ROLL CALL Present upon roll call: Teichert Floros Hendricks Rhea Richardson Wattenberg Absent: Minton APPROVAL OF MINUTES OF APRIL 69 1976 Pg. 3,regarding property at the southwest corner of Central Road and Cathy Lane, the proposed development was for persons 55 years of age. Pg. 4 Ordinance #2617 deleted Danny's Barn and added Barone's and Alvees. Pg. 8: delete "Trustee Min- ton, seconded by Trustee Richardson, moved to reject the four bids for carpeting, shelving, furniture and millwork and re- turn the bid checks to the bidders." Pg. 9: Roll call on motion for Millwork should be: "Ayes: Minton Richardson Wattenberg Rhea Teichert. Nays: Floros Hendricks." Final page: Correct typo for Case 49-V-75. Upon roll call: Ayes: Floros Hendricks Rhea Richardson Wattenberg Motion carried. COMMUNICATIONS AND PETITIONS - CITIZENS TO BE HEARD Mr. George Anderson, 1005 W. Isabella, Mr. Dick Graham, 20 N. Prospect Avenue, and attorney Robert Bush appeared before the Board to further advise the Board on the pro- posed development of property at the southwest corner of Central Road and Cathy Lane, to be known as Central Village. Certain exhibits were displayed and an opinion submitted by Attorney Bush stated age restrictions may be placed on the land by a condominium declaration. After discussion, it was agreed a draft amendment to the Consent Decree for the former Klein property would be presented for review. Mr. John Parsons, President of the MoUnt Prospect �ibrary Board gave a status report on the construction of the new library as to the expending of funds. Mrs. Marie Caylor, e4 1308 Pima Lane, objected to the additional funds requested and felt the Library Board should consider its own library district and own taxing body and remove the responsibility from the Village Board. Mr. Rudolph Vergin5 19 N. Pine, requested the Board to have a referendum. MANAGER'S REPORT Public improvement plans for Colony Country II at Old Orchard, The Colony apartments Phase III and $akowicz First Addition were presented. Trustee Wattenbergs seconded by Trustee Hendricks, moved to approve the Sakowicz plans for public improvments at Mt -Prospect Road and Prospect Avenue as recommended by the Director of Engineering and approved by the Village Mani ager in April 15, 1976 memorandum. The Village Man,ag: ' er re '0 n.ow on the floor of the Nouse, which woul,d p,erman,ently extend unemployment benefits to all municipal employees., According to a bulletjn from the Illinois Municipal League, the Village Manager sug- gested action by the Board to request our Congressman to sponsor an amendment maintaining local government exclusion from the Federal Unemployment Compensation Tax. The Village Manager was requested to supply the Board wi-th, copies of the report so that they may make recommendations. MAYOR'S REPORT The Clerk was requested to place on the agenda of the first regular meeting in May the water supply contract with Citizens utility. Wattenberg Hendricks Mayor Teichert proclaimed the week of May I through May 8 as Fire Service Recognition Week. Mayor Teichert proclaimed Saturday, May 1, 1976 as Law Day USA. Trustee Wattenberg, seconded by Trustee Richardson, moved to authorize attorney R. Marlin Smith as outside counsel to represent the Village in a law suit with the Chicago and North Western Railway to defend the Village interest in the 1974 tax levy in Case 75-36. Upon roll call: Ayes: Floros Hendricks Rhea Richardson Wattenberg Motion carried. p. 5 4/20/76 COMMITTEE CHAIRMEN REPORTS BUILDING COMMITTEE CASE ZBA-49-V-75 Dr. Paul Heck, 435 W. Prospect Ave.: Petition for variation to allow construction and occupation of an addition to a medical building without installation of a fire protection sprinkler system. No recommendation was forthcoming from the Zoning Board of Appeals. The Committee recommended denial of the petition. Trustee Hendricks, seconded by Trustee Floros, moved the Village Board concur with the committee recommendation and deny the petition in Case ZBA-49-V-75., Upon roll call: Ayes: Floros Hendricks Rhea Richardson Wattenberg Motion carried. CASE ZBA-20-V-75 Village of Mount Prospect - 435 W. Prospect: - Petition to grant a variation for a medical building in an R-3 zone. Trustee Hendricks, seconded by Trustee Floros, moved to concur in the recommendation of the ZBA and the Build- ing Committee to grant the variation. Upon roll call: Ayes: Floros Hendricks Rhea Richardson Wattenberg Motion carried. The Village Attorney was requested to draft the appropriate ordinance for the next regular meeting in May. CASE ZBA-8-SU-76 Village of Mount Prospect - Citgo fence variation request - Fairview and Northwest Hwy: Trustee Hendricks, seconded by Trustee Floros, moved to concur with the recommendation of the Building Committee to amend Sec. 1 of Ordinance 2572 regarding an existing fence. Upon roll call: Ayes: Floros Hendricks Rhea Richardson Wattenberg Motion carried. A