WHEREAS, the Metropolitan Sam"tary District of Greater Chicago is desirous of con-
structing an intercepting sewer within the right-of-way of Oakton Street within the
corporate 111'rMits of the Village of Mount Prospect; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have
determined that the best interests of the Village of Mount Prospect willbe served by
the granting of the permit requested by the Metropolitan Sanitary District-,
THEREFORE . BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT , COOK COUNTY o ILLINOIS:
SECTION ONE.- That Article H of Chapter 22 of the Municipal Code of Mount Prospect
of 1957, as amended,, be and the same is hereby further amended by adding thereto an
additionaJ Section, Section 22.209, entitled "Special Permits"- so that hereafter the

Section 23 and the east ♦1/2 of the northeast 1/4 of
Section 26, Township 41 North., Range 11 t East of the
Third Principal Meri than In Cook County, Illinois., as
IMS on a plat marked Exhibit A, attached hereto and
hereby made a part hereof.
141 That the location, size, and manner of construction of the Inter-
cepting Sewer shall be in accordance with plans and speciffica-
tions prepared by the Metropolitan Sanitary District,, which plans
shall be approved by the Village Engineer of the Village of Mount
Prospect prior to the commencement of construction by the Metro-
politan Sanitary District, and which plans are attached hereto and
hereby made a part hereof as Exhibit B #
N
2. That the rights hereby granted to the Metropolitan Sanitary Dis-
trict are granted upon the following conditions:
a. That the Metropolitan Sanitary District shall at its own cost
and expense and as part of this permit construct or cause to
be constructed a minimum twenty-four inch (2411) diameter
Gravity Transmission Line on Illinois Route 83 (Elmhurst
Road) from the existing lift station located on the west side
of Elmhurst Road 580 feet north of the center line of Oakton
Street to the proposed Intercepting Sewer on Oakton Street --
pursuant to the plans and specifications attached hereto and
hereby made a part hereof as Exhibit C.
b That the Metropolitan Sanitary District shall, at its own ex-
pense, make such changes in the location of the police and
fire alarms, street lighting and electric wires of the Village
of Mount Prospect as may be rendered necessary for the con-
struction of the Intercepting Sewer and Gravity Transmission
Line of the Metropolitan Sanitary District.
c., That the Metropolitan Sanitary District shall, at its own cost
and expense, install all such safety devices and traffic con-
trol signals as may become necessary and required by the
Village of Mount Prospect for the public convenience, health
and safety, as a result of any routing or rerouting of traffic
caused by the construction contemplated in this Ordinance.
d, That the Intercepting Sewer and Gravity Transmission Line of
the Metropolitan Sanitary District shall be constructed, recon-
structed, repaired, and efficiently maintained and operated
solely by the Metropolitan Sanitary District at its sole expense
and cost; and that the Village of Mount Prospect shall not be held
responsible in any manner for the location or manner of con-
struction, reconstruction, repair, or operation of the same.
e. That the Metropolitan Sanitary District shall indemnify, save,
and keep harmless the Village of Mount Prospect from any and
all claims for damage to real and personal property and injur-
ies to or death suffered by persons by reason of the construc-
tion, reconstruction, repair, maintenance, or operation by the
Metropolitan Sanitary District of the Intercepting Sewer and
Gravity Transmission Line within the corporate limits of the
Village of Mount Prospect.
f. That the Metropolitan Sanitary District shall, at its sole cost
and expense, restore to their former condition the pavements
of all streets, public alleys and highways which may be dis-
turbed or interfered with by the construction, maintenance,
repair, or operation of the Intercepting Sewer and Gravity
Transmission Line, as well as all walks v cross -walks,, curbs.
gutters, catch basins, and ditches as soon as practicable, and
shall thereafter maintain such restoration from time to time as
may be necessary, but not to exceed two (2) years. All sur-
plus excavation and other spoil shall be removed from the
paved streets , public alleys, and highways by the Metropoli-
tan Sanitary District.
That, insofar as it has authority to do so, the Villageof Mount
Prospect does hereby authorize the Metropolitan Sanitary
trict to order and direct all persons, partnershipscorpora-
tions which shall, at the time of the construction of the Inter-
cepting Sewer and Gravity Transmission Line,operate,
or maintain any conduits , wiresm'pes,, gas mains ,
cables, electric equipment or other structures within any por--
tion of the streets, public alleys and highways to be excavated
in the construction of the Intercepting Sewer and Grav"ity Trans-
mission Line, at his, its, or their own expense, to make such
changes in the location of such conduits, w lires, poles, t)i*pes
gas mains and cable, electric equipment or other structures as
may be rendered necessary by the construction of the Inter-
cepting Sewer and Gravity Transmission Line. By accepting
and receiving this permit, the Metropolitan Sanitary District
hereby agrees to reimburse the Village of Mount Prospect for
it may
any expense 1 incur as a result of the relocation of any of
the aforesaid utilities or structures.
h That the Metropolitan Sanitary District and 'its contractors are
hereby given and granted the right to use in the construction
of the InterceptinSewer and Gravity Traoe

and equipment as may be necessary for the complete construc-
tion of said work.
