PASSED and APPROVED thisday of 1973. -- -------- - Mayor Now No OR Village Clerk ORDINANCE NTO - AN ORDINANCE PROVIDING FOR DISCLOSURE OF INTERESTS IN LAT,TD TRUSTS SECTION ONE: That, pursuant to eatuthority vested in the Village of Mount Prospect 'under Article 'Vof the 1970 Constitution of the State of Illinois as well as the Illinois Revised Statutes, Chapter 24 of the Mount Prospect Municipal Code of 1957, as amended,, be and the same is hereby further amended by adding thereto an additional Article, Article XI, requiring the disclosure of beneficial interests in land trusts; so that here- after the said Article XI of Chapter 24 shall be and read as follows: X). C "Land trust" means any express agreement or arrangement whereof a use , confidence or trust is declared of any land, or of any charge upon land, for the use or benefit of any beneficiary, under which the title to real property, either legal or equitable, is held by a trustee , sub- ject only tothe execution of the trust, is may be enforced by the beneficiaries who have the exclusive right to manage and control the reel estate, to have the possession thereof, to receive the net proceeds from the rental, sale, hypothecation or other disposition ther e , and under which the interest ofthe beneficiary is personal property only. R i SECTION 24.1102. Disclosure of Benea2i2M���. A Whenever any trustee of a land trust or whenever any beneficiary or beneficiaries of a land trust make application to the Village of Mount Prospect foray benefit, authorization 9 zoning amendment, variance, special use, license and/or permit relating to the land which is the subject of such and trust or P ermit relr-.)t*np,, to any interest therein > imp rovein,ents thereto, or use, thereof; such applicati i shall Iden'tify each and every beneficiary of such land trust by name and address and define his interest therein. 1. All such applications shall be verified by the applicant in his capaci ,ty as trustee, or by the beneficiary as a beneficial owner of an interest in such land trust. 2. ifsuch application is filed by a body politic or other corporate entity , it shall be verified by a duly authorized officer of such body politic or other corporate entity for whom the application is made. B . Whoever, in swearing to ori affirming an application, as required under Subsection A hereinabove, either makes a false statement as to the identification of beneficiaries of a land trust or makes a false state- ment material to an is sue or point in question on sr.eb, application; shall be guilty of a misderica nor. AN ORDINANCE AMENDING ARTICLE I OF CHAPTER 23 TO PROVIDE FOR CERTAIN SEWER A�,\'D WATER CONNECTION CHARGE WHEREAS , the Village of Mount Prospect operates a combined water worIcs and sewer system; and WHEREAS . the corporate authorities of the Village of 'Mount Prospect have powers under the, Illinois Municipal Code and under the 1970 Copstitution of the State of Illinois to pro- vide for and collect a fair and reasonable charge for connection to any su h wa er works and sewage system, which charge shall cover the expansion and extention, of the works of the said water works and dditional sewage system, and which charge is to be asssessed against new or ausers of the system so expanded and extended; and WHEREAS , the President and Board of Trustees of the Village of A.,Tount. Prospect have reviewed the needs of owners of land in the vicinity of Westgate Road, and Glenna and Mpadow Lanes within the corporate limits of the Village of Mount Prospect, and have determined that the expansion and extention of the w.,,,Ater works and sewage system Is necessary for the said area to meet said, needs; and WHEREAS , the President and Board of Trustees of the Village of Mount Prospect believe that the best interests of the Village of Mount Prospect will J)e attained by the passage of this Ordinance; NOW. THEREFORE o BE IT ORDAINED 13Y THE PRESIDENT AND BOARD OF TRUS717EEJ *F THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY ILLINOIS: T SECTION ONE: That, pursuant to the authority vested in the Village of Mount Prospect under Article VII of the 1970 Constitution of the State of Illinois as well as the Illinois Revised Statutes, Section 23.110 and Section ?3.111 of Article I of Chapter 23 (Water and Sewer) of the Municipal Code of Mount Prospect of 1957, as amended, be and the same is hereby further amended by renumbering said Section 23. 110 and Section 23. 111 respectively to allow the insertion within the said ArIticle I of an entirely new section, Section, 23.110, establishing reasonable fees for connection to the water works and sewage system of the Village of Mount Prospect; so that hereafter the said Sections 23.110 , 23.111, , and 23.112 shall be and read as follows: "SECTION 23.110. The persons, firms, or corporations desiring to make any such connec- tion to any portion of the water works and sewage system set forth in subsection A hereinabove shall pay the entire cwtount due and owing as a connection fee prior to the actual connection, or shall make pay- ment in installments, provided such connection charge is fully paid within six CO) months from the time, of the connection, and further pro- vided that the applicant desiring such connection gives guarantee of payment of all installments in the form approved by the Village Attorney of the Village of Mount Prospect. C. The funds thus collected for such connections shall be used by the Vil- lage of Mount Prospect for its general corportite purposes with primary application thereof being made to offset the necessary expansion of the water works and sewage system reflected in subsection A hereinabove in order to meet the requirements of the new or additional users thereof. SECTION 23.111. Restriction on Use of Water. A. No person shall at any time, without proper authority, take any water from a fire hydrant. B., In case of mechanical failure of any of the wells providing water for the Village or in case of c a water shortage, the Village Manager, upon declaring an emergency exists, shall be authorized to impose immedi- ate restrictions upon the use of water for sprinkling. SECTION 23.112. PenaLty. Any person, firm, or corporation violating any provision of this Article shall be fined not less than Ten ($10.00) Dollars nor more than Two Hundred ($200.00) Dollars for each offense; and a se- parate offense shall be deemed committed on each day during or on which M a violation occurs or continues. $ECTIONTWO:That this Ordinance shall be in full farce and effect from and after It's ansa e , approval, and publication in the manner provided by law.
