AN ORDINANCE ANNEXING PROPERTY GENERALLY LOCATED SOUTH OF ALGONQUIN ROAD AND COMMONLY KNOWN AS EAST ALGONQUIN ROAD WHEREAS, a written petition under oath signed by the owners of record oif land hereinafter described has been filed with the Village Clerk of the Village of Mount Prospect, requesting that said land be annexed to the Village of Mount Prospect; and WHEREAS, no electors resl,de within the said properfy to be annexed; and WHEREAS, the said land is not within the corporate limits of any municipality, but is contiguous to the Village of Mount Prospect; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect find and believe it to be in the best interests of the said Village that said land and territory be annexed thereto; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY., ILLINOIS: SECTION ONE.- That all land and territory legally described as follows: an accurate map of which, territory is attached hereto, and hereby made a part Iriereof by this reference be and the same ishereby annexed to the Vi'lla,ge of Mount Prospect, Cook County, Illinois. SECTION TWO- That Map 39-S contained in SECTION ONE of Ordinance No. 2410, passed and approved March 20, 1973, be amended to reflect the extention of the corporate limits of the Village of Mount Prospect to include the property herein- above described and hereby annexed. 0 SECTION THREE,: That the Village Clerk of the Village of Mount Prospect is hereby directed to file in the Office of the Recorder of Deeds of Cook County, Illinoisq a certified copy of this Ordinance, together with an accurate map of the territory annexed. AN ORDINANCE GRANTING SPECIAL USES FOR PROPERTY ,,W,,,W—COMMONLY KNOWN AS 1031 EAST ALGONQUIN ROAD WHEREAS, the President and Board of Trustees of the Village of Mount Prospect and Northwest National Bank of Chicago, as Trustee under Trust No. 998, heretofore entered into a certain Annexation Agreement dated 1973 , with respect to the property hereinafter described; and WHEREAS, prior to the execution of the said Annexation Agreement the Zoning Board of Appeals of the Village of Mount Prospect held hearings on September 27, and Octo- ber 4. 1973, at the hour of 8: 00 p.m. , in the Mount Prospect Village Hall pursuant to notice published in the manner provided by law-, and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect heard testi- mony presented under Case No. 38 -SU -73 pertaining to a request for certain special uses pursuant to the Mount Prospect Zoning Ordinance to permit certain uses upon the property hereinafter described; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect has filed a report with the President and Board of Trustees recommending that such special uses be allowed for the reasons stated therein; and WHEREAS, said property has been annexed to the Village of Mount Prospect and duly classified in the I-1 Light Industrial District-, and WHEREAS, pursuant to the aforesaid Annexation Agreement, the Village has agreed that it will adopt an ordinance pursuant to the Mount Prospect Zoning Ordinance per- mitting certain special uses on the subject property; and WHEREAS, the Village has iven all the notices and held all of the public hearings 91 required by law to be held in connection with the approval of such Annexation Agree- ment and of the special uses hereinafter authorizedl and WHEREAS , the President and Board of Trustees of the Village of Mount Prospect have reviewed the said proposed special uses and have determined that the same are in the best interests of the Village of Mount Prospect; NOW,w THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: ,SECTION ONE.- That pursuant to the Mount Prospect Zoning Ordinance, the following special uses are authorized on the property described in SECTION TWO hereinbelow: (A) Retail sales and service of every kind; (B) Agrieultural, BtAldings and '",.)-trttctures; (C) Cai,',1age and Express Facl.lities.; and, (D) Greenhouses. SECTION TWO.- That special uses authorized to be established in SECTION ONE above shall be valid and effective only upon the following property legally described as.- Lot 1 in ALGONQUIN-BUSSE INDUSTRIAL PARK, being a Subdivision M f part of the West Half of the Northwest Quarter of Section 23, Towns - ship 41 North, Range 11 East of the Third Principal Meridian, in Cook County, Illinois, ALSO That part of vacated Imperial Court extended into Lot 1 of Algonquin -Busse Industrial Park aforesaid, ALSO that part of the West Half of the Northwest Quarter of Section 23 , Town- ship 41 North, Range 11 East of the Third Principal Meridian, bounded by a line described as follows: Commencing at the intersection of the West line of the East 473. 11 feet of the West Half of the Northwest Quarter of said Section 23, with the Southerly line of Algonquin Road; thence North 62 degrees, 43 minutes, 45 seconds West along the South- erly line of said road 200. 0 feet; thence South 27 degrees, 16 minutes, 15 seconds West 165.16 feet to a point on the North line of the South 1565.39 feet of the West Half of the Northwest Quarter of said Section 23, thence North 89 degrees , 6 minutes , 55 seconds East along said North line 253.47 feet to a point on the West line of the East 473.11 feet of the West Half of the Northwest Quarter of Section 23 aforesaid; thence North 00 degrees, 00 minutes, 30 seconds East along said West line 51.25 feet to the point of beginning, in Cook County, Illinois, which property has been zoned 1-1 (Light Industrial District) and which zoning classi- fication shall remain in full force and effect. ANNUAL RESOLUTION AUTHORIZING APPLICATIONS FOR PERMITS FROM THE ILLINOIS DIVISION OF HIGHWAYS WHEREAS, the Village of Mount Prospect . located in the County of Cook . State of Illinois, desires to undertake, in the year 1974, the location, construction, opera- tion, and maintenance of driveways and street returns, watermains, sanitary and storm sewers, street lights, traffic signals , sidewalks , landscaping , etc on State highways , within said Village of Mount Prospect, which by law and/or agreement come under the jurisdiction and control of the Department pf Public Works and Buildings of the State of Illinois hereinafter referred to as Depart- ment; and WHEREAS, an individual working permit must be obtained from the Department prior to any of the aforesaid installations being constructed either by the Village of Mount Prospect or by a private person or firm under contract and supervision of the said Village of Mount Prospect; NOW THEREFORE,, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT. COOK COUNTY, ILLINOIS,- SEZCTION' ONE.: That the Village of Mount Prospect hereby pledges its good faith and guarantees that all work shall be performed in accordance with the conditions of the permit to be granted by the Department, and to hold the State of Illinois, De- partment of Public Works, and Buildings harmless on account of any damages that may occur to persons or property during the prosecution of such work, and assume all 116bility for damages to persons or property due to accidents or otherwise by rea- sonof the work which is to be perforined under, the provisioI a n' of s id permit. SECTION TWO.- That all authorized officials of the Village of Mount Prospect are hereby instructed and authorized to sign said working permit on behalf of the Village of Mount Prospect. SECT"10N THREE: That the Village Clerk is hereby directed to forward a certified copy of this Resolution to the Office of the District Engiivision of Highways, State of Illinois.
