AN ORDINANCE AMENDING SECTION 23.103 OF THE MUNICIPAL CODE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That, pursuant to the authority vested in the President and Board of Trustees of the Village of Mount Prospect under Article VII of the 1970 Constitu- tion of the State of Illinois, Section 23.103 of Chapter 23 (Water & Sewer) of the Municipal Code of Mount Prospect of 1957, as amended, be and the same is hereby further amended in its entirety by eliminating the necessity of a user to make a cash deposit with the Village Treasurer for water service; so that hereafter the said Section 23.103 shall be and read as follows: SECTION 23.103., User. As utilized in this Chapter, "User"' is hereby defined as any of the following units to which water and sewer services are provided by the Village of Mount Prospect: A. Any single family residence; B. Any single living unit located in any multi -family building, whether such building is a duplex residence, a townhouse, an apartment build- ing, a condominium building, a cooperative building , or any other re - I s 'dential or combination use building; C. Any eleemonsynary institution; D. Each commercial use occupancy; and E. Each industrial use occupancy. 11 SECTION TWO: That the Village Treasurer be and he is hereby directed to refund any cash deposit for water service heretofore posted by any given user,, pursuant to the terms of the former Section 23.103 of the said Municipal Code, which refund shall be made to such user without interest. A. Such refund may, at the discretion of the Village Treasurer , be credited to the current account of any such user; or refunded by warrant drawn upon the Waterworks and Sewerage Fund of the Village of Mount Prospect. B. Such refunds shall be accomplished during the regular course of business within the procedures determined by the Finance Director of the Village of Mount Prospect. SECTION THREE: That this Ordinance shall be in full force and effect from 12: 01 o'clock a.m. , April 1, 1977, and from and after its passage, approval, and publication in the manner provided by law. ORDINANCE NO. 1977 R.EGULA.R, ELECTION ORDINANCE FOR, THE VILLAGE OF MOUNT PROSPECT COUNTY OF COOK, STATE OF ILLINOIS BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That there shall be held a regular municipal election of officers for the Village of Alount Prospect on the 19th day of April, 1977. SECTION TWO: That at such election there shall be elected the following One (1) Village President - Four year term One (1) Village Clerk - Four year term Three (3) Village Trustees - Four year term. SECTION SIX: That the electronic ballots land separate write-in ballots to be used at election shall be in the form prescribed by statute and it shall be the duty of the Village Clerk to see to the preparation of the official ballots for the election, and to cause a sample of each such ballot to be published at least five (5) days prior to the day of election in two (2) newspapers of general circulation published in the Vil- lage, and to provide the necessary election supplies for each voting district or pre- cinct, which supplies shall include two (2) ballot boxes (one (1) for electronic ballots and one (1) for write-in ballots). SECTION SEVEN: That said election and all matters pertaining thereto shall be conducted in the manner prescribed by statute for the conduct of a regular municipal election for Village officers. State of Illinois, Department of Insurance Report of Examination— Mount Prospect Police Pension Fund As of April 3("), 1.976: According to this report, our Police Pension Board of Trustess has operat.ed the fund within the guidelines with minor exceptions such as: proof of age and proof of physical fitness is absent on some members; written application forparticipation in the X fund is needed from two officers; and two members are not current on salary deductions. All of theseems have now been taken care of by the Board which is made up of: Earl Meese and Doug Winkelmann, appointed,, Jim Lange, Fred Hedlund and Ambrose Kranz, elected. Dick Jesse serves as treasurer. Tax 'levies made during the ensuing fiscal year should be sufficient to assure that the fund will receive net income in the amount of $206,807. from the municipality. The Committee voted 3-0 to recommend Board acceptance of this, report. Mr. Mul dovine y explained the fact that taking those units -'into consideration would reflect no substantial increase in the quarterly rate. Mayor Krause requested Mr. Muldowney to submit a report -,d et in time for the July 5th "Village Boai meing reflecting 7,500 gallon per quarter minii-num, also a report reflecting the effect of no minimurri charge. ANNOUNCEMENT Mayor Krause announced there yowl d be a .meco of the Whole meeting June 30th, at 8:00 P.M. for the purpose of discussing construct -Ion problems involved with the D deep tunnel project. Self -Service Gas Stations: The Committee reviewed a memorandum pertaining to self-service gas stations from Buell Dutton, Director of Building & Zoning. Mr. Dutton is apparently somewhat skeptical of the advantages of these self-service stations and expressed his concern over possible disadvantages of same. However, Trustee Richardson stated that the self-service stations are now operating in more than 45 states, and during the past 6 years there have been no major problems, to the best of his knowledge. After fully discussing the matter, the Committee agreed unanimously to request the Village Attorney to draft an ordinance permitting the operation of self-service stations within our Village limits. The following items charged to our Committee, as listed below: (a) Amendment to trash container ordinance - request of Mr. Bart Keljik-, (b) Rob Roy Golf Course - leave as open space; (c) Scavenger service contract; were briefly discussed, but no action was taken, pending further review.
