AN ORDINANCE AMENDING MAP 47-S OF THE ZONING ORDINANCE
OF THE VILLAGE OF MOUNT PROSPECT
WHEREAS, the Zoning Board of Appeals of the Village of Mount
Prospect did conduct a public hearing under Case No.41-Z-74
on the 22nd day of October, 1974, on a request for a zoning
change from R -X (Single Family Residence) District to I-1
(Light Industrial) District of certain property hereinafter
described; and
WHEREAS, notice of the aforesaid public hearing was made ani
published in the manner provided by law; and
WHEREAS, the President and the Board of Trustees of the Village
of Mount Prospect have determined that the bes*t interests of
the Village of Mount Prospect will be attained by the 'adoption
of the following Ordinance regarding the subject property;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That Map 47-S of the Zoning Ordinance •of the Village
rospect, as amended, be and is hereby further amended by
reclassifying g
from R -X (Sinle Family Residence) District to I-1
(Light Industrial) District the following described property:
The North 653.46 Feet of the East 200 Feet of that
part of the Northeast quarter (1/4) of the South-
east quarter (1/4) of Section 23, Township 41 North,
Range 11, East of the Third Principal Meran,
lying West of the East 20 acres of said Northeast
quarter (1/4) of the' Southeast quarter (1/4), all
in Cook County, Illinois.
The North 683.46 feet of the East 200 feet of that
part of the Northeast quarter (1/4) of the South-
east quarterSection 23, Township 41 North,
Range 11, East of the Third •Principal Meridian,
lying West of the East 20 acres of said Northeast
quarter (1/4) of the Southeast quarter (1/4) except
the North 653.46 feet thereof all in Cook County,
Illinois.
SECTION TWO: That Mapcontained in SECTION ONE of Ordinanc�;
NO. 2410, passed and approved March 20, 197/3, shall be deemed
amended so as to conform with the -reclasscation of the subiect
property herein contained in SECTION ONE above. W
SECTION THREE: That this Ordinance shall be null and void and of
no force and effect whatsoever., until after its passage, approval,
publication, and such time as an accurate plat resubdividing the
subject parcels described in SECTION ONE above is recorded with the
Recorder of Deeds of Cook County, Illinois, a copy of which plat
of resubdivision shall be attached hereto and is hereby made a part
hereof.

AN ORDINANCE GRANTING FRONT YARD REQUIREMENT VARIATIONS
FOR PROPERTY LOCATED AT 1120 GREENFIELD LANE
MOUNT PROSPECT o ILLINOIS
WHEREASO the Zoning Board of Appeals of the Village of Mount Prospect did meet
on the 25th day of July, 1974, and on the 24th day of October, 1974, at the hour
of 8: 00 p.m., at the Mount Prospect Village Hall . and did hear Case No. 28-V-74.,
pursuant to proper legal notice; and
WHEREAS, the Zom**ng Board of Appeals of the Village of Mount Prospect did hear
this request to construct a second story addition to the existing building with a front
yard setback of twenty-four feet ten inches (2411011) of the property line adjacent to
Greenfield Lane, and to within twenty-five feet (251) of the property line adj acent to
Barberry Lane on the lot commonly known as 1.120 Greenfield Lane, Mount Prospect,
Illinois; and
-WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recom-
mend to the President and Board of Trustees of the Village of Mount Prospect the
approval of this request under Case No. 28-V-74 for the reasons that:
There is a practical difficulty and particular
hardship on the petitioner;
(2) The purpose of the variations is not based exclu-
sively upon a desire to make money;
(3) The conditions upon which the petition for these
variations is based are unique in that the lot is a
corner lot, subject to having two (2) front yards; and
(4) The granting of these variations will not be detrimental
to the public or injurious to surrounding property in
that they will not alter the essential character of the.
locality; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
Dave reviewed the matter herein and have determined that the same is in the best
interests of the Village of Mount Prospect;
NOWv THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECTt COOK COUNTY, ILLINOIS:
SECTION ONE: That the property being the subject matter of Case No. 28-V-74,
being; legally described as follows:
Lot 258 in Brickman Manor First Addition Unit No. 3 . being a
subdivision of part of the Southwest Quarter (1) of Section 26,
Township 42 North, Range 11 East of the Third Principal Meri-
dian . in Cook County, Illinois,
is currently zoned under the Zoning Ordinance of the Village of Mount Prospect
as R-1 (Single Family Residence) District, which zoning classification shall remain
in effect subject to the variations granted herein:
(a) That the yard abutting the frontmost lot line of the
subject property adjacent to Greenfield Lane be re-
duced to twenty-four feet ten inches (2411011).
(b) That the yard abutting the frontmost lot line of the
subject property adjacent to Barberry Lane be reduced
to twenty-five feet (251).
SECTION TWO: That all reqUirements of the Mount Prospect Building and Zoning
Code shall be applicable except the variations noted in SECTION ONE heretofore
mentioned.
SECTION THREE: That the Director of Building and Zoning of the Village of
Mount Prospect Is hereby authorized to issue a building permit for construction
in accordance with the variations hereinbefore mentioned.
SECTION OUR: That the variations granted by this Ordinance shall be null and
void and of no force and effect whatsoever unless an application for a building
ol
permit pursuant to such variations is made and construction commenced within
one (1) year of the date this said Ordinance becomes effective.
SECTION FIVE: That this Ordinance shall be in full force and effect from and
after its passage, approval, and publication in the manner provided by law.

