CRITERIA FOR EVALUATING THE VILLAGE MANAGER 3-2-76
ORDINANCE NO.
AN ORDINANCE ANNEXING THE NORTH HALF OF
EUCLID AVENUE ADJACENT TO THE RANDHURST
SHOPPING CENTER
WHEREAS, the land hereinafter described is contiguous to the Village of Mount
Prospect and is dedicated for street purposes under the jurisdiction of the Wheel-
ing Township Highway Department; and
WHEREAS , the said territory is not presently within the boundaries of any munici-
pality; and
WHEREAS, Section 7-1-10 of Chapter 24 of the Illinois Revised Statutes provide for
the annexation of such territory by the Village of Mount Prospect upon passage of
an ordinance pursuant thereto; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
find and believe it to be in the best interests of the Village of Mount Prospect that
said land and territory be annexed to the Village of Mount Prospect;
NOW., THEREFORE,, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT . COOK COUNTY , ILLINOIS:
SECTION ONE: That all of the land and territory legally described as follows , to -wit:
All that part of the North Half (1) of Euclid Avenue lying East of
the West line of the Northeast Quarter (.41) and East of'the West line
of the Southeast Quarter of Section 27, Township 42 North , Range
11, East of the Third Principal Meridian and lying West of the West
line, extended North of Brickman Manor First Addition,, Unit No. 6,,
being a Subdivision of part of the East Half (12
) of the Southeast Quar-
ter ('4) of Section 27, Township 42 North, Range 11, East of the Third
Principal Meridian, in Cook County, Illinois
no part of which territory is presently within the corporate limits or boundaries of
any municipality, but lies in the unincorporated territory of Cook County; and which
territory is dedicated for street purposes and which territory is contiguous to the
present corporate limits of the Village of Mount Prospect; be an ' d the same is hereby
annexed to the Village of Mount Prospect, so that hereafter said territory shall be in-
cluded within the boundary lines and limits of the Village of Mount Prospect as in such
case is by law made and provided.
SECTION TWO: That Map 37-N contained in SECTION ONE of Ordinance No. 2410
passed and approved March 20, 1973 , be amended to reflect the extension of the
corporate limits of the Village of Mount Prospect to include the territory herein-
above described and hereby annexed.

EUCLID AVENUE AND THE NORTH LINE OF
KENSINGTON ROAD TO THE VILLAGE OF MOUNT PROSPECT
WHEREAS, the land hereinafter described is contiguous to the Village of Mount Prospect
and is dedicated for street purposes Under the jurisdiction of the Wheeling Township
Highway Department; and
WHEREAS , the said territory is not presently within the boundaries of any municipality;
and
WHEREAS, Section 7-1-10 of Chapter 24 of the Illinois Revised Statutes provide for

of the North line of Kensington Road and South of the South line of
Euclid Avenue as laid out in Brickman Manor First Addition Unit
Number One, being a Subdivision of part of the East Half (1) of the
Southeast Quarter (') of Section 27,, and part of the West Half of

WHEREAS.. the land hereinafter described is both contiguous to the Village of Mount
Prospect and wholly bounded on all sides by the Village of Mount Prospect and the
City of Prospect Heights; and
WHEREAS,, the said territory is not presently within the boundaries of any munici-
p ality; and
WHEREAS, the said property comprises less than sixty (60) acres; and
WHEREAS, the Illinois Revised Statutes,, Chapter 24, Section 7-1-13 provides for
the annexation of such territory by the Village upon passage of an Ordinance pur-
suant thereto; and
WHEREAS, the President and Board of Trustees of the Village of Yount Prospect,
Cook County, Illinois, find and believe it to be in the best interests of the Village
of Mount Prospect that said land and territory be annexed thereto;
NOW v THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES

Kensington Road and West of the West line of Wheeling Road as

lage of Mount Prospect -- as is by law in such case made and provided.

WHEREAS . the said territory is not presently within the boundaries of any munici-
pality; and
WHEREAS, the said property comprises less than sixty (60) acres; and

Liquor License Request - Class E.
Robert J. Gredei, 1912 Kiowa Lane, Mt. Prospect and his associate,
Gil Cervelli, presented a case for a Class E license for use at
the property formerly known as Alexander's Restaurant, 1803
Algonquin Road. The Class E license is specially intended for
the catering business. Messrs. Gredei and Cervelli plan to operate
a banquet hall for private parties and weddings. The 7000 sq. ft.
facility will accommodate about 300 persons. Parking for 130
autos is available. The Committee, by a 3-0 vote, recommends
creation of a Class E license for a banquet hall at 1803 Algonquin Rd.

