Mayor Teichert called the meeting to order at 8:08 P. M.

APPROVAL OF MINUTES OF REGULAR MEETING HELD JANUARY 20, 1976
Pg. 6, 4th para: Reword motion to read: ."recognizing the

Village 4th of July celebration." Trustee Richardson,
seconded by Trustee Hendricks, moved to approve the minutes
of the regular meeting held January 20, 1976 as amended.

11111N1GER'S REPORT
The Village Manager,, the Publi*t,Works Director and the Financ
Director had been requested at the previous meeting to report
to the Board what effect there would be to the Village r. iv
should there be a reduction from $'9.00 to $7.50 in the minimu
quarterly rate for water. Comments made were that there are
195 multi -family buildings, comprised of 4300 units, which ar
billed at a minimum rate and it was estimated there would be
loss of revenue of approximately $30,000. It was the opinion
that the ordinance should be retained as passed. Under
cussion of this recommendation the Board members felt there
was a need for clarification on the multi -family figure and
the matter was referred back to the admi-nistration for furthe
information.
MAYOR'S REPORT
Mayor Teichert announced the resignation of Joseph Reising as
a member of the Safety Commission and appointed Ben Scola,
1823 Palm Drive to fill the unexpired term to May 1. 1978.
Mayor Teichert requested Board concurrence. Trustee Rhea,
seconded by Trustee Richardson, moved to concur in the Mayor's
appointment.

,Mayor Teichert advised the Board on the County Community De-
.velopment Program and project applications. He gave a brief
recap of proposed projects: combined parking on the mall
behind the Village Hall estimated at $40,000; sidewalks in
the New Town area --$550,000.00; police stat i on (with right
,of first refusal for the old post office) -- work estimated at
$325,000.00; downtown lighting Northwest Highway, Rte. 83 and
Prospect Avenue, approximately $600,000.00; rehabilitation of
the old library as a senior citizen center, including a mall
between the old library and the new --$60,000.00. Pre -applica-
tions must be in at the end of this week. Final applications
must be presented in two weeks. For the purpose of finalizing
those applications the Mayor will write memos and charge the
Downtown Development and Redevelopment with the first project,
and the Board of Local Improvements with the sidewalk project,
the Village Manager and Y Chief on the police station,
downtown lighting to the Safety 'Commission, andthe Senior
Advisory Commission, with the Health Department on the senior
citizen center.

Mayor Teichert discussed the proposed acquisition of Citizens
Utility Company. Legal fees would be involved for preliminary
findings on the ultimate cost for condemnation of the property.
Mayor Teichert suggested retaining outside counsel in this
matter before the Village can proceed with a hearing. Trustee
Minton, seconded by Trustee Richardson, moved to authorize re-
taining of outside counsel not to exceed $3,000.00 for the
initial development of figures for purchase or condemnation
of Citizens Utility Company. X

Motion carried.
Mayor Teichert discussed the Magnus property in unincorporated
area on Central Road. Under the County reclassification it was
to be zoned to permit eight units per acre. However, the
Villages of Mount Prospect and Arlington Heights had opted for
single-family classification. Before the County passed the
rezoning ordinance Mr. Magnus, under a writ of mandamus, com-
pelled the County to maintain the multiple -family zoning,
permitting 728 units on the property. Trustee Minton, seconded
by Trustee Richardson, moved to authorize the Village Attorney
of Arlington Heights, Jack Siegal, to enter an appearance to
intervene in the name of the Village of Mount Prospect, to com-
bine with Arlington Heights, with an offer to absorb some of
the cost.

It will be necessary to obtain temporary easements for the
widening and deepening of the McDonald Creek channel. A
meeting of the Committee -of -the -Whole has been called for
Monday, February 9, 1976 at 7:30 P. M. at 112 E. Northwest
Hwy. to meet with residents in the area concerning these
temporary easements needed during construction. The Clerk
was requested to advise homeowners.

for passage of Resolution No. 6-76:

Motion carried.
The Finance Committee considered the fees charged for permits
for commercial swimming pools. It is recommended the fee be
increased to $75-00. Trustee Rhea, seconded by Trustee
Floros, moved the Board concur with the recommendation to
increase the swimming pool fee to $75.