AN ORDINANCE ESTABLISHING A
MUNICIPAL USE TAX
WHEREAS 1 1 1
,, Section 6 (a) of Article VII of the 1970 Constitution of the State of
Illinois provides that Itany municipality which has a population of more than
25,000 (is) a Home Rule Unit"and the Village of Mount Prospect, Cook County;
Illinois, with a population 'in excess of 25, 000 is, therefore, a Home Rule Unit
and may, under the power granted by Section 6 (a) of Article VII exercise any
power and perform any function pertaining to its government and affairs, in-
cluding , but not limited to, the power to tax and to incur debt; and
WHEREAS, Section 8-11-6 of the Illinois Municipal Code provides for a Munici al

Use Tax; and
WHEREAS, the President atid Board of Trustees of the MM; of Mount Prospect

SECTION ONE: That, pursuant to that power of authority given Home Rule Units
in Article VII of the 1970 Constitution of the State of Illinois, as well as Section 8-11-6
of the Illinois Municipal Code of 1961, as amended, Article V of Chapter 8 of the Muni-
cipal Code of Mount Prospect of 1957, as amended, be and the same is hereby further
amended by adding thereto an entirely new Section, Section 8.510, for the purpose
of imposing a Municipal Use Tax; so that hereafter the said Section 8.510 shall be
and read as follows:
SECTION 8.5,1,0. Munii * ail Use Tax. In accordance with the provisions
of Section 8-11-6 of the Illinois Municipal Code as well as Section 6 of Arti-
cle VII of the 1970 Constitution of the State of Illinoi's , a tax is hereby im-
posed upon the privilege of using within the corporate limits of the Village
of Mount Prospect any item of tangible personal property which is purchas-
ed outside the State of Illinois at retail from a retailer, and which i's titled
or registered with any agency of the Government of Illinois. This tax shall
be at a rate of one 0%) percent of the selling price of such tangible proper-
ty to have the meaning as defined in the Use Tax Act, approved July 14,
1955.
A. Such tax shall be collected by the Illinois Department of Revenue for
the Village of Mount Prospect and all other municipalities imposing this
tax and shall be paid before the title or certificate of re 'stration for

the personal property is issued.
B. The Village Clerk is hereby directed to transmit to the Illinois Depart-
ment of Revenue a certified copy of this Ordinance not later than five
(5) days after its effective date."

