AN ORDINANCE AMENDING MAP 1(A) -S OF THE ZONING ORDINANCE
OF THE VILLAGE OF MOUNT PROSPECT
WHEREAS. th-e 'Plan Commission of the 'Village, of Mount Prospect heretofore
on February 1 16, 197'3,conducted, a, public, hearing under Case No., 73 4P

on a request for a zoning classi"ficatlion chhangle from R -X (Single Family
Residence District) to R-1 (Single Family Residence District) of certain
property, heTeinafter described -1 and,
WHEREAS, a notice of the aforesaid public hearing was made in the manner
provided by law; and
WHEREAS, i
the Plan Commission has determined that the zoning change is in
accord with the Comprehensive Plan in that area and would n no way be
detrimental to the Village of Mount Prospect; and
WHEREAS, the Plan Commission of the Village of Mount Prospect has recom-
mended that the zoning change be granted; and
WHEREAS,, the President and Board of Trustees of the Village of Mount
Prospect have determined that the best interests of the Village of Mount
Prospect will be attained by the adoption of the Plan Commission's 'recom-
mendation on Case No. 73-4P regarding the subject property;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY) ILLINOIS:

AN ORDINANCE ANNEXING PROPERTY GENERALLY LOCATED
AT THE NORTHWEST CORNER OF LINCOLN STREET AND
MEIER ROAD.

WHEREAS, a written petition under oath signed by the owners of record
of land hereinafter described has been filed with the Village Clerk of
the Village of Mount Prospect, requesting that said land be annexed to
the Village of Mount Prospect; and
WHEREAS, no electors reside within the said property to be annexed; and
WHEREAS, the said land is not within the corporate limits of any munici-
pality, but is contiguous to the Village of Mount Prospect; and
WHEREAS, the President and Board of Trustees of the Village of Mount
Prospect find and believe it to be in the best interests of the said
Village that said land and territory be annexed thereto;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES

of general circulation within the Village of Mount Prospect, in its

1973, at 8:00 p.m., before the Plan Commission of the Village of Mount Pros -

as "Owner", is the owner of the following legally described land and

WHEREAS, the VILLAGE OF MOUNT PROSPECT, a municipal corporation,
organized under the laws of the State of Illinois, hereinafter re-
ferred to as the "Village", has the power under state law to enter
into an annexation agreement such as set forth herein; and
WHEREAS, the Owner has heretofore filed a petition to annex
to the Village the Subject Property contingent upon the provisions
of this agreement; and
WHEREAS, all parties believe it to be in the best interests of
the Village and the Owner that the Subject Property be annexed to the
Village of Mount Prospect; and
WHEREAS, the Owner has plans for the use of the Subject Property
upon its annexation to the Village of Mount Prospect; and
WHEREAS, it is beneficial to both the Village and the Owner
that the Subject Property be annexed and developed as planned;

THEREFORE it is agreed by and between the Village and

the Owner as follows:
1. That the Village will annex the subject property.
2. That the Village shall pass such ordinances as will enable
the Subject Property to be zoned R-1.
3. That the Owner agrees to execute and the Village agrees to,
approve a plat of subdivision, drawn at the Owner's expense, and
meeting all applicable ordinances of the Village.
4. That, in addition to providing and installing all storm
sewers necessary to serve the Subject Property, the Owner will pay
$ to the Village to off -set already incurred Village
expenses by reason of the Mount Prospect Special Assessment No. 7Q.
5. That only laws in effect at the date hereto shall apply
to the Subject Property and any future amendments or changes to
building, housing, subdivision, zoning or any other applicable ordi-,
nances during the term of this agreement shall not apply to the SO-
ject Property without the Owner's consent- however, if there are
any changes of said laws and the same are less restrictive in their
application to the Subject Property, then the Owner shall bepntitlqd
to the benefit of the change if it elects.
6. That all provisions, conditions, and regulations set f?Ttli
in this agreement and the documents or plans to which it refers sh_11
supersede all Village ordinances, codes, and regulations that axe 1P

7. That this agreement shall be effective for a term of
five (5) years from the date hereof,
(a) However, construction under any building permit

issued pursuant to the terms of this agreement need not be
completed, and any such permit shall remain in full force
and effect for a period of five (5) years from the date of
issuance of the said permit.
(b) It shall bind the heirs, successors, and assigns
of the Owner- the Village; its corporate officials- and
their successors in office.
(c) Nothing herein shall in any way prevent the aliena-
tion or sale of the Subject Property or portion thereof and
the new owner or owners shall be both benefited and bound by
the conditions and restrictions herein expressed.

8. That, in the event any provisions of this agreement shall
be deemed invalid, such invalidity of said provision shall not affect
the validity of any other provision hereof,
