Trustee Caylor, seconded by Trustee Richardson, moved to
approve the minutes of the regular meeting of January 21,
1975 as submitted.

Motion carried.
Correction of minutes of the special meeting held January
28, 1975: Vote on reconsideration re Rob Roy Golf Course
was carried by a five to two vote. Vote on motion appealing
the ruling not to open themeetingto public debate should
show Ayes: Anderson Hendricks Caylor and Nays: Scholten
Gustus Richardson. On final motion add: "The Chair ruled
that it would require five votes for the motion to carry."

VILLAGE MANAGER'S REPORT
The Village Manager introduced Mike Johnson, a student in-
tern from Forest View High School and gave a status report
on various Village programs and projects.
MAYOR'S REPORT
Tom Petrik of the Fire Department Explorer Post 319 was
presented with the Eagle Scout badge in the presence of
his parents and Boy Scout officials who commended him for
his achievement.
Trustee Scholten, seconded by Trustee Gustus, moved to
waive the rules to consider a resolution in tribute to
the late State Representative Robert S. Juckett.

Mayor Teichert advised the Board of receipt of a letter
from Ro-ss Hardies, O'Keefe, attorneys, concerning a
hearing before the Illinois nois Commerce Commission regard-
ing a petition of Citizens Utilities s for a rate increase
in water and sewer service. To continue defending the
citizens in this matter would cost the Village an addi-
tional $10,000. and Mayor Teichert asked for the sense
of the Board. Trustee Scholten requested the item be
referred to the Finance Committee for consideration on
February 17th.
Considerable discussion followed and Trustee Scholten.,
seconded by Trustee Richardson, called for the order of
the day because there had been no waiver of the rules
and it was not a matter on the agenda.

COMMITTEE CHAIRMEN REPORTS
BUILDING COMMITTEE
Trustee Caylor presented for first reading an ordinance
granting a variation in Case ZBA-47-v-74 - D. Tector,
222 N. William, screen house on existing slab, and also
first reading of an ordinance granting a variation at
the southeast corner of Forest and Thayer, Case ZBA-48-V-74,
petitioner John Mullowney.
FINANCE COMMITTEE
Trustee Scholten reported the Colony Club at Oakton and
Route 83 had withdrawn the petition for a liquor license,
pending application at a later date.
PUBLIC HEALTH AND SAFETY COMMITTEE
Trustee Hendricks, seconded by Trustee Gustus, moved the
Village Board concur with the recommendation of the Public
Health and Safety Committee and the Safety Commission to
amend the entire section of the Municipal Code regarding
flags and pennants and further, to concur with the recom-
mendation of the Village Manager to withdraw the previously
issued violation notices that were sent to local businesses
in October, 1974.

advise the business owners of the action taken by the
Village Board.
PUBLIC WORKS,COMMITTEE
Trustee Gustus, seconded by Trustee Hendricks, moved to con-
cur with the Public Works Committee regarding the MFT Main-
tenance Program for 1975 for maintenance materials and main-
tenance work in the amount of $200,000.

However, there was considerable discussion and Trustee Gustus.,
seconded by Trustee Scholten, withdrew the motion because it
was deemed not advisable to tie up the MFT funds, and therefore
would be reconsidered further in Committee.
OTHER BUSINESS
Listed on the agenda was the proposed annexation of property
north of Euclid Ave. south of Alton Road adjacent to River
Trails Park District property and also under that Jurisdiction.
Mayor Teichert read a letter filed as an official objection by
the Prospect Heights Rural Fire Protection District. In view
of the objection it was deemed inadvisable to have another fire
department in control of that property. A first reading of the
annexation ordinance was presented and in the meantime, there
would be clarification on the objection before the second read-
ing at the next regular meetin

