RISK MANAGEMENT STUDY PROPOSED BY'THR DUPAGE MAYORS AND MANAGERS
CONFERENCE AND THE NORTHWEST MUNICIPAL CONFERENCE,
WHEREAS, the Village of Mount Prospect has experienced considerable
duress, due to insurance rate increases and market instability; and
WHEREAS, such inadequacies have been detrimental to sound municipal
insurance and fiscal management; and
WHEREAS, market confusion with respect to municipal insurance seems
likely for the foreseeable future; and
WHEREAS, the proposed joint municipal risk management 'study of the
DuPage Mayors and ManagersConference and the Northwest municipal

Conference offers potential for alleviating some of the problems
municipalities face in the insurance market; and
WHEREAS, the Village of Mount Prospect views the proposed study as a
reasonable and worthwhile endeavor for individual and group benefit
with respect to municipal insurance; '
NOW, THEREFQREr BE IT RESOLVED by the Mayor and Board of Trustees
of the Village of Mount Prospectr Cook County, Illinois:
,SECTION ONE: That the Village of Mount Prospect expresses its good
intent ntent, to become an active participant in the study contingent upon
final Board review of the Policy Conmittee,proposal'.
SECTION TWO: That the Village of Mount Prospect agrees to the
basIc tenets of partic�pation in Phase I as described below:
1. One (1) study to be conducted for all participating
municipalities;
2. Funding for the study to�be based partly on 4 flat fee
(75% of total 'study cost) and partly on other 'c
Qnsiqerations
municipal budget, population, etc. (25% of total study cost);
the latter as determined by the Policy Committee;
3. Each municipality to be allowed one (1) vote at all dis-
cretionary levels of action with respect to the study,,
SECTION THREE: That the Village of Mount Prospect staff be
authorized to participate in formulation of the final proposal for
study to be submitted to the Board.
SECTION FOUR: That this Resolution shall be in full force and
effect from and after its passage, approval and publication as
prescribed by law.

AN ORDINANCE GRANTING A FRONT YARD VARIATION
TO PROPERTY LOCATED AT THE NORTHEAST CORNER
OF CENTRAL ROAD AND PINE STREET
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet
on the 27th day of May, 1976, at the hour of 8: 00'p.m. , at the Public Safety
Building and did hear Case No. ?3-V-76, pursuant to proper leg'al notice; and
WHEREAS . the Zoning Board of Appe4ls of the Village of Mount Prospect did hear
this request to allow the petitioner a variation from the setback requirements of
the Zoning Ordinance of the Village of Mount Prospect as set forth in Section 14.1102 A.
thereof.
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recommerr—i
to the Building Committee of the Board of Trustees of the Village of Mount Prospect
the approval of this request under Case No. 23-V-76; and
WHEREAS, the Building Committee of the Board of Trustees of the Village of Mou i
Prospect did conduct a public hearing on July 8, 1976, and did review the recom
mendations of the Zoning Board of Appeals in Case No. 23-V-76; and I
WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount
Prospect have recommended that the Board of Trustees of the Village of Mount
Prospect concur in the recommendations of the Zoning Board of Appeals under said
Case No. 23-V-76; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have
reviewed the matter herein and have determined that the same is in the best interests
of the Village of Mount Prospect;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT. COOK COUNTY, ILLINOIS:
SECTION ONE: That the property being the subject matter of Case No. 23-V-76,

WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet
on the 10th day of June, 1976, at the hour of 8: 00 p . m . , at the Public Safety
Building and did hear Case No. 28-V-76, pursuant to proper legal notice; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hear
this request to allow the petitioner a variation from the requirement for separate
rest room facilities in a restaurant and to allow a drive-in restaurant on a tract of

BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE
OF MOUNT PROSPECT. COOK COUNTY, ILLINOIS:
SECTION ONE: That, pursuant to the authority vested in the President and Board
of Trustees of the Village of Mount Prospect under Article VII of the 1970 Constitu-
tion of the State of Illinois, Chapter 8 of the Municipal Code of Mount Prospect of
1957, as amended, be and the same is hereby further amended by amending Sec-
tion 8.115 in its entirety and by adding Section 8.116 and Section 8.117 thereto. -
so that hereafter the said Section 8.115, Section 8.116, and Section 8.117 shall
be and read as follows:
SECTION 8.115. Conflict of Interest
A. Declaration of Polin. The proper operation of government requires
that all officials, elected, appointed, and salaried employees, heremiaf-
ter referred to as Village officials, be independent and impartial; that
government decisions and policy be made and carried out in the proper
channels of the government structure; that public office not be used for
personal gain; and that the public have confidence in the integrity of its
government. The attainment of one or more of these ends is impaired
whenever there exists, or appears to exist, an actual or potention con-
flict between the private interests of a government official and his duties
as an official. The public interest requires, therefore, that the law pro-
tect against such conflicts of interest and establish appropriate ethical
standards with respect to conduct in situations where actual or poten-
tial conflicts exist.
1. Public officials are agents of public purpose and hold office for the
benefit of the public --'they are bound to uphold the Constitution of
the United States and the Constitution of the State of Illinois and to
carry out impartially the laws of the Nation, State and Village, thus
fostering respect for all government. They are bound to observe in
their official acts the highest standards of morality and to discharge
faithfully the duties of their office regardless of personal considera-
tions, recognizing that the public interest must be their primary
concern. Their conduct in both their official and private affairs
should be above reproach.
2. All officials of the Village of Mount Prospect shall be loyal to the ob-
jectives expressed by the electorate and the programs developed to
attain those objectives. Officials shall adhere to the rules of work
and performance established as the standard for their positions by
the appropriate authority. Officials shall not exceed their authority
or breach the law or ask others to do so and they shall work in full
cooperation with other public officials and employees unless prohi-
bited from so doing by law, or by officially recognized confidentia-
lity of their work.
B. Nonpartisan Organization. No public official shall use the prestige of
his position in behalf of any political party.

13. Official Activity. No public official shall engage in any activity or may
be in any manner interested, either directly or indirectly, in his name
or in the name of any other person, association, trust. or corporation,
in any contract or the performance of any work for the making or letting
of which such official may be called upon to act or vote.

any person, association, trust, or corporation, with respect to any
application or bid for any contract or work in regard to which such
official may be called upon to vote.

forms provided by the Village Clerk and shall be filed pursuant to
the following schedule:

form prepared by the Village Clerk, identifying the examiner
by name, occupation, address, and telephone number, listing
the date of examination and reason for such examination.
b. The Village Clerk shall promptly notify each person required to
file a Disclosure Statement under this Section of each instance
of an examination of his Disclosure Statement by sending him a
duplicate original of the identification form filled out by the per-
son examining his Disclosure Statement.
G. Cam 2aign Contributions. Campaign contributions shall be reported by
all candidates for elected Village office in strict conformity with the pro-
visions of the Illinois State Statutes.
SECTION 8.116. Rules and Definitions.
A. The language set forth in the text of Section 8.115 shall be interpreted
in accordance with the following rules of construction:
1, The singular number includes the plural number, and the plural
the singular.
2. The word "shall" is mandatory-, the word "may" is permissive.
3. The masculine gender includes the feminine and neuter.
B., Whenever in Section 8.115 the following words and phrases have been
used, they shall, for the purposes of said Section 8.115 , have the mean-
ings respectively ascribed to them in this Section, except when the con-
text otherwise indicates.
1. Business Entij. Any organization or enterprise operated for pro-
fit, including but not limited to a proprietorship , partnership, firm,
business trust., joint venture, syndicate, corporation, or associa-
tion, that sells material and/or services to the Village of Mount
Prospect.
2. Gift. Any property . real or person , tangible or intangible , of a
market value in excess of Fifty Dollars ($50) obtained by an indivi-
dual without the payment of the property's full market value. Gifts
from an individual's spouse, child, parent, grandparent, grand-
child, brother, sister, parent -in-law, brother -mi -law , sister-in-
law, aunt, uncle, or first cousin, or the spouse of any such person,

or gifts to a church, religious, or charitable organization qualified
as such under the provisions of the Internal Revenue Code shall not
be consideredifts for the purposes of this definition. Gifts of in-

