J. Wattenberg, Chairman, Judiciary Committee SUBJECT,: Judiciary Committee Meeting 8-9-76 DATE: August 10, 1976 Present: Chairman Wattenberg; Trustee L. Floros; Richard Georgen; I r .0 Attorney Gordon; Wilton Battles and James Herbst, representing the Pillsbury Company. ,poppin' Fresh Restaurant, - Rand Road (Pillsbury Company),: The owner of the property located at 306 West Rand Road, opposite the Cadillac agency, and adjacent to Wedgewood Terrace, filed suit after the Zoning Board of Appeals and the Village Board denied the construction of a sit-down restaurant. The reason for the previous denial of the rezoning was the sub- stantial investment in connection with special assessments by the residents of Wedgewood Terrace. On behalf of the owner, Richard Georgen, who owns the lot involved, Attorney Gordon informed the Committee that, in his opinion, the erection of a restaurant would constitute the highest and best use for the property, that it should be commercial, rather than residential. The two homes now on the property are in need of repair, leased on a monthly basis; there are also two vacant lots on the property involved. The restaurant would be a family -type restaurant, for sit - r e, would provide 80 parking stalls, with hours from 11 to 11. No liquor would be served. The fact was further reiterated by the attorney that we have the Cadillac agency as well as the shopping center nearby, and there has been no single-famil'y construction on Rand Road, is involves high traffic, and, further, that the Pillsbury Company intend -s to have a larger setback than, for eke ample,the Cadillac agency acro ' ss the street. They will also provide landscaping as well as bike paths. We would appreciate Mr. Zimmermann's recommendations in connection with this lawsuit, and the plaintiff and his attorney decided to present his case again to the full Board at our next regular Village Board meeting. Trustee Rhea clarified the matter by stating the minimum fee was established to allow the administration to cover the costs of processing the billing procedure. George Flathery, 319 S.George commented to the Board abouthaving the Mayor, Village Manager and Village Attorney on vacation simultaneously. Trustee Rhea assured Mr. Flathery all matters were being disposed of properly through the Assistant Village Manager's Office. MANAGER'S REPORT The Assistant Village Manager requested the Board authorize the Deputy Clerk 1 - to purchase up to 50 voting machines at the cost of $25.00 each--. Trustee Wattenberg, seconded by Trustee Floros, moved to authorize the Deputy Clerk to purchase up to 50 voting machines. Upon roll call.- Ayes: Floros Hendricks Rhea Wattenberg Motion carried. The PGsistant Manager, then, reported enforcement has begun on the lawn sprinkling ordinance. Thus far, one citation has been written. Lastly, the Assistant Manager stated the Village's Community Band has completed it's summer schedule. It was a large success and will continue next year. MAYOR'S REPORT Chairman Rhea read the Resolution of appreciation of service by Mayor Behrel of Des Plaines, Illinois. Trustee Floros, seconded by Trustee Wattenberg, moved for approval of Resolution A RESOLUTION OF RESPECT UPON THE RETIREMENT OF HONORABLE HERBERT H. BEHREL, MAYOR OF THE CITY OF DES PLAINES, COOK COUNTY, ILLINOIS Upon roll call.- Ayes.- Floros Hendricks Rhea Wattenberg Motion carried. After some discussion Trustee Hendricks, seconded by Trustee Wattenberg, moved to continue discussion and action to the regular Board meeting of August 171, 1976. Reew Mayor's memo on Unity Savings & Loan at Old Orchard. Upon roll call: Ayes: Floros Hendricks Rhea Wattenberg Motion carried. Trustee Floros, seconded by Trustee Hendricks, moved for approval of Resolut- ion #24-76: A RESOLUTION IN SUPPORT OF PLANNED MUTUAL AID ON PUBLIC WORKS Upon roll call.- Ayes: Floros Hendricks Rhea Wattenberg Motion carried COMMITTEE CHAIRMAN REPORTS BUILDING COMMITTEE In lieu of the absence of chairman Minton items on the agenda were passed over to a future date. FINANCE COMMITTEE Trustee F1 reported on Red Lobster Inns of America request for a liquor license for an establishment to be constructed on Elmhurst Road, just North of the Colony Apartments. Ri behalf of his company mentioning the company would apply for a Special Use permit so as not to be in conflict with the zoning requirements of the site. Trustee Floros, seconded by Trustee Hendricks, moved for the approval of the creation of a class B liquor license. Upon roll call: Ayes: Floros Hendricks Rhea Wattenberg Motion carried. Next, Trustee Floros reported on a liquor license request from the Score- board Lounge, 421 Euclid. Robert Moore, 315 N. Wheeling, spoke on behalf of the Lounge. He asked the board to defer action on thi's case until the zoning difficulties can be straightened out. Moore reminded the Board this case would shortly go before the Zoning Board of Appeals for a definite ruling. Jim Jacobs, Chairman of the Prospect Christian Church, and Clarence Dyer, 603 Greenwood, spoke against granting the Liquor license to the lounge due to its close proximity to the Church. Trustee Rhea asked the Clerk to advise the Church when this case would go before the Zoning Board of Appeals. With there being no motion on the floor on this case, the Board deferred action until a later date. OTHER BUSINESS Trustee Wattenberg, seconded by Trustee Floros, moved for approval of Keljik's Subdivision. Upon roll call-, Ayes.- Floros Hendricks Rhea Wattenberg Motion carried. There was no motion for reconsideration of cases 5-V-76 and 25-V-76. Trustee Floros, seconded by Trustee Hendricks, moved to waive the rules requiring a second reading of ordinance #2649.