first reading was given to an ordinance amending Ordinance #2572 and the Clerk was requested to place it on the next agenda. p. 6 4/20/76 FINANCE COMMITTEE Trustee Rhea, seconded by Trustee Richardson, moved for passage of Resolution #14-76: A RESOLUTION MAKING CERTAIN APPROPRIATION TRANSFERS, WITHIN THE ANNUAL BUDGET ADOPTED FOR FISCAL 1975-,76 Upon roll call: Ayes: Floros Hendricks Rhea Richardson Wattenberg Motion carried. Trustee Rhea, seconded by Trustee Hendricks, moved for passage of Resolution #15-76: A RESOLUTION ADOPTING THE ANNUAL BUDGET, 1976 - 1977 Under discussion, Trustee Richardson, moved to amend the library budget to $447,745. The motion failed for lack of a second. Trustee Rhea, seconded by Trustee Richardson, moved that the amount in the 1976-77 budget for the library $357,100 be amended to read $391,845 which would cover the operating budget as submitted by the Library Board, but make no pro- vision for purchase of books, tapes, or any new items. Trustee Rhea, seconded by Trustee Richardson, moved to waive the rules requiring two readings of a proposed Ordinance 2620 regarding establishment of procedures for creating a line of credit. Upon roll call: Ayes: Floros Hendricks Rhea Richardson Wattenberg Motion carried. p. 7 4/20/76 Trustee Rhea, seconded by Trustee Richardson, moved for passage of Ordinance #2620: AN ORDINANCE ESTABLISHING PROCEDURES TO BE FOLLOWED FOR INCURRING INDEBTEDNESS FOR CORPORATE PURPOSES AND AUTHOR- IZING AN APPROPRIATION 'WITHOUT LIMIT AS TO RATE OR AMOUNT FOR THE PURPOSE OF PAYING INTEREST ON SUCH INDEBTEDNESS AS THE SAME ACCRUES Upon roll call: Ayes: Floros Hendricks Rhea Richardson Wattenberg Motion carried. FIRE AND POLICE COMMITTEE An ordinance amending the Traffic Code to provide for a 2 -way stop sign east and westbound on Memory Lane at the inter- section of Fairview Avenue was read for first reading and the Clerk was requested to place it on the May 4th agenda. PUBLIC WORDS COMMITTEE Trustee Wattenberg requested the Finance Committee study insurance for civil rights, error and omission, and vandalism coverage. OTHER BUSINESS Trustee Hendricks, seconded by Trustee Richardson, moved to authorize the Mayor to sign and the Clerk to attest the Agreement with Barton-Aschman for certain studies and plans for downtown Mount Prospect. PUBLIC HEARING RE ANNEXATION OF WESTGATE GARDENS Attorney Robert Moor6 representi,n'gLorasq, Inc. stated there are 15 acres of property involved, 10 of which are already within the Village limits, and 5 abutting Meadow Lane which his client has petitioned the Board to annex. The petitioner proposes to develop the property for duplex housing, with lots 37 to 42 reserved for development of senior citizen con- dominiums on a cul-de-sac as proposed by the Dell Corp. of Northbrook under HUD. Trustee Hendricks, seconded by Trustee Floros, moved the Village Board concur with the recommendation of the Building Committee and Zoning Board of Appeals and deny the petitioner's request for R-3 zoning in Case No. ZBA-39-Z-75. Upon roll call: Ayes: Floros Hendricks Rhea Richardson Wattenberg Motion carried. P. 9 4/20/76 Trustee Hendricks, seconded by Trustee Floros, moved the Village Board concur with the recommendation of the 'Build- ing Committee and grant R-2 zoning for the subject prop- erty in Case ZBA-39-Z-75. Upon roll call: Ayes: Floros Hendricks Rhea Richardson Wattenberg Motion carried. Discussion followed regarding the impact of the proposed development on Westgate. It was the Building Committee recommendation to the Village Board that MFT funds be made available for improvement of Westgate Road. Trustee Hendricks, seconded by Trustee Floros, moved the Village Board concur with the recommendation and place this matter as top priority for the improvement of Westgate Road as a four -lane roadway through the use of MFT funds - Central north to the south line of the property to be known as Westgate Gardens. Trustee Hendricks, seconded by Trustee Floros, moved to amend the motion to add "including the east half of Westgate Road contiguous to the subject property." Roll call vote on the amendment: Ayes: Floros Hendricks Rhea Richardson Wattenberg Motion carried. Mr. W. T. Ciofani, 7 N. Westgate,, hoped Westgate Road would be improved within a reasonable time and questioned the use of MFT funds. Mr. William Draper of the Dell Corp. of Northbrook, Ill. discussed the proposed development of Lots 37 through 42 for senior citizens and adjustment of the configuration of Lot 43. It was agreed the subdivision plat of Westgate Gardens would be amended and presented to the Board at a later date. COMMITTEE ANNOUNCEMENTS FINANCE - Thursday, April 22, 1976 - Agenda: Generalized discussion creating a library district P. 11 4/20/76 Mayor Teichert called an executive session of the Boards meeting as a Committee -of -the -Whole for discussion of police wage negotiation status, following adjournment.
