AN ORDINANCE AMENDING MAP 6-S OF THE MOUNT PROSPECT ZONING ORDINANCE WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect heretofore on May 24, 1973, at the hour of 8:00 p.m., conducted a public, hearing under Case No. 2-Z-73 requesting a zoning classification change, from B-3 (Business - Retail and Service) District to B-4 (Business - Retail and Service) District of a certain parcel of property hereinafter described; and WHEREAS, notice of the aforesaid public hearing was made in the manner provided by law and published in the May 8, 1973, edition of a newspaper of general circulation with the Village of Mount Prospect; and WHERtA8, the Zoning Board of Appeals of the Village of Mount Prospect recommended to the President and Board of Trustees that the subject property be reclassified as requested; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have determined that the best interests of the Village of Mount Prospect will be attained by the adoption of the recommendations of the Zoning Board of Appeals on Case No. 2-Z-73 regarding the subject property; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That Map 6-S of the Zoning Ordinance of the Village of Mount Prospect, as amended, be and the same is hereby further amended by reclassifying from B-3 (Business - Retail and Service) District to B-4 (Business - Retail and Service) District the following described property: Lots 1, 2, 3. and 4 in Henry J. Ehard's Subdivision of that part of the Northeast Quarter (NE 1/4) of Section 11, Township 41 North, Range 11, East of the Third Principal Meridian lying North of the Chicago & North Western Railroad Company's right of way, in Cook County, Illinois, SECTION TWO: That Map 6-S contained in SECTION ONE of Ordinance o7 241 -U-,- passed and approved March 20, 1973, shall be deemed amended so as to conform with the reclassification of the property herein contained in SECTION ONE above. NORTHWEST HIGHWAY WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect heard testimony presented under Case No. 35 -SU -74, on August 22, 1974 and September 26, 1974, pursuant to a request for certain special uses pursuant to the Mount Prospect Zoning Ordinance to permit certain uses upon the property hereinafter described; and WHEREAS, notice of the public hearings held in conjunction with the aforesaid case were published in the manner provided by law-, and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect has filed a report with the President and Board of Trustees recommending that such special uses be allowed for the reasons stated therein; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have reviewed the said proposed,special uses under Case No. 35 -,SU -74 and have determined that the same are in the best interests of the Village of Mount Prospect; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY., ILLINOIS: SECTION ONE: That pursuant to the Mount Prospect Zoning Ordinance, t1176—f-61-1-ow—ing special uses are authorized on the property ,described in SECTION TWO hereinbelow: Laundry and dry cleaning where actual cleaning or laundry is done on the premises by the use and operation of the following equipment thereon: A., Two (2) fifty (50) pound automatic washers and extractors; B One (1) shirt presser-, C,. A RESOLUTION DIRECTING THE EXECUTION OF AN ANNEXATION AGREEMENT 111 REGULATING THE ANNEXATION OF PROPERTY LOCATED ON MAP 25-N IN THE ZONING ORDINANCE OF THE VILLAGE OF MOUNT PROSPECT WHEREAS, the Corporate Authorities of the Village of Mount Prospect on November S. 1974, at the hour of 8:00 p.m. did hold a public hearing upon the proposed Annexation Agreement for the regulation of an annexation of certain property to the Village of Mount Prospect, which property is located on Map 25-N in the Zoning Ordinance of the Village of Mount Prospect; and WHEREAS, a notice of said public hearing was published in a newspaper of general circulation within the Village of Mount Prospect, in its October 14, 1974, edition; and WHEREAS, notice has been given and a joint hearing was held on July 25, 1974, at 8:00 p.m. before the Zoning Board of Appeals of the Village of Mount Prospect with respect to the aforementioned Annexation Agreement and certain rezoning, variations, and special uses to be agreed upon therein; and WHEREAS, the Corporate Authorities of the Village of Mount Prospect believe that such Agreement is in the best interests of the Village of Mount Prospect. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS. SECTION ONE: That the President and the Board of Trustees of the Village of Mount Prospect is hereby authorized to sign and the Village Clerk of the Village of Mount Prospect is hereby authorized to attest the Annexation Agreement made a part hereof and attached hereto as Exhibit 1, which Annexation Agreement, pursuant to the provisions of Division 15.1 of Article II of Chapter 24 of the Illinois Revised Statutes shall regulate the annexation of the following described property: PARCEL 1 Lots 1030, 1031, 1032 and Outlot "B" in Brickman Manor First Addition Unit No. 6 being a Subdivision of part of the East half of the Southeast Quarter of Section 27, Township 42 North, Range 11 East of the Third Principal Meridian,, in Cook County, Illinois. ATTEST: Village Clerk Mayor 1 -2- ANNEXATION AGREEMENT WHEREAS , American National Bank and Trust Company of Waukegan, not individually but as Trustee under Trust No. 60, hereinafter referred to as the "Owner" is the owner of the following legally described land and territory: Lots 1000, 1001, 1002 and Outlot "All in Brickman Manor 1st Addition Unit No. 6, being