A RESOLUTION DIRECTING THE EXECUTION OF AN ANNEXATION AGREEMENT
REGULATING THE ANNEXATION OF PROPERTY LOCATED ON MAP
THE ZONING ORDINANCE OF THE VILLAGE OF MOUNT PROSPECT
WHEREAS, the Corporate Authorities on April 24, 1973, at the hour of
8:00 p.m. did hold a public hearing upon the proposed Annexation Agree-
ment for the regulation of an annexation of certain property to the
Village of Mount Prospect, which property is located on Map 1- (A) S in the
Zoning Ordinance of the Village of Mount Prospect; and
WHEREAS, a notice of said public hearing was published in a newspaper
of general circulation within the Village of Mount Prospect, in its
April 2, 1973, edition; and
WHEREAS, notice has been given and a hearing has been held on February 16,
1973, at 8:00 p.m. before the Plan Commission of the Village of Mount Pros-
pect with respect to the aforementioned Annexation Agreement and certain

rezoning to be agreed upon therein; and
WHEREAS, the Corporate Authorities of the Village of Mount Prospect believe
that such Annexation Agreement is in the best interests of the Village of
Mount Prospect.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the President of the Board of Trustees of the Village

the Village of Mount Prospect is hereby authorized to attest the Annexa-
tion Agreement made a part hereof and attached hereto as Exhibit I, which
Annexation Agreement, subject to the provisions of Article 7 of the Illinois
Municipal Code of 1961, shall regulate the annexation of the following
described property:

SECTION TWO: That the said Annexation Agreement shall be binding upon
successor owners of record of the above described land which is the
subject of the said Agreement and upon successor municipal authorities
of this Village of Mount Prospect, Cook County, Illinois.

WHEREAS, JAMES P. SHEEHAN, JOHN L. SULLIVAN and JAMES FLOOD,
doing business as J. P. SHEEHAN DEVELOPERS, hereinafter referred to
as "Owner", is the owner of the following legally described land and
territory, hereinafter referred to as the "Subject Property":

WHEREAS, the VILLAGE OF MOUNT PROSPECT, a municipal corporation,
organized under the laws of the State of Illinois, hereinafter re-
ferred to as the "Village", has the power under state law to enter
into an annexation agreement such as set forth herein; and
WHEREAS, the Owner has heretofore filed a petition to annex
to the Village the Subject Property contingent upon the provisions
of this agreement; and
WHEREAS, all parties believe it to be in the best interests of
the Village and the Owner that the Subject Property be annexed to the
Village of Mount Prospect; and
WHEREAS, the Owner has plans for the use of the Subject Property
upon its annexation to the Village of Mount Prospect; and
WHEREAS, it is beneficial to both the Village and the Owner
that the Subject Property be annexed and developed as planned,
NOW, THEREFORE, it is agreed by and between the Village and
the Owner as follows:
1. That the Village will annex the subject property.
2. That the Village shall pass such ordinances as will enable
the Subject Property to be zoned R-1.
3. That the Owner agrees to execute and the Village agrees to
approve a plat of subdivision, drawn at the Owner's expense, and
meeting all applicable ordinances of the Village,
4. That, in addition to providing and installing all storm
sewers necessary to serve the Subject Property, the Owner will pay
$ to the Village to off -set already incurred Village
expenses by reason of the Mount Prospect Special Assessment No. 70.
5. That only laws in effect at the date hereto shall apply
to the Subject Property and any future amendments or changes to
building, housing, subdivision, zoning or any other applicable ordi-
nances during the term of this agreement shall not apply to the Sub-
ject Property without the Owner's consent; however, if there are
any changes of said laws and the same are less restrictive in their
application to the Subject Property, then the Owner shall be entitled
to the benefit of the change if it elects.
6. That all provisions, conditions, and regulations set forth
in this agreement and the documents or plans to which it refers shall
supersede all Village ordinances, codes, and regulations that are in
conflict therewith as they may apply to the Subject Property. How-
ever, where this agreement is silent, the Village ordinances shall
apply and control.
7. That this agreement shall be effective for a term of
five (5) years from the date hereof.
(a) However, construction under any building permit
issued pursuant to the terms of this agreement need not be
completed, and any such permit shall remain in full force
and effect for a period of five (5) years from the date of
issuance of the said permit.
(b) It shall bind the heirs, successors, and assigns
of the Owner; the Village; its corporate officials; and
their successors in office.
(c) Nothing herein shall in any way prevent the aliena-
tion or sale of the Subject Property or portion thereof and
the new owner or owners shall be both benefited and bound by
the conditions and restrictions herein expressed.

8. That, in the event any provisions of this agreement shall
be deemed invalid, such invalidity of said provision shall not affect
the validity of any other provision hereof.
IN WITNESS WHEREOF, the parties hereto have entered their
hands and seals this day of 1973.