Affairs Committee, Northwest Suburban Board of Realtors, read from
a letter to the Finance Committee, outlining the group's opposition
to the proposed real estate transfer tax. (Copy of the letter is
attached.) There was considerable discussion, but no action was
taken on the proposed tax. The Chairman of the Finance Committee
said he would ask additional information from the administration on
how and if such a tax could be,collected.

John Parsons, President of the Mount Prospect Library Board, outlined
the financial position of the Library. He and other members of the
Library Board pointed out that the Library would have difficulty
moving into the new facility with the monies allocated by the
Village Board in the current budget. The Chairman of the Finance
Committee suggested that the Village Board consider the possibility
of dissolving the Library Board through referendum, and operate the
Library by means of an appointed commission. No action was taken.
No proposals were offered or presented by the Library Board members.

Insofar as I may have the power to veto ordinances and
resolutions, I am hereby exercising that power as to
Resolution No. 15-76, IVA Resolution Adopting the Annual Budget,
1976--77" , and advising the Village Board of my reasons therefor.
The annual budget is a ponderous and complex document in which
each of us find items on which we disagree. In this respect, in
order for us to meet statutory requirements and, indeed, so that
the Village government may continue to operate, it is necessary
to vote for the passage of various ordinances and resolutions,
even though they may not reflect what we may individually think
is proper and, in some cases.,, include things we disagree with.
While this is true of the proposed budget (at least from my point
of view) , it has an added infirmity that I cannot in ,good
conscience accept as being proper or beneficial for the community,
to wit: the appropriation of $357,100 for library operating
expenses.
Apart from anyones personal belief as to whether there should or
should not be a library in this community,or whether there should
or should not be an expanded facility for library use, it is a
fact that there is a Mount Prospect Public Library functioning
within our community and there is also a $3,500,000 edifice under
construction that is intended to provide expanded facilities for
that library. Again, apart from personal considerations, the
Mount Prospect Public Library was created and does operate in a
legal manner and the proposed new quarters now being constructed
was undertaken in a proper and legal manner. If I am correct in
my statements of facts and my statements of proms and If
a 1, actions ,
then it would appear that the Village Board has an obligation to
provide adequate .funding so that theLibrary Board can, in fact,
utilize the proposed expanded facilities.
The arbitrary restrictions on the library operating fund (by
forfeiting that amount of revenue which would otherwise be
produced) by conforming to the existing levy rate is unreasonable
in that it does not attempt to relate the dollars appropriated to
any determination of dollars needed to operate the new facility.

I find it difficult to believe that anyone can honestly expect
any entity to operate a facility three times as large as an
existing facility at virtually no increased cost. It is a matter
of record that every expansion of a facility for Village government
is accompanied with an increase of expenses for the operation of
the expanded facility. If the proposed restrictions of expanded
costs is proper for the library, it should be equally true for the
Village government and the budget should therefore be amended to
strike out all additional costs occasioned by our own expansion.

It is also my belief that the arbitrary fixing of the library
budget at the existing levy rate is itself a contradiction of our
obligation to review, and comment on the unreasonableness of the
proposed library budget. Apart from expressed disagreements to
certain items proposed by the library in, its proposed budget figure
of $357,100., that figure does not in any, way reflect a, total which
is the result of cutting specific items from the budget. I note
that this principle, i.e. a fixed limit, was not applied to any
other area of the budget except the library ... in fact, such a
principle was expressly rejected by the majority of the Board
members predicated in the theory that fixing arbitrary limitations
bore no relationship to the actual expenses needed for .defined
services.
Any disagreement that Board members may .have as to whether there
should be a library or whether that library should have expanded
facilities is no longer an issue ... the only issue is how much
will it cost to operate the expanded facility. Inadequate funding
for the proper operation of this new facility would work in
opposition to the very existence of the facility. We cannot, as
prudent representatives of the people.,, take positive steps, to 'insure
the inefficient or inadequate operation of the library ... the
library deserves at least the same consideration this Board gave to
every other operating unit of Village government.
If I am to believe that education is a basic requisite for our
citizens (and I do)., and if I am to believe that the basic single
source of education is books (and I do)., then I must confirm those
beliefs in such actions as will properly underwrite the library
operation and contribute to its success. I stand prepared to join
with the Village Board in further discussions with the library to
compromise their budget request in a manner that ' will at least
recognize that their obligation to operate an expanded facility is
no less or more than our equal obligation to provide the funds
necessary for such operation. What that figure is I do not know,

