ILLINOIS WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet on the 21st day of November, 1974, at the hour of 8: 00 p.m., at the Mount Prospect Village Hall and did hear Case No. 47-V-74, pursuant to proper legal notice; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hear this request to construct a screened -in porch on an existing concrete slab to within ten feet four and one-half inches (10' 411 11) instead of the required twenty feet (201) on the lot commonly known as 222 North William Street, Mount Prospect,, Illinois; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did re'pomr- mend to the President and Board of Trustees of the Village of Mount Prospect the approval of this request under Case No. 47-V-74 for the reasons that: There is a practical difficulty and particular hardship on the petitioner; (2) The purpose of the variation is not based exclu- sively upon a desire to make money; (3) The conditions upon which the petition for this variation is based are unique in that its layout is not similar to any other lot in the area, being a corner lot of unusual physical shape; and (4) The granting of this variation will not be detri- mental to the public or injurious to surrounding property in that it will not alter the essential character of the locality; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have reviewed the matter herein and have determined that the same is in the best interests of the Village of Mount Prospect; NOW. THEREFORE , BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the property being the subject matter of Case No. 47-V-74, being legally described as follows: Lot One (1) in Block Nine (9) in Bluett's Subdivision of part of the North Half Q (2') of the southeastuarter 4 G) of Section 34, Township 42 North. Range 11, East of the Third Principal Meridian, according to Plat thereof registered in the Office of the Registrar of Titles of Cook County, Illinois,, as Document No. 1464233, is currently zoned under the Zoning Ordinance of the Village of Mount Prospect as R-1 (Single Family Residential) District, which zoning classification shall remain in effect subject to the variation granted herein: N That the rear yard abutting the frontmost lot line of the subject property adjacent to Isabella: Street be reduced to ten feet four and one-half inches (1014-1"). 2 SECTION TWO That all requirements of the Mount Prospect Building and Zoning Code, shall be applicable except the variation noted in SECTION ONE heretofore mentioned. SECTION THREE: That the Director of Building and Zoning of the Village of Mount Prospect is hereby authorized to issue a building permit for construction in accordance with the variation hereinbefore mentioned. SECTION FOUR: That the variation granted by this Ordinance shall be null and void and of no force and effect whatsoever unless an application for a building permit pursuant to such variation is made and construction commenced within one (1) year of the date this said Ordinance becomes effective. A RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT FOR THE REGULATION OF TRAFFIC AND PARKING FOR CERTAIN AREAS OF "HUNTINGTON COMMONS" WHEREAS, Section 6 (a) of Article VII of the 1970 Constitution of the State of Illinois provides that "any municipality which has a population of more than 25, 000 (is) a Home Rule Unit" and the Village of Mount Prospect , Cook County . Illinois , with a population in excess of 25, 000 is, therefore, a Home Rule Unit and may, under the power granted by said Section 6 (a) of Article VII exercise any power and perform any function pertaining to its government and affairs; and WHEREAS, pursuant to such authority.. the Mayor and Board of Trustees of the Village of Mount Prospect have heretofore passed and approved Ordinance No. 2534 on Novem- ber 5, 1974, adding Section 8.509 to the Mount Prospect Municipal Code, which Sec- tion provides that the President and Board of Trustees of the Village of Mount Pros- pect shall have the power to contract with the owners of record of driveways and parking areas located upon., within, and/or through Planned Unit Developments lying within the corporate limits of the Village of Mount Prospect to regulate traffic and parking and enforce such regulations upon the said driveways and parking areas located upon, within, and/or through such Planned Unit Developments; and WHEREAS, the Mayor and Board of Trustees of the Village of Mount Prospect believe it to be in the best interests of the Village of Mount Prospect that such an agreement be made with the owners of that certain Planned Unit Development commonly known as "Huntington Commons". NOW . THEREFORE , BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the Mayor and Village Clerk be authorized to sign and attest that contract attached hereto and hereby made a part hereof as Exhibit 1, for the regulation of traffic and parking upon Huntington Commons Road, Hunt Club Drive, Quail Walk, Partridge Lane, and Dove Court, and certain parking areas of that Planned