The Committee resumed discussion regarding letters sent by the
administration to local businesses for possible violations of
our sign ordinance. All 14 businesses were notified by mail of
our Committee meeting. The Committee received a memo dated
January 15, 1975 from Village Manager Robert Eppley. Each
businessman present received a copy of this memo. Also received
was a letter from C.O. Schlaver, Executive Director of the
Chamber of Commerce. This letter was presented at the meeting.
Each businessman was given an opportunity to present his views
and comments to the Committee. Comments were also made by the
administration and the Committee members. The consensus of the
Committee is that flags would be allowed to be used in the
Village so long as they are attached to a firm pole. The pole
would be structurally sound as set by the criteria established
by the administration in the new draft of the sign ordinance.
These flags would be permissible when installed on roofs of
businesses. It was also suggested that flags be allowed to be
used for a 4 -month period maximum and then replaced for esthetic
reasons. Mr. Dutton was directed to include this in his draft
of the sign ordinance. This would be in addition to the present
ordinance. The Committee stated roof signs will not be permitted
a's presently written. Flags are not signs. Pennants, when
connected together by means of a string or wire will not be
permitted to be used in the Village. Provisions will be made
in the new draft to allow a business or a person to obtain a

special permit,to install pennants for a 30 -day period only
for a special occasion such as a grand opening. The administration
recommends that the entire section of the Municipal Code re-
garding flags and pennants be rewritten. This will take

The Committee, by a vote of 3-0, recommends to the Mayor and
Board of Trustees to concur with the recommendation of the Village
Manager to withdraw the previously issued violation notices that
were sent to our local businesses in the month of October, 1974.

Ordinance -- Flags and Pennants

In response to your request for the administration's position
on this matter, please be advised that it is our recommendation
that this entire section of the Municipal Code be rewritten.
This can not be accomplished in less than 6 months, but we
will go to work immediately on the preparation of a proposed
draft for Village Board review.
If the Committee and Village Board approve, the previously
issued violation notices will be officially withdrawn. In
the interim period, any recommendations concerning policy and
the substantive sections of this ordinance from the Board of
Trustees would be most appreciated. I suggest you forward
them directly to the Director of Building & Zoning Buell Dutton.
Mr. Dutton and Mr. Amundsen will be present at your meeting.

Special meeting of the Mayor and Board of Trustees of the
Village of Mount Prospect called by Mayor Teichert on
Friday, January 24, 1975 pursuant to Chapter 2 "The
Board Of Trustees" Section 2.103 "Meetings" as specified
in the Municipal Code of Mount Prospect.
The purpose of the meeting was to hold a public hearing re-
garding a pre -annexation agreement for property located at
Wheeling Road and Camp McDonald Road, known as the Rob Roy
Country Club property.
The meeting is a continuation from one held December 10,
1974, at which time a motion was made by Trustee Gustus,
seconded by Trustee Hendricks, that the Board cease nego-
tiations for a pre -annexation agreement covering the subject
property commonly known as Rob Roy Golf Course. The motion
carried by a four to three vote.
Trustee Gustus, then seconded by Trustee Richardson, moved
for reconsideration of the vote taken to cease negotiations;
postpoiied to- a dato, -certain--, b.el*'ng the second Tuesday in
January. The motion carried by a four to three vote.
The date of the meeting, January 14th, 1975, there was no
quorum present, and therefore, the public hearing was con-
t ilnued to January 28, 1975.
Attorney Robert Gorton, representing Riverhurst Civic Asso-
ciation, River Trails Civic Association and Prospect Heights
Improvement Association presented petitions containing 3,875
signatures objecting to rezoning and special use of the
property for a planned unit development.
Mayor Teichert ruled the meeting would not be open to public
debate because of the opportunities for open discussion- at
previous meetings.
Trustee Hendricks, seconded by Trustee Anderson, moved to
appeal the ruling of Mayor Teichert to not open the meeting
to public debate.

