AN ORDINANCE GRANTING A VARIATION FROM THE ZONING ORDINANCE WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet on the 26th day of February, 1976, at the hour of 8: 00 p.m. , in the Public Safety Build- ing , pursuant to proper legal notice; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect heard testi- mony presented under Case No. 20-V-75 pertaining to a request for a land use varia- tion to operate a medical and professional office building use of premises zoned within the R-3 (Apartment Residence) District; which premises is commonly known as 435 West Prospect Avenue,, Mount Prospect, Illinois; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recom- mend to the President and Board of Trustees the approval of this request under Case No. 20-V-75; and WHEREAS . the Building Committee of the Board of Trustees of the Village of Mount Prospect did meet on April 14, 1976, and did consider the recommendations of the Zoning Board of Appeals under Case No. 20-V-75; and WHEREAS, the Building Committee recomm-ended to the President and Board of Trustees of the Village of Mount Prospect to allow the variation as presented in said Case No. 20-V-75; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have reviewed the matter herein and have determined that the same is in the best interests of the Village of Mount Prospect. NOW . THEREFORE , BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT , COOK COUNTY 9 ILLINOIS: SECTION ONE.- That the property being the subject matter of Case No. 20-V-75, being legally described as follows: Lot 1 *in The Heck Resubdivision in Mount Prospect, being a resub- division of Lots 20 9 21, and 22 in H. Roy Berry Company's Subdivi- sion of part of the Northeast Quarter (1) of Section 11, and part of 4 the Northwest Quarter () of Section 12 2 all in Township 41 North 4 Range 11, East of the Third Principal Meridian, in Cook. County, Illi- nois, is currently zoned under the Zoning Ordinance of the Village of Mount Prospect as R-3 (Apartment Residence) District, which zoning classification shall remain sub- ject to the following granted variation: That any building erected thereon shall be used solely for dental office purposes or such other purpose as may be authorized as an allowable use under the R-3 (Apartment Residence) District, and that no other uses shall hereafter be allowed upon the subject pro- perty. Ara SECTION TWO: That the construction of any building shall conform to the applicable r reqinrements, of the Building Code of the Village of Mount Prospect for construction within the Conflagration Hazard District 1ST o. 1; and that in all other respects all other requirements of the Municipal Code of Mount Prospect shall be applicable to the subject property, except as altered herein and except for the variation specified in SECTION ONE hereinabove. AN ORDINANCE AMENDING ORDINANCE NO. 2572 WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did con- duct a public hearing on February 26, 1976, at the hour of 8: 00 p.m., in the Mount Prospect Public Safety 'Building, and did hear Case No. 8 -SU -76, pursuant to pro- per legal notice; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect heard testimony presented under Case No. 8 -SU -76 pertaining to a request to amend SECTION ONE to Ordinance No. 2572, which granted a special use for property commonly known as 606 West Northwest Highway, in order to allow the "Citgo Quik Mart facility" to be constructed upon the property which was the subject matter of said Case No. 8 -SU -76; and WHEREAS,, the Zoning Board of Appeals of the Village of Mount Prospect did recom- mend to the President and Board of Trustees of the Village of Mount Prospect the approval of this request under Case No. 8 -SU -76; and WHEREAS , the Building Committee of the Board of Trustees of the Village of Mount Prospect did meet on April 14, 1976, and did consider the recommendations of the Zoning Board of Appeals under said Case No. 8 -SU -76; and WHEREAS, the Building Committee has recommended that the President and Board of Trustees of the Village of Mount Prospect concur in the recommendations of the Zoning Board of Appeals to allow an amendment to SECTION ONE of Ordinance No. 2572; and WHEREAS., the President and Board of Trustees of the Village of Mount Prospect have reviewed the matter herein and have determined the same is in the best interests of the Village of Mount Prospect; NOW , THEREFORE , BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT. COOK COUNTY, ILLINOIS: SECTION ONE: That SECTION ONE of Ordinance No. 2572, passed and approved on July 15, 1975, be and the same is hereby amended in its entirety; so that here- after the said SECTION ONE of Ordinance No. 2572 shall be and read as follows: "SECTION ONE: That the special use authorized and granted in SEC- TION TWO hereinbelow is conditioned upon and shall be valid and ef- fective only so long as: A The existing gas station structure located upon the sub- ject property & the date hereof shall be razed and demo- lished by the owner; and further,, the owner shall replace the existing fence along Henry Street with a six foot (61) high stockade fence to run from a point eight feet (81) cast of the east line of Forest Avenue to a point sixteen feet (161) west of the west line of Fairview Avenue upon the subject property along and adjacent to the south line of Henry Street; . . . . . . . .......... . ..... _r.