but it most assuredly cannot be met by a figure of $357,100.
I am aware that the budget can be amended at any time, but I am
not confident,, in view of the Board's present posture, that any
amendment would be forthcoming merely by the passage of time.
Accordingly, at this point it must be brought to issue so that
the Library Board can act or re -act in formulating their plans
prior to the completion of the new facility. In this respect,
if the Board members are reluctant to disturb the projected cash
balance, then it would be appropriate to readjust our priorities.
I would be quite willing to eliminate quarterly newsletters,
fireworks displays, conference dinners., etc. in order to provide
adequate heat and electricity for the new library and I would be
willing to trim such projects as beautification, tree planting,
tree trimming, etc, in order to provide the library with sufficient
funds to at least maintain the level of service now being offered.
I note that this is the first time I have exercised veto power and
I also note that my action is symbolic, however, it is, I believe
a necessary step that I must take in order to assure myself and
the members of our community that this largest of our public
facilities is not doomed to failure by our unwillingness to provide
funds based on need rather than a technicality.
While I appreciate that my action places burden on the Village
Board,, since they must act before May lst, the burden would not
seem to be any greater than that which has been imposed upon the
Library Board. Also.., while I regret that I must be absent from
the Village next week on business for my company, my presence is
not necessary since I cannot vote on the matter of overriding or
sustaining my veto. Insofar as any communication with me is
necessary, the Village and my business .office have my itinerary.

The comments of members of the Village Board in overriding my
veto of the budget at the Special Meeting of April 25th, made
reference to the absence of' mayoral comments in opposition to
the budget at the time ,it was, passed. In view of my public comments
previously made at many, meetings, both. at the Village Board and
Committee level, -1 -finds it difficult to believe that any Board
member was unaware of my feelings on the subject. However., to
--prevent any future misunderstanding o-n-thi-s-matt-er, I.am, submitting
this memo in writing.
In, my opinion,3t the continuing battle between the Village Board and
the Library Board is, divisive in character, --not only for the

the Library Board's actions appears designed to use them as a
whipping, boy'as, an outlet for the frustration. the Village Board has
in meeting its own r-esponsibilities. Certainly if --our financial
--difficulties . -can be placed -on the doorstep of thelit-rary, the
Village Board can avoid criticism of its own financial policies. The
continuing requests for "biting the bullet",� "tightening the belt"
coupled with -repeated requests -that the -library reduce its expenditures
has a tendency to put the spotlight on one isolated. portion of the
Village budget 0 0 . which in this case means taking the spotlight off
of the bulk of the Village budget. I believe it is time for the
Village Board to redirect its criticism at itself and begin doing
those things that 'have been making popular reading in the newspapers
for the past year 0as mainly, getting around to biting its own bullet
--and-tightening-its own belt.
Upon its formationq this Village -Board was warned that we had future
financial problems unless expenditures --
-mere --radically reduced or
-revenue increased. This warning has been, �repeated through the
administration as well, as, by individual Board members on a continuing
basis even, to the point of the administration recommending
drastic cuts in services I no pay raises, etc in order to have a
balanced budget.
A review of the record shows that collectively"(and almost

unanimously) the Board continued to vote for existing or increased

expenditures but without any concerted action -to increase revenue*
-Various proposals for increasing revenue by individual members barely
gained majority support and then only for bare minimums and under

critical, attack for being unresponsive to the community's wishes
or unduly burdensomes It is, my belief that a Village Board that
can act with such unaminjty in, spending money should be equal in
unami,nity to the responsibility' of raising the necessary funds to
offset their spending polices,
Because of higher revenue than originally es,timated,,,, contractual
obligations, less than, originally estimated, etc., it appears 'to me
that our pres.ent budget is very close to being balanced it
does,however, provide for any emergency contingency nor cash,
balancie for the following year* That is ba,sicallY the Same Situation
that existed a year ago and It was not attended to at that time
and from all -indications this Board has -no- inte-ntion of joining
tolgether to attend to it. In my judgment, it must be attended to 4000
and by unanimous or near unanimous action of the Village Board ...
and within the same guidelines we have directed at the Library Board.
In this respect, it is my intention to resist and vote against any
new forms of revenue production that constitutes a burden to the
taxpayers of Mount Prospect,*# specifically, at this time I will
oppose a direct garbage charge., Since the Board members must
garner 5 votes, in order to amend the budget., and, since amendments
are only permissible by providing the necessary funds, I believe
that the Board should now proceed on the theory that a minimum
of 5 votes will be necessary for any new revenue production
proposals - * . at least if such proposals are to have my support.
The popularity of spending money to provide the tremendous services
offered by the Village of Mount Prospect goes harid in hand with the
unpopularity of taxing the recipients to pay for those services.
In summary, if the - Board won't -jbin hands to produce revenue,, then
it must -join hands to cut expenses.