Motion carried.
Trustee Rhea, seconded by Trustee Richardson, moved to double
the business license fee schedule.
Under discussion, Mr. George Anderson, representing the
Chamber of Commerce recommended a 25% increase. Mr. J.
Kiefer, and Mrs. Margaret Erwin, a representative of
Randhurst, concurred.

Motion failed.
Trustee Rhea, seconded by Trustee Minton, moved to increase
the business license fees by 50% across the board.
Mr. Max Ulrich, representing VanDriel's drug store, requested
a breakdown in costs. Mrs. Marie Caylor recommended action
be deferred.

Motion carried.
Trustee Rhea commended the Finance Director and Bob Simpson
for their assistance to the Finance Committee in reviewing
the business license charges.

JUDICIARY COMMITTEE
Trustee Minton discussed a proposed apartment licensing
ordinance and requested each Trustee to review his memo-
randum. The Clerk was reqUe,Sted to place the matter on
the agenda of the next Board Meeting.
Trustee Minton requested two charges be placed in Committee:
Creation of regional consumer protection agency, or that
Mount Prospect join one, and investigate relocation of
Village Board Meetings to the new library.
OTHER BUSINESS
Mayor Teich rt referred the matter of garbage charges to
the Public Health and Safety Committee for contract review.
An ordinance amending Chapt. 18 in its entirety (Traffic Code)
was read for first reading and the Clerk was requested to
place it on the next agenda.

AN ORDINANCE GRANTING A VARIATION FOR, PROPERTY
LOCATED AT 908 PALM DRIVE
WHEREAS, the Zoning Board of Appeals of the Village of'Mouint Prospect did hold a
public hearing on December 1-8, 1975, at the hour of 8: 00 p.m., in the Mount Pros-
pect Public Safety Building, pursuant to proper leg*<,il notice; and
11111JEREAS, the Zoning Board of Appeals of the Village of Mount Prospect heard testi-
mony presented under Case Ne. 50-V-75 pertaining to a request for <,I variation from
paragraph 20 of subsection B of' Section 14.2602 of the Zoning Code in order to install
a secondary kitchen in conjunction with a proposed recreation room in the basement
of the property described hereunder; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recommend
to the Building Committee of the Po(ard of Trustees of the Village of P)ount Prospect the
approval of this request under Case No. 50-V-75; and,
WHEREAS, the Building Committee of the Board of'Trustees of the Village of lfturit Pros-
pect did meet on February 11, 1976, and did consider the recommendations, of the. Zonirr,
Board of Appeals under Case No. 50--V-75; and
WHEREAS, the Building Committee has recommended to the, President and Board of
Trustees of the Village of Mount Prospect to allow the variation os, [,)resented; and

NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRU-STEEII-z
OF THE VILLAGE OF DJOUNT PROSPECT, COOK CM`NTY, ILLINOIS:
SECTION ONE: That the property being the subject matter of Case No. 50-V-75, being
legally described as follows:

AN ORDINANCE AMENDING CHAPTER 11 OF THE
MUNICIPAL CODE OF MOUNT PROSPECT
WHEREAS , it has been determined that increased costs of special services of the
Village of Mount Prospect in the form of various inspections, added police protec-
tion and patrol,, etc. , currently being provided each business, occupation, and/or
profession conducted within the Village of Mount Prospect necessitate an increase
in the business license fees currently charged by the Village of Mount Prospect; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
have reviewed the charges and fees for licensing such businesses, occupations,
and/or professions; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
believe that an increase in such license fees is in the best interests of the citizens
of the Village of Mount Prospect;
NOW 9 THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That., pursuant to the authority vested in the President and Board
of Trustees of the Village of Mount Prospect under Article VII of the 1970 Constitu-
tion of the State of Illinois, Section 11.202 of the Municipal Code of Mount Prospect
of 1957, as amended, be and the same is hereby amended in its entirety so as to
increase the license fees for Auctioneers; so that hereafter the said Section 11.202 shall
be and read as follows. -
SECTION 11.202. License Fees. The fees for an auctioneer's license shall
be as follows: $52.50 for a period of one (1) month; $7.50 per day for any
period of less than one (1) month. It
SECTION TWO: That,, pursuant to the authority vested in the President and Board
of Trustees of the Village of Mount Prospect under Article VII of the 1970 Constitu-
tion of the State of Illinois, Section 11.303 of the Municipal Code of Mount Prospect
of 1957, as amended, be and the same is hereby amended in its entirety so as to
increase the license fees for Bankers and Brokers; so that hereafter the said Sec-
tion 11.303 shall be and read as follows:
11 SECTION 11.303. License Fees.
A. The fee for a banker's license shall be $52.50 for a period of one (1) year.
B ., The fee for a broker's license shall be $52.50 for a period of one (1) year. 11
SECTION THREE: That, pursuant to the authority vested in the President and Board
of Trustees of the Village of Mount Prospect under Article VII of the 1970 Constitu-
tion of the State of Illinois, subsection B of Section 11.502 of the Municipal Code of
Mount Prospect of 1957, as amended, be and the same is hereby amended in its entire-
ty so as to increase the license fees for Shooting Galleries - so that hereafter the said
subsection B of Section 11.502 shall be and read as follows:
B Th , e fees for shooting galleries shall be: $150 per year; $7.50 per day,
if for less than one (1) year. It
SECTION FOUR: That, pursuant to the authority vested in the President and Board
of Trustees of the Village of Mount Prospect under Article VII of the 1970 Constitu-
tion of the State of Illinois, Section 11.604 of the Municipal Code of Mount Prospect
of 1957, as amended, be and the same is hereby amended in its entirety so as to
increase the license fees for Carnivals and Circuses; so that hereafter the said
Section 11.604 shall be and read as follows:
11 SECTION 11.604. License and Permit Fees.
A. The fee for a carnival license or a circus license shall be $75 per day
for each day of operation, with a minimum fee of $300.
1. An additional license fee of $7.50 per day shall be charged for
each concession operated in conjunction with a carnival.
2. An additional license fee of $7.50 per day shall be charged for each
concession and/or side show operated in conjunction with a circus.
B., The fee for each permit for each mechanical amusement riding device
shall be calculated to equal the cost of the safety inspection by the Vil-
lage of such device at the rate of $30 per hourt 11
SECTION FIVE: That,, pursuant to the authority vested in the President and Board
of Trustees of the Village of Mount Prospect under Article VII of the 1970 Constitu-
tion of the State of Illinois, subparagraph e. of subsection E of Section 11.605 of the
Municipal Code of Mount Prospect of 1957, as amended, be and the same is hereby
amended in its entirety so as to increase the license fees for lottery drawings; so
that hereafter the said subparagraph e. of subsection E of Section 11.605 shall be
and read as follows:
71 e. License Fee.
1) The Village Treasurer shall charge a non-refundable
application fee in the amount of Fifteen Dollars ($15)
for each lottery license application.
2) Within thirty (30) days after the drawing held at the
culmination of any lottery, the licensee shall pay over
to the Village Treasurer a license fee in the amount of
one and one-half percent (T. Q13%) of the gross ticket
and/or chance sales. 11
SECTION SIX: That,, pursuant to the authority vested in the President and Board
of Trustees of the Village of Mount Prospect under Article V11 of the 1970 Constitu-
tion of the State of Illinois, subsection A of Section 11. 703 of the Municipal Code of
Mount Prospect of 1957, as amended, be and the same is hereby am -ended in its en-
tirety so as to increase the license fees for Coin -in -Slot devices; so that hereafter
the said subsection A of Section 11.703 shall be and read as follows:
11 SECTION 11. 703. License Fees.
A. Every applicant. before being granted a license shall pay the follow-
ing annual license fee for the privilege of operating or maintaining for
operation each cigarette vending machine, juke box, or other mechani-
cal or electronic coin -in -slot device:
1. Cigarette Vending Machines $37.50 per machine
2. Juke Boxes $15.00 per machine