------__-- . ........... ...... B. The construction of any new buildings shall be in strict com- pliance with the site plans attached hereto and hereby made a part hereof as Exhibit I and II; C In constructing buildings pursuant to the aforesaid Exhibits I and H (Site Plans), the owner expends a minmilum of Four Thousand Dollars ($4,000.00) to landscape the subject pro- perty in a fashion approved by the Director of Public Works of the Village of Mount Prospect so that said landscaping shall act as a buffer to suitably screen the less desirable uses upon the subject property from adjoinir-g residential areas; D That no other uses or accessory uses other than those shown on the aforesaid Exhibit I and Il (Site Plans) shall be estab- lished; and E. A notation of these conditions in the form of restrictive cove- nants running with the land is recorded along with the Plat of Subdivision which shall consolidate the existing six (6) lots upon the subject property into one (1) lot of record -- which Plat of Subdivision shall be recorded by the owner pursuant to the approval of the corporate authorities of the Village of Mount Prospect prior to the effective date of this Ordinance. 11 SECTION TWO: That this Ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law. AN ORDINANCE ANNEXING THE WEST HALF OF WHEELING ROAD BETWEEN THE NORTH LINE OF EUCLID AVENUE AND THE NORTH LINE OF KENSINGTON ROAD TO THE VILLAGE OF MOUNT PROSPECT WHEREAS , the land hereinafter described is contiguous to the Village of Mount Prospect and is dedicated for street purposes under the jurisdiction of the Wheeling Township Highway Department; and WHEREAS, the said territory is not presently within the boundaries of any municipality; and WHEREAS, Section 7-1-10 of Chapter 24 of the Illinois Revised Statutes provide for the annexation of such territory by the Village of Mount Prospect upon passage of an ordinance pursuant thereto; and Ak WHEREAS, the President and Board of Trustees of the Village of Mount Prospect find and believe it to be in the best interests of the Village of Mount Prospect that said land and territory be annexed to the Village of Mount Prospect; NOW , THEREFORE , BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT. COOK COUNTY, ILLINOIS: SECTION ONE: That all of the land and territory legally described as follows, to -wit: That part of the East 50 feet of Section 27, Township 42 North, Range 11 East of the Third Principal Meridian, which lies South of the North line of Euclid Avenue and North of the South line of Euclid Avenue , together with All that part of the West Half () of Wheeling Road which lies North 2 of the North line of Kensington Road and South of the South line of Euclid Avenue as laid out in Brickman Manor First Addition Unit Number One, being a Subdivision of part of the East Half (jl) of the Southeast Quarter (4) of Section 27, and part of the West Half (1) of the West Half (1) of the Southwest Quarter (4) of Section 26, all in Township 42 North, Range 11 East of the Third Principal Meridian in Cook County, Illinois, no part of which territory is presently within the corporate limits or boundaries of any municipality, but lies in the unincorporated territory of Cook County; and which territory is dedicated for street purposes and which territory is contiguous to the pre- sent limits of the Village of Mount Prospect-, be and the same is hereby annexed to the Village of Mount Prospect, so that hereafter said territory shall be included within the boundary lines and limits of the Village of Mount Prospect as in such case is by law made and provided. 400000'_ SECTION TWO: That Map 25-N contained in SECTION ONE of Ordinance No. 2410, passed and approved March 20, 1973, be am -ended to reflect the extension of the corporate limits of the Village of Mount Prospect to include the territory hereinabove described and hereby annexed. SECTION THREE: That the Village Clerk of the Village of Mount Prospect is hereby directed to file M' the Office of the Recorder of Deeds of Cook County, Illinois , a cerd. fied copy of this Ordinance, together with an accurate map of the territory annexed,. Unit No. One, being a Subdivision of part of the East Half (1) of the Southeast Quarter 2 (41) of Section 27 and part of the West Half (1) of the West Half 2 2 of the Southwest Quarter () of Section 26, all in Townshi 42 4 ip North. Range 11 , East of the Third Principal Meridian, in Cook County, Illinois , which territory is not presently within the boundaries of any municipality but is in the unincorporated territory of Cook County. is contiguous to the Village of Mount Pros- pect, is wholly surrounded by both the Village •of Mount Prospect and the City of Prospect Heights , and comprises 41.480 acres'and is, therefore, less than sixty (60) acres in size; be and is hereby annexed to the Village of Mount Prospect so that here- after said territory shall be included within the boundary lines and limits of the lage of Mount Prospect as is by law in such case made and provided. SECTION TWO: That Map 25-N contained in SECTION ONE of Ordinance No. 2410, passed and approved March 20, 1973, be amended to reflect the extension of the corporate limits of the Village of Mount Prospect to include the property herein- above described and hereby annexed. N SECTION THREE: That the Village Clerk of the Village of AlLount Prospect is hereby directed to file in the Office of the Recorder, of Deeds of Cook County, Illinois , a cert.. fied copy of this Ordinance, together with an accurate map of the territory annexed.
