'AN ORDINANCE AMENDING MAP 22-N OF THE ZONING ORDINANCE WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did conduct a Public Hearing under Case No. 29-Z-74, on July 25,, 1974, on a request for a zoning classification change from R -X (Single Family Residential District) to R-1 (Single Family Residential District) of certain property hereinafter described; and WHEREAS, a notice of the aforesaid Public Hearing was made and published iin the manner provided by law; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have determined that the best interests of the Village of Mount Prospect will be attained by the adoption of the following Ordinance regarding the subject pro- (�erty; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD'OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT.9 COOK COUNTYp ILLINOIS: SECTION ONE: That Map 22-N of the Zoning Ordinance of the Village of Mount 101 Prospect, as amended, be and is hereby further amended by reclassifyin• g from R -X (Single Family Residential District) to R-1 (Single Family Residential District) the following described property: All that part of the West Half of the Southwest Quarter of Section 27, Town- ship 42 North, Range 11 East of the Third Principal Meridian described as follows: Commencing at a point on the West line of the Southwest Quarter of Section 27 aforesaid which is 50.0 feet North of the Southwest corner thereof; thence North on the West line of the Southwest Quarter of Section 27 aforesaid to a point which is 250.0 feet South of the Northwest corner of the Southwest Quarter of Section 27 aforesaid; thence East parallel with the North line of the Southwest Quarter of Section 27 aforesaid, 436.78 feet; thence Northeasterly at right angles to the center line of Rand Road 134.77 feet to the Northeasterly line of Rand Road and the Southwesterly line of Lot 7 IM Arlington Meadows , 'being a Subdivision of that part of the West Half of the Southwest Quarter lying Northeasterly of the center line of Rand Road in Section 27, Township 42 North, Range 11 East of the Third Principal Meri- di"an; thence, Southeasterly along the Northeasterly line of Rand Road and the Southeasterly line of Lot 7 in Arlington Meadows aforesaid to the Northwesterly corner of Lot 9 in Arlington Meadows aforesaid; thence Southwesterly at right angles to the Northeasterly line of Rand Road, a distance of 50 feet to the cen- ter line of Rand Road; thence Southeasterly along the center line of Rand Road to its intersection with the extension to the Northeast of the Southeasterly line of Lot 5 in Block 3 in Prospect Meadows, a subdivision of the West Half of the Southwest Quarter of Section 27, Township 42 :North, Range 11 East of the Third Principal Meridian, thence Southwesterly along the aforesaid extension and the Southeasterly line of Lot 5 in Block 3 aforesaid to the Southeasterly corner of Lot 5 iri Block 3 aforesaid; thence Southeasterly along the Northeasterly line of Lots 16 and 15 in Block 3 aforesaid to the Southeasterly corner of Lot 15 in Block 3 aforesaid; thence Southeasterly to a point on the Northwesterly line of Lot 14 in Block 3 aforesaid which is 48.0 feet Southwesterly of the Northeast corner of Lot 14 aforesaid; thence Southeasterly to a point on the Southeasterly line of Lot 14 in Block 3 aforesaid which is 11.0 feet Southwesterly of the South- east corner of Lot 14 in Block 3 aforesaid-, thence Northeasterly along the South- westerly line of Lot 14 in Block 3 aforesaid 11. 0 feet to the Southeast corner of Lot 14 in Block 3 aforesaid; thence South along the East line of the West Half of the South- west Quarter of Section 27 aforesaid to a point 50.0 feet North of the Southeast corner of the West Half of the Southwest Quarter of Section 27 aforesaid; thence West along a line which is 50. 0 feet North of and parallel to the South line of the West Half of the Southwest Quarter of Section 27 aforesaid to the point of beginning,, all in Cook County, Illinois; SECTION TWO: That Map 22-N contained in SECTION ONE of Ordinance No. 2410, passed and approved March 20,, 1973, shall be deemed amended so as to conform with the reclassification of the subject property herein contained in SECTION ONE above. d! AN ORDINANCE GRANTING A VARIATION FOR PROPERTY LOCATED AT 415 NORTH PROSPECT, MOUNT PROSPECT, ILLINOIS WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet on April 25,, 1974, at the hour of 8: 00 P.M. in the Village Hall to hold a public hearing under Case No. 16-V-74, pursuant to proper legal notice-, and I WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hear a petition requesting a variation to construct an office building; and WHEREAS , the Building Committee of the Board of Trustees of the Village of Mount Prospect has recommended to the President and Board of Trustees of the Village' of Mount Prospect the granting of this additional variation and has found that: There is a practical difficulty and particular hardship on the petitioner; (2) The purpose of the variation is not based exclusively upon the desire to make money; (3) The granting of the variation will not be detrimental to the public or injurious to surrounding property in that it will not alter the essential character of the locality; and WHEREAS , the President and Board of Trustees have reviewed the matter herein and have determined that the same is for the best interests of f the Village of Mount Prospect; NOW , THEREFORE . BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SEGTION' ONE: That the property being the subject of Case No. 16-V-74,, being legally described as: Lots 23, 24, 25 in H. Roy Berry Company's Colonial Manor being a subdivision of part of the northeast I of section 11, and part of the northwest I of section 12, all in township 41 north, range 11, east of the third principal meridian, in Cook County, Illinois. is currently zoned under the Zoning Ordinance of the Village of Mount,, Prospect as R-3 (Apartment - Residence District) which zoning classification shall remain sub- ject to the following granted variations and conditions: m - A i That the subject property hereinabove described may be ' proved with an office building in substantial accordance with the plans attached hereto and hereby made a part hereof. B That the total building area upon the subject property shalt not cover more than seventy-five (75%) percent of the land; C. That the parking requirements to be utilized in conjunction with the land use variation herein shall be identical to those contained in the )3-2 Business -Office District o namely: One (1) ten foot by twenty foot (10,1x2,01) space shall be provided for each two hundred 1(200) square, feet of'gross, floor area; F D That the three (3) lots described hereinabove shall be resub- divided into one (1) lot of record and further such Plat shall be drawn in accord with the subdivision regulations of the Village of Mount Prospect and recorded only after it has been properly approved by the corporate authorities of the Village of Mount Prospect; and E That, all other, requirements of the Municipal Code, of the Village of Mount Prospect shall be applicable to the development of the subject propertyiv excep,t as, they may conflict with the varia- tions and, conditions indicated hereinabove' -- in which case the latter variations and conditions shall apply and control. SECTION TWO: T hat the Director of Building, and Zoning of the Village of Mount Prospect is, hereby authorized to issue a Building Permit, for, construction, in accord- ance with the plant!
