AN ORDINANCE GRANTING A VARIATION FOR. PROPERTY LOCATED AT 320 WEST CENTRAL ROAD WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet on January 31, 19 74, at the hour of S: 00 p. m. in the Tillage Hall and did hold a public hearing under Case No. 6-V-74, pursuant to proper legal notice; and WHEREAS, the Zoning Board of Appeals of the "Village of Mount Prospect did hear a petition requesting a variation to enlarge a presently non -conforming residential use in an otherwise commercial building located in the B-3 (Business -Retail and Service) zoning district under the Zoning Ordinance of the Village of Mount Prospect; and WHEREAS, the Zoning Board of Appeals of the "Village of Mount Prospect has recom- mended to the President and Board of Trustees of the Village of Mount Prospect the granting of this variation by a vote of 6- 0 and has found that: 1. There is a practical hardship on the petitioner in that the present structure is a sixteen year old building in which there is a 4 -room apartment used as living quarters; and that due to an increase in the family status, the petitioner is in need of additional room; 2 The purpose of the variation is not based exclusively upon the desire to make money; 3. The granting of the variation will not be detrimental to the public or injurious to surrounding property in that it will not alter the essential character of the locality; and WHEREAS , the Building Committee of the Board of Trustees of the Village of Mount Prospect did subsequently meet on February 21, 1974, and considered Case No. 6-V-74, and recommended to the President and Board of Trustees that the variation requested under the said Case No. 6-V-74 be granted; and WHEREAS, the President and Board of Trustees have reviewed the matter herein and have determined that the same is in the best interests of the Village of Mount Prospect; NOW , THEREFORE , BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT , COOK COUNTY , ILLINOIS: SECTION ONE: That the property being the subject matter of Case No. 6-V-74, "being legally described as follows: Lot 9, 10, 11, 12, 13 and 14, Block 25 Prospect Manor subdivision, of part of the South Three -Quarters (3/4) of the West Half (1/2) of Section 34, Township 42 North, Range 11 East of the Third Principal Meridian, in Cook County, Illinois; is currently zoned under the Zoning Ordinance of the Village of Mount Prospect as B-3 (Business -Retail and Service) District, which zoning classification shall remain subject to the variation granted hereinbelow: 0 That there be allowed one (1) dwelling unit consisting of a total of seven (7) rooms and located on the second floor level and at the rear of the existing funeral parlor building. SECTION TWO: That, except for the variation granted in SECTION ONE hereinabove, all other requirements of the Building Code and Zoning Code of the Village of Mount Prospect shall be applicable including the requirement that the three (3) room addi- tion applied for under Case No. 6-V-74 be constructed in compliance with the codes relative to construction in Conflagration Hazard District Number 1. SECTION THREE: That, in accordance with the plans for the addition hereinabove mentioned, which plans are attached hereto and hereby made a part hereof as Ex- hibit I, the Director of Building and Zoning of the Village of Mount Prospect is here- by authorized and directed to issue a building permit in accordance with the varia- tion hereinabove mentioned. SECTION FOUR: That the variation granted by this Ordinance shall be null and void and of no force and effect whatsoever unless an application for a building per- mit pursuant to such variation is made and constructed commenced within one (1) year of the date said Ordinance becomes effective. SECTION FIVE: That this Ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law. NAYS: PASSED and APPROVED this day of 1974. Variations as to height, number of parking stalls, parking stall size, and loading space requirement. Thorp, Attornev, represented petitioner.' His witnesses, in order of their testimony, were: Mr. R. D. Padula, President,' Mount Prospect State Bank, Mr. P. M. Tsolinas, Principal, Peter M. Tsolinas & Associates, Inc., Mr, A. O. Peterson, Traffic Engineer, Barton- Aschman. Associates, Inc. ,,Mr. A. W. Pir)enhagen, President, Smith- Pipenhagen, Inc., Realtors and Appraisers, and.Mr. Schlaver of the Mount Prospect Chamber of Commerce. Mr. Padula testified that within the last five years there has been a 100% increase in their assets. The present bank quarters have become confined and inefficient, therefore the need for expansion, Land not being available necessitated the excessive building height ren ' uired to provide services. Presently, the bank cannot accommodate the full service needs of the community within the existing structure, The uniqueness of the business is 1. that it is necessary ' to the locality, a local it benefit, sery ce'that must be available o local residents. Tho project cost is estimated at $4,000,000.00. The plan -follows the redevelopment of the downtown area, -.i.nd is beneficicril' to the Village. I Mr. Tsolinas testified as to the site layout and architectural characteristics of the proposed building. 