WHEREAS , PARKWAY BANK AND TRUST COMPANY as Trustee under Trust
No. 11.31, dated March 27, 1969, hereinafter referred to as the "Owner", is the
owner of certain real estate hereinafter referred to as the "subject Property",
which is legally described as follows:
The East 205.10 feet of the West 434.20 feet (measured
along a line parallel with the North line) of Lot 2 (ex-
cept the North 703.79 feet thereof and except that part
taken for Algonquin Road) in Edward Busse's Division
of part of the Southeast Quarter (D of section 15 and
Northeast Quarter Q) of section 22, Township 41 North,
Range 11 East of the Third Principal Meridian, in Cook
County, Illinois;
WHEREAS, the VILLAGE OF MOUNT PROSPECT, a municipal corporation
organized under the laws of the State of Illinois, hereinafter referred to as the
"Village", has the power under state law to enter into an agreement such as set
forth herein; and
WHEREAS , all parties believe it to be in the hest interests of the Village and
the Owner that this agreement be entered into;
NOW, THEREFORE , it is agreed by and between the Village and the Owner
1. That, within sixty (60) days after the execution of this agreement,,
the Owner will cause the ownership and title to certain water and sewer mains
to be transferred to the Village substantially as shown upon Exhibit A , attached
hereto and hereby made a. past hereof. Further, within the said sixty (60) day
period, the Owner will dedicate to the Village five (5) foot easements for the
maintenance, access, and extension of such water and sewer mains located on
its private property substantially as shown upon the Plat of Dedication of Ease-
ment attached hereto and hereby made a part hereof as Exhibit B.
2. That upon receipt of the title oft aforesaid mains as well as the

recordation of the aforesaid maintenance easements , the Village will maintain
the said mains 'thereafter.
3. That the Village agrees to supply potable water to the Subject Pro-
perty subject to each and every applicable statute, law or municipal ordinance.
IN WITNESS WHEREOF, the parties hereto have set their hands and seals
