Maple PETITIONER: Ken and Anita Chapman PUBLICATION DATE: May 9, 2007 PIN NUMBERS: 08-12-105-005-0000 REQUEST: Conditional Use - Unenclosed Porch in front yard MEMBERS PRESENT: Richard Rogers, Chairperson Joseph Donnelly Leo Floros Marlys Haaland Mary McCabe Ronald Roberts Keith Youngquist STAFF MEMBER PRESENT: Judith Connolly, Senior Planner Ellen Divita, Deputy Director of Community Development INTERESTED PARTIES: Anita Chapman, Larry Kowalczyk Chairman Richard Rogers called the meeting to order at 7:32 p.m. Joseph Donnelly moved to approve the minutes of the April 26, 2007 meeting and Leo Floros seconded the motion. The minutes were approved 6-0, with Keith Youngquist abstaining. Chairman Rogers thanked former Planning and Zoning Commission Chairperson Arlene Juracek and Trustee Michaele Skowron for their years of service to the Village. Mr. Donnelly made a motion to continue Cases PZ-15-07 and PZ-16-07 to the June 28, 2007 Planning and Zoning Commission Meeting. Mr. Youngquist seconded the motion. The motion to continue was approved 7-0. Chairman Rogers introduced Case PZ-17-07, a request for a Conditional Use at 9 South Maple Street, at 7:37 p.m. Judith Connolly, Senior Planner, stated that the Subject Property is located on the east side of Maple Street, between Central Road and Busse Avenue, and contains a single-family residence with related improvements. The Subject Property is zoned RA Single-Family Residence and is bordered on all sides by the RA District. Ms. Connolly said the Petitioner is proposing a number of improvements to the property that include updating the existing landscaping, removing the existing patio in the rear yard, and the construction of an unenclosed porch. The proposed unenclosed porch would extend along the entire front elevation of the house and then wrap around it. She stated that the Petitioner's exhibits indicate the porch would have a wood floor, railings, and columns. Also, there will be a decorative lattice screen around the base of the porch. The proposed porch will extend 5-feet from the house, resulting in a 25-foot front yard setback. Therefore, the proposed porch requires Conditional Use approval. Ms. Connolly stated that the standards for Conditional Uses are listed in the Zoning Ordinance and include specific findings that must be made in order to approve a Conditional Use. These include: . The Conditional Use will not have a detrimental impact on the public health, safety, morals, comfort or general welfare; Richard Rogers, Chairman Planning & Zoning Commission Meeting May 24, 2007 PZ-17-07 Page 2 . The Conditional Use will not be injurious to the use, enjoyment, or value of other properties in the vicinity or impede the orderly development of those properties; . There would be adequate provision of utilities, drainage, and design of access and egress to minimize congestion on Village streets; and . There would be compliance of the Conditional Use with the provisions of the Comprehensive Plan, Zoning Code, and other Village Ordinances. Ms. Connolly said the existing residence complies with the Village's zoning regulations, but the detached garage does not because it encroaches into the required side yard setback. The garage is allowed to remain in its current location because it is a legal non-conformity. She showed a table comparing the Petitioner's proposal to the RA Single-Family Residence District's bulk requirements. Ms. Connolly stated that the proposal would not adversely affect the character of the surrounding neighborhood, utility provision, or public streets. Also, the proposed Conditional Use will be in compliance with the Village's Comprehensive Plan and Zoning Ordinance. Ms. Connolly said the proposed unenclosed porch meets the Conditional Use standards contained in Section 14.203.F.8 of the Zoning Ordinance. Based on this analysis, Staff recommends that the P&Z approve the following motion: "To approve a Conditional Use for an unenclosed porch to encroach into the front yard resulting in a 25- foot setback, as shown on the Petitioner's site plan and elevations prepared by Kostak Associates, PC, dated April 26, 2007, for the residence at 9 South Maple Street, Case Number PZ-17-07." Ms. Connolly stated that the Planning and Zoning decision is final for this case. Chairman Rogers stated that he saw the petition signed by the neighbors in support of the project. Chairman Rogers swore in the Petitioner Anita Chapman of 9 South Maple Street, Mount Prospect, Illinois. Ms. Chapman gave a brief history of the home and project. She stated that the landscaping in the front yard is dying out and will need to be replaced. The front porch would be replacing the existing landscaping and they would plant new landscaping material in-front of the new porch. She said they will be maintaining the large maple tree in their yard. Chairperson Rogers asked the Petitioner if she understands that this is a Conditional Approval and that the porch must remain unenclosed. Ms. Chapman stated that she understands the Condition. Chairperson Rogers swore in Larry Kowalczyk of 11 South Maple Street, Mount Prospect, Illinois. Mr. Kowalczyk stated that he was there tonight in support of the Chapman's project. Chairperson Rogers called for additional comments or questions. Hearing none, the public hearing was closed at 7:43 p.m. Keith Youngquist made a motion to approve Case Number PZ-17-07, a Conditional Use for a unenclosed front porch at 9 South Maple Street. Ronald Roberts seconded the motion. UPON ROLL CALL: AYES: Donnelly, Floros, Haaland, McCabe, Roberts, Youngquist, Rogers NAYS: None Motion was approved 7-0.
