COMMUNICATIONS AND PETITIONS - CITIZENS TO BE HEARD
Mr. Kerser J. DeJong, Vice President of the Crystal Towers
Condominium Association, 1717 Crystal Lane, appeared before
the Board to discuss water rates in condominiums. The matter
was charged to the Village Manager to review the water rates
in the southern area of the Village as set forth in the ordi-
ance for multi -family dwellings.

The Village Manager concurred with the recon�wiendation Of the
Police Chief that the lowest and best bid fo,111" 10 new squad
cars was that of Sullivan Pontiac in thie aniount of' $33,436-50.

An ordinance for the creation of a Class "A" liquor license
would be presented at the next regular meeting.
MAYOR'S REPORT
Copies of the Cook County Community Development Recommended
Funding Program dated February 26, 1976 were distributed.
There were six categories, and the projects recommended were
Redevelopment --Mount Prospect --$30,000 for Downtown Parking;
Rehabilitation; Environmental; Utilization of Land; Economic
Development; Demonstration Programs --Mount Prospect --
$59,000 for Senior Citizens Center -5 and Cook County Programs.
The projects had approval of the advisory council and will go
to the County Board to be approved by HUD. Mayor Tei ort ex-
plained the procedure for selection of the communities to re-
ceive funding. Mayor Teichort reported he will contact the
Planning Commission to complete the community development pro-
gram and the Downtown Commission to complete the downtown plan
by 1976. He further recommended a delay in a housing assistance
plan until the end of the year. May lst is the date aimed for
hearing approval by HUD.

ORDINANCE NO.
AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY
COMMONLY KNOWN AS 701 SOUTH CAN DOTA
MOUNT PROSPECT. ILLINOIS
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet on
the 26th day of February, 1976, at the hour of 8: 00 p.m., at the Mount Prospect Pub-
lic Safety Building and did hear Case No. 44-V-75 , pursuant to proper legal notice;
and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hear thi's
request for variations to allow the petitioner to construct a garage to within twelve
feet (121) of the property line adjacent to Man-A-Wa Trail, and to within two feet (21)
of the property line adjacent to Lot 12, which Lot 12 is immediately adjacent to and
southeast of the subject property commonly known as 701 South Can Dota, Mount
Prospect, Illinois; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recommend
to the President and Board of Trustees the approval of this request under Case No.
44-V-75 for the reasons t.Va-t:
(1)
he is a practical difficulty and particular hardship
on the petitioner;
(2) The purpose of the variations is not based exclusively
upon a desire to make money-,
(3) The conditions upon which the petition for these varia-
tions is as are unique in that the lot is a corner lot,
subject to having two front yards, and
(4) The granting of these variations will not be detrimental
to the public or injurious to surrounding property in
that said variations will not alter the essential character
aft locality; and
WHEREAS , the President and Board of Trustees of the Village of Mount Prospect have
concurred with the recommendation of the Zoning Board of Appeals that the variations
herein be granted; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have
reviewed the matter herein and have determined that the same is in the best interests
oft Village of Mount Prospect.o
NOW 9 THEREFORE,, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT. COOK COUNTY ILLINOIS. -
SECTION ONE.- That the property being the subject matter of Case No. 44-V-75, being
legally described as follows,-,
Lot 11 in Block 27 in Prospect Park Country Club,, being a subdivision
of the Southeast Quarter (4) of Section 11 and the South 15 acres of the

R-1 (Single Family Residence) District, which zoning classification shall remain in
effect subject to the variations granted hereinffi

(a) That the yard abutting the frontmost lot line of the subject
property adjacent to Man-A-Wa Trail be reduced to twelve
feet (121) to allow the construction of a twenty-two foot by
twenty-four foot (22lx241) garage upon the subject property.
(b) That the yard adjacent to Lot 12, which lot is located to the
southeast of the subject property. be reduced to two feet (21)
so that the same aforesaid garage may be constructed upon
the subject property In the manner and location shown upon
the tracing attached hereto and hereby made a part hereof as
Exhibit I.
SECTION TWO ' : That all requirements of the Mount Prospect Building and Zoning
Code shall be applicable except the variations noted in SECTION ONE heretofore
mentioned.
SECTION THREE: That the Director of Building and Zoning of the Village of Mount
Prospect is hereby authorized to issue a building permit for construction in

SECTION FOUR: That the variations granted by this Ordinance shall be null and void
and of no force and effect whatsoever unless an application for a building permit pur-
suant to such variations is made and construction commenced within one (1) year of
the date this said Ordinance becomes effective.

AN ORDINANCE GRANTING A FRONT YARD REQUIREMENT
VARIATION AND A FENCE VARIATION FOR PROPERTY
COMMONLY KNOWN AS 1 NORTH ELMHURST AVENUE
MOUNT PROSPECT, ILLINOIS
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet on
the 26th day of February, 1976, at the hour of 8: 00 p.m., in the Mount Prospect
Safety Building and did hear Case No. 7-V-76, pursuant to proper legal notim, and
WHEREAS . the Zoning Board of Appeals of the Village of Mount Prospect did hear this
request for a variation to allow the owner to construct a United States Postal Service
facility on a tract of land located within the B-3 (Busines s- Retail & Service) District,
which District lies immediately adjacent to and across from a tract of land lying with-
in the R-1 (Single Family Residence) District-, and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recom-
mend to the President and Board of Trustees of the Village of Mount Prospect the ap-
proval of this request under Case No. 7-V-76; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have
concurred with the recommendation of the Zoning Board of Appeals that the variations
herein be granted-, and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have
reviewed the matter herein and have determined that the same is in the best interests
of the Village of Mount Prospect-,
NOW 9 THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY 9 ILLINOIS. -
SE CTION ONE That the property being the subject matter of Case No. 7-V- 76 . be-
ing legally described as follows:
The West 70 feet of Lots One to Nine inclusive in Block Three (3)
in the Ernst Busse Addition to Mount Prospect, a Subdivision of
the South 543 feet of the East Half (1) of the Southwest Quarter (1)

of Section 34, Township 42 North, Range 11, East of the Third
Principal Meridian, in Cook County, Illinois,
is currently zoned under the Zoning Ordinance of the Village of Mount Prospect as
B-3 (B usine ss -Retail & Service) District, which zoning classification shall remain
I n effect subject to the variations granted herein:
(a) That the yard abutting the frontmost lot line of the subject
property adjacent to Elmhurst Avenue be requeed to
twenty-three feet six inches (2316") and
(b) That the five foot (51) maximum height requirement for
fences be increased to six feet (6y) so as to permit the
use upon the subject property to be wholely surrounded
by a six foot (61) high fence.