Motion tied.
Trustee Caylor gave a recap of proceedings leading up to
this meeting , and talked on flooding, tax base, signaliza-
tion, water and sewer lines,' open space, effect on nei•ghbor-
ing homes, and the proposed pl-anned unit development.
Questions were directed to Mr. Roy Cottlieb, of Kenroy, Inc.
regarding the pro -posed development by members of.the Board.

WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet
on the 21st day of November, 1974, at the hour of 8- 00 p.m.. , at the Mount

Prospect Village Hall and did hear Case No. 47-V-74, pursuant to proper
legal notice; and
WHEREAS . the Zoning Board of Appeals of the Village of Mount Prospect did hear
this request to construct a screened -in porch on an existing concrete slab to within
ten feet four and one-half inches (1014111) instead of the required twenty feet (201) on

the lot commonly known as 222 North William Street, Mount Prospect, Illinois; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recom-
mend to the President and Board of Trustees of the Village of Mount Prospect the
approval of this request under Case No. 47-V-74 for the reasons that:
There is a practical difficulty and particular
hardship on the petitioner;
(2) The 'purpose of the variation is not based exclu-
sively upon a desire to make money-,
(3) The conditions upon which the petition for this
variation is based are unique in that its layout
is not similar to any other lot in the area,, being
a corner lot of unusual physical shape; and
(4) The granting of this variation will not be detri-
mental to the public or injurious to surrounding
property in that it will not alter the essential
character of the locality; and I
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
have reviewed the matter herein and have determined that the same is in the best
interests of the Village of Mount Prospect;
NOW 9 THEREFORE , BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT , COOK COUNTY, ILLINOIS:
SECTION ONE: That the property being the subject matter of Case No. 47-V-74,

Lot One (1) in Block Nine (9) in Bluett's Subdivision of part of the
North Half (1) of the Southeast Quarter (4) of Section 34, Township

42 North. Range 11, East of the Third Principal Meridian, according
to Plat thereof registered in the Office of the Registrar of Titles of
Cook County, Illinois . as Document No. 1464233 1,
is currently zoned under the Zoning Ordinance of the Village of Mount Prospect
as R-1 (Single Family Residential) District ,, which zoning classification shall
remain in effect subject to the variation granted herein:

CORNER OF FOREST AVENUE AND THAYER STREET

WHEREAS , the Zoning Board of Appeals of the Village of Mount Prospect did meet
on the 21st day of November, 1974, at the hour of 8: 00 p.m., at the Mount
Prospect Village Hall and did hear Case No. 48-V-74, pursuant to proper
legal notice; and

ORDINANCE NO.
AN ORDINANCE ANNEXING RIVER TRAILS PARK DISTRICT
PROPERTY NORTH OF EUCLID AVENUE TO THE
VILLAGE OF MOUNT PROSPECT , ILLINOIS
WHEREAS . the Board of Park Commissioners of River Trails Park District, Cook
County, Illinois, have adopted a Resolution recommending the annexation of one
(1) parcel of real estate hereinafter legally described to the Village of Mount Pros-
pect; and
WHEREAS, a certified copy of said Resolution was duly filed with the Village Clerk
of the Village of Mount Prospect; and
WHEREAS, a written petition under oath duly executed by the said Board of Park Com-
missioners of River Trails Park District , being the owner of record of said parcel of
real estate hereinafter described has been filed With the Village Clerk of the Village
of Mount Prospect , requesting that said land be annexed to the Village of Mount Pros-
pect; and
WHEREAS, no electors reside within the said property to be annexed; and
WHEREAS, the said land is not within the corporate limits of any municipality, but
is contiguous to the Village of Mount Prospect; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect find
and believe it to be in the best interests of the said Village that the said land and terri-
tory be annexed thereto;
NOW , THEREFORE , BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT , COOK COUNTY, ILLINOIS:
SECTION ONE: That all land and territory legally described as follows:
The Southwest Quarter (1) of the Northeast Quarter ("') of
Section 26 (except the West 686.5 feet thereof and that part
lying South of the North line of Euclid Avenue as per Docu-
ment No. 12599682 and lying North of the South Line of the
Southwest Quarter (4) of the Northeast Quarter (4) of Sec-
tion 26) . all in Township 42 North, Range 11 East of the
Third Principal Meridian, in Cook County, Illinois,
an accurate map of which territory is attached hereto and hereby made a part hereof
by this reference be and the same is hereby annexed to the Village of Mount Prospect,
Cook County, Illinois.