tion of the State of Illinois, Section 11.903 of the Municipal Code of Mount Prospect
of 1957, as amended, be and the same is hereby amended in its entirety so as to
increase the license fees for Contractors ; so that hereafter the said Section 11.903
shall be and read as follows:

tives; so that hereafter the said subsections A and B of Section 1.1. .1004 shall be 8nd,
read as follows:
A. The application required herein shall be accorrpanied by an applica-
tion fee of $ 7.5 0.
B No license provided for herein shall be issued, if at all, until the pay-
ment of the annual license fee of $45 is received by the Chief of Police.
SECTION NINE: That, pursuant to the authority vested in the President and Board
of Trustees of the'Village of Mount Prospect under Article VII of the 1,970 Con,stitu,-
tion of the State of Illinois, subsection A of Section 11.1106 of the Municipal Code of
Mount Prospect of 1957, as amended, be and the saime is hereby amended in its en-
tirety so as to increase the license fees for Draymeng Ambulances, Cabmen and
Taxicabs ; so that hereafter the said subsection A of Section 11.1106 shall be and read
as follows:

increase the license fees for Taximeter Inspection so that hereafter the said Sec-
tion 11.1116 shall be and read as follows:
SECTION 11. 1116. Taximeter Ins p ction Fee. The fee for each certificate
of inspection shall be Four and Fifty One Hundredths Dollars ($4.50), but
no charge shall be made for any certificate when the inspection and test is
made upon complaint, and it is found that the taximeter is in proper work-
ing condition and accurately registers the lawful rates and charges. 11
SECTION ELEVEN: That, pursuant to the authority vested in the President and Board
of Trustees of the Village of Mount Prospect under Article VII of the 1970 Constitu-
tion of the State of Illinois, paragraph 2 of subsection H of Section 11.1119 of the
Municipal Code of Mount Prospect of 1957, as amended, be and the same is hereby
amended in its entirety so as to increase the license fees for Public Chauffeurs; so
that hereafter the said paragraph 2 of subsection H of Section 11. 11. 1119 shall be
and read as follows:

ty so as to increase the license fees for Wrecker or Towing Service; so that hereafter
the said subsection A of Section 11. 1120 shall be and read as follows:

SECTION THIRTEEN: That, pursuant to the authority vested in the President and

of Mount Prospect of 1957, as amended, be and the same is hereby amended in its en-
tirety so as to increase the license fees for Independent Drivers ; so that hereafter the
said subsection A of Section 11.1202 shall be and read as follows:
A. The annual fees for independent drivers licensed under this Article

SECTION FOURTEEN: That, pursuant to the authority vested in the President and
Board of Trustees of the Village of Mount Prospect under Article VII of the 1970 Con-
stitution of the State of Illinois, subsection B of Section 11.1602 of the Municipal Code
of Mount Prospect of 1957, as amended, be and the same is hereby amended in its en-
tirety so as to increase the license fees for Miniature Golf Courses, Par 3 Golf Courses,
Cher Golf Courses, and Golf Driving Ranges ; so that hereafter the said subsection B
of Section 11. 1602 shall be and read as follows:
B The annual fees for such miniature golf course, par 3 golf course,
other golf course, and golf driving range shall each be One Hundred
Fifty Dollars
SECTION FIFTEEN: That. pursuant to the authority vested in. the President and
Board of Trustees of the Village of Mount Prospect under Article VII of the 1970 Con-
stitution of the State of Illinois, subsection A of Section 11. 2002 of the Municipal Code
of Mount Prospect of 1957, as amended, be and the same is hereby amended in its en--
tirety so as to increase the license fees for Outdoor Advertisers . Printers and Pub-

its entirety so as to increase the license fees for certain motion pictures and theatri-
cals ; so that hereafter the said subsection B of Section 11. 2502 shall be and read as

