINOIS DIVISION OF HIGHWAYS
WHEREAS , the Village of Mount Prospect, located in the County of Cook, State of
Illinois, desires to undertake, in the year 1977, the location, construction, opera-
tion, and maintenance' of driveways and street returns watermaxins , sanl'tar-v
and storm, sew,e—rs, streef'fights —, traffic l. signals, sidewalks landsca

agreemen't come under the jurisdiction and control of the Department of Public
Works and Buildings of the State of Illinois hereinafter referred to as Depart-
ment; and
WHEREAS, an individual working permit must be obtained from the Department
prior to any of the aforesaid installations being constructed either by the Village
of Mount Prospect or by a private person or firm under contract and supervision
of the said Village of Mount Prospect-,
NOW , THEREFORE . BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT , COOK COUNTY , ILLINOIS:
SECTION ONE: That the Village of Mount Prospect hereby pledges its good faith
and guarantees that all work shall be performed in accordance with the conditions
of the permit to be granted by the Department , and to hold the State of Illinois, De-
partment of Public Works and Buildings harmless on account of any damages that
may occur to persons or property during the prosecution of such work, and assume
all liability for damages to persons or property due to accidents or otherwise by rea-
son of the work which is to be performed under the provision of said permit.
SECTION TWO: That all authorized officials of the Village of Mount Prospect are
hereby instructed and authorized to sign said working permit on behalf of the
Village of Mount Prospect.
SECTION THREE: That the Village Clerk is hereby directed to forward a certified
copy of this Resolution to the Office of the District Engineer, Division of Highways,
State of Illinois.
SECTION FOUR: That this Resolution shall be in full force and effect from and after
its passage and approval in the manner provided by law.

A RESOLUTION DIRECTING THE EXECUT16N OF AN ANNEXATION
AGREEMENT REGULATING THE ANNEXATION OF PROPERTY
LOCATED ON MAPS 38-S and 43-S OF THE ZONING ORDINANCE
OF THE VILLAGE OF MOUNT PROSPECT
WHEREAS, the Corporate Authorities of the Village of Mount Prospect on January
18, 1977, at the hour of 8: 00 p.m. , did hold a public hearing upon the proposed
Annexation Agreement for the regulation of the annexation of certain property to
the Village of Mount Prospect, which property is located on Maps 38-5 and 43-5
of the Zoning Ordinance Of the Village of Mount Prospect; and
WHEREAS, a notice of said public hearing was published in a newspaper of general
circulation within the Village of Mount Prospect; and
WHEREAS, notice has been given and a public hearing held on January 13 9 1977,
at 8: 00 p.m. , before the Zoning Board of Appeals of the Village of Mount Prospect
with respect to the aforementioned Annexation Agreement and certain rezoning to be
agreed upon therein; and
WHEREAS, the Corporate Authorities of the Village of Mount Prospect believe that
such Annexation Agreement is in the best interests of the Village of Mount Prospect;
NOW 9 THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY o ILLINOIS:
SECTION' ONE: That the President of the Board of Trustees of the Village of Mount
Prospect is hereby authorized to sign and the Village Clerk of the Village of Mount
Prospect is hereby authorized to attest the Annexation Agreement made a part hereof
and attached hereto as Exhibit I,, which Annexation Agreement, pursuant to the pro-
visions of Division 15.1 of Article II of Chapter 24 of the Illinois Revised Statutes,
shall regulate the annexation of the following described property:
The North 8 acres (except the West 210 feet thereof) of the
East Half (1) of the Southeast Quarter (j) of Section 22, Town-
ship 41 North, Range 11 East of the Third Principal Meridian,
together with the West 50.0 feet of that part of the Southwest
Quarter (1) of Section 23, Township 41 North, Range 11 East
of the Third Principal Meridian, lying North of the South line,
extended East, of the North 8 acres of the East Half 0) of the
Southeast Quarter (1) of Section 22 aforesaid, all in Cook County ,
Illinois.
SECTION TWO: That the said Annexation Agreement shall be binding upon the suc-
cessor owners of record of the above descr-ibed land which is the'subject of the said
agreement and upon successor municipal authorities of this Village of Mount Prospect,
Cook County. Illinois.
SECTION THREE: That this Resolution shall be in full force and effect from and
after its passage and approval in the manner provided by law.

Present: Acting Chairman Richardson; Trustee T. J. Wattenberg.
(Trustee Hendricks unable to attend due to the death of
his father). Buell Dutton, Bill Amundsen, representatives
from Courtesy Home Center and,Mufich Buick.
Flags & Pennants:
This is an old charge which, according to Buell Dutton, can not be
resolved without a complete revision of our local sign ordinance.
Mr. Dutton plans to redraft the ordinance when time permits; however,
he requested that the charge be transferred to the Building Committee
since he normally attends all Building Committee meetings, thus
eliminating the necessity for him to attend the Public Health &
Safety Committee meetings.
By a 2-0 vote, the Committee recommends this transfer., subject to
approval by the respective Chairmen.
Representatives from Courtesy Home Center and Mufich Buick expressed
their concern and objection to flags and pennants being classified
as signs. This matter should be clarified in the revised ordinance.