'lose to the North-East, corner of the site the proposed structure will be six stories (96 ft.) high, the exterior finishes are pre -cast marble quartz panels with anodized aluminum window mullions glazed with bronze tone glass. Building dimensions are 105 ft. by 105 ft. giving us 11,025 SF per floor. Building will have a fire sprinkler system throughout. Village Engineers and Fire Department have been conferred with. All local building codes will be met. Shadow and space affects were dis- cussed. Worst shadow would occur in December when two lots on Maple Ave. would be affected. Mr. Tsolinas felt that a six stoty edifice is a vital asset which must be kept within the downtown area. The Building would bring order to the chaotic downtown area. Mr. Peterson testified that Present traffic patterns are as follows: Saturday, Peak period; using Saturdav as 100% we get 50% traffic on Monday, Tuesday and Thursdav, 33% of Saturday numbers on Wednesdav and 75% on Friday, Existing Darkling situation confusing at best. Present lots one-way causing one chance only for finding Parking spaces. Further testimony by Mr. Peterson states that Parking vari- ation adequate in that bank needs can be complied with with re- duced parking. The proposed parking layout uses Busse and Emerson as main entrances and exits. Only drive-in traffic will go onto Maple Ave. Mr. Pippenhagen testified that under Present B-2.1 zoning ordinances the bank would not be economically feasible. A fair return could not be had under present rea ' uirements. Parking space requirements ade- quate for bank. It would be detrimental if bank had to move outside of area. Central business clusters around the local banks. There- fore, new bank would promote best and highest use for Dropertv. Mr. PiDpenhagen felt bank:will revitalize the downtown area. Mr. Schlaver, speaking for the Mount Prospect Chamber of Commerce, hoped the Board would act favorably, The C.hamber endorses the proposal. The bank would be a positive svmbol for a progressive revitalization of the Central Business District, Having heard the testimony, the Board felt that the bank is the logical leader in the revitalization of the downtown area. The structure will stand as a central monument to the beginning of a new era in which some order will be made out of the existing chaotic situation. The Board voted 4-0 to recommend both the rezoning of the areas and the following variations, a 68 ft. height variation, a 9 x 20 (1 ft.) variation in stall size, reduced parking from 1/200 to 1/300 SF of net space, a variation of one loading space from three to two. I AA ANORDINANCE ADOPTING AMENDMENTS TO THE BUILDING CODE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNTPROSPECT, COOK COUNTY, ILLINOIS: SEC,,,rION ONE,. That . pursuant to the authority vested in the Village of Mount Prospect unde"r Article VII of the 1970 Constitution of the State of Illinois as well as the Illinois Revised Statutes, Article I of Chapter 21 (Building Code) contained in the Municipal Code of Mount Prospect of 1957, as amended,, be and the same 16S hreby amended in its entirety by substituting therefor the following Article I: " ARTICLE I ENACTMENT AND SCOPE SECTION 21. 101. Pylyose. The purpose of this code is to provide for safety, health and public welfare through structural strength and stabi- lity, means of egress, adequate light and ventilation and protection to life and property from fire and hazards incident to the design, con- struction, alteration, removal or demolition of buildings and structures, and to regulate the architectural design of bungs or structures erec- ted or to be erected in the village limits of Mount Prospect. SECTION 21.102. Sc2pe,. The provisions of this code apply to the con struction., alteration, equipment, use and occupancy, location, mainte- nance of and additions to buildings and structures and to appurtenance such as vaults, areaways and street encroachments hereafter erected and, where expressly stated, existing on land or over water; and to buildings and structures and equipment for the operation thereof here- after moved or demolished in the municipality. The provisions of this code based on occupancy also apply to conversions of existing build- ings and structures or portions thereof from one occupancy classifica- tion to another. SECTION 21.103. A ption" of the BOCA Basic Bung,, Code. For the purpose of establishing rules and regulations for the construction , altera- tion, removal, demolition, equipment, use and occupancy, location and maintenance of buildings and structures, there is hereby adopted the 19 70 edition of the BOCA Basic Building,,, Code promulgated by the Building Of- als and Code Administrators International, Inc. , together with the 1973 Accumulative Supplement thereof , except such portions thereof as are here inafter expressly deleted, modified, or amended. I A. This code shall establish restrictions within fire limits and regulate the construction of all buildings and structures except where other provisions of this Chapter specifically cover the subject matter in question. B While the 1970 edition of the BOCA Basic Building Code and the 1973 Accumulative Supplement have hereinabove been adopted, the follow- ing exceptions thereto (consisting of certain deletions and changes) shall control wherever the said exceptions are applicable or are in con- flict with certain other provisions of the said BOCA Code and its sup- plements: 1. Deletions-, Section 128. 