a subdivision of part of the East half of the South- west Quarter of Section 27, Township 42 North, Range 11 East of the Third Principal Meridian, together with the South 241.56 feet of the West 30 feet of Outlot 11H11 in Brickman Manor 1st Addition Unit No. 1, being a subdivision of part of the East Half of the Southeast Quarter of Section 27 and part of the West Half of the West Half of the South- west Quarter of Section 26 . Township 42 North, Range 11 East of the Third Principal Meridian, in Cook County, Illinois. located on Kensington Road . just West of Wheeling Road , adjacent to East Avenue of Randhurst Shopping Center, Mount Prospect. Illinois, hereinafter referred to as the "Subject Property"; and WHEREAS . the VILLAGE OF MOUNT PROSPECT, a municipal corporation organized under the laws of the State of Illinois, hereinafter referred to as "Village" has the power to enter into an Annexation Agreement as set forth herein; and WHEREAS, the Owner has heretofore filed a petition to annex the Subject Pro- perty to the Village contingent on the provisions contained in this Agreement; and WHEREAS, both parties believe it to be in the best interests of both the Village and the Owner that the Subject Property be annexed; and t- - WHEREAS , it is beneficial to both the Owner and the Village that the project * be constructed in accord with the plan contained herein; NOW , THEREFORE , it is agreed by and between the Village and the Owner as follow s: 1 That upon execution of this Agreement by all the parties hereto, the Village will act upon the Owner's written petition for annexation and will annex the Subject Property. 2. That the Village shall pass such ordinances as will enable the Subject Property to be zoned R-4 (Residential Development District) , under the Zoning Ordi- nance of the Village of Mount Prospect and will permit the construction of one thirteen (13) story building, as a special use, having inside parking for eight -four (84) cars . two (2) stories of commercial office space, consisting of approximately 61, 000 sq. feet, and eleven (11) stories of eight -two (82) multi -family units comprising forty-two (42) one -bedroom 848 sq. ft. units and forty (40) two-bedroom 1050 sq. ft. units. The Owner will provide grade level parking for an additional two hundred nineteen (219) cars -- which building together with its appurtenances shall be constructed in general conformity with the plans attached hereto and hereby made a part hereof as Exhibit A. 3. That the Owner will execute a plat of resubdivision of the Subject Pro- perty substantially in the form as attached hereto and hereby made a part hereof as Exhibit B 4. That the Owner will cause Wheeling Trust and Savings Bank of Wheeling, Illinois, not individually but as Trustee under Trust No. 71-134 dated September 2 0 1971, to annex the following legally described land and territory into the Village of Mount Prospect: Lots 1030, 1031, 1032, and Outlot "B" in Brickman Manor First Addition Unit No. 6, being a Subdivision of part of the East Half of the Southeast Quarter of Section 27, Township 42 North, Range 11 East of the Third Principal Meridian, in Cook County, Illinois, located on South side of Euclid Avenue just West of Wheeling Road and adjacent to East Avenue of Randhurst Shopping Center of Mount Prospect. Illinois, and herein- after referred to as "the Unit No. 6 properties". 5. That the Village shall pass such ordinances as will enable the Unit No. 6 properties to be zoned and classified in the B-3 Business (Retail and Service) District I under the terms of the Mount Prospect Zoning Ordinance. 6. That the Owner will cause the title holder of the building known as the "Randwood Apartments" to take the necessary steps to eliminate the outstanding vio- lations cited by the Village of Mount Prospect Fire Prevention Bureau and to otherwise maintain said building in conformity with the Mount Prospect Fire Prevention Code and other applicable laws. 7. That,, pursuant to the plans reflected upon the Utility Exhibit attached hereto and hereby made a part hereof as Exhibit C , the Owner shall install and the Village shall receive the ownership of certain water mains and certain trunk sewer lines as required to serve the aforesaid special use to be constructed upon the Sub- ject Property. 8. That all provisions, conditions, and regulations set forth in this Agree- ment and the Exhibits to which it refers shall supercede all Village ordinances . codes and regulations that are in conflict therewith as they may apply to the Subject Property. Where this Agreement is silent, the Village ordinances shall apply and control. 9. That this Agreement shall be effective for a term of five (5) years from date hereof and that thereafter all properties in the Planned Unit Development shall become subject to Village ordinances. A It shall bind heirs and successors and assigns, the Village,, its corporate officials, successors in office, and be enforceable by order of court pursuant to the provisions of the statutes made and provided. B Nothing herein shall in any way prevent alienation or sale of the Subject Property or portion thereof except that said sale shall be subject to the provisions hereof and of the Plannted Unit Develop- ment ordinance of the Village of Mount Prospect and the new Owner shall be both benefited and bound by the conditions and restrictions herein and therein expressed. 10. That , in the event any provisions of this Agreement shall be deemed invalid, then the invalidity of said provisions shall not affect the validity of any other provisions hereof.
