AN ORDINANCE GRANTING A PARKING VARIATION FOR PROPERTY LOCATED AT 1300 WEST NORTHWEST HIGHWAY WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did meet on the 26th day of July, 1973 , at the hour of 8: 00 p.m. , at the Mount Prospect Village Hall and did hear Case No. 17-V-73, pursuant to proper legal notice; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did hear this request to construct an office building and provide twenty (20) parking spaces rather than forty-five (45) required by the Mount Prospect Zoning Ordinance; and WHEREAS, the Zoning Board of Appeals of the Village of Mount Prospect did recom- mend to the President and Board of Trustees of the Village of Mount Prospect the approval of this request under Case No. 17-V-73 for the reasons that: 1. The purpose of the variation is not based exclusively upon the desire to make money; 2. The granting of the variation will not be detrimental to the public or injurious to surrounding property in that it will not alter the essential character of the local- ity and will not run with the land, being granted solely to the National Fraternal Society of the Deaf during its use and enjoyment of the subject property; and 3. The proposed variation will not impair an adequate supply of light and air to adjacent property, or substantially in- crease the congestion in the public streets . or increase the danger of fire, or endanger the public safety, or otherwise substantially diminish or impair property values within the neighborhood; and WHEREAS. the President and Board of Trustees of the Village of Mount Prospet"t have reviewed the matter herein and have determined, that the same is in the best interests of the Village of Mount Prospect. NOW , THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the property being the subject matter of Case No. 17-V-73, being legally described as follows: Lot 3 in H. Roy Berry Company's North West Heights, being a subdivision of all that land lying North of Chicago North Western Railroad in the North West I of the South East' of Section 33, 4 Township 42 North, Range 11 East of the Third Principal Meri- dart in Cook County, Illinois. AND Lots 4, 5 and 6 in H. Roy Berry Company's North West Heights, being a subdivision of that land lying North of Chicago North Western Railroad in the North West 4 I of the South East of '4 4 Section 33, Township 42 North, Range 11 East of the Third Princi- pal Meridian, in Cook County, Illinois; is currently zoned under the Zoning Ordinance of the Village of Mount Prospect as B-2 (Business - Office District), which zoning classification shall remain in effect subject to the variation granted herein: That the land described above may include the construction and erection of an office building with provisions for twenty (20) 101x201 off-street parking spaces to serve same during that period of time the said building and premises are occupied by the National Fraternal Society of the Deaf. SECTION TWO,-. That all requirements of the Mount Prospect Building and Zoning Code shall be applicable except the variation noted in SECTION ONE heretofore mentioned. SECTION THREE: That the Director of Building and Zoning of the Village of Mount Prospect is hereby authorized to issue a building permit for construction in accordance with the variation hereinbheforfe mentioned. SECTION FOUR: That the variation granted by this Ordinance shall be null and void and of no force and effect whatsoever unless an application for a building ol permit pursuant to such variation is made and construction commenced within one (1) year of the date this said Ordinance becomes effective. SECTION FIVE: That this Ordinance sliall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
