Results of Testimony:
Petitioner testified they hoped to construct a two story and
basement structure. Each floor will contain an associate of
the Northwest -Waterman Associates., made up of a consulting
engineer, commercial insurance broker and residential contractor.
The associates require 16 parking stalls, existing large trees
and inability to obtain adjoining park district property create
the parking hardship.
The nature of the businesses do not require a loading zone.
Petitioner testified that contractors storage yard was located
at some other area and'no construction vehicles would be parked
at the site.
Board voted 4-0 to recommend the variations.

Home is located on a corner lot. Petitioner testified that
the condenser would have to be located either upon his -patio
or in. the middle of his back yard to fall within the ordinance.

The neighbor whose property is abutting the side the compressor
will. located wrote a letter stating he had no objection. to
the location.
Moard voted 4-0 to recommend granting the variation.

Petitioner requested permission to construct an addition to his
building within a wedge- shaped area why ch ils'not -usable for park-
ing or open area. Addition would be one'story of the same type
construction as existing building.
There is ample street parking and a municipal parking lot abuts
the alley to .the rear. There is sufficient 'access for fire equipment.
Presently, there exists a fire and safety hazard.
The alley is not posted as a limited parking or non -loading area.
Board members showed concern for neighboring business as the
structure is used as a music store. Petitioner testified
that common walls would be sound deadened.
Board voted 4-0 to recommend granting the variations.

limits of the City of Des Plaines.

and expense and as part of this permit construct or cause to
be constructed a r;iinimum twenty-four inch (2411) diameter
Gravity Transmission Line on Illinois Route 83 (Elmhurst
Road) from the existing lift station located on the west side
of Elmhurst Road 580 feet north of the center line of Oakton
Ptreet to the proposed Intercepting Sewer on Oakton Street --
pursuant to the plans and specifications attached hereto and
hereby made a part hereof as Exhibit C.
b That the Metropolitan, Sanitary District shall, at its own ex-

That, sofar as it has authority to do so, the Village of Mount
Prospect does hereby authorize the Metropolitan Sanitary
trict to order and direct all persons, partnerships , or corpora-
tions which shall, at the t ' ime of the construction of the Inter-
ce,pting Sewer an(I Gravity Transmission Line, own � operate,
gas mains ,
or maintain any bonduits, Wires, poles, pipes,
cables , electric ejuipment or other structures within any por-
tion of the♦
streets, public alleys and highways to be excavated
in the construction of the Intercepting Sewer and Gravity Trans-
mission Line, at his, , or their own expense, to make such
MM in the location of such conduits, Wires, poles, pipes,
gas means and cable, electric equipment or other structures as
may be rpndered necessar'y by the construction of the Inter-
cepti4g Sewer and Gravity Transmission Line. By accepting
and receiving this permit , the Metropolitan Sanitary D listrict
hereby agree's to reimburse the Village of Mount Prospect for
any expense it may incur as a result of the relocation of any of
the aforesaid utilities or structures.
h. That the Metropolitan Sanitary District and 'its contractors are
hereby given and granted the right to use in the construction
of the Intercepting Sewer and Gravity Transmission Line such
motor trucks, excavators, hoisting engines. and other plant
and equipment ap may be necessary for the complete construc-
tion of said work.

AN ORDINANCE AMENDING MAP 6N OF THE
MOUNT PROSPECT ZONING ORDINANCE
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect heretofore
on June 3 v 1974, did conduct a Public Hearing pursuant to proper legal notice under
Case Na. 23-Z-74, on a request to rezone certain property at 2-40 North Main Street,,
Mount Prospect, Illinois. hereinafter legally described from the P-1 (Off -Street Park-
ing) District to the B-3 (Business -Retail and Service) District; and
WHEREAS, the Zoning Board of Appeals has determined that the zoning change in that
area would in no way be detrimental to the Village of Mount Prospect and has recom-
mended that the zoning change be granted, and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have
determined that the best interests of the Village of Mount Prospect will be attained by
the adoption of the Zoning Board of Appeal recommendation in Case No. 23-Z-74 re-
garding the subject property-,
NOW P THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT v COOK COUNTY, ILLINOIS:
SECTION ONE: That Map 6N of the Zoning Ordinance of the Village of Mount Prospect,
as amended, be and is hereby further amended by reclassifying from P-1 (Off -Street
Parking) District to B- 3 (Business -Retail and Service) District the following described
property:

WHEREAS . the land hereinafter described is both contiguous to the Village of Mount
Prospect and wholly bounded on all sides by the Village of Mount Prospect ; and
WHEREAS , the said territory is not presently withjji the boundaries of any municii-
p ality; and
WHEREAS the said property comprises less than sWy (60) acres; and
WHEREAS, the Illinois Revisecl StAtutes . C�apt�r 24, §ection 7-1-13 provides for
the annexation of spch territory b� the Village upon passage of an Ordinance pur-
suant thereto; and