WHEREAS, the Village of Mount Prospect, hereinafter
,referred to as "the Village, a municipal corporation organized
'under the laws of the State of Illinois and the Forest River
�Tire Protection District, 4e'rei,'nafter referred to as "the District,,"'
�a municipal corporation organized under the laws of the State of
Illinois, are municipal corporations organized under the laws of
:,�the State of Illinois and as such have the power under State law
to enter into agreements for providing fire protection- and
WHEREAS,.the Village is desirous of providing such
"services to the District,,
NOW.T.HEREFOILREr IT IS AGREED BY 'AND, BETWEEN THE VILLAGE
!` A.ND THE DISTRICT AS FOLLOWS;
1. That for the period beginning January 1, 1977 to
December 31, 1977, at 12:00 midnight said day, the Village

fshall furnish all fire fighting, fire protection., fire pre -

�v ration, and other emergency services including emergency
"ambulance service, by such volunteer or paid on call and/or
,regular firemen available to the Village as the Fire Chief of
the Village shall determine, to the District for a certain area

2. That for the period of time during which. this agree-
!'ment shall be in full force and effect., the District agrees to
'pay and the Village agree's, to accept as full payment for said
,,fire protection, fire prevention services, and emergency ser-

,vices that amount of moniesreceived from tax receipts collected
during the period beginning January 1, 1977, and ending
,.Decentber 31., 1977, ;less all costs of running the' said District
�jncluding but not limited to all administrative legal salaries
and other' expenses incurred.

taxes at the maximum rate*.authorized by statute without

rec'eive any available state arid/or federal aid to fire
protection districts as,, is now avallable or may be made

ever', shall be exclusive of the" amount of taxes levied
for payment of the. bonded indebtedness of the District

share I of such bonded. indebtedness of the District at the

for the purpose of amor-
tizing such bonds, until such time as sufficient funds to
retire such bonds h.ave been collected.

1977.
3. That the Fire Chief of the Village shall have the sole
and exclusive right, duty, and responsibility to prescribe the
manner and pethod of c",ving the alarm for fire and/or other
emergencies occurring within the District's territory as out-
lined upon said Exhibit I.
4. That the Fire Chief of the Village or hi.s authorized
representative shall have 'the sole and exclusive authority and
responsibility to direct and control any and all fire fighting,
fire protection, fire prevention, and other 'emergency operation
.,,carried on at the scene of any alarm or emergency occurring

5. That all fire fighting, fire protection fire pre -

fire protection, fire Prevention, building construction as related
to fire safety, and other' emergency procedures.

6 That all expense and cost of maintaining equipment,
" apparatus, salaries, insurance premiums, and any and all other
,.items, of expense connected with the several services contem-
plated herein to be supplied by the Village to the District
"shall be borne by the Village.' The only expense falling upon
,the District shall be in the'form of the payments scheduled
,,,,to be made hereinabove under Paragraph 2b.

That, within seven (7) days of receipt of notice of
annexation by any municipality of land and territory within
its district (as sho'wn in orange upon the i aid Exhibit I hereto),
"the District shall forward a copy of said notice with the legal
description contained therein) to the Village by addressing

ARTICLES OF AGREEMENT
ARTICLES OF AGREEMENT made end entered into this Tenth
day of November, 1976 by and between the MOUNT PROSPECT RURAL
FIRE. PROTECTION DISTRICT, a municipal corporation, Wheeling Town-
ship, Cook County, Illinois, hereinafter referred to as the "First
Party", and the VILLAGE O.F.4 MOUNT PROSPECT, ILLINOIS, a municipal
corporation, Wheeling and Elk Grove Townships, Cook County, Illimp
nois, hereinafter referred to as the "Second Party".
'WHEREAS The First Party and the The Second Party are
munl-cilpal corporations organized under the, respective statutes in
such case made and provided; and
TWHEREAS the First Party is desirous of obtaining a contract
from the Second Party for the purposes of providing fiee protection,
,"ire fighting, fire prevention and emergency servl*c'es for that certain
territory outlined in red ink on Exhibit A attached hereto and by
reference made a part hereof, which area constitutes the entire area
within the corporate limits of the First Party, and which area con-
stitutes the entire and only area to be serviced by the Second Warty
for the First Party; and
WHEREAS the Second Party is willing to enter into a" contract

ARTICLE IV,** T7HhT the Fire Chief 'designated by said Second
Party shall i=tediately upon arriving at the scene of any alarm
or eme-rgency (or such other officers as may be designated by said
Second Party) have the sole and exclusive authority and responsi-

billity to direct and control any and fire -fighting, fire pre-
vention., fire protection and emergency operations carried on at
such scene or scenes, and further) that any officers and/or fire-
men appointed by the First Party shall be subject to the order
and direction of the Fire Chief designated by the Second Party
ARTICLE Voo THAT all fire -fighting, fire protection, fire pre-
vention and emergency procedures conducted under the provisions of
these Articles shall be under and in accordance with the r'ecrulations
and ordinances, if any, of the Second Party. First Party -agrees to
conform its Ordinance No. 48-21, "An Ordinance Adopting A Fire Preven'-
tion, and Building Code", to ordinances of Second Party relating to
fire fighting, fire protection, fire prevention, building construction as
related to fire safety, and other emergency procedures within thirty days,
of receipt of, certified copies of Second Party's related ordinances,
ARTICLE VlTHAT all expenses of maintaining equipment, ap-
paratus, s'alaries, insurance premiums, and any and all other items
of expenses connected with the several services to be supplied by
the Second Party to the First Party shall be supplied at the sole
expense of the Second Party and that the only expense falling upon
the First Party shall be the payment s scheduled to be made herein-
above in Article II.
ARTICLE VII: THAT the First Party shall within seven (7) days
of receipt of notice of proposed annexation by any municipality of
properties within its District forward a copy of said notice with
the legal description contained therein, to the Second Party by
addressing said copy of notice to the attention of the Village
Clerk, 112 East Northwest Highway, Mount Prospect, Illinois g Fail-
ure to forward any such notice of proposed annexation by the First
Party shall not be sufficient reason for Second Party to rescind
these Articles of Agreement,