B. For motion pictures and theatricals, which are to be presented on pre-
mises which are not covered by such license fee, the fee to be paid
shall be Fifteen Dollars ($15) per day; provided that DO such motion
picture or theatrical shall be presented in or on any prerr;,ises or build-
ing which does not fully comply with the requirements of the ordinances
relating to public gatherings and to mc-Lintenance of buildings for this

SECTION NINETEEN: That, pursuant to the authority vested in the President and P(,"arc;
of Trustees of the Village of Mount Prospect under Article VII of the 1970 Constitution
of the State of Illinois, subsections A and B of Section 11. 2807 of the Municipal Code
of Mount Prospect of 1957, as amended, be and the same are hereby amended in their
entireties so as to increase the license fees for the businescs of hawker, peddler, itine-
rant merchant, or transient vendor; so that hereafter the said subsections A rt.. B of
Section 11. 2807 shall be and read as follows:

establishments shall pay a $15 basic component fee to cover the pro-
cessing , documentation, and filing of their application and license.
B. Such professions, occupations, businesses, and/or commercial estab-
lishments which have an established place of business within the cor-
porate limits of the Village of Mount Prospect shall be assessed an addi-
tional component fee to cover the cost of enforcement of safety regula-
tions including fire prevention, which component fee shall be deter-

SECTION 11. 3107. Late Payments.
A Whenever an application for a renewal of a license previously issued
for the prior fiscal year is received by the Village Clerk between
July I and August 31 of any given fiscal year, the Village Clerk is here-
by authorized to compute the license fee for such license at the rate of
one hundred eighty percent (180%) of the license fee heretofore desig-
nated in this Article.
B Whenever an application for a renewal of a license previously issued
for the prior fiscal year is received by the Village Clerk after Aug -
gust 31 of any given fiscal year, the Village Clerk is hereby authorized
to compute the license fee for such license at the rate of two hundred
twenty-five percent (225%) of the license fee heretofore designated in
this Article. 11
SECTION TWENTY' -THREE.: If any part of parts of this Ordinance shall be held to be

SECTION' 4. 1001. Establishment. In order to prevent., minimize , repair.
and alleviate injury or damage resulting from, disaster cause by enemy at-
tack 9 sabotage, or other hostile action, or from natural or man-made disas-
ter, in accordance with "The Illinois Emergency Services and Disaster Act
of 197511 . there is hereby established a Department of Emergency Services
and Disaster (ESDA), which shall be under the jurisdiction and control of
the Village Manager.
SECTION 4.10, 2. Coordinator. The Coordinator of the Mount Prospect De-
partment of Emergency Services and Disaster shall be appointed by the Vil-
lage Manager.
A. The Coordinator shall have direct responsibility for the organization,
administration, training, and operation of the ESDA , subject to the di-
rection and control of the Village Manager, as provided by statute.
B In the event of the absence, resignation , death , or inability to serve as
Coordinator
1 . the Village Manager, or any person designated by him
shall be and act as Coordinator until a new appointment is made as pro-
vided by this ordinance.
SECTION 4.1003. Functions,. The ESDA of the Village of Mount Prospect
shall perform such ESDA functions within the corporate limits of the Village
as sha,11 be prescribed in and, by the State of Illinois ESDA plan and program
prepared by the Governorand, such orders, rules. and regulations as may
be promulgated by the Governor, and iin addition shall perform such duties,
outside the corporate limits as may be required pursuant to any Mutual Aid
agreement with any other political subdivision, municipality, or quasi -muni-
cipality entered into as provided in "The State ESDA Act of 1975".
SECTION 4.1004. Service as Mobile S2222EL_12M. All or any member of
the Mount Prospect ESD,A organi,z-ation may be designated as members of a
Mobile Support Team created by t, he Director of the State ESDA as provided
by
A. The leader of such,mObile Support Team, shall be designated by the
Coordinator of the Mount Prospect ESDA.
B Any member of a Mobile Support, Team who is a Village employee or of-
ficer while serving on call to duty by the Governor, or the State Direc-
tor, shall, receive the compensation and have the powers, duties, rights,
and immunities incident to such employment or office. Any such m,einber
who is not a paid officer or employee of the Village, while so serving,
shall receive from the State reasonable compensation as provided by
law .
A In the event of enemy caused or other disaster, the Village Coordinator
of ESDA is authorized, on behalf of the Village, to procure such serv-
ices, supplies, equipment, or material as may be necessary for such
purposes, in view of the
or oexigency without regard to the statutory pro-
cedures frmalities normally prescribed by law pertaining to Villag
contracts or obligations, as authorized by "The State E SDA Act of 19751
provided that if the Village Manager meets at such time he shall act sub
ject to the directions and. restrictions imposed by that body.
SECTION 4.1010. Oath. Every person appointed to serve in any capacity
in the Mount Prospect ESDA organization shall, before entering upon his
duties, subscribe to the following oath, which shall be filed with the Coordi-
nator:
do solemnly swear (or affirm) that I will
support and defend and bear true faith and allegiance to the Constitu-
tion of the United States of America and the Constitution of the State of
Illinois . and the territory, institutions , and faces thereof , both pub—
lic and private, against all enemies, foreign and domestic; that I take
this obligation freely, without any mental reservation or purpose of
evasion; and that I will well and faithfully dischare the e