Unit Development commonly known as "Huntington Commons". SECTION TWO: That this Resolution shall be in full force and effect from and after its passage, approval, al, and publication in the manner provided by law. AN ORDINANCE ANNEXING RIVER TRAILS PARK DISTRICT PROPERTY NORTH OF EUCLID AVENUE TO THE VILLAGE OF MOUNT PROSPECT. ILLINOIS WHEREAS, the Board of Park Commissioners of River Trails Park District, Cook County, Illinois., have adopted a Resolution recommending the annexation of one (1) parcel of real estate hereinafter legally described to the Village of Mount Pros- pect; and WHEREAS, a certified copy of said Resolution was duly filed with the Village Clerk of the Village of Mount Prospect-, and WHEREAS , a written petition under oath duly executed by the said Board of Park Com- missioners of River Trails Park District, being the owner of record of said parcel of real estate hereinafter described has been filed with the Village Clerk of the Village of Mount Prospect t requesting that said land be annexed to the Village of Mount Pros- pect; and WHEREAS , no electors reside within the said property to be annexed; and WHEREAS , the said land is not within the corporate limits of any municipality, but is contiguous to the Village of Mount Prospect; and WHEREAS , the President and Board of Trustees of the Village of Mount Prospect find and believe it to be in the best interests of the said Village that the said land and terri- tory be annexed thereto; NOW , THEREFORE , BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That all land and territory legally described as follows: The Southwest Quarter ("D of the Northeast Quarter (1) of 4 Section 26 (except the West 686.5 feet thereof and that part lying South of the North line of Euclid Avenue as per Docu- ment No. 12599682 and lying North of the South Line of the Southwest Quarter U) of the Northeast Quarter (I4 ) of Sec- tion 26), all in Township 42 North, Range 11 East of the Third Principal Meridian, in'Cook County, Illinois, an accurate map of which territory is attached hereto and hereby made a part hereof by this reference be and the same is hereby annexed to the Village of Mount Prospect, Cook County, Illinois. d SECTION TWO: That Map 41N contained in SECTION ONE of Ordinance No. 2410, passed and approved March 20 , 1973 be amended to reflect the extention of the corporate limits of the Village of Mount Prospect to include the property herein- above described and hereby annexed. Upon roll call the following responded as present: Grier, Kloster, Lorensong Ross, Busenhart. Absent; Schultz, Velasco,, Weibel and young. Louis Velasco entered the meeting at 7:38 P.M. APPROVAL OF MINUTES OF MEETING OF JANUARY 159 1975 Mr. Lorenson moved, seconded by Mr. Grier, that the minutes of January 15, 1975 be approved as distributed. Motion carried* RIVER TRAILS PARK DISTRICT ANNEXATION PLAT Mr. Grier moved, seconded by Mr. Kloster, that we accept the plat of annexation of the River Trails Park District and that the vice chairman and the secretary be authorized to sign the linen. Motion carried* MARY KATHRYN PELFRESNE'S RESUBDIVISION, NORTH OF ALGONQUIN ROAD Attorney Zimmerman notified the Planning Commission that the above subdivision had been withdrawn. SEMAR-HOME BUILDERS RESUBDIVISION Mr. Grier moved, seconded by Mr. Ross, that the commission approve Semar-Home Builders Resubdivision with the awareness under Section 16 of the subdivision ordinance, and Section 11, which allows a variance in the depth of the lot (in this case from 120' to 1161) because all property behind the subdivision is developed, and this plat does not meet the RX Standards, but it is before the Zoning Board to be rezoned from RX to Rl -- thus the Planning Commission would approve the plat of resubdivision and authorize the vice chairman and the secretary to sign the linen. Motion carried. DiMUCCI-GOLF-BUSSE SUBDIVISION The commission reviewed the proposed subdivision and requested that it be resub- mitted and that on the linen the sidewalks and the easement for Busse Road be listed. CAMP McDONALD AND RIVER ROAD SUBDIVISION This plat will be resubmitted showing the sidewalks. Mr. Weibel entered the meeting at 8:50 P.M. COMPREHENSIVE PLAN Mr. Grier, chairman of the Comprehensive Plan Committee, distributed maps which had been received. He also reported that the Plan Commission should be in attendance at the public hearing which will be held February 11, 1975. At that time the commission will present to the Village Board the Comprehensive Plan. COMMUNITY DEVELOPMENT PLAN AND PROGRAM The commission considered the memorandum from Mayor Teichert relative to the above topic. The commission had difficulty in deciding just how the Plan Commission should react to the memorandum, thus Vice Chairman Ross will consult with the village manager and/or attorney Zimmerman for direction. ADJOURNMENT Since there Was no further business to be brought before the commission at this time Vice Chairman Ross adjourned the meeting at 9z5O P.M.