formational material such as books, pamphlets , reports , calendars ,
'or periodicals shall not be considered gifts for the purposes of this
definition.
3. Immediate FaMiL. An individual's spouse, dependent children, or
others claimed by such individual as dependents for Federal income
tM x purposes .
4. Interest in Real Pr2per includes, but is not limited to the follow-
ing: Legal or equitable title-, a beneficial interest in any trust (in-
cluding a land trust); any assignment of any interest from a benefi-
ciary or any other party of an interest; a power to direct convey-
ance; a right to receive rents or proceeds from property; the obli-
gation to pay rent; a lien; a tax sale certificate; an option; or any
other financial interest, real or personal, direct or indirect, in
such property including status as a nominee or undisclosed princi-
pal.
5. E2yment. Payment , distribution , transfer , loan , advance, deposit,
gift, or other rendering of money, property, services, or anything
else of value, whether tangible or intangible.
6. Person. An individual, proprietorship, firm , partnership , joint
venture, syndicate , business trust, company.. corporation, asso-
ciation, committee, and any other organization or group of persons
acting in concert.
7. Public Official. Any person who seeks to be elected or is elected to
any public office in the Village of Mount Prospect government, or is
appointed as a member of any board, committee, commission, sub-
committee, or as Manager or head of any department of the Village
of Mount Prospect. 1
8. Purchase Transaction. A purchase, or a contract to purchase
goods or services of any kind.

ship, joint venture, sole proprietor, or other business entity which
enters into a "purchase transaction" with the Village of Mount Pros-
pect.

SECTION 8.117. Penaly. Any person, firm, or corporation violating the
provisions of Section 8.115 and/or Section 8.116 shall be guilty of a misde-
meanor and shall be fined not to exceed Five Hundred Dollars ($500), and/or
removal from office. Each day that a violation is permitted to exist shall con-
stitute a separate offense. 11

AN ORDINANCE AMENDING SECTION 23 � 110 AND
SECTION 23 � 111 OF TIE MUNICIPAL CODE
WHEREAS, all of the citizens of the Village of Mount Prospect utilize potable water
provided from ells located within the corporate limits of the Village Of MOU
Prop or its immediate -vicinity; and
WHEREAS, the artesian. level. of the aforesaid wells has dropped and continues to
drop, thereby diminishing the yield of water from the said wells; and
WHEREAS, the corporate authorities of the Village of Mount Prospect have caused
studies to be made and have made a determination that the diminishing water supply
to the citizenry of the Village of Mount Prospect has reached a critical phase,
potentially hazardous to the health and safety of the residents of the Village of
Mount Prospect; and
WHEREASY the President and Board of Trustees of the Village of Mount Prospect
believe that it is in the best-, interests of the Village of Mount Prospect to impose
certain restrictions upon, the use of the potable water supply found within the
corporate limits of the 'Vill age of Mount Prospect and its environs;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:

B. It shall be unlawful for anv person, firm, or corporation to use or any
owner to allow the use of any water, whether drawn directly or in --
directly from public wells and/or public water supply distributioi-.1 sys-
tems for the purpose of watering and/or sprinkling lawns and/or gar-
de -ns or for the purpose of filling and/or reffillincy swi mr-ming pools--

receipt for the money so received and promptly remit said amount to
the Village Treasurer to be credited to the proper municipal fund.
3. In the event that the person to wh-om said CITATION is issued fails
to settle arid pay said violation claim, within the prescribed, time, or
within a period of time specified in a Final Notice (if one is served,
upon him) then such designated official is authorized to cause a
Notice to Appear to be served upon said. alleged violator and is
authorized. to file a Complaint and to prosecute the same in the
Circuit Court of Cook County,
4. The fact that the water meter through which the water flows is "reg ..
Este with the Village Treasurer -Collector in the name of said
alleged violator for billing purposes, shall, be considered L)jLima
facle that said alleged violator allowed the use of such. at at the
time of such alleged violation.
5. The violation claim described in said. CITATION so tobe isstied
pursuant to the terms of this �Section may be settled, compromised
and paid in the respective amo-ants set forth in the following
schedule:

