AN ORDINANCE GRANTING VARIATIONS FOR PROPERTT
LOCATED ON LOT 7 IN TRENDEL & CHRISTENSENtS
RESUBDIVISION OF LAKE BRIARWOOD9
MOUNT PROSPECTILLINOIS
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet
on the 23rd day of August, 1973, at the hour of 8: 00 p.m. , at the Mount Prospect
Village Hall and did hear Case No. ZBA-19-V-73� pursuant to proper legal notice;
and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hear
this request for a rear yard variation of twenty feet at the northwest corner of the
proposed structure and a rear yard variation of ten feet at the southwest corner of
the proposed structure.
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recom-
mend to the Building Committee of the Board of Trustees of the Village of Mount Pros-
pect the approval of this request under Case No. ZBA-19-V-73 for the reasons that:
(1) There is a practical difficulty and particular hardship
upon the petitioner;
(2) The purpose of the variations is not based exclusively
upon a desire to make money;
(3) The conditions upon which the petition for these variations
is based are unique in that the property is an odd pie -shaped
lot on the corner of a. cul-de-sac having frontage both on the
cul-de-sac and an adjoining street, the effect of which is to
place upon the property two front yards and two rear yards;
(4) The granting of these variations will not be detrimental to
the public or injurious to surrounding property in that it
will not alter the essential character of the locality; and
WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount
Prospect have reviewed the recommendations of the Zoning Board of Appeals and have
recommended that the Board of Trustees of the Village of Mount Prospect concur in
the recommendations of the Zoning Board of Appeals; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have
reviewed the matter herein and have determined that the same is in the best interests
of the Village of Mount Prospect.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECTCOOK COUNTY., ILLINOIS:
SECTION ONE: That the property being the subject matter of Case No. ZBA-19-V-73,
being legally described as follows:
Lot 7 in Trendel and Christensen's Resubdivision of certain lots
and parts of lots in Lake Briarwood and Lake, Briarwood, Unit No. 2,
both being a subdivision of part of the West Half of the East Half of
Section 22, Township 41 North, Range 11 East of the Third Principal
Meridian as per plat of resubdivision recorded February 7, 1973, as
Document No. 22213740, in Cook County, Illinois,

is currently zoned under the Zoning Ordinance of the Village of Mount Prospect
as R-1 (Single Family Residential) District, which zoning classification shall
remain in effect subject to the variations granted herein:
(a) To reduce that rear yard opposite the front lot line abutting
and adjacent to a Lynn Court cul-de-sac by twenty (20) feet
to a minimum five (5) foot setback, pursuant to that sketch
attached hereto and hereby made a part hereof as Exhibit A; and
To reduce that rear yard opposite the front line abutting and
adjacent to Lynn Court ten (10) feet to a minimum fifteen (15)
foot setback, pursuant to that sketch attached hereto and here-
by made a part hereof as Exhibit A.
SECTION TWO- That all requirements of the Mount Prospect Building and Zonin
=0
Code shall be applicable except the variations noted in SECTION ONE heretofore
mentioned. I
SECTION THREE: That the Director of Building and Zoning of the Village of Mount
Prospect is hereby authorized to issue a building permit for construction_ in accord-
ance with the variations hereinbefore mentioned.
SECTION FOUR: That the variations granted by this Ordinance shall be null and vol
and of no force and effect whatsoever unless an application for a building permit pur
suant to such variations is made and construction commenced within one (1) year of
the date this said Ordinance becomes effective. I
SECTION FIVE: That this Ordinance shall be in full force and effect from and after
its passage, approval, and publication in the manner provided by law.

AN ORDINANCE AMENDING SECTION 14.2001
OF THE ZONING ORDINANCE
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did
meet on September 27 t 19 73 , at the hour of 8: 00 p. m. , at the Mount Prospect
Village Hall and did hear Case No. ZBA-22-V-73, pursuant to proper legal
notice - and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hear
this request for the repeal of Section 14.2001, Subsection F, of the Municipal Code-
, of Mount Prospect of 1957, as amended; and
WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recom-
mend to the Building Committee of the Board of Trustees of the Village of Mount
Prospect the approval of this request under Case No. ZBA-22-V-73, and
WHEREAS, the Building Committee of the Board of Trustees of the Village of Mount
Prospect have reviewed the recommendations of the Zoning Board of Appeals and
have recommended that the Board of Trustees of the Village of Mount Prospect con-
cur in the recommendations of the Zoning Board of Appeals; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect
have reviewed the matter herein and have determined that the same is in the best

interests of the Village of Mount Prospect-,
NOW THEREFORE. BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT I, COOK COUNTY ILLINOIJ
SECTION ONE: That Section 14.2001 of the Municipal Code of Mount Prospect of
1957, as amended, be and the same is hereby further amended by deleting there-
from Subsection F, so that general hospitals for humans, orphanages, homes for
aged and similar institutions shall not be allowed within the B-3 (Business -Retail
and Service) District, and relettering the existing Subsections thereof; in order
that Section 14.2001 shall hereafter be and read as follows;

"SECTION 14.2001. Permitted Uses. In the B-3 Business Retal1 and
Service District, the only uses which may hereafter be established are:
A. Temporary carnival or circus, operating not longer
than ten (10) days;
B Cleaning, dyeing, and laundry establishments where
no actual cleaning, dyeing, or laundry is done on the
premises,,
C Coin operated cleaning, dyeing, and laundry estab-
lishments;
D Finance Banking, including: Federal Reserve Banks;
Commercial and Stock Savings Banks; Mutual Sav-
ings Banks; Trust Companies; and establishments
performing functions closely related to banking such
as Check Cashing Agencies and Currency Exchanges,
Safe Deposit Companies, and Clearing House Asso-
clations;
E. Financial Institutions other than banks, including*.
Savings and Loan Associations, Rediscount and Fi-
nancing Institutions for Credit Agencies other than
banks, Personal Credit Institutionst and Business
Credit Institutions;
F. Hotel, lodging house, or motel, with sleeping rooms
or units in number not exceeding one (1) for each
five hundred (500) feet of lot area-,
G. Professional or business office;
H # Parking lots for private self-propelled passenger
automobiles-,
Restaurant (except drive-in vari ety) , tavern. or con-
fectionery,;
K. Private music, dancing, business, vocational, or other
school or college;
L. Signs, insofar as they may be allowed under the Sign
Ordinance of the Village of Mount Prospect-,
M. Undertaking or funeral parlor;
N. Village Hall, Police or Fire Station, or other munici-
pal building; and
Retail business establishments, whether retail sales
or retail service, except the following uses hereby
specifically excluded:
1. Abattoirs
2. Advertising signs, bill boar dsq or poster panels
3 Animal hospitals, including dog pounds

and outdoor- arcades- dance halls; miniature golf

5. Arsenals

Storage warehouses

Truck and bus terminals, and milk distributing