which I am about to enter. And I do further swear (or affirm) that I do
not advocate, nor am I nor have I been a member of any political party
or organization that advocates the overthrow of the government of the
United States of America or of this State by force or violence; and that
during such time as I am affiliated with the Mount Prospect Department
A f Emergency Services and Disaster, I will not advocate nor become a
member of any political party or organization that advocates the over-
throw of the government of the United States of America or of this State
by force or violence."
SECTION 4. 1011. Office. The Village Manager is authorized to designate
space in a Village building, or elsewhere, as may be provided for by the
Village Manager for the Mount Prospect ESDA as its office.
SECTION 4.1012. Appropriation - Levy of Taxes. The President and
Board of Trustees of the Village of Mount Prospect may budget for ESDA
purposes in the manner provided by law , and may levy in addition for
ESDA purposes only, a tax not to exceed five cents per one hundrei
dollars ($100) of the assessed value of all taxable property in addition to
all other taxes, as provided by "The State ESDA Act of 1975tt; however,
that amount collectable under such levy shall in no event exceed twenty-

SECTION TWO: That Chapter 8 of the Munici al Code of Mount Prospect of 1957 , as

amended, be and the same is hereby further amended by adding thereto an addition-
al Article, Article VII, providing for succession of officers in the event of emergene
so that hereafter the said Article VII of Chapter 8 shall be and read as follows: I

A. In the event that the Village Manager is killed or rendered incapable of
performing the duties of such office or position, said office or position
shall be filled in the following order of preference until such time as a
successor is named and takes office in the manner provided by law:
1. The Coordinator of the Mount Prospect Department of Emergency
Services and Disaster-, or
2. Assistant Manager; or
Personnel Director; or

B. In the event that the Village President is killed or rendered incapable of
performing the duties of such office, said office shall be filled in the
following order of preference until such time as a successor is named
and takes office in the manner provided by law:
1. The remaining members of the Board of Trustees - senior Trustees
utilized first and in alphabetical order if two or more are of the
same seniority; or
2. The Village Clerk
SECTION 8.702. Powers and Duties. The person(s) filling such vacan-
cies as provided herein shall exercise all the duties and powers of that posi-
tion during the emergency and until such time as a successor can be appoint-
ed or selected in the manner provided by law. 11
SECTION THREE: That Ordinance No. 2349 be and the same is hereby repealed.
SECTION FOUR: That this Ordinance shall be in full force and effect from and
after its passage, approval. and publication in the manner provided by law.