0 of Article 1, the entire Articles 14, 15, and 17 of the BOCA Basic Buildin Code as adopted in this Section are hereby deleted from this Chapter 21 of the Municipal Code of the Village of Mount Prospect. 2. B. All property 1 ing within, or which hereafter may be situated with- Yi in, the B-1, B-2, B-3, B-4 and I-1 zoning districts as delineated in the Village of Mount Prospect Zoning Ordinances shall be constru- ed as being in the said Conflagration Hazard District Number 1. All properties developed under special use ordinances for business uses or industrial uses shall be included in the Conflagration Haz- ard District Number 1. C. A building or structure shall be deemed to be within the Conflagra- tion Hazard District Number 1 if any portion of the area of such building or •structure is located therein. Nothing in this Article shall be interpreted to prevent the application of location limitations by the Village Zoning Ordinance. SECTION 21.302. Buildin Restrictions In Conflagration Hazard District Number 1. The following building restrictions shall apply as to all Yproperty 1 *nwithin the Conflagration Hazard District Numb ger 1 as 1 aforesaid: A. No building or structure of Type 4A or 4B wood frame construction as set forth in the Mount Prospect Building Code and the BOCA Code, shall be erected hereafter nor shall any wood frame addition be made to any existing building or structure in the said Conflagration Hazard District Number 1. B. No existing building or structure of wood frame construction shall be remodeled or substantially altered except where- the remodeling or alteration shall serve to reduce the risk of conflagration or fire spread. C jo, No building or structure of Type 4A or 4B wood frame and/or Type 2C construction lying within the said Conflagration Hazard District Number 1 which has been damaged by fire or other cause to the extent of 50% or more of its value shall be repaired or replaced, except by buildings or structures of other than Type 4A or 4B construction - D A building or structure of 4A or 4B wood frame or Type 2C con- struction lying within the said Conflagration Hazard District Num- ber 1 which has been damaged by fire or other cause to an extent of less than 50% of its value may be repaired or replaced provided the building or structure after repair or replacement shall not be increased to a size greater than its original dimensionso and further provided that combustible roof coverings shall not be used in the repair or replacement. B. Storm enclosures not exceeding •12 feet in height and not more than three feet wider than the entrance doors which they serve. Private detached garage buildings, which primary purpose is to house an automobile within the R -X and R-1 Single Family Resi- dence Districts,, provided said garage buildings: (1) do not ex- ceed 600 square feet 'in area nor 15 feet in height; and (2) have concrete floors as required in Section 21.1227; and (3) are locate -V not less than five feet from the interior lot lines nor less than six feet from any structure or building on the same lot. D Verandas , balconies , entrance porticos and similar permanent struc- tures on dwellings exceeding ten feet in depth nor projection two feet above the second story beams , may be erected of Type 4A construction provided that the same do not extend nearer than five feet from the lot line. E. Fences not exceeding the limitations of Article VII, Chapter 21 herein. F. Except as provided in paragraphs A to E herein, all exterior walls and roof of said buildings or structures are to be covered or con- structed of non-flammable materials. SECTION 21.306. ERoof CoveEL*n ings and structures within s. All build' the said Conflagration Hazard District Number 2 shall have roof cover- ings of tile, slate, approved asbestos shingles, or other roofings of a like grade, which rank'as Class A or B in the "Fire Protection Equip- ment List" of Underwriters' Laboratories, Inc., as defined and descri- bed in the pertinent Sections of this Building Code, among which..is Section 928 of the BOCA Code. SECTION 21.307. Moved Buildings. No building or structure of Type 4A or 4B wood frame and/or Type 2C construction, as described and defined in the BOCA Code, shall be moved from without to within the said Confla- gration Hazard District Number 2 , or from one lot to another in said Confla- gration Hazard District Number 2 or any other conflagration district. SECTION 21.308. Damaged Build A. No building or structure of Type 4A or 4B wood frame and/or Type 2C construction lying within the said Conflagration Hazard District Num- ber 2 which has been damaged by fire or other cause to an extent of more of its • value shall be repaired or replaced,, except by build- ings or structures of other than 4A, 4B or 2C type construction. buildin•g or structure of Type 2C � 4A or 4B wood frame construction lying within the said Conflagration Hazard District