AN ORDINANCE GRANTING A ZONING MAP AMENDMENT AND A CONDITIONAL USE FOR A
FINAL PLANNED UNIT DEVELOPMENT FOR PROPERTY LOCATED AT
1798 S. ELMHURST ROAD, MOUNT PROSPECT, ILLINOIS
WHEREAS, The Petitioner, Nitin Patel, ("Petitioner), has filed a petition for a zoning map amendment
from B-4 Commercial Corridor to B-3 Community Shopping and a Conditional Use for a Planned Unit
Development (PUD) consisting of a two-story, mixed-use building with a drive-through for property located
at 1798 S. Elmhurst Road, Mount Prospect, Illinois ("Property') legally described as follows:
LOT 1 IN SHELL OIL COMPANY RESUBDIVISION, BEING A SUBDIVISION OF THE
NORTHEAST 1/4 OF SECTION 23 TOWNSHIP 41 NORTH RANGE 11, EAST OF THE THIRD
PRINCIPAL MERIDIAN, RECORDED JUNE 22, 1987 AS DOCUMENT 87339994, IN THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS.
Commonly known as: 1798 S. Elmhurst Rd., Mount Prospect, Illinois
Property Index Number: 08-23-203-020-0000
WHEREAS, the Petitioner proposes to demolish the existing vacant gas station and accessory car wash
to construct a two-story, mixed-use building with a drive through, consisting of approximately 5,715
square feet of ground level commercial, and five residential dwelling units on the 2nd floor; and
WHEREAS, a Public Hearing was held on the request for rezoning being the subject of PZ -03-21 before
the Planning and Zoning Commission of the Village of Mount Prospect on the 25th day of March, 2021,
pursuant to proper legal notice having been published in the Journal & Topics Newspaper, Mount
Prospect edition, on the 10th day of March, 2021; and
WHEREAS, the Planning and Zoning Commission has submitted its findings and recommendations to the
President and Board of Trustees in support of the request being the subject of PZ -03-21; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have given
consideration to the request herein and have determined that the same meets the standards of the
Village and that the granting of the Zoning Map Amendment and the proposed Conditional Use permit
would be in the best interest of the Village.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS ACTING IN THE EXERCISE OF THEIR
HOME RULE POWERS:
SECTION ONE: That the recitals set forth hereinabove are incorporated herein as findings of fact by the
President and Board of Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect approve a zoning
map amendment from B-4 Commercial Corridor to B-3 Community Shopping and grant a Conditional Use
for a planned unit development consisting of one (1) two-story, mixed-use building with a drive-through as
shown on the site plan prepared by Antonio Fanizza Assoc. LTD dated January 15, 2021 a copy of which
is attached and made part of this Ordinance as Exhibit "A" and subject to the following conditions:
1. Compliance with all applicable development, fire, building, and other Village Codes and
regulations;
2. Compliance with all Illinois Environmental Protection Agency regulations, perform corrective
actions against further soil/groundwater contamination if any, and provide proof of a newly issued
'No Further Remediation' letter prior to building permit issuance; and
3. All ground and rooftop mounted mechanical equipment shall be screened according to Village
code; and

4. Development of the site in general conformance with the site plan prepared by Antonio Fanizza
Assoc. LTO. dated January 15. 2021^
SECTION THREE: This Ordinance shall be in full force and effect from and after its paoaagg, approval
and publication inpamphlet form inthe manner provided bvlaw.
