AN ORDINANCE AMENDING MAP 47-S OF THE ZONING ORDINANCE OF THE VILLAGE OF MOUNT PROSPECT WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did conduct a public hearing under Case No.41-Z-74 on the 22nd day of October, 1974, on a request for a zoning change from R -X (Single Family Residence) District to I-1 (Light Industrial) District of certain property hereinafter described; and WHEREAS, notice of the aforesaid public hearing was made ani published in the manner provided by law; and WHEREAS, the President and the Board of Trustees of the Village of Mount Prospect have determined that the bes*t interests of the Village of Mount Prospect will be attained by the 'adoption of the following Ordinance regarding the subject property; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That Map 47-S of the Zoning Ordinance •of the Village rospect, as amended, be and is hereby further amended by reclassifying g from R -X (Sinle Family Residence) District to I-1 (Light Industrial) District the following described property: The North 653.46 Feet of the East 200 Feet of that part of the Northeast quarter (1/4) of the South- east quarter (1/4) of Section 23, Township 41 North, Range 11, East of the Third Principal Meran, lying West of the East 20 acres of said Northeast quarter (1/4) of the' Southeast quarter (1/4), all in Cook County, Illinois. The North 683.46 feet of the East 200 feet of that part of the Northeast quarter (1/4) of the South- east quarterSection 23, Township 41 North, Range 11, East of the Third •Principal Meridian, lying West of the East 20 acres of said Northeast quarter (1/4) of the Southeast quarter (1/4) except the North 653.46 feet thereof all in Cook County, Illinois. AN ORDINANCE GRANTING FRONT YARD REQUIREMENT VARIATIONS FOR PROPERTY LOCATED AT 1120 GREENFIELD LANE MOUNT PROSPECT o ILLINOIS WHEREASO the Zoning Board of Appeals of the Village of Mount Prospect did meet on the 25th day of July, 1974, and on the 24th day of October, 1974, at the hour of 8: 00 p.m., at the Mount Prospect Village Hall . and did hear Case No. 28-V-74., pursuant to proper legal notice; and WHEREAS, the Zom**ng Board of Appeals of the Village of Mount Prospect did hear this request to construct a second story addition to the existing building with a front yard setback of twenty-four feet ten inches (2411011) of the property line adjacent to Greenfield Lane, and to within twenty-five feet (251) of the property line adj acent to Barberry Lane on the lot commonly known as 1.120 Greenfield Lane, Mount Prospect, Illinois; and -WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recom- mend to the President and Board of Trustees of the Village of Mount Prospect the approval of this request under Case No. 28-V-74 for the reasons that: There is a practical difficulty and particular hardship on the petitioner; (2) The purpose of the variations is not based exclu- sively upon a desire to make money; (3) The conditions upon which the petition for these variations is based are unique in that the lot is a corner lot, subject to having two (2) front yards; and (4) The granting of these variations will not be detrimental to the public or injurious to surrounding property in that they will not alter the essential character of the. locality; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect Dave reviewed the matter herein and have determined that the same is in the best interests of the Village of Mount Prospect; NOWv THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECTt COOK COUNTY, ILLINOIS: SECTION ONE: That the property being the subject matter of Case No. 28-V-74, being; legally described as follows: Lot 258 in Brickman Manor First Addition Unit No. 3 . being a subdivision of part of the Southwest Quarter (1) of Section 26, Township 42 North, Range 11 East of the Third Principal Meri- dian . in Cook County, Illinois, is currently zoned under the Zoning Ordinance of the Village of Mount Prospect as R-1 (Single Family Residence) District, which zoning classification shall remain in effect subject to the variations granted herein: (a) That the yard abutting the frontmost lot line of the subject property adjacent to Greenfield Lane be re- duced to twenty-four feet ten inches (2411011). AN ORDINANCE ESTABLISHING A MUNICIPAL USE TAX WHEREAS 1 1 1 ,, Section 6 (a) of Article VII of the 1970 Constitution of the State of Illinois provides that Itany municipality which has a population of more than 25,000 (is) a Home Rule Unit"and the Village of Mount Prospect, Cook County; Illinois, with a population 'in excess of 25, 000 is, therefore, a Home Rule Unit and may, under the power granted by Section 6 (a) of Article VII exercise any power and perform any function pertaining to its government and affairs, in- cluding , but not limited to, the power to tax and to incur debt; and WHEREAS, Section 8-11-6 of the Illinois Municipal Code provides for a Munici al IP Use Tax; and WHEREAS, the President atid Board of Trustees of the MM; of Mount Prospect believe it to be in the bestint.Mk rests of the Village of Mount Prospect-, X A, SECTION ONE: That, pursuant to that power of authority given Home Rule Units in Article VII of the 1970 Constitution of the State of Illinois, as well as Section 8-11-6 of the Illinois Municipal Code of 1961, as amended, Article V of Chapter 8 of the Muni- cipal Code of Mount Prospect of 1957, as amended, be and the same is hereby further amended by adding thereto an entirely new Section, Section 8.510, for the purpose of imposing a Municipal Use Tax; so that hereafter the said Section 8.510 shall be and read as follows: SECTION 8.5,1,0.