Number 2 which has been damaged by fire or other cause to an extent of less than 50% of its value may be replaced or repaired, provided the building or structure A fter repair or replacement shall not be increased to a size greater than its original dimensions, and further provided that combustible roof coverings shall not be used in the repair or replacement. SECTION 21.309. A bung or structure shall be deemed to be within the Conflagration Hazard District Number 2 if one-third (1/3) or more of the area if such building or structure is located therein. SECTION 21.310. The provisions of the Village of Mount Prospect Zon- ing Ordinance relating to non -conforming uses and structures shall not af- fect the requirements of this Article. ~ A. The Bureau of Fire Prevention, in conjunction with the Director of Building and Zoning of the Village of Mount Prospect, shall prepare or cause to be prepared a master map on which shall be accurately indicated the area and boundaries of the Conflagration Hazard Dis- tricts established by this Ordinance. Same shall be available 'in the office of the Village Clerk. B. A zoning map showing the boundaries of the various zoninv dis- tricts and special uses mentioned in this Article shall be a suffi- cient map for the purposes of this Section. SECTION 21.312. Automatic Detection and/or Extin,gPi'shmen,t of Fire, A. Authority is hereby conferred upon the Chief of the Fire Department to adopt and promogate rules based upo I n the standards of any na- tionally recognized organization embodying details for the installa- tion and construction of automatic sprinkler equipment and/or auto- matic fire detection equipment in such instances where, based upon the standards contained herein, any building or part thereof be- cause of its size, construction, occupancy, or lack of suitable pro- tective equipment, shall be deemed by the said Fire Chief or his duly authorized agent to constitute a special fire hazard to life or property or an excessive burden upon the fire extinguishing faci- lities of the Fire Department. B. All automatic sprinkler equipment and/or fire detection equipment *fied herein shall be inspected at least once each year by the speci Bureau of Fire Prevention and at all times maintained in proper operative condition by the owner or occupany of such building. The occupant (s) of such buildings containing such equipment shall promptly notify the Fire Prevention Bureau of the Fire De- partment in case such sprinkler system or any other equipment ified herein is withdrawn from such building, or the use of speci such equipment therein interrupted, curtailed, or altered. C. Automatic sprinkler equipment approved by any nationally recog- nized testing laboratory shall be installed and connected to an ade- quate water supply, with the sprinkler heads, valves,, and auxil- lary equipment being of standard types as determined by the Chief of the Fire Department. CW1. No automatic sprinkler equipment shall be installed or altered until plans have been submitted to the Bureau of Fire Prevention and ap- proved by the Chief of the Fire Department or his authorized agent, E. The Fire Chief shall require the installation of such approved auto- matic sprinkler equipment in all of the following instances based upon the standards contained therein: 1. CHURCHES, SCHOOLS and PUBLIC BUILDINGS. Throughout all buildings or structures over one (1) story in height and/or over 10,000 square feet in area; ME 2 . HOSPITALS , NUR ING , CONVALESCENT HOMES , and/or HOUSING FOR THE ELDERLY. Throughout all buildings or structures over 7500 square feet in area and/or exceeding one story in height; 3. THEATRES , PLACES OF ASSEMBLY, and/or RESTAURANTS. Throughout all buildings or structures, unless such theatres. places of assembler and/or restaurants are located on the ground floor and are less than. 10,000 square feet in area. 4. BUILDINGS CONTAINING FOUR STORIES OR MORE , MULTI -FAMILY HOUSES and/or DORMITORIES. In the basement, trash chutes, cellars,, common kitchens. store rooms, work.. rooms, dumbwaiters, hallways, and stairways of all multi -family houses and dormitories more than three (3) stories in height and more than two (2) stories in height if over 5400 square feet in area; 5. "HOTELS and/or MOTELS. a. In all basements. trash chutes, cellars, kitchens, store rooms, bailer or furnace rooms, work, rooms. dumbwaiters , hallways and stairways, and any ether areas where combus- tible materials are handled or stored; and b g Throughout all hotels and/or motels over three (3) stories in height; 6. BASEMENTS. 