AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY LOCATED AT 908 LONNQUIST BOULEVARD MOUNT PROSPECT, ILLINOIS WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet on the 21st day of February, 1974, and on the 28th day of March, 1974, at the hour of 8: 00 p.m. , at the Mount Prospect Village Hall and did hear Case No. 11-V-74, pur- suant to proper legal notice; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hear this request to allow the petitioner to construct a single family residence to within twenty feet (201) of the property line adjacent to We -Go Trail and to provide a thirty-eight foot (381) rear yard on the lot commonly known as 908 Lonnquist Boule- vard; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recom- mend to the President and Board of Trustees of the Village of Mount Prospect the approval of this request under Case No. 11-V-74 for the reasons that: (1) There is a practical difficulty and particular hardship on the petitioner; (2) The purpose of the variations is not based exclu- sively upon a desire to make money; (3) The conditions upon which the petition for this varia- tion is based are unique in that the lot is a corner lot, subject to having two (2) front yards; and (4) The granting of these variations will not be detrimental to the public or injurious to surrounding property in that it will not alter the essential character of the locality; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have reviewed the matter herein and have determined that the same is in the best interests of the Village of Mount Prospect; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY9 ILLINOIJ SECTION ONE: That the property being the subject matter of Case No. 11-V-74, being legally described as follows: Lot 12 in Block 24 in Prospect Park Country Club Subdivision, a Subdivision of the Southeast Quarter of Section 11, and South 15 acres of the East Half of the Northeast Quarter of Section 11 Township 41 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois, is currently zoned under the Zoning Ordinance of the Village of Mount Prospect R-1 (Single Family Residence District), which zoning classification shall remain in effect subject to the variations granted herein: (a) That the yard abutting the frontmost lot line of the subject property adjacent to We -Go Trail be reduced to twenty feet (201). (b) That a rear yard of thirty-eight feet (381) be provided rather than the required twenty-five feet (251). SECTION TWO: That all requirements of the Mount Prospect Building and Zoning Code shall be applicable except the variations noted in SECTION ONE heretofore mentioned . SECTION THREE: That the Director of Building and Zoning of the Village of Mount Prospect is hereby authorized to issue a building permit for construction in accordance with the variations hereinbefore mentioned. SECTION FOUR: That the variations granted by this Ordinance shall be null and void and of no force and effect whatsoever unless an application for a building ol permit pursuant to such variations is made and construction commenced within one (1) year of the date this said Ordinance becomes effective. SECTION FIVE: That this Ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law. AN ORDINANCE VACATING A PORTION OF THE PUBLIC ALLEY EAST OF WATERMAN AVENUE AND NORTH OF NORTHWEST HIGHWAY WHEREAS, the Board of Trustees of the Village of Mount Prospect have met and have considered the sale of a portion of� the public alley east of Waterman Avenue to the abutting property owners; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have determined that the sale thereof is in the best interests of the Village of Mount Prospect; NOW., THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION' ONE: That the following portion of the public alley lying east of Waterman Avenue and north of Northwest Highway shall be and the said alley is hereby vacated, to -wit: That part of the Public Alley lying Northeasterly of and adjoining Lots I and 2 in H. Roy Barry Company's Northwest Heights, being a Subdivision of all that land lying North of the Chicago and North- western Railroad in the Northwest Quarter of the Southeast Quarter of Section 33, Township 42 North, Range 11 East of the Third Princi- pal Meridian, which lies Southeasterly of the Northerly extension of the West line of said Lot I and Northwesterly of the Northeasterly ex- tension of the Southeasterly line of Lot 2 aforesaid, all in Cook County, Illinois. SECTION TWO: That the Village Clerk of the Village of Mount Prospect is hereby directed to file in the Office of the Recorder of Deeds of Cook' County, Illinois,, a copy of this Ordinance, together with an accurate map of the territory so vacated. SECTION THREE: That this Ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law. REV M_ PASSED and APPROVED this day of 19 74.
