ALGONQUIN JOINT VENTURES, By RICHARD FANSLOW will maintain control of the Planned Unit Development proposed on the property described as follow s.. ALGONQUIN JOINT VENTURES, By RICHARD FANSLOW does further covenant that for a period of twenty (20) years from the date of commencement of construction of said Planned Unit Development that it will, by contract(s), provide for adequate maintenance of all building exteriors, parking areas. and other paved areas, and of all open space located within said Planned Unit Development, which open space is defined as all of the land upon completion of construction of the said Planned Unit Development, less residential buildings, commercial buildings, parking areas and other paved areas. 3. That as final occupancy by residents occur as to each stage of develop- ment, ALGONQUIN JOINT VENTURES, By RICHARD FANSLOW will cause a Plat of Open Space Easement to be delivered to the Village of Mount Prospect for recordation, which, by said Plat, it is intended to permanently guarantee open space substantially in accordance with said approved Planned Unit Development and any amendment thereto. Said Plat of Open Space Easement shall constitute' a covenant running with the land for fifty (50) years from the date of said recording of those covenants and shall be enforceable by said Village of Mount Prospect. 4. The covenants herein contained shall run with the land for the periods of time set forth herein. Thereafter, said covenants shall be extended I ,?-utomatically for successive periods of ten (10) years unless by a vote of the majority of the said landowners of the said property it is agreed otherwise. 5. Nothing in these covenants shall in any way prevent alienation or sale of the subject property or portion thereof except that said sale shall be subject to the provisions hereof and of the Planned Unit Development Ordinance of the Village of Mount Prospect and the new Owner shall be both benefited and bound by the conditions and restrictions herein and therein expressed. By acceptance of these Restrictive Covenants, the Village of Mount Prospect acknowledges that its Ordinances relating to Restrictive Covenants has been fully complied with. 7. If the parties hereto, or any of them . or their heirs or assigns shall violate or attempt to violate any of the covenants herein, it shall be lawful for the other parties hereto, including the Village of Mount Prospect , to prosecute any proceedings at law or in equity against the per.son or persons violating or attempting to violate any such covenant -- and either to prevent him or them from so doing or to recover damages or other dues for such violation. AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY SO LOCATED THAT IT FRONTS ON THE SOUTH SIDE OF BUSSE AVENUE AND ON EMERSON AND MAPLE STREETS WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hold a special hearing on February 15, 1974, at the hour of 8: 00 p.m. , in the Mount Prospect Village Hall, pursuant to proper legal notice published in the Mount P,rospect Herald on January 31, 1974; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hear testi- mony presented under Case No. 9-V-74, pertaining to requests to locate and construct a bank building of up to eight (8) stories or ninety-six (96) feet in height, with addi- tional variations concerning parking: to provide less than the required one (1) space for each two hundred (200) square feet of floor area in the bank building, with the size of such spaces measuring nine feet by twenty feet (91x201) to provide for two (2) off-street loading areas instead of the three (3) required; and to provide for portions of such parking to be located off-site; and WHEREAS, the Zoning Board of Appeals of the Village of'Mount Prospect has recom- mended to the President and Board of Trustees of the Village of Mount Prospect to' allow the variations as presented; and 0 WHEREAS, the President and Board of Trustees of the Village of Mount Prospect subse- quently met on March 5, 1974, and considered the recommendations of the Zoning Board of Appeals under Case No. 9-V-74; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have reviewed the matter herein and have determined that the same is in the best interests of the Village of Mount Prospect. Village Clerk Village President ORDINANCE NO., AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY GENERALLY LOCATED AT 602- 610 ALGONQUIN ROAD MOUNT PROSPECT, ILLINOIS WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet on the 26th day of July, 1973, and the 9th day of August, 1973, at the hour of 8: 00 p.m. , at the Mount Prospect Village Hall and did hear Case No. 16-V-73, pursuant to proper legal notice; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hear this request for variations from the Zoning Ordinance requirements of density, floor area ratio, side yard, minimum floor area, and parking with respect to property here- tofore granted a special use in the nature of a Planned Unit Development; and 111THEREAS, the President and Board of Trustees of the Village of Mount Prospect - have reviewed the matter herein and have determined that the same is in the best interests of the Village of Mount Prospect; NOW THEREFORE , BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT , COOK COUNTY, ILLINOIS: SECTION ONE: That the property being the subject matter of Case No. 16-V-73, being legally described as follows: The East 205. 10 feet of the West 434.20 feet (measured along a line parallel with the North line) of Lot 2 (except the North 703. 70 feet thereof, and except that part taken for Algonquin Road) in Edward Busse's division of part of the Southeast Quarter of Section 15 and the Northeast Quarter of Section 22, Township 41 North., Range 11 East of the Third Principal Meridian, in Cook County, Illinois , is currently zoned under the Zoning Ordinance of the Village of Mount Prospect "r as R-4 -- PUD, which zoning classification shall remain in effect subject to the varia- tions granted herein: (a That the developer 9 ALGONQUIN JOINT VENTURES , be allowed a variation in density to construct a maximum of ninety-six (96) multi -family dwelling units in five (5) buildings pursuant to the Site Plan attached as Exhibit A to Ordinance No. _ granting a special use in the nature of a Planned Unit Development; (b) That the side yard requirement of twenty-seven feet five inches (27'511) be reduced to thirteen feet (131); (c) That the maximum floor area be reduced from six hundred (600) square feet to four hundred ninety-five (495) square feet-, (d) That parking stalls be reduced in size from ten feet by twenty feet (101x201) to eight feet by nineteen feet (81xl9l).