'Throughout all basements and cellars having an area of 2000 square feet or more used for the manufacture, storage or sale of combustible material or merchandise, or the housing of motor vehicles; 7. i` GARAGES. SECTION 21.313. Spe.cial Mrulations for all Buildin s Containin Four Stories or more. A. Standp,Tes 1. Standpipes and sprinkler fire department siamese connections shall be no further than ten (10) feet apart,, shall be located on the street or road side all of any such building, shall be readily accessible, and shall be located no further than 300 feet from the nearest operable fire hydrant - is 300 feet shall be measured along a route normally used by motor vehi- cles. 2. Wet standpipes for Class 11 and Class III service shall be pro - v ided on each floor. I a., All hose so installed shall be of a type single jacket rubber lined 300 P.S.I. Test with N.S.T. (National Standard Thread). b. Such standpipes shall be installed in accordance with the National Fire Protection Association Pamphlet No. 14. B. Elevators Fire Service 1. A two -position keyed switch shall be provided at the main floor for each single elevator and for each group of elevators. This keyed switch shall be located in the left door jamb of the elevator entrance. Where there is more than one elevator, the left elevator shall have the switch. The keyed switch shall be located not less than 61611 above the floor and approximately 41 below the head jamb. When the switch is in the "ON" position, the single elevator and all elevators in a group which are in normal service shall return non-stop to the main floor, and the doors shall open. The main floor shall be defM'ed as the floor where keyed switch is located. The main floor shall be determined by the Chief of the Bureau of Fire Prevention. Key shall not be removable when switch is *in the "ON" position. a. An elevator traveling away from the main floor shall reverse at the next available floor without opening its doors and re- turn non-stop to the main floor. b Door re -opening devices for power operated doors which may be affected by smoke or heat so as to prevent door closures shall be rendered inoperative. M"J c. Elevators equipped with power operated doors and standing at a floor other than the main or street floor shall close their doors without delay. d,, The emergency stop button in the car shall be rendered in- operative until the car reaches the main floor. e. All key switches shall be marked "ON" and "OFF". 2. A keyed switch shall be provided in or adjacent to the operating panel of each elevator. The switch, when operated, shall put the elevator on emergency service. The key shall be compatible with the Fire Department master key for all elevators located within the Village of Mount Prospect. a. When on emergency service an elevator shall be operable only by a person in the car. b Elevators on emergency service shall respond to the car buttons only and shall not be affected in their operation from registered corridor calls. c . Power operated doors shall remain closed when the elevator stops at any landing except the main floor until opened by continuous pressure on a door -open button orswitch. As soon as this door -open button switch is released, the doors shall automatically reclose. d. Where mechanical- electrical safety edge devices are installed on the leading edge ofthe car doors, these devices shall re- main operative and doors may be maintained in open position by operation of the device. Any features that may cause doors to reclose after in held a predetermined time shall be dis- connected. 3. Keys required to call or operate elevators shall be kept in a metal box mounted in a conspicuous location at the main floor as approved by the Bureau of Fire Prevention. The box shall have a lock -type cover which can be opened only by the Fire Department's alarm box key. The box shall contain a separate key for each elevator in the group. 4. When the elevator or elevators are controlled by an attendant, the operation of the key switch shall sound a bell mounted under the car platform as a signal to the attendant to return non-stop to the main floor. 5. Attendant operated elevators shall comply with all the provisions and operations, except that automatic operation is not re quired when the car control is manual through a car switch. 6. For double deck elevator installations, the upper deck 'i's to be used for Firemen's Emergency Control and as such will comply with all provisions of this section. 7. Every group of elevators in a building subject to the provisions of this Section shall be available for Firemen's emergency service. In buildings where there are several groups of elevators and where a individual key switches are provided to cause cars to return to the main floor, this arrangement is satisfactory provided that a separate key box is provided for each group of elevators. 8. Immediately adjacent to the Firemen's return switch in the car sta- tion, a pushbutton shall be provided to cancel all registered calls when the elevator is on Firemen's Control. The button shall be marked "Fire Cancel". This button shall not be required if all car calls are cancelled when the car makes its first stop. C. Fire Extinguishers and Pull Stations 1. Ten pound ABC Fire Extinquishers shall be installed in breakable glass fronted cabinets at locations meeting the requirements of "the standard for the installation of portable fire extinquishers", National Fire Protection Association Pamphlet No. 10. 