AN ORDINANCE ANNEXING PROPERTY GENERALLY LOCATED
AT THE NORTHWEST CORNER OF LINCOLN STREET AND
MEIER ROAD.
WHEREAS, a written petition under oath signed by the owners of record
of land hereinafter described has been filed with the Village Clerk of
the Village of Mount Prospect, requesting that said land be annexed to
the Village of Mount Prospect; and
IVAEREAS, no electors reside within the said property to be annexed; an -4
WHEREAS, the said land is not within the corporate limits of any munici'_
pality, but is contiguous to the Village of Mount Prospect; and

ORDINANCE NO.
AN ORDINANCE AMENDING MAP l(A)-S OF THE ZONING ORDINANCE
OF THE VILLAGE OF MOUNT PROSPECT
WHEREAS, the Plan Commission of the Village of Mount Prospect heretofore
on February 16, 1973, conducted a public hearing under Case No. 73-4P,
on a request for a zoning classification change from R -X (Single Family
Residence District) to R-1 (Single Family Residence District) of certain
property hereinafter described; and
WHEREAS, a notice of the aforesaid public hearing was made in the manner
provided by law; and
WHEREAS the Plan Commission has determined that the zoning change is in
accord with the Comprehensive Plan in that area and would in no way be
detrimental to the Village of Mount Prospect; and
WHEREAS, the Plan Commission of the Village of Mount Prospect has recom-
mended that the zoning change be granted; and
WHEREAS, the President and Board of Trustees of the Village of Mount
Prospect have determined that the best interests of the Village of Mount
Prospect will be attained by the adoption of the Plan Commission's recom-
mendation on Case No. 73-4P regarding the subject property;
NOW., THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:

AND REPAIR OF THE METROPOLITAN SANITARY DISTRICT OF GREATER
CHICAGO SANITARY SEWERS WITHIN THE VILLAGE OF MOUNT PROSPECT
FOR FISCAL 1973-74
WHEREAS, the representatives of the Village of Mount Prospect and the Metropolitan
Sanitary District of Greater Chicago have conducted several meetings with respect
to the general maintenance and repair of the Metropolitan Sanitary District sanitary
'thon the corporate limits of the Village of Mount Prospect; and

WHEREAS , titles to said sewers are in the name of the Metropolitan Sanitary District
of Greater Chicago as collateral for an existing bond issue, and
WHEREAS, all parties concerned are cognizant of the much needed continual general

WHEREAS, certain funds are available for the general maintenance and repair of same,
which funds are currently held by the Metropolitan Sanitary District of Greater
Chicago-, and

sewers that this Department could adequately do the general maintenance and repair

determined and negotiated based on experience.

Maintenance Agreement is terminated after one year or prior to the complete reim-
bursement from the Metropolitan Sanitary District of Greater Chicago for capital
expenditures the District will reimburse the

A Mr. Huntziker appeared before the Committee without prior
notice to discuss this,case which is a rezoning of the south-
west corner of West Kensington and North Wille Street from
R-1 to R-3.
It had been suggested by the Plan Commission that Mr. Huntziker
attempt to exchange with the Commonwealth Edison Company the
back two lots of his property fronting on North Wille Street
for two lots fronting on West Kensington. Also, a bung
setback of 10 additional feet on Wille Street so the one-sto , ry
brick building to be constructed would align with the
residences on the east side of North Wille Street. These
changes have been arranged.

He presented 'a 'rough draft for our statement of purpose-- Mike Minton is going
to form6lize the statement and present it for our approval at our next get -to-,
gether...
We have all volunteered or been assigned to act as,REPRESENTATIVES to the
various Village Committees and Commissions... Please note the enclosed schedule.
It is our intent (until we can formalize an orgenization) to attend all the
meetings of our assigned Committees/Commissions... As cases are presented to
these Comm/Comms, and we, as REPRESENTATIVES., feel they warrant action by the
'concerned citizen group" it is our obligation to inform the other members...
Hopefully we will be able to act, and present a united front... I realize
this will be difficult without a "leader" but it is too important to wait
for a formalized statement of purpose, by-laws, or a voting of officers.,
We all have the same purpose -w --the the success of our organization depends on us,

We have all volu,nteered or been assigned to act as REPRESENTATIVES to the
various Village Committees and Commissions... Please note the enclosed schedule.
It is our intent (until We can formalize an organization) to attend all the
meetings of our assigned Committees/Commissions... As cases are presented to
these Comm/Comms., and we,, as REPRESENTATIVES, feel they warrant action by the
concerned citizen §roup" it is our obligation to inform the other members,,.
Hopefully we will be able to act, and present a united front... I realize
this will be difficult without a "leader" but it is too important to wait
for a formalized statement of purpose, by-laws, or a voting of officers...
We all have the same purpose—the success ofour organization depends on us,
we must continueto communicate with each other, and more importantly, we must
continue to CARE*...
