The Northeastern Illinois Planning Commission was asked to send a
representative to this meeting to answer questions pertaining to
a letter directed to Mayor Teichert, dated October 16, 1974.
This letter requested Mount Prospect to pass a resolution support-
ing NIPC as the designated area -wide waste management planning
agency to coordinate water quality planning for the region.
Mayor Teichert asked the Judiciary Committee to review and make
recommendations to the Board.
According to Mr. DuCharm, this same request was sent to more than
250 municipalities and sanitary districts. Approximately 10 have
passed a resolution to date, including Barrington Area Council of
Governments, Northbrook, Aurora, Elgin, Wheaton,. Bloom Township
and Oak Park Sanitary Districts.
NIPC's designation as the area -wide agency to coordinate water
quality planning for the region probably will give the area's
local governments an edge in seeking Federal construction funds
for later planned implementation.
Section 208 of the Federal Water Pollution Control Act authorizes
the governor of each state to designate a single representative
organization, including elected officials from local government.s,
to develop effective area -wide waste treatment management plans
for such areas. Such a designation requires substantial con-
currence from local governments in the region before it will be
accepted by the United States Environmental Protection Agency.
Thus, we can be of assistance in the protection of the purity of
water in northeastern Illinois.
Once designation is set., an application for a planning grant may
be funded by the United States Environmental Protection Agency and
the planning begun.

Mr. DuCharm was asked if the supporting bodies would be expected
to participate in the funding, and his answer was negative unless
the adopted plan included a . project within our own municipality
and even then any participation in the funding would be voluntary
on our part.
The planning period is to take two years and requires strong
local input. These inputs include:
1. The requirements of formal resolutions from local
governments concurring in the area -wide agency design-
ation.
2. Formation of an area -wide water quality planning
advisory committee.
3., Submittal of the proposed plan to public hearing before
it is forwarded to the State and Federal governments.
4. Our comments and recommendations accompanying it upon
its submittal to the State and Federal governments.
The resulting management plan will then be the framework for
future facilities, construction, and scheduling. An area without
such a plan will almost assuredly be at a disadvantage in competing
for future grands.
The Committee voted 2-0 in favor of supporting the MPC request.

Lomman Eley, Attorney for Petitioner, testified that the present
owner has a contract to sell property if rezoned to a Mr. Smigel:
The property in question is approximately 107 ft. wide by approx-
imately 1150 ft. deep (see plat). A single building containing
60 units with 30 one -bedroom units and 30 bedroom units. All
building Code requirements would be met and based on testimony,
all requirements appear to have been met. It was also testified
by Leonard W. Happ, Real Estate Broker for the transation, that
the playground at the northerly portion of the property {approx-
imately 315' x 107') would be retained. Mr. James A. Mussatto,
architect testified that a fence separating the development
from the playground would be built. Several of the Board
Members suggested that Mr. Smigel give serious consideration
to making a donation to the School District for the 30 two
bedroom units to be included in this development.
The Board voted 6-0 to recommend granting the rezoning.