2. Fire alarm systems shall conform to all requirements of the Nation- al Fire Codes hereinbefore adopted. D ecial Wirla'' 1. Non -energized wiring to provide emergency power for fire fighting and other fire department purposes shall be installed and located in each stairwell, at each floor level and at ground level -- all interconnected in the following manner: a. An N.E.M.A. L10 -30P or approved equivalent weatherproof corrosion resistant male with a snap type waterproof cover shall be installed adjacent to the Fire Department sprinkler connection (but not so as to interfere with same) and color coded red. b An N.E.M.A. LI0-30R or approved equivalent weatherproof corrosion resistant female with a snap type waterproof cover shall be installed in each stairwell, at each floor level and color coded red. c If these installations are not flush mounted, a waterproof enclosure shall be provided. d. Wiring shall conform to the following: T . H . W . # 8 3/411 con- duit , with ground from conduit to neutral , if exposed con- duit to be heavy wall, if concealed conduit to be thin wall for buildings up to 100 feet in height. e. T.H.W. 6 in 111 conduit, with ground from conduit to neu- tral, if exposed conduit to be heavy wall, if concealed con- duit to be thin wall for building over 100 feet in height. f. Wiring shall be 3 -pole 3 -wire grounded circuit conforming with N.E.M.A. L10-30. 2. Non -energized interconnected communication plugs and associa- ted wiring for fire fighting and other Fire Department purposes shall be located in the main floor lobby, at ground level, in each stairwell at each floor level. The exact location of such outlets shall be determined by the Fire Chief or his authorized agent. a. Wiring shall be 18 ANG Stranded twisted pair shielded in conduit not to exceed 1000 feet in length from lobby (ground floor) station with shield on grounded lug and twisted pair on remaining lugs, observing polarity at each connection. b. Receptacles shall conform to N.E.M.A. L5 -15R weatherproof corrosion resistant receptacle with snap type waterproof cover and color coded yellow. If installation is not flush mounted , a waterproof enclosure shall be provided. 3. Emergency lighting circuits shall be provided for all exit signs and in all corridors, stairwells, basementsassembly rooms, and any other public areas. Such lighting shall conform to the requirements of the National Fire Codes hereinbefore adopted. E. Blue ring L. Prior to the issuance of any building permit,, all plans, specifi- cations and blueprints for all construction shall be approved A the Bureau of Fire Prevention of the Mount Prospect Fire De- partment. I 2. All such blueprints shall conform to the requirements specified in "The Life Safety Code", National Fire Protection Association Pamphlet No. 101. F. Smoke Hatches Smoke hatches shall be provided in all stairways. Such hatches shall be activated by automatic smoke detection devises. 1. All stairways , shafts, corridors, boiler or furnace rooms, laundry rooms, storage rooms, trash rooms, janitor closets, mechanical equipment rooms shall be completely enclosed ant fire rated at no less than two hours. 2. One smoke proof tower shall be provided on all buildings exceeding six (6) stories in height. SECTION 21.314. Special Regulations for the Installation of Un,de Flammable Liquid Storag_e_Tanks or the Construction of Other Buil• near such Existing Tanks. service station tank or tank for the storage of gasoline motor fuel, or other flammable liquid shall hereafter be erected, built, constructed, or installed within the corporate limits of the Village of Mount Prospect by any person, firm, or corporation when the type of, number of, and/or ♦capacity of such storage tanks does not meet the requirements for same as prescribed by the ordinances of the Village of Mount Prospect or when such tank itself shall be installed within 300 feet from any tunnel or shaft, air or escape shaft for a mine, school, church, hospital, or public hall. '10 B No tunnel or shaft, air or escape shaft for amine, school, church, hospital, or public all shall hereafter be erected, built, construct- ed, or installed within the corporate limits of the Village of Mount Prospect by any person, firm, or corporation where the location of such proposed tunnel or shaft, air or escape shaft for a mine, school, church, hospital, or public hall is within 300 feet from any existing service station tank or tanks for the storage of gasoline, motor fuel, or other flammable liquid. C. The distances hereinabove enumerated shall be measured from the near edges of such tanks in all directors to the nearest point of such tunnel or shaft, air or escape shaft for a mine, school, church, hospital, or public all. D. "Public Hall" as used in this Section means any building or struc- ture which is used at any time for public meetings or the assem- bling of people for purposes of amusement, instruction or religious worship. SECTION 21.315. Ve, ntilation Panels. All perable buildings of a controlled at- mosphere design, having non-owindows or no windows at all, shall be constructed with the Fire Department ventilation panels at all floor levels at locations determined by the Chief of the Fire Prevention Bureau. SECTION 21.316. Conflict with Other Ordinances. Nothing in this Arti- cle III shall be deemed to conflict with any other law or ordinance of the Village of Mount Prospect or any such regulations contained in this Chapter, SECTION THREE : That this Ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