through a system of pipes and attached garden hopes or nozzles
used for watering 4 lawn, garden, greenhouse, golf course, or
any vegetation .
G. If any part or parts of this Section shall be held to be unconstitutional,,
such unconstitutionality shall not affect the validity of the remaining
parts of this Section. The Board of '
f Trustees hereby declares that it
would have passed the remaining parts of this Section if it had known
that such part or parts thereof would be declared unconstitutional.
SECTION 23.111. Penalt Notwithstanding the provisions of
Section 23.110 of this Article, whenever a Police Officer arrests a person
because of a violation of Section 23.110 of this Article, every person, firm,
or corporation convicted of a misdemeanor for a violation of any of the
provisions of this Article shall for first conviction thereof be punished by a
fine of not less than Twenty-five Dollars ($25) nor more than Five Hundred
Dollars ($500).
SECTION TWO: That the Village Clerk be and is hereby directed to publish the
foregroing Ordinance in pamphlet form, pursuant to the statutes of the State of
Illinois made and provided.
SECTION THREE: That this Ordinance shall be in full force and effect as of
12: 01 p'clock a.m. August 1, 1976, and after its passage, approval, and
publication in the manner provided by law'.

Anthony Brown of the N.W. Suburban Center for Transcendental
Meditation spoke on "The Ideal Society." He felt through T.M.
dne could better cope with life's problems, thus enabling one
to contribute more to society. Society, in turn, will receive
the maxi mum benef i t f rom the. 1 ndi vi dual .
Mr. Brown asked the Board for some official action of endorsement.
Mayor Teichert explained a proclamation would be presented at the
next Board Meeting endorsing T.M. and its goals.

Teichert to write a letter to Bob Vehe, Jr. of Mount Prospect

The Village Manager reported the response from the newsletter

Construction has been started on the sidewalk repair,, program. It
does not teem possible for the`s" Curve improvementto be completed by
November.
The Village Manager recommended the Board award the tree mainten.-t
ance contract to the low bidder, A. J. Davis Company.

Trustee Floros read his committee report on the Real Estate Transfer
Tax. No action was taken.

Trustee Floros read his committee report on the Mount Prospect
Library. He asked Mr. Eppley if the Village's Public Works
Dept. was helping in the landscaping contract. Mr. Eppley re-
sponded by-saying that as tivne permitted,all Village Depts. were
cooperating with the library.
Trustee Floros questioned the way administrative salaries are
determined. He suggested the Village Manager present recom-
mendations to the Village Bolard for each Dept. head. After
considerable discussion, it was f6lt the Board was not in a pos•i-
tion to review individual Dept. heads salaries since it would in-
volve appraising their day to day job functions and this is a
direct responsibility'of the Village Manager.
Trustee Floros then withdrew the matter for the time be•ing.
FIRE AND POLICE COMMITTEE
Trustee Richardson read his committee report. There was con-
siderable discussion on the traffic problem at John Jay School.
Throuhgout the discussion, it was felt School Board
District 59 would not be able to fund the necessary $19,800 to
complete- a proposed horseshoe drive to eliminate the congestion.
Mr. Bernard Scola, Secretary of the Safety Commission, 1823 Palm Dr. spoke on this matter.
He thought after attending District 59 meetings on the subject, the
School Board was agreeable to crossing guards to be funded by
the Village of Mt. Prospect.
Mayor Teichert finally suggested aspecial Village sub -committee meet with
the School Board in the hope of resolving this problem. Mayor
Teichert -will contact the School Board by letter expressingthis wish.

restricting enforcement powers of the Police Dept. He
informed Mr. Rogers the Village would look again into the problem
from a traffic engineering point of view with costs to be borne
at the complex's expense'.

purchase Civil Riqhts Tnsurance for all employees & elected

Trustee Rhea gave a report on Huntington Commons Condominiums
water rate schedule.
Trustee Rhea introduced a lawn sprinkling ordinance. Discussion
on the enforcement provisions followed. After a thorough discussion
the Village Attorney was instructed to add the words "Public
Utility Wells" in Section 23.110, B.,, line 2. Enforcement in full
would commence August 1, 1976. Prior to that date the Village,
through various methods, will notify the residents of the ordinance.
Trustee Rhea, seconded by Trustee Minton, moved for the first
reading of an ordinance amending Section 23.110 and Section 23.111 to
the Municipal Code - Lawn Sprinkling.