A RESOLUTION MAKING CERTAIN APPROPRIATION TRANSFERS
WITHIN THE ANNUAL BUDGET ADOPTED FOR FISCAL 1974-75
WHEREAS, the Mayor and Board of Trustees of the Village of Mount Prospect have passed
and approved Ordinance No. 2342, which set the finances of the Village under the
"Budget Officer System"; and
WHEREAS, pursuant to the aforesaid Ordinance and the statutes of the State of
Illinois made and provided, an annual budget for 1974-75 was passed by the corporate
authorities of the Village of Mount Prospect by Resolution 13-74 on April 23,
1974; and
WHEREAS, the Mayor and Board of Trustees of the Village of Mount Prospect have
reviewed certain transfers and additions to the aforesaid budget for 1974-75-,
and
WHEREAS) the Mayor and Board of Trustees of the Village of Mount Prospect believe

hearing upon,, the proposed, Annexation Agreement for the regulation

of an, annexation of certain property to the Village of Mount Prospect,
which �proplerty is located, on Maip 25-N in the Zoning Ordinance of the
ViLlIage of Mount Prospect; and,
WHEREAS, a notice of said public hearing was published in a -newspaper
of general circulation within the Village of Mount Prospect, in its
October 14, 1974, edition; and
WHEREAS, notice has been given and a joint
0 hearing was -held on
July 25, 1974, at 8:0p.m. before the Zoning Board of Appeals of
the Village of Mount Prospect with respect to the aforementioned
Annexation AgreeMent and certain, rezoning, vaiiations, and special
uses to be agreed upon therein; and
WHEREAS, the Corporate Authorities of the Village of Mount Prospect
believe that such Agreement is in the best interests of the Village
of Mount Prospect.
AM THEREFORE, BE IT ORDAINED BY THE MAYOR AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS,
SECTION ONE: That the President and 111 -he Board of Trustees of the

Village Clerk of the Village of Mount Prospect is hereby authorized
to attest the Annexation Agreement made a part hereof and attached
hereto as Exhibit 1, which Annexation Agreement, pursuant to the

Illinois Revised Statutes shall regulate the annexation of the
following described property:

perty to the Village contingent on the provisions contained in this Agreement; and
WHEREAS, both parties believe it to be in the best interests of both the Village
and the Owner that the Subject Property be annexed; and
WHEREAS, it is beneficial to both the Owner and the Village that the project be

will act upon the Owner's written petition for annexation and will annex the Subject

5. That the Village shall pass such ordinances as will enable the Unit No. 6
properties to be zoned and classified in the B-3 Business (Retail and Service) District
under the terms of the Mount Prospect Zoning Ordinance.
6. That the Owner will cause the title holder of the building known'as the
"Randwood Apartments" to take the necessary steps to eliminate the outstanding vio-
lations cited by the Village of Mount Prospect Fire Prevention Bureau and to otherwise
maintain said building in conformity with the Mount Prospect Fire Prevention Code
and other applicable laws.
7. That,, pursuant to the plans reflected upon the Utility Exhibit attached
hereto and hereby made a part hereof as Exhibit C, the Owner shall install and the
Village shall receive the ownership of certain water mains and certain trunk sewer
lines as required to serve the aforesaid special use to be constructed upon the Sub -

j . ect Property.
8. That all provisions , conditions, and regulations set forth in this Agree-
ment and the Exhibits to which it refers shall supercede all Village ordinances, codes,
and regulations that are in conflict therewith as they may apply to the Subject Property.
Where t s Agreement is silent , the Village ordinances shall apply and control.
9. That this Agreement shall be effective for a term of five (5) years from
date hereof and that thereafter all properties in the Planned Unit Development shall
become subject to Village ordinances.
A . It shall bind heirs and successors and assigns, the Village, its
corporate officials, successors in office. and be enforceable by
order of court pursuant to the provisions of the statutes made
and provided.
B . Nothing herein shall in any way prevent alienation or sale of the
Subject Property or portion thereof except that said sale shall be
subject to the provisions hereof and of the Plazinted Unit Develop-
ment ordinance of the Village of Mount Prospect and the new Owner
shall be both benefited and bound by the conditions and restrictions
herein and therein expressed.
101. That,, in the event any provisions of thi s Agreemenis ll be deemed
invalid, then the invalidity of said provisions shall not affect the validity of any
other provisions hereof.

July 25, 1974, pursuant to a request for certain special uses
pursuant to the Mount Prospect Zoning Ordinance to permit certain
