CALL TO ORDER
Mayor Teichert called the meeting to order at 8:00 P. .

This special meeting of the Mayor and Board of Trustees of
the Village of Mount Prospect was called by Mayor Telchert
on Tuesday, May 6, 1975 pursuant to Chapter 2 "The Board
of Trustees" Section 2.103 ""Meetings" as specified in the,
Muni cipal,Code of Mount Prospect. The purpose of the meet-
ing was to consider the A. J. DavisCo,trep maintenance
contract and a public library referendum.
A. J. DAVIS CO. CONTRACT
Trustee Minton posed several questions regarding man-hours
expended and Village personnel used in conjunction with the
A. J. Davis Co. personnel. The Public Works Director ex-
plained the operation of his department 'and his tree care
program, as well as the work performed by' the outside con-
tractor. After consideration discussion, Trustee Floros,
seconded ' by Trustee Richardson, moved to award the tree main-
tenance contract to A. J. Davis Co. effective May 1, 1975 at
a cost not to exceed $35,000,00.

CONSIDERATION OF PUBLIC LIBRARY REFERENDUM
Memorandums had been distributed to the Board from Paul D.
Speer & Co. and Chapman & Cutler and the Library Board re-
garding the proposed new library and the issuance of bonds
and the 'effect of a referendum. The Village Attorney gave
an opinion on the legal aspects., After review of the vari"
ous reports it was the sense pf.the majority of the Board
to proceed with the construction of the new library.
Interested citizens, Mrs. Cay]or, Idyl Nipper and Anton Dvylis
all expressed their approval of the Board's decision.
Mayor Telicher t read the following letter and requested i be
made a part cif these minutes: May 22, 1975
"To.- The Pres ' ident and Board of Directors of the
Mount Prospect Public Library
and the President and Board of Trustees of the
Village of Mount Prospect
Ladies and Gentlemen:
Please consider this an open, public letter and notice to all
of you of a unique problem that may develop in conjunction
with the proposed new library building in Mount Prospect.
For 70 years, my family-owne,d company, of which I am a stock-
holder and President, has sold fire prevention equipment
on both a retail and wholesale level to thousands of customers
throughout the country. As you know, selling to wholesalers
means that we have no idea who the end-userof our products
w ill be nor do we have any control over this part of our
business.
Early this week, I was requested to give our current prices'
on equipment to a customer who happens to be a Contractor,
and who also happens to be Interested in quoting on the
construction bid for the proposed new library. At this
point I realized that this could develop Into an embarrassing
situation and I asked our Village Attorney, Mr. Zimmermann,
for guidance.
Mr. Zimmermann informed me that under present laws in Illinois
it could be considered a conflict of 'Interest if any products
originally sold by my company went into the new building.
Whether I vote or not on the awarding of bildsor-have no ad-
vance knowledge of where the equipment is,going, does not re-
ible cloud over the situation.

Please let me inform all of you that I will not cast; a vote
concerning the awarding, approval or recommendation of any
contractor to -building the new building. Also, I will not
knowingly sell my company's products to any source whereby
they might wind up in the -new building. However, we sell to
hundreds of wholesalers and move thousands of product items
each month, therefore it will be impossible for me to give you
my guarantee that some of these items will not be involved in
the new building. I will guarantee you that if this happens,
it will not be with my prior knowledge.
I suppose the best way to remove the problem would be to re-
move myself from the Library Board. This I will not do. I
have served on two separate Village library boards since 196�,

and I feel that my past record denotes my', honesty.... If the
above,mentlioned situation does come to pass, Iit "will not be
of my doing. If someone wants 'towave the issue of "conflict
of' interest" let them be damned..
Please understand my desire to avoid embarrassment assment for any
board, its. members, , or my company,, and I sincerely hope that
I have your help and under &tandilng in this matter."

Some time after the fire which substantially destroyed the house at the above location, the
Board of Trustees authorized me to file a demolition suit with the Circuit Court of Cook County,
In this type of litigation, municipalities seek the order of the court to allow the municipality
involved to raze and demolish the specific building which has been declared unsafe.
Immediately following the authorization by the Board of Trustees, I set about obtaining the
permanent tax index number and legal description of the above captioned property. While
we had reason to believe the sole owner was one Charles Gillison, I feel that in demolition
and condemnation cases it is extremely important to serve the proper parties -- in that fail-
ure to serve all necessary parties is fatal to the cause of action. I have applied to Chicago
Title and Trust Company for a necessary parties policy in the nominal amount of $1,000.00
-- which policy will also guarantee the Village's lien upon the property upon entry of the
co-L"Trt order, which lien would be in the amount of the costs for the demolition of the building.
For some two to three months, no action on this policy was forthcoming because we had pro-
vided an inaccurate address and legal description of the above property. In addition, we
were busy contacting lawyers who had become involved with Charles Gillison to determine
whether the building would be sold or renovated voluntarily -- in an effort to save the
lage some tax dollars.
It now appears that our efforts to achieve a voluntary demolition, renovation , or sale are
fruitless. Meanwhile, we have finally ordered down a new policy from Chicago Title and
Trust Company with an accurate legal description and the true address of the property --
304 West Memory Lane. Our Complaint is in ready form. When the necessary parties names

Some may question the reasonableness of seeking a voluntary demolition of the building. Tit.

Village of Mount Prospect took over five years to finalize. Accordingly, I felt 'it prudent to
seek other means than the courts to accomplish the ultimate goah To make the intersection
of Memory Lane and Elmhurst Road aesthetically pleasing once again through the razing of
this unsightly and structurally unsound building.
