RESOLUTION NO.
A RESOLUTION OBJECTING TO PROPOSED
COUNTY ZONING AMENDMENT
WHEREAS, the Zoning Board of Appeals of Cook County has presently pending
before it a proposal to reclassify the property hereinafter described, commonly
known as the Magnus Farm, to the R-7 General Residence District under the
proposed Comprehensive Amendment to the Cook County Zoning Ordinance; and
WHEREAS, the reclassification of the subject property to said classification would
permit the development of said property for high density multiple -family develop-
ment; and
WHEREAS, said property is contiguous to the Village of Mount Prospect and the
development of the subject property under the R-7 classification would be highly
detrimental to the, public health . safety , and welfare of the citizens of the Village
of Mount Prospect; and
WHEREAS , the Appellate Court of this District has held that restrictive covenants
as conditions for rezoning are invalid and void; and
WHEREAS o if the present owners of the subject property wish to develop it for an
extension of the existing nursing home and home for the aged use, they have the
privilege of seeking a use '
I e and planned development under the R-5 Single-
Family Dwelling District to accomplish said development;
NOW I THEREFORE 'BE IT RESOLVED BYTHE MAYOR AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT I COOK COUNTY o ILLINOIS:
SECTION ONEV- That pursuant to the provisions of the County zoning Enabling Act
and, the, Cook County, Zoning Ordinance , the Village of Mount',Pr,ospect does hereby
object to the reclassification of the property legally described as. -
The Northeast Quarter (4) of the Northwest Quarter (14) of
Section 10, Township 41 North, Range 11 East of the Third
Principal Meridian, in Cook County, Illinois,
which property is located at Central Road and Douglas Street in Elk Grove Town-
ship and is commonly known as the Magnus Farm , to the R-7 General Residence
District classification. The Village of 'Mount Prospect hereby requests that said
property be classified for the R-5 Single -Family Dwelling District under the Com-
prehensive Amendment to the Cook County Zoning Ordinance.
SECTION TWO,: That the Village Clerk 'of the Village of Mount Prospect is hereby
directed to file a certified copy of this Resolution with the Honorable Stanley T.
Kusper, Jr., County Clerk of Cook County, 118 North Clark Street, Chicago, Illi -