SECTION TWO: That Map 41N contained in SECTION ONE of Ordinance No. 2410,
passed and approved March 20 0 1973 9'be amended to reflect the extention of the
corporate limits of the Village of Mount Prospect to include the property herein-
above described and hereby annexed.
SECTION THREE-, That the Village Clerk of the Village of Mount Prospect is hereby
directed to file in the Office of the Recorder of Deeds of Cook County, Illinois, a certi-
fied copy of this Ordinance 9 together with an accurate map of the territory annexed.
SECTION FOUR: That this Ordinance shall be in full force and effect from and after
its passage, approval, and publication in the manner provided by law.

AN ORDINANCE AMENDING ARTICLE II., CHAPTER 9 OF
THE MUNICIPAL CODE
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTESS OF THE VILLAGE OF
MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE. That., pursuant to the authority vested in the President and
Board of tees of the Village of Mount Prospect under Article VII of the
1970 Constitution of the State of Illinois, Article II of Chapter 9 of the
Municipal Code of the Mount Prospect of 1957, as amended, be and the same
is hereby further amended by adding thereto two additional Sections to be
known as Section 9.202 and Section 9.203; which Sections 9.202 and 9.203 shall
hereafter be and read as follows:
",Section 9.202 Prior AMroval of Work by the President and
Board of Trustees.
A. No person, firm, corporation, trustee, and/or other legal
entity or association, and no unit of local goverment as
defined in the Illinois Constitution of 1970 (other than
the Village of Mount Prospect and any other public utility
holding the current franchise granted to it by the Village
of Mount Prospect) shall commence installation, construction,
re -construction, repair, or replacement of any roadway,
thoroughfare, street, highway, easement, open space for the
use of the public for the primary purpose of vehicular
traffic, water main, sanitary sewer, storm sewer,, field
tile., cable, -or any other structure, or perform any other
work of any kind upon, above, or below the surface of the
ground which is upon any real estate, easement, right-of-
way, street, highway, roadway, licensed, leased, or owned
by or under the control of or within the corporate limits
of the Village of Mount Prospect, unless and until the
President and Board of Trustees of the Village of Mount
Prospect shall have first approved such proposed work.
B. The approval provided for in Section A hereinabove shall be
in addition to the requirements of other prior approvals
of other official or officials as set forth in any other
applicable ordinances of the Village of Mount Prospect.
"Section 9.203 Penalties.
It is a misdemeanor for any person to violate any of the
provisions of this Article. Every person, firm,
corporation, trustee, other legal entity, association, or
unit of local goverment as defined in the Illinois
Constitution of 1970 convicted of a misdemeanor for the
violation of any of the provisions of this Article shall
be punished by a fine of not less than Twenty Five ($25)
Dollars nor more than Five Hundred ($500) Dollars. Each
and ery., a itionai violation isting shall be deemed
a separate and distinct violation for the purposes of
determining punishments hereunder.'
SECTIO ' #- The provisions of this Ordinance shall apply to all applications
on
.1e_ th the Village of Mount Prospect at the effective date hereof as
well as any and all future applications and/or work to be done..
SECTION That, if any part or parts of this Ordinance shall be held to
e const tu;ional, such unconstitutionality shall not effect the validity
of the remainingparts of this Chapter. The Board of Trustees of the "i .lage
of Mount, Prospect hereby declares, that it would have passed the remaining
parts of this Ordinance if it had known that such part or parts thereof would
be unconstitutional.
SECTION FOUR. That this Ordinance shall be in full force and effect from and
