PROPERTY: Bounded by .Euclid Road, ITheeling Road and C ' amp McDonald
Road, Wheeling Township., Cook County known as Rob Aoy
Golf Course.
REQUEST: An amended annexation of the entire tract with split
zoning. Approximately 96 acres to remain R -X (Area
proposted to be retained as golf course and approximately
104 acres to be rezoned to R-4 with a PUD variation on
the approximately 104 acres,

RESULTS OF TESTIMONY:
The petitioner, represented by Mr. Snyderman,Attorney, proposed a
PUD of 2350 units on approximately 104 acres of buildable area or a
density of approximately 23 units per acre, , The development would
be 2 and 3 bedroom attached single family units (approximately 136)
and 1, 2 and 3 bedroom condo'apartments (approximately 2214). Avail-
able parkling would allow 392.5 spaces,, Floor area ratio would be .87.
The remaining approximately 96 acres are to -be retained as a golf
course at least during thetime of the annexation agreement but
negotiations are continuing with the River Trails Park District to
buy the golf course in order to permanently retain the land as open
recreational space.
Parts of the golf course and certain areas of the buildable area would
be landscaped to provide the necessary water retention in connection
with the McDonald -Creek and the buildings would not be on any flood

plains area within the parcel.
Objectors were voiced primarily to the following areas:
1) Density on the Site
2) Loss of open recreational space
3) Traffic conjestion in the area due to numerous development
(Old Orchard, Brickman, etc.) in the area
4) Impact on the school district
5) Potential increased flooding due to development crowding
the flood plain area.
The petitioner notified the Board of pending agreement with the
school district but numerous "ifs" prevent any firming a I t the time
of the last meeting,
A similar situation exists relating to the proposed sale of the golf
course to the Park District.

In viAw of the ahove uncertainties as a matter of record., the Board
decided to vote on the evidence -presented and withheld any directional
amendm,-rAs
The Board voted G-2 against the rezoning CZBA-26Z-73) and 6-1 against
the special use (ZRA-27SU-73).
Board Member, Norman Dozy, stated for the record several considerations
which should be satisfied by the leve loper before the Board -of Trustees
considers the request.

present these as facts in evidence necessitated Mr. Kozyts,vote with
the majority on the petitioner's request,
1) A firm settlement of the open space (golf course) with
transfer to the Park District of ownership through some financial
arrangement to absolutely insure the recreational open space for
purpituity.,
2) Assistance to the School District to obtain the necessary
state approval for land requirement for the planned area schools as
well as making the financial commitment in writing as agreed to
tentatively by-- the School District and the Developer
3) The developer assume all costs in any required traffic--:
improvement on roads surrounding the development as the impact will
be caused by the development
4) Water requirement of the development will necessitate
enlargement of the water supply and the cost of such enlargement
(additional well, well site and/or reservoir) should be borne by the
developer,

ORDINANCE NO.
AN ORDINANCE GRANTING A SIDE YARD REQUIREMENT VARIATION FOR
PROPERTY LOCATED AT 1801p7 MAYA LANE, MOUNT PROSPECT,ILLINOIS,
WHEREAS , the Zoning Board of Appeals of the Village of Mount Prospect did meet
on the 25th day of July, 1974, at the hour of 8: 00 p.m. , at the Mount Prospect Village
Hall and did hear Case No. 27-V-74, pursuant to proper legal notice; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hear
this request for a side yard variation to allow the petitioner to construct an attached
two (2) car garage to within 2.83 feet of the side lot line instead of the required 5.75
feet of the lot described hereinbelow; and
WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount
Prospect did conduct a hearing on August 14 9 19 74 , and did, recommend to the
Board of Trustees of the Village of Mount Prospect the granting of the requested
variation under Case No. 27-V-74; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have
concurred with the recommendation of the Building Committee that the variation
herein be granted; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
have reviewed the matter herein and have determined that the same is for the best
interests of the Village of Mount Prospect;
NOW , THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES

SECTION ONE: That the property being the subject matter of Case No. 27-V-74,
being legally described as follows:
Lot 99 , except the west 7.50 feet thereof, in Brickman Manor Third
Addition, Unit No. 1, being a subdivision in the Southwest J of Section
2 4, Township 42 North , Range 11 ast of the Third P rincip al Meridian,
in Cook County, Illinois
is currently zoned under the Zoning Ordinance of the Village of Mount Prospect
as R-1 (Single Family Residence), which zoning classification shall remain in
effect s�ibject to the variation granted herein:
That the side yard located at the east side of the subject property he
reduced by 2.92 feet from 5.75 feet so as to allow'struct�on of a

garage addition to within 2,.83 feet of the said side lot line --all in
accordance with the plans and specifications therefor attached hereto
and hereby made a part hereof.

SECTION FOUR: That the variation granted by this Ordinance shall be null and
void and of no force, and effect whatsoever unless an application for a building per -
Mit pursuant to such variation is made and construction commenced within one (1)
year of the date said Ordinance becomes effective.
SECTION FIVE: That this Ordinance shall be in full force and effect from and after
its passage, approval, and publication in the manner provided by law.
